00:08:44.000 But to get into it, to get into the topic tonight, there are two major reasons why I'm psyched about this.
00:08:54.000 And the first is the obvious.
00:08:57.000 Ruth Bader Ginsburg, for as long as she's been alive, at least for the past couple of decades, has been a human bulwark against repealing Roe v. Wade in particular.
00:09:08.000 And when I say that I'm celebrating and I'm not mourning, it's because of that.
00:09:13.000 For all the conservatives that are out there tonight, or anybody for that matter, saying that it's not classy or it's not appropriate to celebrate when someone dies, consider that tens of millions, possibly hundreds of millions of babies.
00:09:27.000 Have been aborted and killed because she stood in the way of a conservative court repealing or overturning Roe v. Wade.
00:09:36.000 And she knows that, and everyone knows that.
00:09:39.000 She wouldn't resign from the court after getting cancer multiple times and getting sick in her advanced age because she knew that if she stepped down, a conservative would be appointed and abortion would be overturned.
00:09:53.000 She knew that, and she said as much. 0.84
00:09:56.000 She held on for dear life, no pun intended, to her seat on the court for that reason, so that babies could continue to be killed while she protected this terrible judicial precedent.
00:10:10.000 So that's why I celebrate.
00:10:11.000 That's why it's awesome, right?
00:10:13.000 And of course, now that she's out of the way, this paves the way for a conservative court. 1.00
00:10:21.000 Arguably, we had a conservative court before Ginsburg died. 1.00
00:10:25.000 Arguably, it was five to four.
00:10:28.000 Conservatives versus liberals, but we found that time and time again throughout this year, we've covered many Supreme Court cases that have come down on the side of the liberals on the court because the Chief Justice Roberts now sides with liberals most of the time.
00:10:44.000 Formerly conservative and now siding with liberals.
00:10:48.000 And even Neil Gorsuch sometimes siding with the liberals.
00:10:52.000 So maybe it's not fair to say that it was five to three so much as it was, you know, I guess four and four, and then there's one that sometimes goes either way.
00:11:03.000 Now that Ginsburg is out of the way, it clears the way for an unabashedly, unambiguously conservative court.
00:11:11.000 Really having five justices that are conservative against three, or rather, it would be six, right?
00:11:17.000 If you replace Ginsburg, it would be six.
00:11:19.000 I guess five plus Roberts sometimes against three liberals.
00:11:24.000 And that makes it so that overturning Roe v. Wade becomes possible, overturning gay marriage, overturning countless things.
00:11:31.000 It's huge. 0.66
00:11:32.000 Overturning challenges to the Second Amendment or blocking challenges to the Second Amendment, blocking challenges to the First Amendment, protecting religious liberty.
00:11:42.000 I mean, you name it, this is a huge deal.
00:11:44.000 This paves the way for another Kavanaugh, somebody who's truly conservative, getting on the court and creating, you know, not a situation where we're dependent on a swing vote, but something that we can count on and that's reliable.
00:11:56.000 That's the first reason why this is awesome and exciting.
00:11:59.000 And those are huge issues.
00:12:01.000 Because ultimately, what it comes down to in this country these days, if we can't Ever win the House of Representatives again?
00:12:08.000 If the presidency and the Senate are very challenging in the years to come, if we can solidify our control over the Supreme Court, that may be one of the last stands for our civil liberties.
00:12:21.000 And that may count one day.
00:12:22.000 In a hypothetical future Democratic administration, you might get to the point where there will be real challenges to our First Amendment and even being able to say the things that I'm saying without being arrested.
00:12:35.000 I mean, we know that you can't say these things on the internet without getting deplatformed, demonetized.
00:12:40.000 Fired, etc.
00:12:41.000 But we're talking about challenges to the First Amendment where you could be put in jail for saying these things.
00:12:48.000 And then the same goes for challenges to the Second Amendment where we will not be able to protect ourselves against the mob and the rioting and all of that.
00:12:56.000 And the list goes on and on.
00:12:57.000 So it's hard to overstate what a huge deal, what a huge benefit comes our way politically that she is cleared out of the way and hopefully for a conservative judge to take her place.
00:13:09.000 But that is only one benefit.
00:13:10.000 I know that's the most obvious.
00:13:12.000 I know that's the one that everybody's talking about, but of course, we know that the secondary benefit is what comes after the election.
00:13:22.000 And this is maybe something that people haven't thought about yet, people haven't thought very strongly about, but it's something we've been talking about on this show for the past few weeks or so.
00:13:33.000 We've been talking about how the real battle is not even necessarily this election, it is the legal battle and political battle that will come after the election.
00:13:44.000 We know that on November 3rd, that is when most people will vote, but we have heard now that votes will be counted in states like Michigan and Pennsylvania and other places.
00:13:55.000 Days and sometimes weeks after the election, depending on when they're mailed in.
00:14:01.000 But we will be seeing states swing states, not giving us a final tally until November 10th, November 17th, all the way through the month.
00:14:11.000 And then the battle will commence over was the voting legitimate?
00:14:15.000 Is there legitimacy to the process?
00:14:19.000 And of course, you'll have lawyers from both campaigns debating, and this will be very contentious.
00:14:24.000 I'm sure there will be civil unrest over this.
00:14:27.000 People will be in the streets.
00:14:29.000 And ultimately, whatever comes after the election, whatever the outcome is, whether it's ballot fraud or they try to steal it by suing or there's some kind of secession crisis, who knows?
00:14:42.000 Maybe Trump is able to pull it off and secure all the electoral votes by winning the contests in enough states.
00:14:49.000 But what happens if the states don't send their electors to Washington, D.C. to actually formally vote for the president?
00:14:56.000 What happens if Trump is inaugurated and it's still contentious and some states begin to secede?
00:15:04.000 Well, ultimately, then, a lot of these questions may come down, like I said, whatever the outcome, whatever the outcome is, if it's contentious, it may ultimately be decided by the Supreme Court.
00:15:15.000 And you have to think that if it was 5 to 4 or maybe 4 to 4 plus Roberts, it is very uncertain.
00:15:25.000 It is highly uncertain what the outcome would be in the event that a decision was passed over to the Supreme Court about who's going to become the next president, and then, therefore, who will dictate.
00:15:36.000 How the next century will go, how the next decade, how the next century will go.
00:15:40.000 If the left gets in now, it's over for us.
00:15:43.000 If Donald Trump stays in, if the Supreme Court gives it to him, if that's the trajectory that we're on, then we still have a window of opportunity to hold back the night.
00:15:53.000 So it's a huge decision.
00:15:54.000 With Ginsburg out of the way, now you've got a court that's four to three plus Roberts.
00:16:01.000 You know, maybe that's four to four, whatever.
00:16:03.000 But if Trump can get another judge in there, not only does he stand a chance at overturning Roe v. Wade and everything like that.
00:16:09.000 But also, that is going to be extremely consequential if and whenever the presidential election is decided, if that winds up in the hands of the Supreme Court.
00:16:20.000 So, it is a huge deal politically, tactically, and this is a decision that will affect, like I said, and I don't think it's an exaggeration to say this.
00:16:31.000 This is an event that will decide the next 100 years.
00:16:35.000 The rest of this century hinges upon this moment Ginsburg dying at this time and what will come next.
00:16:42.000 If someone will be appointed or whatever.
00:16:44.000 And this leads me to another observation, another thought about what has happened since Ginsburg died just two hours ago or a few hours ago.
00:16:53.000 I see so many conservatives are already saying that they will not vote for a replacement for Ruth Bader Ginsburg.
00:17:01.000 Republican senators and a lot of conservative commentators are now saying that we cannot select a replacement, we cannot vote in a replacement for Ginsburg because that just wouldn't be right.
00:17:13.000 It wouldn't be fair.
00:17:15.000 The argument goes something like this.
00:17:17.000 In 2016, before the presidential election, of course, Antonin Scalia died or was killed.
00:17:27.000 I think he was probably killed.
00:17:29.000 But Antonin Scalia, whether he was killed or whether it was something else, he was no longer in the picture.
00:17:35.000 And Barack Obama famously nominated Merrick Garland to replace him.
00:17:39.000 And Merrick Garland was thought to be the moderate choice, he was a choice that was less offensive to Republicans than other liberals.
00:17:48.000 And this was a very strategic play.
00:17:50.000 And the expectation was if Antonin Scalia died well before the election, but during the election year, it would be appropriate for a Republican controlled Senate at that point that they would have had to hold the vote on Merrick Garland becoming a justice.
00:18:06.000 And they wouldn't do it.
00:18:07.000 Mitch McConnell would not allow a vote on Merrick Garland.
00:18:10.000 He said that the next president has to decide.
00:18:13.000 It's an election year.
00:18:14.000 And so the election should be a referendum on the court.
00:18:17.000 And then whoever wins the election will get the justice, whether.
00:18:21.000 That's Clinton, or whether that's Trump.
00:18:23.000 At that point, they didn't even have nominees, but that was the going logic.
00:18:27.000 So now in 2020, the argument goes something like this Well, Mitch McConnell wouldn't give a vote for Merrick Garland in 2016, so it's only right that with just a month and a half before this election, Mitch McConnell cannot hold a vote on whatever nominee Trump puts up now, because it just wouldn't be fair.
00:18:49.000 He didn't do it for Obama from the opposing party for Merrick Garland in 2016.
00:18:56.000 So, if we're doing the right thing and being consistent, he cannot do it for Donald Trump in 2020.
00:19:02.000 It wouldn't be fair.
00:19:03.000 It wouldn't be right.
00:19:04.000 And, you know, I really love that so many people are saying this because this just illustrates a concept that I have been trying to impress upon you, upon this audience, for months and years, which is we cannot afford to care about being fair.
00:19:22.000 We cannot afford to care about thinking about what's consistent and doing the right thing and anything like that.
00:19:29.000 We have to win at any cost.
00:19:33.000 Us winning is always good, and them losing is always good.
00:19:39.000 And that is the only thing that you need to know about politics.
00:19:42.000 What is good for us is good, what is bad for them is good.
00:19:48.000 That's what we need to know.
00:19:49.000 There's nothing about this fairness or civility or the integrity of the procedure or following the rules.
00:19:58.000 And I'll tell you why that is.
00:20:00.000 It's because, and in case you don't understand this, in case you've been living under a rock for the past three months or four years, we're in a civil war.
00:20:10.000 And the people on the other side are not our compatriots.
00:20:14.000 These are not friends of ours.
00:20:17.000 These are people who have a diametrically opposite view for what this country should be on issues that really matter.
00:20:24.000 These people on the other side, they don't just think that we should have higher taxes, they don't just think that we should maybe have a more internationalist foreign policy. 0.76
00:20:35.000 They want drag queens in public schools.
00:20:38.000 They want to abort millions of babies post birth, late term. 1.00
00:20:44.000 It doesn't matter to them.
00:20:46.000 These people, if they had it their way, would have you fired from your jobs.

00:20:52.000 They would take away your right to vote.
00:20:55.000 Look at what Barack Obama did when he was president he stripped away conservative nonprofits, their nonprofit status.
00:21:02.000 He went to gun manufacturers and bullet manufacturers and, using the EPA, closed down their factories.

00:21:11.000 They have contempt for our way of life.
00:21:13.000 They have contempt for us.
00:21:15.000 And if they succeed, we will be wiped out, our country, our inheritance, our traditions, along with us.
00:21:21.000 And that is why any kind of idea that we are supposed to show these people some kind of fairness or consideration or goodwill or good sportsmanship, we're not playing a sport, we're in a war.
00:21:35.000 And anything that we offer them is a concession, it's a surrender.
00:21:39.000 For them to make our lives worse and for them to hurt our country and our children further.
00:21:45.000 And I should add, any goodwill that we show them will not be reciprocated, maybe more importantly than anything else.
00:21:53.000 Everybody that talks about fairness and anything like that, do you think for a minute that a gesture of goodwill towards Chuck Schumer and Nancy Pelosi and people like Chris Hayes and Rachel Maddow and all these other characters, do you think for a second, for a moment, that Anything that we could show them as far as sportsmanship goes will be reciprocated towards us.
00:22:16.000 These people are ruthless, cold blooded killers.
00:22:19.000 And you know that by their policy, you know that by their politics.
00:22:23.000 And so not only does it make no sense to help people that their mission every day when they wake up is to destroy our way of life, but more than that, anything that we could show them as far as sportsmanship will not be returned in kind.
00:22:37.000 If anything, if we give them any kind of weakness or vulnerability, they will take an opportunity to stab us in the back.
00:22:44.000 Mark my words.
00:22:46.000 For example, I mean, what do you think is going to happen in this case if we were to say that we're not going to put up a nominee for the court or we're not going to hold a vote on a nominee for the court before the election?
00:22:58.000 What do you think the turn of events will be?
00:23:00.000 Well, the election will happen.
00:23:02.000 Democrats will steal it, right?
00:23:04.000 I mean, we know this.
00:23:05.000 They will stuff the ballots with fake mail in ballots.
00:23:08.000 And even if that doesn't work, they'll not send the electors or they'll threaten to secede.
00:23:14.000 They will do everything in their power to steal the election.
00:23:17.000 And then, when Joe Biden gets elected president, probably he'll step down. 0.96

00:23:23.000 And we'll say, that's not fair. 0.88

00:24:37.000 We have to look at the dynamic here where you've got now the Republicans in the Senate because the way that the process goes, if you're not certain about this, is this.
00:24:49.000 Now that Ruth Bader Ginsburg is dead, Constitutionally, there's no actual set number of justices on the court.
00:24:57.000 Historically, we've had nine, but there in the Constitution is no limit, there's no quota on how many or how few justices should be on the court.
00:25:06.000 But because a justice has died and now there's only eight as opposed to nine, the expectation is that her seat will be filled.
00:25:14.000 So the way this goes is the president is supposed to nominate a judge, the Senate will review the judge, they'll hold hearings like they did with Kavanaugh.
00:25:23.000 Was that last year or two years ago?
00:25:25.000 They'll review, right?
00:25:27.000 They'll question, they'll hold the hearing, and then they'll hold a vote.
00:25:30.000 And then, if the Senate, with a majority, votes to confirm the judge, then obviously the judge will take a seat on the court.
00:25:39.000 So, we have to look at, as far as what comes next, what the president is going to do and then what the Senate is going to do, specifically the Senate Republicans.
00:25:47.000 We've got a very slim majority on the Senate.
00:25:50.000 So, if we were to get a judge through, we would really need every single Republican to vote, you know, because that's the problem with the last midterm election.
00:25:59.000 We didn't do so great in the Senate, we could have done very good.
00:26:02.000 We didn't do so hot.
00:26:03.000 I think we're at 52 votes.
00:26:06.000 So, if you need a majority of 51, I mean, you really can't have more than one or two Republicans sit this one out.
00:26:13.000 So, we have to look at if Senate Republicans will vote for a Trump nominee, if they'll hold the floor vote, specifically the Senate Majority Leader, Mitch McConnell.
00:26:23.000 And then we have to look at Trump.

00:26:29.000 It says that Donald Trump is going to put forth a nominee and Mitch McConnell is going to hold the vote.

00:26:55.000 Sources add that Senate Majority Leader Mitch McConnell has already been in touch with members of the Republican caucus after news of Ginsburg's passing was announced.
00:27:05.000 McConnell, who refused to bring then President Barack Obama's nominee to replace Antonin Scalia in 2016, Merrick Garland to the floor for a vote said he will not do the same this time.
00:27:17.000 He said, In the last midterm election before Justice Scalia's death in 2016, Americans elected a Republican Senate majority because we pledged to check and balance the last days of a lame duck president's second term.

00:29:13.000 And lastly, he was very good on the powers of the president.
00:29:16.000 He would be a good bulwark for the president against challenges by the Democratic House majority.
00:29:24.000 And other challenges to the president's authority during the impeachment and, of course, during the reelection.
00:29:29.000 So I said Kavanaugh is probably the best.
00:29:32.000 Now, since that happened, Kavanaugh's been okay.
00:29:36.000 He's been better than Gorsuch for sure.
00:29:37.000 He's been pretty solid.
00:29:39.000 And in addition to that, we've had a few cases where Amy Barrett has ruled on immigration and she appears to be solid.
00:29:45.000 So I think she's a good choice Catholic, conservative, proven record now in immigration.
00:29:50.000 I think she'd be a good selection.
00:29:52.000 So if she were to be put forward by Trump, If there were a vote on the Senate floor, we're most of the way there.
00:29:59.000 The problem, however, is, and I'm going to try and pull this up here.

00:37:07.000 The second benefit that I talked about earlier that in the event that the election is contentious, right, if it's a contested election where, for whatever reason, whether there's ballot fraud or there's a legal challenge or a recount or they don't send the electors, whatever permutation you want to say, however, the election may go down, the benefit still remains of Ruth Bader Ginsburg not being on the court because you're still down with or without.

00:37:42.000 Now, arguably, Roberts is a liberal.
00:37:46.000 I mean, sometimes, and maybe you say most of the time now, he goes liberal.

00:37:55.000 You've got, what is it, Alito, Thomas, Kavanaugh, Gorsuch versus three liberal judges.

00:38:11.000 Versus the three liberals plus Roberts, that's still a better situation than the worst outcome being four liberal judges plus Roberts versus four conservatives when we're deciding who is going to be the president.

00:38:26.000 So the worst case scenario for us, if the decision is put in the hands of the Supreme Court, is that the court is split.
00:38:33.000 It's four versus four, meaning that there's no chance that a liberal court will decide that Donald Trump cannot be the president.

00:39:41.000 And that is, it cannot be overstated how good the timing is on this because, with just six weeks before the election, with everything we've been talking about, With how social media is gearing up to steal the election, some of these decisions that have been made in Pennsylvania and in Michigan about how far after the election you can still count mail in ballots.
00:40:04.000 Given all these weird improprieties about the election, it is great timing that now the court has been spared from the possibility where they'll have a liberal majority deciding the outcome.
00:40:15.000 So that is a huge deal.
00:40:17.000 So that's Ruth Bader Ginsburg dying.

00:40:21.000 It's a game changer for the election.

00:40:35.000 I mean, you've seen already people are gathering in Washington, D.C., and I think some other places already to mourn the loss of Ruth Bader Ginsburg.

00:41:03.000 It was contentious enough with that and the 2020 presidential election right around the corner.
00:41:09.000 And now add to that the death of a Supreme Court justice and the possibility that the Trump administration will ram through a replacement.
00:41:18.000 I don't think it's possible for the tension to get any higher at this point.
00:41:23.000 The way that history and events have sort of conspired to create this situation where you can cut the tension with a knife.
00:41:31.000 Where it's so unbelievably tense all across the country.
00:41:35.000 And it'll be interesting to see how this plays out in the coming weeks.
00:41:39.000 Not just if they're going to hold a vote, if Republicans will vote in favor of a replacement, how that'll play out, but also then how people will react.
00:41:48.000 Because remember, it was crazy when Kavanaugh was getting confirmed.

00:41:54.000 If you remember, there were protesters storming the halls of the Senate and outside, and people were glued to the TV watching the confirmation hearing.

00:42:44.000 And I wonder not only what the effect of this will be on the election and how the election may be decided if there are challenges to the legitimacy of the vote, but I wonder now what kind of effect this will have on turnout.

00:43:00.000 And now people that maybe they don't like Trump or maybe they don't like Biden, they're now finding a reason to vote for Trump or Biden because what they're really voting for is for.
00:43:09.000 A potential liberal justice will be on the court for a generation, or a conservative justice will be on the court for a generation.
00:43:17.000 And that means that maybe more progressive types are now going to vote for Biden, and maybe more Bill Crystal rhino types are now going to vote for Trump.

00:43:28.000 You'd have to look at, I guess, based on the issues and based on some of these demographics, how will women, for example, respond to this?
00:43:36.000 Maybe that is a way that we can make it work for us.

00:43:41.000 Let's say, hypothetically, Trump puts forth Amy Barrett as a nominee, a woman, a Catholic conservative woman, and says Democrats won't let me confirm her.

00:43:54.000 Do you think that putting a female judge in the confirmation process before the election maybe that has an appeal for women voters? 1.00
00:44:03.000 Maybe that has an appeal for suburban voters, college educated white voters? 0.97
00:44:07.000 You have to imagine that that might be a home run for them politically, even if they can't get her through, even if it's impossible that they get her through before the election.
00:44:16.000 You might think that in the same way that Kavanaugh's confirmation battle rallied conservatives to the cause of Donald Trump and Kavanaugh, and I think really activated our base.
00:44:28.000 Could you say that we could do something similar here?
00:44:31.000 I think that there's a lot of angles where we can play this.
00:44:35.000 As always in politics, there's a lot of different angles where we can make this work.
00:44:39.000 Not merely putting somebody in so that they will be confirmed and replace Ginsburg very mechanically, but how can we play this during the election?
00:44:48.000 How can we spin it?
00:44:48.000 I think that might be the ticket.
00:44:51.000 And you could activate the evangelicals, you could activate every Christian in this country.
00:44:56.000 I think there's a way that you could pull this off where we could not only make it work for us strictly by Ginsburg dying and it swings the court, you know, it totally shifts the balance, but at the same time, we can play this confirmation process probably to our strengths.
00:45:10.000 And it'll be difficult because it'll activate the other side, but I think that that might be an angle where we could really make this into a home run here.
00:45:19.000 And you have to wonder, and I don't want to, you know, I know some people like this, some people don't like this, but you have to wonder.
00:45:27.000 The way that all of these events have unfolded, it seems almost providential, I have to say.
00:45:32.000 The timing of this, I mean, of all the times when Ginsburg was near death or could have died, it happens September 18th, less than six weeks before the presidential election, where this election, for the first time since the Civil War, might cause a Civil War, right?
00:45:50.000 Obviously.
00:45:51.000 For the first time since the Civil War, there might be the Civil War.
00:45:55.000 Well, you know what I'm saying.
00:45:56.000 For the first time since the Civil War, there will be a challenge by the states.
00:46:00.000 Perhaps to secede, for there to be some kind of a corrupt bargain like that happened in 1824 with Jackson and John Quincy Adams.
00:46:10.000 You know, in a truly unprecedented time where the court might be activated to make a really consequential decision, she dies all of a sudden.
00:46:18.000 You know, that to me is very, it seems like that's meme magic.

00:46:28.000 But those are my thoughts on how this will all play out over the coming weeks.

00:47:03.000 The wars in Afghanistan and Iraq, not started any new wars, not expanded existing wars, virtually ended our occupation in Syria.

00:47:14.000 He'll have beaten China in a trade war, created detente with North Korea and Iran at the same time, created peace agreements between Israel and the Gulf states, which I think may create a deal with Iran.
00:47:28.000 He's cut legal immigration by 50%, created the greatest economy in history.
00:47:34.000 When you look at unemployment, not just the stock market, but by any metric, It looks like the economy is coming back even after the coronavirus.
00:47:41.000 And then, when all is said and done, a record amount of federal judges and three Supreme Court justices.
00:47:51.000 And that's in four years.
00:47:52.000 That's in four years with the Democratic House that was against him, with the media against him, with his own party in the House and Senate against him, with people in his own White House like Jared Kushner working against him, constantly subverting him.
00:48:05.000 I mean, we could go down the list with an impeachment, with the Russia investigation, the list goes on and on.
00:48:11.000 And you really have to take stock.
00:48:13.000 You really have to look at all of that.
