00:01:12.380 a criminal prosecution? So I think the three points are there was probable cause. They shouldn't have

00:04:23.520 They're going to indict Trump. They want to indict him. And unless there is massive public pushback,
00:04:30.360 they are going to indict him because they want this to be a preemptive coup. That's what's underway.

00:07:50.160 right? You have no clue how we got that information, and you're not going to. This is a joke, and it
00:07:55.360 doesn't matter also because at the same time, from a legal standpoint, the President of the United
00:07:59.900 States has the ability to declassify something. The President doesn't have security clearance. The

00:08:07.740 Jack, hang on for one second. Please hang with me. I want to bring in Mike Davis. Mike, I want you to
00:08:11.900 respond to Jack's. He's going to get indicted, but I want to put in the framework. You have

00:08:25.100 you to address Dershowitz's three points because it's kind of confusing. They didn't really have,

00:08:33.240 but there's enough here to indict him, and he's going to get indicted, but the only reason he
00:08:36.940 shouldn't get indicted is that it doesn't meet the Nixon standard, and it doesn't meet the
00:08:40.720 Clinton standard. Mike Davis, can you make it all clear for us, sir?
00:08:45.240 Well, I just, I respectfully disagree with Professor Dershowitz on this because, again,
00:08:50.400 he has to step back and remember that you cannot indict a President of the United States or a former
00:08:57.660 President of the United States, no matter what the evidence you find for non-crimes. It is legally
00:09:03.040 impossible for a President of the United States to violate the Espionage Act for the way he handles
00:09:10.240 classified information because, as Jack rightly said, the President is the classifier. He is the
00:09:16.780 security clearance. He doesn't need a security clearance. He's the one who decides how classified
00:09:20.520 materials are handled as Commander-in-Chief under the United States Constitution. It doesn't matter
00:09:26.120 what any statute says or regulation says. He doesn't have to get permission or jump through anything.
00:09:30.880 Okay. Why is Andrew Weissman, the psychopath, is on MSNBC last night? You know, he was Mueller's
00:09:38.260 deputy. He was the FBI's guy. He's been coming at Trump since we won on November 8th of 2016. Weissman
00:09:43.860 is a psychopath. He's been all over this thing from day one with nothing but epic fails. But why is he on
00:09:50.260 TV? And why is Dershowitz on TV in the last 24 hours saying, no, there's enough here to indict him?
00:09:56.680 What are they either missing or purposely not saying that you and Posobiec think is accurate about this
00:10:04.720 whole thing about the conflict with the Presidential Records Act, the classifications, all this back and
00:10:10.500 forth, sir? They're under the misunderstanding that a President of the United States is subject to the
00:10:15.580 Espionage Act. They're under the misunderstanding that a President of the United States doesn't have
00:10:20.320 the sole statutory power under the Presidential Records Act to take a copy of Presidential Records
00:10:26.240 with them when he leaves office. They're under the misunderstanding, legally, misunderstanding that
00:10:31.720 you can charge the former President of the United States for obstructions of investigations into these
00:10:37.300 two non-crimes. That's the problem. So not only is it legally impossible for the President to have
00:10:43.960 committed these three crimes based upon the United States' 1988, the United States Supreme Court's 1988
00:10:52.120 decision in Eagan, Department of Navy v. Eagan, and the 2012 District of Columbia case with the Clinton
00:11:00.400 judge with Obama, or excuse me, with Clinton's audiotapes in his sock where Tom Fenton's judicial watch that
00:11:06.100 John Solomon in Just the News reported. It is legally impossible for President Trump to have violated
00:11:12.560 these crimes. Separate from that, I don't know how you can look at this affidavit or even these leaks
00:11:18.720 that are coming out of the Justice Department and come to the conclusion that there's probable cause
00:11:23.020 that President Trump committed any crime. Because even if the legal standard were, you know, that the
00:11:28.420 President didn't have to, that the President was, that President Trump could not have violated these
00:11:34.040 as a matter of law, even if President Trump could have violated these statutes as a matter of law,
00:11:37.760 I'm not seeing the evidence that he did. I'm not seeing the evidence of any intent that he,
00:11:42.120 that he intended to do this.
00:11:44.700 But so, but jump in here. What Mike Davis just did, like he did on Fox said, he goes through chapter
00:11:49.820 and verse of references and cases and precedent and all that in the legal framework. Are you saying
00:11:56.520 that, is your theory the case in the preemptive coup, that that's all nice and that's, that's very
00:12:01.620 interesting, but it's irrelevant because these people are lawless. They don't believe in the law and
00:12:06.600 they're just going to play smash mouth. Steve, all they need is one judge who agrees with Andrew
00:12:13.120 Weissman. Andrew Weissman was the top bulldog for Mueller during the Mueller investigation over there
00:12:18.760 at the Department of Justice in that special counsel's office. They want to indict, they were
00:12:22.680 trying to indict Trump on everything. And it was only, by the way, we saw the memo. It was Barr coming
00:12:29.360 in in 2019 who said, look, I'm an institution guy. We need to protect the institution. We're not
00:12:35.240 indicting Trump over this because it's a bunch of chicken scratch. But if they can get one,
00:12:41.320 now you don't have him. Now you have Garland. And now you have any judge, all these Obama judges and
00:12:45.920 everybody else up there that's just going along to get along. They're going to play smash mouth.

00:12:54.540 their perspective. And we're hearing this from the white house, by the way, they think if we're
00:12:58.700 alleging that he did all these things, if we went to the point that we were going to raid Mar-a-Lago,

00:13:07.400 motivated. So you're saying they've got to go all in. Mike Davis, give us a response for a go to
00:13:13.380 break on Jack Posobiec. Are they totally lawless right now, Mike Davis? Yes. I mean, I completely
00:13:20.280 agree with Jack's assessment. They want to indict President Trump. And I think that they had every
00:13:25.460 intention of indicting President Trump when they went into this home raid, Mar-a-Lago, until they saw the
00:13:30.340 blowback from the raid. And I think that concurs with Jack's point that there has to be blowback.
00:13:36.500 They have to see tremendous political blowback in order for them to pause. Otherwise, they are
00:13:40.360 absolutely going to indict President Trump. Now, it's not going to stand up. It will probably stand
00:13:47.640 up with some uniparty judge in the D.C. District Court. It will almost certainly stand up with the
00:13:53.140 Obama-stacked D.C. Circuit. But the Supreme Court, including even Democrat justices on the Supreme
00:13:59.660 Court, like Justice Kagan, there's no way that they can go along with this. This is much bigger
00:14:04.280 than President Trump. This is destructive to the presidency, and it's lawless.
