00:00:36.480 Also, Daniel Penny was found innocent, thank goodness,
00:00:39.760 by a jury of his peers in New York City for being a good Samaritan.
00:00:43.120 The question now is, can he sue New York for taking him to court for doing the right thing?

00:01:16.980 And there was certainly a pretty intense conversation about what Donald Trump has said he wants to do.
00:01:24.460 And I think the American people actually know what his plan is.
00:01:28.000 The media just doesn't want to accept that he has a mandate to do it.
00:01:32.100 Here is part of that conversation.
00:01:34.380 Let's talk about mass deportation, one of your big agenda items.
00:01:37.840 You've talked about prioritizing people who have criminal histories.
00:01:41.520 Correct.
00:01:41.940 But is it your plan to deport everyone who is here illegally over the next four years?
00:01:47.340 Well, I think you have to do it.
00:01:49.220 And it's a very tough thing to do.
00:01:53.300 But you have to have, you know, you have rules, regulations, laws that came in illegally.
00:01:58.800 You know, the people that have been treated very unfairly are the people that have been online for 10 years to come into the country.
00:02:03.880 And we're going to make it very easy for people to come in in terms of they have to pass the test.
00:02:09.080 They have to be able to tell you what the Statue of Liberty is.

00:03:30.600 And just to get back, because I know exactly what you're getting at, number one, we're doing criminals, and we're going to do them really rapidly.

00:04:35.460 But we're starting with the criminals, and we've got to do it.

00:05:04.260 So why even act like you can deport or round up a bunch of heinous criminals?

00:05:30.220 We are going to see on January 20th, we're going to see the new administration come in.

00:05:45.380 What it is going to mean is that on January 20th, if you come here illegally and you're apprehended,

00:05:56.080 The first priority Trump is going to focus on is securing the border itself,
00:05:59.620 and very closely connected to that, is going after illegal immigrants,
00:06:03.620 and in particular, as he said repeatedly, starting with the criminal aliens,
00:06:07.620 starting with the convicted murderers, the rapists, the child molesters,
00:06:11.100 starting with the Venezuelan gangs, starting with the most dangerous illegal immigrants.
00:06:17.120 And, you know, Welker was saying, well, gosh, this is going to be expensive.
00:06:19.480 It's going to take a lot of resources.
00:06:21.240 I'm going to hold on to that clip.
00:06:22.960 That's going to be valuable, because you know what?
00:06:24.760 Congress is going to—we are going to take up and pass a reconciliation bill.
00:06:29.200 We're going to do it early in this next year that is going to provide funding
00:06:34.060 to enable us to secure the border.
00:06:36.320 We're going to get it done, and I think Trump was very matter-of-fact laying out

00:06:41.940 He intends to do it, and I intend to work hand-in-hand with him to make sure it gets done.
00:06:46.660 And finally, Senator, Donald Trump went to France.
00:06:50.580 It was a very interesting trip.
00:06:52.560 He was meeting with world leaders, and one of the things that I thought was really interesting
00:06:57.840 about this trip was social media reacted to Trump's just dominating force
00:07:04.060 and the clear contrast between how world leaders were interacting with him
00:07:08.900 compared to Joe Biden and this administration.
00:07:12.260 There was an interesting handshake when there was a meeting in France as well.
00:07:17.700 I'm sure you saw some of this on social media and on the news.
00:07:21.340 I want to get your reaction to even Macron and their handshake.
00:07:25.220 It was like a fist, like, hey, we're back, bros.

00:07:29.440 Yeah, look, I mean, Donald Trump shakes hands like a man, and when it came to Macron,
00:07:36.420 he shook hands in a way that was a dominating way to shake hands.
00:07:41.540 Macron was nervous.
00:07:42.740 He was uneasy.
00:07:43.660 He wasn't sure what to do.
00:07:45.080 Now, Macron's own political situation in France is incredibly tenuous.
00:07:49.260 And listen, the contrast.
00:07:50.840 Macron has been kissing up to Biden like crazy.
00:07:54.220 Biden, when he interacts with Macron and every other world leader, interacts from a position of weakness.
00:07:59.780 None of them are afraid of him.
00:08:01.040 None of them are worried about what he might do.
00:08:04.500 You know, you look at our southern border.
00:08:06.740 I'm reminded we did a podcast, I don't know, about a year, year and a half ago,
00:08:11.180 where we played AMLO, then the president of Mexico, standing next to Joe Biden
00:08:16.540 and just crowing how he's the only president in our lifetimes who has not built even one meter of wall or fence.

00:08:26.680 And he's saying, and Biden's just grinning like a goofy fool,
00:08:30.900 while AMLO is saying, well, look, this guy, we can just run all over him.
00:08:33.920 Well, we have seen that Trump is not someone that foreign leaders are going to run all over.
00:08:40.600 And so that is a powerful demonstration of the simple fact that America's back.

00:09:29.180 This is one of those stories where I hope that people will stand up and say,
00:09:33.400 this is a hero and be proud to say he is a hero.
00:09:38.020 Because that's exactly what he is.
00:09:40.520 And we should celebrate heroes.
00:09:42.440 And we should not have to worry that when men need to stand up and act to protect and defend people,
00:09:47.940 that they're going to do it.
00:09:49.520 And not have to worry about thinking twice because of what just happened to this individual.
00:09:53.480 It's also a really sad commentary about New York and New York City.
00:09:57.200 And the activist prosecutors there.
00:09:59.000 And finally, I want to get your thought on that with the prosecutors that went after him.
00:10:02.780 Should there be any scenario where he can, in essence, say, hey, you guys didn't treat me the right way?
00:10:10.840 Look, look, I could easily see a lawsuit following from this.
00:10:15.260 I hope Alvin Bragg is thrown out of office.

00:10:20.520 The governor has the authority to do that.
00:10:22.360 Of course, the governor, Kathy Hochul, is a leftist herself, a cultural Marxist herself.
00:10:27.640 She's someone who, by the way, said, if you're a Republican, get the hell out of my state, move to Florida.
00:10:32.240 You don't belong in New York.
00:10:33.880 That is their ideology.
00:10:35.580 If you are the enemy, they are opposed to you.
00:10:38.320 I got to say, I want you to listen to Daniel Penney and him talking about how he was trying to protect other people's lives.
00:10:45.360 He was acting as a good Samaritan, acting as a hero, intervening, risking his own life.
00:10:51.100 Look, encountering a mentally ill, potentially violent person, threatening violence is a dangerous thing to do.
00:10:58.660 Here's what Daniel Penney had to say.
00:11:00.620 The guilt I would have felt if someone did get hurt, if he did do what he was threatening to do, would never be able to live with myself.
00:11:11.060 And I'll take a million court appearances and people calling me names and people hating me just to keep one of those people from getting hurt or killed.
00:11:22.860 Look, that is.
00:11:25.340 Yes.
00:11:25.540 Look, and of course, how is the left reacting?
00:11:30.040 Well, I want you to listen to MSNBC just expressing misery that Daniel Penney was acquitted.
00:11:39.880 And understand, by the way, initially, so there were two charges that were brought.
00:11:45.640 So Alvin Bragg brought two charges.
00:11:48.280 One charge was for manslaughter, and the second charge was for criminally negligent homicide.
00:11:58.680 The jury deadlocked on the second-degree manslaughter claim, which was the more serious charge.
00:12:06.400 So that means they had a disagreement.
00:12:08.880 They could not come to agreement.
00:12:11.080 And so what did Alvin Bragg do?
00:12:13.400 Well, Alvin Bragg moved to dismiss the more serious charge, and he was trying to get a conviction on the less serious charge.
00:12:21.260 And I got to say, to the jury's credit, they came back very quickly with a not guilty.
00:12:27.280 So the jury has determined he is innocent.
00:12:29.700 But listen to MSNBC and just how upset they are that this innocent man was found not guilty.
00:12:36.440 Breaking news here.
00:12:37.320 Daniel Penney found not guilty.
00:12:39.100 But, Lisa, we also know that Jordan Neely's family had filed, I believe, a civil suit in this case as well.
00:12:45.060 Does the verdict in this case impact that?
00:12:48.300 Not necessarily.
00:12:49.300 I mean, the law is rife with examples of people who are acquitted in criminal cases and yet find justice with respect to civil accountability.
00:12:58.740 I think the best example of that is with respect to Fred Goldman's family, Fred Goldman.
00:13:03.600 I'm sorry, Ron Goldman being the man who was murdered alongside Nicole Brown Simpson, even though O.J. Simpson was never found criminally guilty for those two murders.
00:13:13.920 Fred Goldman, the father, along with his daughter, then sued O.J. Simpson civilly and won a fairly large verdict with respect to civil liability for O.J. Simpson.
00:13:24.140 There are many other examples of similar disjuncture between what happens in a criminal court and what happens with respect to a wrongful death action, for example, by a family.
00:13:33.640 It's sad, Senator, but there seems to be another trend, and that is if you are an innocent person and then you are found innocent of a crime, if the media doesn't like you, they're still going to act like you're a threat to society.
00:13:45.080 Well, you look at that's a reporter, Lisa Rubin on MSNBC, who is calling for the mentally ill homeless man who was high on drugs and threatening to murder people on the train, calling for him to find justice against the Marine who intervened to protect people and keep people safe.
00:14:06.980 And she analogizes it to the O.J. Simpson case, which is utterly absurd, because, look, O.J. Simpson was charged with, and the facts were pretty powerful, was guilty of murder.
00:14:20.460 Now, to be fair, O.J. Simpson was not found guilty of murder, but there was significant evidence that O.J. was guilty.
00:14:27.180 There was significant enough evidence that he ended up being hit with a large civil judgment.
00:14:33.900 This is not remotely, there's no argument, no rational, reasonable argument under the law that Daniel Penny is guilty of murder, self-defense is fully protected.
00:14:45.980 And by the way, if perchance you don't believe me, you should listen to my former criminal law professor, Alan Dershowitz.
00:14:54.860 Now, Alan Dershowitz is a liberal, he's been a liberal his whole life, but he has the courage to speak out and speak the truth and listen to what Alan Dershowitz said about this case and about the absolutely corrupt prosecutor, Alvin Bragg.
00:15:13.240 I'm going to start off with just the immediate reaction to the not guilty verdict in the Daniel Penny case.
00:15:17.620 I have to admit I was a little surprised. Having hung on the higher count, I was not expecting that they would so quickly acquit on the lower count.
00:15:26.460 It probably shows that there were only one or two people in the original high count that hung based on their desire to see a conviction.
00:15:36.520 So I think it's a good thing. Now, I think the next step has to be the removal of Alvin Bragg from the role of district attorney.
00:15:43.200 He is a disgrace to the office. The two cases he brought should never have been brought.
00:15:49.180 The case against Donald Trump, which was made up out of whole cloth, which, to my mind, involves unethical, unprofessional conduct by Bragg.
00:15:56.860 And also this case, which should never have been brought either.
00:16:00.460 He brought it only because of the racial component of the case and because of pressures from Black Lives Matter and other groups on the outside,
00:16:08.460 both white and black radicals who wanted these cases to be brought, wanted this case to be brought.
00:16:13.720 And we're going to continue to complain, even though there were obviously black members of the jury who voted to acquit as well.
00:16:20.780 Professor, what do you make of how quickly they came back with this verdict?
00:16:24.520 And also, too, there's the civil case that that he's also facing to Daniel Penny.
00:16:29.400 Does that given that he's not guilty on the criminal case, what happens to the civil case as well?
00:16:34.960 Well, it'll be thrown out. There's no case there.
00:16:38.620 Civilly, the only thing that will happen is that Penny will get an enormous amount of discovery
00:16:44.620 and will get much more information that we don't now have about the alleged victim in the case.
00:16:52.700 So my prediction is it will be withdrawn.
00:16:55.680 I don't think they'll go any further.
00:16:57.740 I don't think they'll get any kind of a verdict.
00:16:59.460 Now, you know, maybe the city will settle if they sue the city as well.
00:17:06.180 If I were the lawyers for the alleged victim, I'd probably think I'd have a better shot of getting some money from the city,
00:17:15.640 which was sympathetic, obviously, to the victim, than from a poor former Marine who probably doesn't have a lot of money.
00:17:24.420 So I don't think the civil case is going anywhere.
00:17:27.220 This is not O.J. Simpson, where the civil case won after the criminal case lost.
00:17:31.500 There was no case here to bring it all, either civil or criminal.
00:17:35.240 Alan Dershowitz there seems to be optimistic, and I'm glad he's saying,
00:17:39.960 hey, I don't think he's going to have to deal with what, for example, O.J. Simpson had to deal with.
00:17:44.220 This is very different.
00:17:45.420 I hope he's right.
00:17:47.360 Well, listen, Alan Dershowitz, he's a good friend.
00:17:49.900 As I said, he was my criminal law professor, and I actually took another class from him in law school as well.
00:17:55.940 He was a fantastic professor.
00:17:57.200 He was the best professor I had in law school, and he's a brilliant lawyer.
00:18:00.100 He's an incredibly talented lawyer.
00:18:02.780 And, you know, I remember my first year in law school when Dershowitz stood up and he said,
00:18:10.140 listen, he said, by any reasonable measure, I am in the most liberal 1% of Americans across this country.
00:18:18.480 And he said, at Harvard Law School, oddly enough, I'm considered something of a conservative.
00:18:23.840 This is not America.
00:18:27.420 I don't remember if he said this is not America, but this is not a typical place.
00:18:30.460 I mean, this was 30 years ago, so I'm paraphrasing.
00:18:33.860 But his point was, so Dershowitz believes in free speech.
00:18:39.240 That is no longer where the left is.
00:18:41.180 The left is eager to censor someone who disagrees.
00:18:44.200 Dershowitz does not celebrate the murder of those he disagrees with.
00:18:48.440 Dershowitz is not a cultural Marxist.
00:18:50.080 He's an old-school liberal.
00:18:52.180 He's a civil libertarian.
00:18:53.580 He is, you know, has represented criminal defendants successfully.
00:18:58.840 He's gotten a lot of criminal defense off.
00:19:00.200 He believes in a vigorous protection of constitutional rights for criminal defendants.
00:19:05.900 And look, I respect his courage.
00:19:09.140 He's been demonized.
00:19:10.980 He also supports Israel and speaks out very powerfully and effective for Israel.
00:19:15.160 He's been demonized by the left for doing so because they brook no dissent.
00:19:19.400 Anyone who dares oppose them is the enemy.
00:19:22.220 And so even though he's been one of the most prominent liberals in the country for decades, he is rejected by today's left because he actually has the courage to speak out against them.
00:19:39.600 I hope he's right about the civil case.
00:19:41.720 In any sane and ordinary universe, that would be true.
00:19:44.960 I have to say I have a little bit less confidence about a New York jury and a New York judge, and maybe that's because we all saw the absolute kangaroo courts that were convened against Donald Trump.
00:19:58.020 And having seen the civil suits and the criminal case against Donald Trump in the New York justice system, he is right on what should happen.
00:20:09.820 Look, I am very grateful that Daniel Penny was acquitted, but it says something about how little confidence I have about the justice system in New York that I was not sure this would happen.
00:20:21.840 I thought there was a chance they would come back and follow through on what Alvin Bragg wanted them to do, which is punish him because he was deemed the bad guy.
00:20:33.720 And thankfully, the justice system worked in this case.
00:20:38.040 And you ought to ask yourself, have you seen even a single Democrat celebrate the Daniel Penny verdict?

00:21:50.780 And that is that the Biden administration is saying, hey, we don't respect the voters.
00:21:55.000 We do not respect that the American people decided we want security at our southern border.

00:22:03.800 They're saying, all right, watch this.
00:22:05.360 We're going to sell pieces of the border wall that have not been erected yet just to say screw you to the American people.

00:22:40.660 The Biden administration is using its final weeks to haul a massive amount of border wall materials away from the southern border to be sold off at a government auction.
00:22:49.560 An apparent effort to hinder President-elect Trump's efforts to secure the border, The Daily Wire has learned.
00:22:56.400 Videos obtained exclusively by The Daily Wire from a U.S. Customs and Border Patrol agent show unused sections of the wall being hauled away on the back of flatbed trucks from a section of the border just south of Tucson.
