00:00:26.100 against the Trump administration,
00:00:27.420 the pattern of nationwide injunctions
00:00:30.560 has in the last three months
00:00:33.220 exceeded what has happened in the last 20 years.
00:00:36.320 It's exceeded what happened in the entire 20th century
00:00:39.340 in terms of the number of nationwide injunctions
00:00:42.300 issued against the Trump administration.
00:00:44.260 Well, the good news is in the last couple of days,
00:00:46.920 we've had not one, not two,
00:00:48.900 but three Supreme Court victories
00:00:50.720 for the Trump Department of Justice
00:00:53.200 against these nationwide injunctions.
00:00:55.180 We're going to break down all three of them
00:00:56.960 and lay out, we've talked about on this podcast
00:01:00.060 how the principal check on this abuse of power
00:01:03.540 that's going to be effective
00:01:04.500 is the appellate process and the Supreme Court.
00:01:07.740 It's encouraging now we have three victories.
00:01:10.060 We're also going to talk about a new report from Doge
00:01:13.040 that over 4 million Social Security numbers
00:01:16.340 were given to illegal aliens,
00:01:18.340 people who are not U.S. citizens.

00:03:37.580 these rulings that you mentioned
00:03:39.260 in the lead-in there in the show,
00:03:41.580 because it's not just one, not two,
00:03:43.880 but three victories for the Trump administration,
00:03:46.160 and no one's covering this.
00:03:48.300 No, that's exactly right.
00:03:49.680 And let's start with the most prominent one,
00:03:51.780 which is the Supreme Court on Monday
00:03:53.880 lifted a judge's order
00:03:55.240 that had blocked the deportation
00:03:57.480 of suspected Venezuelan gang members
00:03:59.700 to a prison in El Salvador.
00:04:02.020 And it was the Trump administration
00:04:05.040 was removing these gang members
00:04:06.980 under an 18th century law
00:04:08.980 known as the Alien Enemies Act.
00:04:11.760 And you'll recall a district judge,
00:04:15.260 James Bozberg,
00:04:16.640 had ordered the halt
00:04:18.280 of the removals under the act.
00:04:20.800 And in fact, President Trump
00:04:22.260 had called for Judge Bozberg's impeachment
00:04:24.820 as a result of that.
00:04:26.540 Well, the court issued a 5-4 decision
00:04:29.040 that blocked the judge's order
00:04:32.640 stopping the deportation.
00:04:34.560 The vote was 5-4.
00:04:36.560 So it was close.
00:04:38.040 5-4.
00:04:39.220 It was a per curiam decision.
00:04:41.180 In the majority were the Chief Justice,
00:04:44.500 Clarence Thomas,
00:04:45.780 Samuel Alito,
00:04:47.220 Neil Gorsuch,
00:04:48.460 and Brett Kavanaugh.
00:04:49.620 And a whole lot of attention
00:04:50.700 has been focused on the fact
00:04:52.020 that Amy Coney Barrett
00:04:53.100 voted with the liberals on this.
00:04:55.180 And so it was a 5-4 decision.
00:04:56.760 Nonetheless, it's a victory
00:04:58.440 in that what the court concluded
00:05:00.160 was that if you wanted
00:05:01.680 to challenge the deportation,
00:05:03.600 that you could not do so in D.C.,
00:05:06.560 which is where they filed the case.
00:05:08.000 Instead, you had to file it
00:05:09.460 as a habeas corpus petition.
00:05:12.340 What is a habeas corpus petition?
00:05:14.880 Habeas corpus is a Latin term.
00:05:17.240 It means produce the body.
00:05:19.020 And habeas corpus is a civil avenue
00:05:21.680 to justify someone's unlawful detention.
00:05:25.900 But the court said,
00:05:26.860 look, these individuals,
00:05:28.520 these gang members were detained
00:05:29.920 at the time the case was filed
00:05:31.320 in South Texas.
00:05:32.680 They said the right place
00:05:33.680 to file the case is in South Texas,
00:05:35.560 not D.C.
00:05:36.560 They weren't being held in D.C.
00:05:37.780 They were being held in South Texas.
00:05:39.340 So the right avenue to challenge this
00:05:41.740 was to file a habeas corpus petition
00:05:43.520 in South Texas.
00:05:44.960 And they said you shouldn't do so
00:05:46.500 as a class action
00:05:47.960 on behalf of everyone,
00:05:49.060 which is what had been done here.
00:05:50.480 Rather, each individual defendant,
00:05:53.880 if you have a claim,
00:05:55.280 so look, if you've been detained,
00:05:56.800 if you're getting ready to be deported,
00:05:58.100 and they say you're a
00:05:59.440 Venezuelan gang member,
00:06:00.540 if you have a claim
00:06:01.260 that I'm not a Venezuelan gang member,
00:06:03.000 the facts are wrong.
00:06:04.300 They said the avenue to do that
00:06:05.620 is go and file a habeas corpus petition
00:06:08.060 in the location
00:06:09.640 where you're being detained.
00:06:10.840 That was 5-4.
00:06:12.360 I wish it had been 9-0.
00:06:14.120 That was clearly right.
00:06:16.300 Now, the court did say
00:06:17.720 that anyone who is being detained
00:06:20.920 and being deported,
00:06:22.100 they should have reasonable notice
00:06:24.420 under due process
00:06:25.260 to have the challenge,
00:06:26.780 the opportunity to challenge
00:06:28.540 their detention and deportation.
00:06:31.000 But this victory is a big,
00:06:33.760 big victory
00:06:34.840 in what had been,
00:06:36.320 I think,
00:06:36.940 an egregious order
00:06:38.240 from the district court
00:06:39.260 trying to stop the deportation
00:06:41.460 of really, really dangerous criminals.
00:06:43.900 Well, let me ask you a question
00:06:44.920 because you mentioned it there,
00:06:46.020 and I think it'd be crazy
00:06:47.260 if I didn't ask it
00:06:48.480 because there's so many people asking.
00:06:50.140 Why was there a,
00:06:51.460 what many would consider
00:06:52.600 a conservative justice,
00:06:54.400 go with the Democrats
00:06:55.660 in this decision?
00:06:57.680 As an aside here,
00:06:58.860 that was obviously part of the headline
00:07:00.880 that we saw on social media.
00:07:02.420 Yeah, look,
00:07:03.020 I don't have a good answer.
00:07:04.560 I think it is unfortunate.
00:07:06.040 I disagree with her decision on that.
00:07:08.060 In this case,
00:07:10.700 look,
00:07:11.380 the left,
00:07:12.600 but both the Democrats
00:07:13.900 and activist judges
00:07:15.600 and left-wing radical legal groups
00:07:18.960 are challenging any deportation.
00:07:22.300 The Trump administration
00:07:23.680 relied on a law
00:07:25.580 called the Alien Enemies Act,
00:07:27.500 which is a law
00:07:28.420 that was signed into law
00:07:29.540 in 1798
00:07:31.080 by President John Adams.
00:07:32.800 And what the Trump administration did
00:07:34.580 is it classified
00:07:35.460 a transnational criminal gang,
00:07:37.440 Tranda Aragua,
00:07:39.180 as an arm of a hostile government,
00:07:41.260 Venezuela.
00:07:42.320 And based on that law,
00:07:45.560 there are very broad
00:07:46.940 legal authorities
00:07:48.140 to deport
00:07:48.920 those who are part
00:07:50.780 of a hostile government
00:07:51.720 waging war
00:07:52.440 on the United States.
00:07:53.520 That was the basis
00:07:54.680 of the deportations.
00:07:56.120 The district judge,
00:07:57.280 Judge Bozberg,
00:07:58.480 had tried to shut down
00:07:59.920 all these deportations
00:08:01.180 and thankfully,
00:08:02.700 the Supreme Court,
00:08:03.700 by a vote of five to four,
00:08:05.560 ended that and said,
00:08:06.700 if you've got an issue
00:08:07.740 with a particular deportation,
00:08:09.720 bring a case,
00:08:10.700 but bring it in the location
00:08:12.020 where the individual is detained.
00:08:14.040 And they did say,
00:08:15.060 you've got to give them
00:08:16.380 a reasonable time
00:08:17.700 to challenge it.
00:08:18.540 And so that presumably
00:08:21.060 will slow down
00:08:21.820 the deportation slightly,
00:08:23.080 but I don't expect
00:08:24.240 it will slow it down much.
00:08:25.400 It may slow it down
00:08:26.440 a matter of days
00:08:27.540 rather than months.
00:08:28.820 And to be clear,
00:08:30.680 this is a victory
00:08:31.680 because it allows
00:08:32.620 the president
00:08:33.140 to continue doing
00:08:34.380 what he wanted to do
00:08:35.520 when it comes to deportations.
00:08:37.360 If this would have gone
00:08:38.220 the other way,
00:08:38.800 this could have been catastrophic.
00:08:40.360 No, that's exactly right.
00:08:41.740 Look, the election in November
00:08:43.760 was a clear mandate
00:08:45.140 to secure the border
00:08:46.740 and to end the invasion
00:08:48.780 at our southern border.
00:08:49.960 And the Trump administration
00:08:51.880 has been following through
00:08:53.400 on that mandate
00:08:54.860 and has been deporting
00:08:56.320 vast numbers
00:08:57.700 of criminal illegal aliens.
00:08:59.880 The left is losing their mind.
00:09:01.680 And that was the basis
00:09:05.820 of this injunction.
00:09:06.960 Thankfully,
00:09:07.420 the Supreme Court reversed that.
00:09:08.720 Now, there's another victory
00:09:10.420 that occurred,
00:09:11.500 which is another 5-4 decision
00:09:13.460 where the Supreme Court
00:09:15.000 concluded that it was okay
00:09:16.300 to cancel $600 million
00:09:18.680 in teacher training grants.
00:09:21.060 $65 million of that
00:09:22.480 had yet to be distributed.
00:09:23.780 And there you had
00:09:25.480 a different majority.
00:09:26.820 You had Clarence Thomas,
00:09:29.000 Samuel Alito,
00:09:30.460 Neil Gorsuch,
00:09:31.760 Brett Kavanaugh,
00:09:32.960 and Amy Coney Barrett.
00:09:34.040 So she was in the 5-4.
00:09:35.800 The chief justice
00:09:36.900 joined the liberals.
00:09:37.900 So in the Venezuelan case,
00:09:39.800 Amy Coney Barrett
00:09:40.580 joined the liberals.
00:09:41.940 In the case about
00:09:43.240 canceling the teacher
00:09:44.400 training grants,
00:09:45.820 it was the chief justice
00:09:46.900 who joined the liberals.
00:09:48.240 And what the court concluded
00:09:49.640 in this other case
00:09:50.560 is that that should have been brought
00:09:52.200 in the court of federal claims.
00:09:54.080 That if you have a claim
00:09:55.020 against money being given
00:09:57.420 from the federal government,
00:09:58.560 that the proper venue
00:09:59.440 for challenging that
00:10:00.540 is the court of federal claims.
00:10:02.580 Now, look,
00:10:03.240 some might say,
00:10:04.140 gosh,
00:10:04.840 these decisions are narrow
00:10:06.220 and technical.
00:10:07.500 And they are.
00:10:08.900 But that being said,
00:10:10.640 they're nonetheless victories
00:10:12.120 against district judges
00:10:14.500 that are engaged in lawfare,
00:10:17.000 that are trying to shut down
00:10:19.420 the Trump administration's agenda
00:10:22.220 and the agenda
00:10:24.020 they were elected
00:10:24.680 to implement
00:10:26.140 by the American people.
00:10:27.280 So when you look at this,
00:10:29.260 these, really,
00:10:30.260 these three big decisions,
00:10:32.000 does this also empower
00:10:34.060 the Trump team
00:10:35.260 and administration
00:10:35.780 to do their job now
00:10:37.340 saying, hey,
00:10:38.060 we now know
00:10:39.220 that when we go to court,
00:10:40.340 we're going to be,
00:10:40.980 our side is going to be
00:10:41.980 at least listened to
00:10:43.240 and it's not stacked against us
00:10:45.160 and we're doing the right thing
00:10:46.400 within the law.
00:10:47.300 So yes and no.
00:10:48.020 No, we've only talked about
00:10:48.960 two of the cases.
00:10:49.720 Let me talk about the third one.
00:10:51.320 The third one was
00:10:53.460 there was an order
00:10:54.200 from a district judge
00:10:55.400 that was ordering
00:10:56.740 the Trump administration
00:10:57.680 to reinstate
00:10:58.880 16,000 federal employees
00:11:01.520 that it had fired.
00:11:03.280 Yeah.
00:11:04.240 And that went to the Supreme Court
00:11:06.320 and the Supreme Court
00:11:07.580 actually by a vote of 72
00:11:09.200 reversed it
00:11:10.700 and they said
00:11:12.380 that these federal employees
00:11:15.920 did not have to be reinstated.
00:11:18.520 The two liberal justices
00:11:20.620 that dissented
00:11:21.340 were Sonia Sotomayor
00:11:23.120 and Ketanji Brown Jackson
00:11:24.480 but the full court,
00:11:26.920 what happened in that case,
00:11:29.580 it was an injunction
00:11:30.340 that was issued
00:11:31.000 by Judge William Alsep
00:11:33.040 who was a district judge
00:11:35.100 in San Francisco
00:11:35.860 and he required
00:11:37.400 the reinstatement
00:11:38.300 of probationary employments
00:11:39.800 at multiple agencies
00:11:40.960 that the Trump administration
00:11:42.940 had sought to dismiss.
00:11:44.520 The judge was appointed
00:11:45.880 by Bill Clinton
00:11:46.580 and the judge concluded
00:11:49.220 that the administration
00:11:50.520 hadn't followed
00:11:51.380 the proper procedures
00:11:53.120 for the firing.
00:11:54.760 Well, the Supreme Court
00:11:56.040 disagreed
00:11:56.760 and 72,
00:11:58.500 they reversed that
00:11:59.460 which is yet another victory.
00:12:01.420 So if you look
00:12:02.180 at the combination of these,
00:12:03.800 you have a victory
00:12:04.660 for deporting
00:12:05.760 violent criminal gang member
00:12:08.020 illegal aliens.
00:12:08.760 You have a victory
00:12:10.120 for canceling
00:12:11.440 grants that were given
00:12:14.460 and grants that were given
00:12:16.020 in the Trump administration's view
00:12:18.120 inappropriately.
00:12:19.340 And you have a victory
00:12:20.240 for dismissing
00:12:21.440 16,000 primarily
00:12:23.700 probationary employees
00:12:25.020 from federal agencies.
00:12:26.320 In all three of them,
00:12:28.200 you had federal district judges
00:12:29.460 that had stepped in
00:12:30.380 and said,
00:12:30.880 no, we're going to stop you
00:12:32.560 from carrying out
00:12:33.180 this agenda.
00:12:34.200 And in all three of them,
00:12:35.880 the Supreme Court,
00:12:36.800 albeit on technical grounds,
00:12:38.880 reversed or vacated
00:12:40.340 the district court's orders.
00:12:41.800 This is a very,
00:12:43.600 very good development
00:12:44.740 because it's exactly
00:12:45.980 what we talked about.
00:12:47.080 The remedy
00:12:47.800 for lawless decisions
00:12:49.760 by district courts,
00:12:51.420 the best remedy
00:12:52.420 is the appellate process
00:12:54.200 and the U.S. Supreme Court.
00:12:55.980 Now we've talked about
00:12:56.760 on this podcast
00:12:57.620 how there are other remedies,
00:12:59.640 how Congress could pass
00:13:00.860 legislation limiting
00:13:02.660 nationwide injunctions.
00:13:04.180 I support that.
00:13:05.160 In fact,
00:13:05.420 I'm the co-sponsor
00:13:06.320 of legislation
00:13:07.020 to do that,
00:13:08.160 but the problem is
00:13:08.860 the Democrats
00:13:09.360 will filibuster that.
00:13:10.880 It will never get 60 votes.
00:13:12.660 Another possible remedy
00:13:13.780 is impeachment.
00:13:15.000 It is possible
00:13:16.260 the House of Representatives
00:13:17.360 could impeach
00:13:18.280 a district judge
00:13:19.720 who had egregiously
00:13:20.620 abused his power.
00:13:22.220 That takes simply
00:13:23.260 a majority vote
00:13:24.140 in the House of Representatives,
00:13:25.260 218.
00:13:26.100 The Republicans
00:13:26.580 could vote to do that.
00:13:28.140 However,
00:13:28.660 to convict a judge
00:13:29.940 under the Constitution
00:13:31.200 takes two-thirds
00:13:32.160 of the Senate,
00:13:32.840 which means we would need
00:13:33.940 a lot of Democrats,
00:13:35.840 we would get zero,
00:13:37.700 so impeachment
00:13:38.500 will not be
00:13:39.180 an effective remedy either.
00:13:41.480 That means
00:13:42.280 we really are dependent
00:13:43.760 on the appellate process
00:13:44.920 of the Supreme Court,
00:13:46.180 and I'm very encouraged
00:13:47.460 to have three victories
00:13:49.680 within just a couple of days.
