01:41:20.000 Well, the first thing I'm seeing right now is that our government is continuing to factionalize, and not everybody is in agreement with pursuing this war in Iran, because even if Bush uses the nuclear option against some of the key targets, the conventional wisdom that I'm hearing from military sources is that the U.S.

01:41:40.000 is not going to win a land war in Iran.

01:41:43.000 Well, we're going to lose the global publicity, too, and we're going to lose that fight.

01:41:49.000 And so, a lot of people are seeing invading Iran as a huge, huge, huge mistake, and that Bush is continuing to push this, primarily because he doesn't want to look like he's backing down, especially for the election, and secondarily, he's under huge pressure from Israel to continue to pursue these wars.

01:42:12.000 And we know they're blackmailing the White House.

01:42:14.000 Yeah, absolutely, and unfortunately, you know, Bush may yield to that blackmail and commit a mistake from which this country is never going to recover.

01:42:23.000 What is wrong with Israel?

01:42:24.000 Do they just have the worst hubris or chutzpah ever seen in the galaxy? 0.99

02:09:03.000 They just, they revoke You see, you're guilty until proven innocent by a kangaroo court.

02:09:13.000 So it's kind of a play on words.

02:09:14.000 They go, oh, this doesn't affect you as citizens, because they strip you of citizenship when they do it.

02:09:53.000 You know, it's interesting, we didn't hear this in the corporate media, but the definition of unlawful enemy combatants, and somebody who can be locked up indefinitely, is not limited to Al Qaeda or the Taliban, it's not even limited to aliens, it covers U.S.

02:10:09.000 citizens as well.

02:10:10.000 It's not limited to people who are captured or detained overseas, It's not even limited to the armed conflict against Al-Qaeda and the Taliban, and it's not even limited to a time of war it could apply in peacetime.

02:10:23.000 It's very, very frightening.

02:10:25.000 It's extremely broad and purposefully vague and mirrors a lot of what we saw in Patriot Act 1 and the attempted Patriot Act 2.

02:10:33.000 I call it 1.5.

02:10:34.000 They did pass a few new provisions.

02:10:36.000 Last year.

02:10:38.000 Where do you... I mean, break down some of these sub-provisions for us, please, with your expertise.

02:10:43.000 A lot of experts, a lot of political, you know, Yale law professors are saying it's the end of the Constitution, are saying it affects U.S.

02:10:50.000 citizens.

02:10:50.000 They've got the same analysis, basically, that you had.

02:10:53.000 Friday, when I finally finished reading the bill, I felt a great sense of loss And shock!

02:10:58.000 We knew things were going in the wrong direction for a while, but this is very similar to Hitler's Enabling Act, and I actually feel a type of bone-chilling melancholy.

02:11:08.000 You know, I agree with you, Alex.

02:11:10.000 Look at particularly Section 948A1, that's 948A1, that defines unlawful enemy combatants.

02:11:19.000 And that's anybody that Bush and Rumsfeld say has purposefully and materially supported hostilities against the United States or its co-belligerents.

02:11:28.000 In other words, let's say that somebody gave money to a charity not knowing that it might turn up on Bush's list of terrorist organizations or someone who writes or speaks out against the government's policies, they could be declared an unlawful enemy combatant and locked up.

02:11:45.000 And what if they say, well, What if they say, you are an alien, and you don't even have, the aliens don't even have any rights of habeas corpus, so say they make a mistake and you're really a U.S.

02:11:58.000 citizen, you're going to rot there for the rest of your life, in who knows where, could be in one of the secret CIA prisons somewhere in the world, with no way at all to prove that you're a U.S. 0.90

02:12:07.000 citizen.

02:12:10.000 And then, Bush played this whole Ponzi scams, smoke and mirrors, fraud with McCain coming out like it was a defeat of Bush.

02:12:21.000 It was billed as, oh, Bush has to compromise.

02:12:24.000 And then legal experts looked at it.

02:12:26.000 The LA Times reported it actually gave Bush more than what he had even declared Previously, and then up until the day of the final votes on Friday, they were still claiming that it was a compromise, and still now I'm having arguments with other pundits saying, oh no, this doesn't affect U.S.

02:12:43.000 citizens, where it clearly affects U.S.

02:12:46.000 citizens.

02:12:47.000 It absolutely affects U.S.

02:12:49.000 citizens, and Yale Law professors like Bruce Ackerman, Jack Balkin, several other professors at very top schools, All agree that it does affect U.S.

02:12:59.000 citizens.

02:13:00.000 Now, they can't be tried in the military commissions, and they can't be denied habeas corpus, but there are several provisions that do affect U.S.

02:13:08.000 citizens, and one of them, and I think the most disturbing part, is that they could declare that you're an unlawful enemy combatant and lock you up.

02:13:16.000 And it could be indefinitely.

02:13:18.000 Well see that is a violation of habeas corpus.

02:13:22.000 In fact, my reading of it, if you tie it into the U.S.

02:13:25.000 Code, is even wider than what you just stated.

02:13:28.000 Well, you know, if you look at the Supreme Court's decision in Hamdi, not Hamdan, but Hamdi, they said the President has authority to detain an enemy combatant, and Hamdi was a U.S.

02:13:40.000 citizen.

02:13:41.000 But ONLY, ONLY, if they were captured in Afghanistan.

02:13:45.000 What?

02:13:45.000 They limited it to Afghanistan, and so we don't know.

02:13:48.000 You know, Bush pulled this thing with Jose Padilla, the so-called dirty bomber, and of course there was never any evidence that he was a dirty bomber except from someone who had been tortured into saying it.

02:13:59.000 But Jose Padilla was kept, he's a U.S. 0.87

02:14:02.000 citizen, and he was not captured in Afghanistan the way Hamdi was.

02:14:06.000 He was captured in Chicago, which is the United States, of course.

02:14:09.000 And they locked him up for years.

02:14:11.000 And finally, on the eve of the due date for the government's brief in the Supreme Court to determine whether or not it's constitutional for the President to hold a U.S.

02:14:20.000 citizen who's been picked up in the U.S.

02:14:22.000 as an enemy combatant, the Bush administration said, oh, we're going to charge him with a crime.

02:14:26.000 This is moot.

02:14:27.000 Well, Professor, I agree, but right here at 950J, Line 24, no court justice or judge shall have any jurisdiction to hear or consider any claim or cause of action whatsoever.

02:14:40.000 And it goes on.

02:14:41.000 And then we have Gonzales coming out telling the courts, you stay out of this.

02:14:46.000 In fact, the San Francisco Chronicle picked up on this on Friday and said he has a new power risen to a level above the courts.

02:14:53.000 That is official dictatorship.

02:14:55.000 It is, and yeah, I mean, can you imagine Gonzalez saying, stay out of the courts?

02:15:00.000 I mean, that's why the Founding Fathers put three branches into the Constitution.

02:15:03.000 I'll tell you, the Center for Constitutional Rights has already filed a legal challenge to this bill.

02:15:10.000 But they've got it in law in here that you're not even allowed to do that.

02:15:14.000 This is the executive literally declaring the Fuhrer principle.

02:15:19.000 I mean, folks, we're not joking.

02:15:20.000 They're openly saying that they are supreme, when in truth it's co-equal branches.

02:15:26.000 That's true, and we'll see whether the courts actually take this test case or not.

02:15:30.000 But I'll tell you something else.

02:15:32.000 What Bush has done is to sign every single bill that's come before him, except for the stem cell research bill.

02:15:39.000 It's the only one he's vetoed.

02:15:41.000 And he has then quietly attached a little signing statement at the end of over 800 bills, more than all other presidents combined, saying, I'm going to follow those parts of the law that I want to follow.

02:15:53.000 Basically, giving the finger to Congress.

02:15:55.000 And that's what we have.

02:15:57.000 We have what is rapidly becoming a dictatorship in this country.

02:16:02.000 I've never really been scared.

02:16:05.000 I know it's dangerous what we're doing.

02:16:06.000 I know these people are very serious and very corrupt.

02:16:10.000 But Friday, when this all happened, I was literally staggering around in the middle of the night.

02:16:15.000 I was waking up.

02:16:16.000 I couldn't sleep.

02:16:17.000 I never have trouble sleeping.

02:16:19.000 I mean, I have a real sense of loss and I'm grieving.

02:16:22.000 I mean, even Hitler didn't put stuff like this down on paper.

02:16:30.000 And also, keep in mind that Kellogg, Brown and Root, which you probably recognize as a subsidiary of Halliburton Cheney's company, It's building a huge facility at an undisclosed location to hold tens of thousands of undesirables.
