00:05:25.580 How does this work when you tell a grand jury to stay home?

00:05:29.900 Yeah, look, there are two types of juries
00:05:31.920 in our criminal justice system.
00:05:33.260 There's a grand jury and a pettit jury.
00:05:35.700 A grand jury occurs before the trial.
00:05:38.420 And a grand jury consists of citizens from the community
00:05:43.000 who are impaneled for an extended period of time.
00:05:46.740 And the prosecutor will go and present evidence
00:05:49.540 to the grand jury seeking an indictment.
00:05:51.980 And the prosecutor does that
00:05:53.520 without the defense attorney present.
00:05:55.680 So it's a one-sided presentation.
00:05:57.320 And it's the prosecutor presenting evidence to say,
00:06:01.200 is this enough to charge the defendant
00:06:03.780 with whatever crime they're trying to indict him on?
00:06:06.560 The prosecutor has enormous leeway with the grand jury.
00:06:10.820 There's an old line that is repeated a gazillion times,
00:06:14.040 which is a prosecutor can indict a ham sandwich.
00:06:16.480 And part of the reason is the ham sandwich doesn't get a lawyer.
00:06:19.140 So it's the prosecutor is alone with the grand jury.
00:06:23.160 In this instance, the reason that the Manhattan DA
00:06:26.320 would have told the grand jury, stay home, don't come in today,
00:06:29.580 is that Alvin Bragg made the decision.
00:06:32.980 He didn't want to indict Donald Trump today.
00:06:35.500 Now, at least according to public reporting,
00:06:38.380 they are coming in tomorrow on Thursday.
00:06:40.360 So we may have a podcast coming up
00:06:43.340 where we have different news to report.
00:06:45.920 The fact that he hit pause
00:06:47.520 does not necessarily mean that Bragg is hitting stop.
00:06:51.460 And you have to assume that Bragg,
00:06:53.800 like every other Democrat, has Trump derangement syndrome.
00:06:56.440 They hate him so much, he may not be able to stop.

00:07:04.780 are not terribly interested in obsessing

00:07:32.520 rather than the personal failings
00:07:35.420 that Bill Clinton may have had.
00:07:37.440 We've sadly seen politicians from both parties
00:07:40.480 have serious moral failings
00:07:43.660 and sexual improprieties.
00:07:46.100 But I do think a lot of Democrats
00:07:47.920 are pretty dismayed
00:07:50.960 that their opening salvo

00:07:54.660 is focused on an alleged affair with a porn star.
