The Charter of Rights and Freedoms, the Coronation Oath, the Bill of Rights, the Canadian Human Rights Act, and the Universal Declaration of Human Rights, are all pre-charter human rights. According to the Canadian Constitution and Charter, we have the right to live, work, assemble, worship, and visit our family and friends. No one can force you to have anything stuck into any part of your body without your 100% consent. In addition, everyone has the right not to be arbitrarily detained or imprisoned. The values underlying the privacy interest protected by the Charter are dignity, integrity, and autonomy. As such, privacy is essential not only to human dignity, but also to the functioning of our democratic society.
