00:08:39.000 Articles where you go out with a sign amongst 500, 1,000 Bush supporters, and you say, no blood for oil, and they come over and arrest you and charge you with federal crimes.
00:08:52.000 And Mr. Bovard said, you know, I can't imagine that they're doing this, and he says, I can't imagine that a judge will convict The latest 55-year-old man that they arrested and have criminally charged.
00:09:10.000 And they admit he was standing in a big crowd of people on the side of the road.

00:09:16.000 They had held back the protesters out of view of the media and the President.
00:09:20.000 He went with his sign and just said, I'm going to stand here with it.

00:09:25.000 I guess our veterans have fought and died so that you can't stand amongst Bush supporters with pro-Bush signs and have an anti-Bush sign.

00:10:12.000 And said, well, you're only going to have to pay a $500 fine, but then repudiated him and said, you know, how dare you think that you can go protest?
00:10:25.000 So I have that article, and I want to get Bovard back on, because he said, well, I can't believe they're arresting people all over the country, and I can't believe they're criminally charging, you know, 65-year-old steelworkers and, you know, grabbing 55-year-old people and just standing there with signs.
00:10:41.000 Then I pointed out that the Dallas Morning News and Austin American Statesman have both reported that the state lost three lawsuits.
00:10:50.000 This was about five years ago, four and a half years ago.
00:10:53.000 Bush was governor, and if you stood anywhere on the streets around the governor's mansion across the street from the Capitol, these are main avenues in Austin, Texas.
00:11:03.000 They're on the corner of 11th and Lavaca, or anywhere around there, they would come over and arrest you.
00:11:11.000 And I have been out there protesting before.
00:11:14.000 And, you know, protesting against gun grabbing and other stuff that was going on.
00:11:19.000 And Bush wanting open borders here in Texas and trying to do that.
00:11:24.000 And I had state police walk over and APD walk over and say, we're going to arrest you if you don't leave.
00:11:28.000 And I'd say, hey, go ahead and arrest me.
00:11:30.000 I'm going to sue you personally.
00:11:32.000 Understand that, buddy.
00:11:33.000 I'm going to sue you.
00:11:35.000 And I'd say, I know you've been arresting a lot of people, but please, I want to sue you.
00:11:39.000 And they'd back off from me, but others.
00:11:42.000 In fact, one of the big suits they lost was a bunch of handicapped folks who were out there protesting, and they arrested a bunch of old ladies in wheelchairs, loaded a paddy wagon with them, and that was just one of the lawsuits.
00:11:57.000 They had to pay $100,000 a piece out to each of the old people.
00:12:00.000 A couple of them were old ladies of those that sued and won.
00:12:04.000 And they were on the sidewalk, not blocking traffic, sitting there with signs about the state budget.
00:12:10.000 And boy, really dangerous.
00:12:11.000 Let's arrest them.
00:12:12.000 And that was under the governor's orders.
00:12:14.000 Get them old ladies out of here.
00:12:16.000 And that was in the paper.
00:12:18.000 And when it really got obvious, here in Austin, when I worked for KJFK, one of the hosts who was on before me, Shannon Burke, he said, To one of the interns, he said, I want you to go down there with a sign that says, I like Bush.
00:12:38.000 And they sent somebody down there with an audio recorder and a video camera as well across the street to tape all this.
00:12:44.000 And the intern, I ought to call Shannon and get her name and have her on.
00:12:48.000 It was in the Dallas Morning News, as I said.
00:12:50.000 And she went and stood with the sign, I like Bush, during another protest of about 15 people against the death penalty.
00:12:57.000 Pops came, arrested every one of them.
00:12:59.000 She was standing among them, didn't say a word, just held her sign.
00:13:02.000 They didn't arrest her.
00:13:04.000 And then she came back on the radio and talked about how they winked at her.
00:13:07.000 There was video of all this too, I ought to get that video.
00:13:12.000 So they kept arresting people and arresting people and they lost three different suits.
00:13:16.000 Several of the suits had multiple parties, and in the cases, they all won $100,000, a little over $100,000 a piece.
00:13:28.000 I mean, folks, that's not a free country.
00:13:30.000 That's what they do in China and Russia.

00:14:36.000 But the cops, the average police officer out there, and I don't dislike you, I'm just angry at your ignorance, has been told our policy is, arrest anybody on the street with a sign, take anybody to jail that's doing this, but when they lost all those lawsuits downtown, at the Capitol, now suddenly in this city we don't see as much of that.
00:14:56.000 Though Mike Hanson, who does some camera work for me, got a call that one of our listeners, they wanted to search his car and have his ID and all that, and he said no.

00:18:55.000 I have watched illegal aliens with no ID, unable to speak Spanish.
00:19:00.000 I've sat there in line with my wife, who does speak Spanish, and I have sat there and she has told me what they're saying and they are there with no paperwork and a Spanish-speaking teller comes up and gives them a bank account.

01:34:51.000 Tell us a little bit about yourself, and then let's get into the Second Amendment and where you see it going.
01:34:57.000 Well, you hit the high spots.
01:34:59.000 That covers a lot of Years.
01:35:02.000 I used to be a newspaper man down in the great state of Texas, in North Texas, Vernon, Wichita Falls.
01:35:10.000 Then I went to Sydney, Ohio to start Gun Week back in 1966.
01:35:15.000 At that time, I had been writing for some of the gun magazines.
01:35:19.000 I had what I believe was the first footnoted scholarly type article on Whether or not gun laws actually reduce crime, because I was chopping down what Tom Dodd was saying then.
01:35:35.000 But I started lobbying the Hill back in the summer of 1966 and I have been at it ever
01:35:43.000 since.
01:35:44.000 I didn't want to bore anybody with a long life tenure, but during the time that I was
01:36:01.000 the Island Director, which was from 1978 to 1982, that was a year after the Cincinnati
01:36:08.000 Reform, the so-called member revolt, which I played a significant role in that.
01:36:16.000 We put Harlan Carter in as the one that was on the board and a former Executive Director of ILA, we felt that he would do the best job and he talked me into coming back to D.C.
01:36:34.000 in January of 78.
01:36:36.000 At that time I was in Prescott, Arizona editing Hand Loader and Rifle.
01:36:46.000 He made some speeches that anybody who's dumb enough to leave Prescott, Arizona and come
01:36:51.000 to Washington, D.C. is too dumb to do the job when he gets here.
01:36:55.000 There's a lot of truth in that.
01:36:57.000 But I'm very proud of the fact that my so-called too hard of a line, the no compromise line,
01:37:09.000 and hold their feet to the fire line, I'm proud to say that that did work.
01:37:15.000 I remember the day that I took the job.
01:37:18.000 I sat down at my desk and thought, well, Neil, you've been preaching for a lot of years.
01:37:24.000 It's time now for you to plow.
01:37:28.000 And it was a scary thought, but it did work.
01:37:34.000 During my four and a quarter years that I was in there, not one federal gun law was passed and we started out with an anti-gun majority in the House, particularly, and in the Senate.
01:37:52.000 They were all Democratic-controlled, Democratic Party-controlled.
01:37:57.000 Not one bill passed.
01:38:01.000 Part of that was luck.
01:38:03.000 Part of it was greed on their part.
01:38:04.000 They wanted more than they could get for sure.
01:38:08.000 And by trying to get more, they got nothing.
01:38:12.000 But we hammered them very hard.
01:38:16.000 Now back then they were a little more honest about their plans to disarm us.
01:38:19.000 Now they use mislabeling in this creeping death format.
01:38:24.000 But I'm very interested that back in 1977, the NRA convention in Cincinnati, how you had that members revolt.
01:38:32.000 How do we engineer one of those today?
01:38:34.000 Because the NRA and its magazine and its publications will not tell its members that Bush has said And the Associated Press that he's going to reauthorize the assault weapons ban, no matter what's tacked onto it.
01:38:46.000 That is incredible!
01:38:48.000 Well, I don't think he has said quite that strong, but what he said was... Yes, he has.
01:38:53.000 You may have missed it.
01:38:54.000 Well, I didn't see the, no matter what is tacked onto it.
01:38:58.000 What has happened is Scott McClellan, who was then deputy and is now the full-time press secretary for Mr. Bush, He said, in answer to a question, that they did support, as he had supported in the 2000 campaign, the re-enactment.
01:39:22.000 And I don't think they've gone beyond simple re-enactment.
01:39:27.000 I don't like simple.
01:39:28.000 I want to see that thing gone.
01:39:30.000 It expires September 13 of this year.
01:39:33.000 I want to keep it off his desk so that he doesn't Have the opportunity to do it.
01:39:39.000 He has done nothing, I guarantee you, that I know of, to push it.
01:39:43.000 And this has been causing the people over on the other side to scream madly.
01:39:48.000 I don't like the fact that he's where he is.
01:39:51.000 At the same time, he hasn't been out there pushing for it.
01:39:56.000 And I think that if we all keep putting the pressure on the White House, he won't.
01:40:05.000 Well, I don't have the articles in front of me, but I've had quite a few guests on and Pratt and others, and we've gone over the statements and they have been asked, well, you know, if they bring you this bill and it's got stuff added to it, what are you going to do?
01:40:20.000 And they say, well, we support the reenactment.
01:40:23.000 And, you know, that sounds to me like they're saying they're going to authorize it.
01:40:28.000 And they've said that they will re-authorize what's already there that's bad enough.
01:40:34.000 I mean, look, most politicians that are pro-gun get re-elected, what is it, 86% in the 2000 election, I saw the numbers.
01:40:43.000 It's constitutional, it's what the people want, we've been winning the fight for the minds of the people.
01:40:50.000 I mean, how do we get that law repealed or not get it re-enacted?
01:40:54.000 Well, that's the advantage.
01:40:55.000 We do not have to repeal it.
01:40:58.000 All we have to do is let that thing die.
01:41:00.000 Now, Tom DeLay has said that he would not call that bill to the floor.
01:41:09.000 What's bothered me is that the other side is going to do their best, and I've seen some internal memos from the other side where they were talking about working with certain senators, that they want to put The Quote Assault Weapon Band, mechanically identical to the one that my dad, who's 91 years old, last year when he busted a nice 10 point buck about 70 miles north of you up near Lampassus.

01:41:50.000 that is gas operated magazine fed semi-automatic with the debt
01:41:55.000 with a box magazine detachable box mag
01:42:00.000 that is what they call an assault weapon and if they could they would ban them all to quote diane feinstein

01:42:16.000 and they will expire you're going to see a knock down drag out effort
01:42:21.000 to put that on any piece of legislation that they can get to the floor

01:42:27.000 Whether or not Tom DeLay can prevent that from coming up, I don't know.
01:42:32.000 He's a potent man up there and I'm proud of it.
01:42:35.000 He's been very supportive of us.
01:42:38.000 And I must say that the administration has been helpful to us in a lot of ways.
01:42:44.000 I was irritated with them back in the fall when they did not help us on one that The Office of Personnel Management had given a contract to Andrew McKelvey, the guy that came up with this mislabeling that you're talking about.
01:43:01.000 McKelvey's group is so-called Americans for Gun Safety.
01:43:04.000 It's not even really an organization.
01:43:07.000 It's funded through one of these not-for-profit groups and goes through the Tsunami Fund.
01:43:15.000 He gave 3.6 million bucks.
01:43:18.000 I don't know how much he gives each year to it, but that mislabeling business of his is the one that says now we're going to talk about gun safety instead of gun control, that kind of thing.
01:43:34.000 Now, those people plan to try to add the so-called assault weapon ban to S-659, which is the It's like if I go and buy a Louisville Slugger and kill somebody with it, you don't go after me, you sue Louisville Slugger.
01:43:53.000 from being sued for the criminal misuse of their products, which is just stupid that
01:44:00.000 anyone would think.
01:44:04.000 Yeah, it's like if I go and buy a Louisville Slugger and kill somebody with it, you don't

01:44:13.000 That's their weird notion. That's one of the big fights of the year.
01:44:17.000 Now, NRA has been pushing that one since 1998.
01:44:22.000 They have called that their top priority, and I was more than a little concerned, oh, let's say a little over a year ago, when I first started hearing this noise about combining those two.
01:44:39.000 I was afraid that NRA might accede.
01:44:44.000 To combine it.
01:44:45.000 And for those that don't know, that would bring massive California-style so-called safety regulatory control over gun manufacturers, you know, like they do with a lot of other industries.
01:44:58.000 And then with that, they'd be able to ban guns outright by declaring them unsafe.
01:45:04.000 Well, you're talking about the Consumer Product Safety Commission stuff, which You're right about what they want to do and what it would do, but the one I'm talking about... I've read articles where they're going to try to attach that to a bill.
01:45:17.000 Oh, they absolutely, they've been trying to do it ever since 1974 when they first rolled it out.
01:45:23.000 Okay, let me cover a few other issues here real quick with you, Neil.

01:45:26.000 This is very important.
01:45:28.000 I mean, again, if we had people like you at the NRA again, back on the board, we'd be repealing laws.
01:45:33.000 How about Bush?
01:45:34.000 If he's so pro-gun, they stop the building of this new giant BATF complex.
01:45:40.000 How about he not increase the funding for the BATF, which he's done?
01:45:43.000 How about they get rid of Project Exile, Which federalizes gun crimes.
01:45:47.000 You know, some old guy carrying a gun in his car in some state where you quote, can't do that.
01:45:52.000 How do we get lots of these laws repealed?
01:45:54.000 We have the force of numbers.
01:45:56.000 We have the Constitution.
01:45:58.000 How do we force the Republicans that have the Supreme Court, the House, the Senate, and the Executive to start repealing and dismantling gun control that has made Chicago the most dangerous city in the country?
01:46:13.000 Well, in answer to all those questions, I don't know.
01:46:19.000 But I do know that you cannot do it by patting a Republican on the head just because he's a Republican and saying, there, there, that's okay, go ahead and vote against us once in a while and we won't object.
01:46:32.000 You've got to object.
01:46:34.000 That's one of the keys.
01:46:36.000 Now, I don't know, on all these bills out here, How we're going to stop the laws, how we're going to turn it around.
01:46:46.000 I was one of them who warned the NRA board that this idea of enforce the gun laws we've got, which came from NRA.
01:46:55.000 And it's a great PR move, but it is terrible policy because we've got a bunch of guys that have a 40 year old conviction.
01:47:07.000 That could be a domestic violence conviction, that's one thing.
01:47:12.000 Well, now they're going after people with misdemeanors.
01:47:14.000 Yeah, that is a misdemeanor.
01:47:16.000 Domestic violence misdemeanor.
01:47:19.000 And right there in the great state of Texas, I remember in Austin, statesman American a couple of years ago bragging about Project Exile version in Texas, they said that This one old boy that had been hammered had no previous criminal record, but he had possessed a gun while he was under a restraining order.
01:47:49.000 In the great state of Texas, a restraining order in a divorce.
01:47:53.000 It's just automatic.
01:47:55.000 It's almost boilerplate.
01:47:57.000 Yeah, they admitted that she admitted there was no violence.
01:48:01.000 The lawyer just has that done to control the proceedings and to kick the man out of the house.
01:48:09.000 And this is just a standard procedure.
01:48:11.000 And then, of course, he won that case, went to the Fifth Circuit.
01:48:15.000 And that brings us into my next issue, the Ninth Circuit.
01:48:18.000 Again, I wouldn't call it a Republican court.
01:48:20.000 I'm not that fond of it.
01:48:21.000 I'm not that fond of all Republicans.
01:48:23.000 wants to ban all the guns they say we can ban every gun we want it's not an
01:48:26.000 individual right and the supreme court says yeah yeah we're gonna let that
01:48:30.000 ruling stand now this is our republican court again neil again i wouldn't call
01:48:36.000 it a republican court i'm not that fond of it okay so i'm not that fond of all
01:48:41.000 republican don't misunderstand but the reichert the judge in the ninth circuit
01:48:48.000 wrote that that opinion which uh all he had to do is say we affirm what we've
01:48:56.000 said before But he wanted to get his licks in, and he took a slap in his opinion at the Fifth Circuit Emerson case decision that you were talking about.
01:49:07.000 And in his case, they went up to the Supremes.
01:49:13.000 They've declined to hear it.
01:49:16.000 But I'm thankful they did, because look at what this other, what you call Republican court, which I really don't.
01:49:24.000 Put in by Republicans!
01:49:25.000 Well, I wouldn't argue that.
01:49:27.000 Souter was put in by Republicans, so was Senator Dale Conner.
01:49:32.000 They both voted wrong on, as far as I'm concerned, on under God in the Pledge of Allegiance.
01:49:41.000 Uh, on affirmative action.
01:49:44.000 These things that, that they just turned the constitution on its head.
01:49:49.000 I don't want this court considering the second amendment.
01:49:53.000 And I was not pleased with the severe case because it was a real bad case technically to bring that case up.
01:50:02.000 They, uh, the most people don't realize that, uh, Here you're dealing with a state law, and the state law in California is far worse even than the federal law.
01:50:19.000 It's really nasty, and they're saying that that, quote, assault weapon law would have to be found, first of all, to be a violation of the Second Amendment and applicable to the states.
01:50:32.000 See, the Second Amendment has never been held I understand.
01:50:36.000 They can use the Tenth Amendment when they want to destroy our liberties, and then ignore the Tenth Amendment when they're federalizing.

02:01:25.000 With the exception of the Middle East, which I don't begin to understand, there is no case of a totalitarian dictatorship that has existed where the people had the right to own firearms.
02:01:38.000 Now there are places where we didn't yet have a dictatorship, but we've got a socialist government We've got total control of the people, even in England, where they have very restrictive laws and it's getting much worse very quickly.
02:01:55.000 But it's an insurance policy for us to have that, and that's exactly why the Founding Fathers made sure that that pre-existing right continued to exist.
02:02:10.000 Let's talk about, if you don't mind, before we jump to calls, Let's talk about a couple of things that people can do right now, things that are coming up that are positive, that are where we are on the offense.

02:02:26.000 One of them is a section of, it was originally the Representative Todd Tearch's amendment to the Justice Department funding bill.
02:02:42.000 The TRD Amendment was put into the Omnibus Crime Act, which is going to be the first item up when Senate gets back January 20.
