00:01:42.940 This is a library dispute over like an overdue book, the equivalent overdue book between the,
00:01:49.640 you know, the secretary for the administrative state, the librarian for the administrative
00:01:54.640 state, which is the National Archives and others.

00:02:43.920 Fortunately, this magistrate or excuse me, there's a district court judge in the Southern
00:02:49.240 District of Florida, Aileen Cannon, who has said that on Saturday she she put out a ruling
00:02:57.520 that she's tentatively inclined to grant President Trump's request to appoint a special master
00:03:04.760 in this matter.
00:03:05.360 That is a very good sign that what that means to me is this this district court judge does
00:03:12.600 not have confidence that the Biden Justice Department, including the corrupt counter espionage
00:03:18.360 unit within the National Security Division, along with the corrupt counter espionage unit within
00:03:24.320 the FBI are going to be able to handle these records as honest brokers.
00:03:28.980 And so this judge is inclined to appoint a special master to get to the bottom of this.
00:03:33.880 I think the President Trump and his legal team should and will go on offense and they should update and amend
00:03:40.160 their rule 41 G motion to get back all of these records that that the Biden administration rated for
00:03:49.120 Mar-a-Lago and tee up the legal argument that we've been talking about for several weeks now,
00:03:54.120 including the president has the constitutional power to declassify anything he wants.
00:03:58.620 He has the statutory power to make any presidential record personal and therefore it's not even
00:04:05.460 possible that he could have investigated or that he could have obstructed investigations into non-crimes.
00:04:11.020 The Presidential Records Act expressly contemplates that presidents have classified materials in the office
00:04:18.580 of the former president and Congress gives former presidents staff with security clearances for the
00:04:24.500 former president and staff secure office space or SCIFs and Secret Service protections.
00:04:29.240 This is starting to blow up on the Biden Justice Department, the Biden administration.
00:04:35.800 And let's see how desperate they get here, because these crossfire hurricane records,
00:04:40.680 these Russian collusion records that they are clearly that was the reason they went in to do this
00:04:46.520 home rate, as was reported by Newsweek, by Bill Arkin at Newsweek a couple of weeks ago.
00:04:52.040 Let's see how desperate the Biden regime gets here.
00:04:55.900 So, you know, the New York Times thing was yesterday.
00:04:57.980 Maggie Haverman had a huge piece and they they go through your arguments and they were talking about,
00:05:03.560 you know, Trump's legal teams needs to come together and he needs a couple of quarterbacks or whatever.
00:05:07.240 But they in that whole piece, they tee up a lot of your arguments and they kind of dismiss them out of hand.
00:05:14.400 And they also do this on MSNBC and CNN all night long.
00:05:18.160 Like, you know, he he doesn't have there's all sorts of procedures to go through to declassify that these are not presidential records that given the long time that he was actually going back and forth,
00:05:30.180 that in fact, it talks about Evan Corcoran's letter, I think, in May to the Justice Department.

00:05:38.000 I mean, are they gaslighting the American people because they never really address the legality of it,
00:05:43.020 but they just kind of dismiss the counter arguments or the arguments from the Trump people saying that, hey, there's a whole pattern of judicial decisions.
00:05:51.880 There's all types of precedent on both form and substance of how this has been done in the past.
00:05:58.660 And but these but on MSNBC, New York Times, they just dismisses out of hand into the fact that the New York Times actually advocated strongly the other day that the president be criminally indicted.

00:06:13.160 These liberal apologists for the Biden regime should go read a 1988 Supreme Court case called the Department of the Navy versus Egan.
00:06:22.420 They should read a 2012 decision in the D.C. District Court by an Obama judge related to eight years of audiotapes and Bill Clinton's sock drawer.
00:06:32.660 They should read the OLC opinion related to the Mueller investigation about how president how it's illegally impossible for a president to obstruct justice for these non crimes.
00:06:43.880 They should actually go read the law.
00:06:46.520 You know, I I bet I will bet them anything that a Supreme Court will side with what I'm saying.
00:06:52.920 And that is precisely why I think that the Merrick Garland, who said he deliberated four weeks before he ordered this home raid, that he didn't walk down the hall at the Justice Department and go to the Office of Legal Counsel or OLC and get an opinion on the legality of this home raid, because he almost certainly would not have liked what they told him because there is a Supreme Court decision directly on point.
00:07:17.140 And what I'm saying and I've been saying since since August 8th, whenever this home raid occurred, is the president is has the constitutional power as commander in chief to declassify anything he wants for any reason he wants.
00:07:31.360 He doesn't need any bureaucrat's permission.
00:07:33.100 And a good example is of this was March 2012, when Bill Clinton got caught on the hot mic with the Russian president divulging our most classified nuclear information, saying that that Obama would have more negotiating room after the November 2012 presidential election eight years later.
00:07:52.420 That is the most classified material President Obama could have conveyed to our enemy and it was nuclear nuclear information and he wasn't charged with espionage.
00:08:02.300 There wasn't a home raid because he's the president of the United States.
00:08:05.300 He doesn't need to take off labels or get a bureaucrat's permission.

00:08:50.780 And they say, oh, well, you know, we're already done with a filter team, judge.
00:08:53.860 There's no need for a master.

00:08:57.160 What do you mean you're done?
00:08:58.660 You know, the president and his team haven't heard anything from the filter team.
00:09:02.800 They haven't heard from the DOJ regarding attorney-client privilege documents, regarding executive privilege documents,
00:09:08.140 which the DOJ did not even mention in this supplemental filing that they did today.
00:09:14.360 Let's keep in mind the order of battle here.
00:09:17.660 The judge, having made that amazing, thunderous ruling on Saturday, which was really, you know, big news in this process,
00:09:26.780 the judge having made that ruling on Saturday and putting the DOJ in a pretty significant way on the back foot
00:09:33.080 and saying, I'm inclined to allow for the special master and want the DOJ to provide, under seal, a more substantial inventory.
00:09:43.400 You know, after that happened Saturday, it's really, the ball's already in the DOJ's court.
00:09:47.720 And they were supposed to, tomorrow, to file a response.
00:09:51.240 And what's interesting is that, you know, the caption of this case is,
00:09:53.820 President Trump is the plaintiff, the DOJ is the defendant, right?
00:09:57.140 So the DOJ is the defendant, is supposed to file their answer tomorrow.
00:10:01.540 They rushed and filed something today to tell the judge, oh, no, no, don't worry about it.
00:10:06.460 We're already finished.
00:10:07.160 And, by the way, we've sent the documents to the Office of the Director of National Intelligence,
00:10:11.880 as if somehow that obviates the need for a special master, when it does the opposite.
00:10:16.300 We don't have no idea what's in the documents.
00:10:18.560 President Trump hasn't been able to be briefed on what was taken, what was left, what was the process.
00:10:26.880 Remember, his attorneys were forced to wait outside and were not allowed to observe, to observe the raid.
00:10:34.760 So tomorrow, now, the government is going to put forth their actual response,
00:10:39.140 let alone this intermediate half-step they took today.
00:10:41.940 Tomorrow, they're going to put forth their actual response.
00:10:44.320 And then from there, the president and his counsel are going to put in a reply to that.
00:10:49.240 And then you've got the hearing on Thursday.
00:10:51.720 So this is a robust week.

00:10:54.940 The bottom line being that Judge Eileen Cannon in the Southern District of Florida
00:11:00.360 has now put the onus on the DOJ to explain what happened through this process,
00:11:06.260 meaning vis-a-vis the affidavit, but further the inventory,
00:11:10.520 how the inventory was put together and what's really in the inventory in terms of what was taken during the raid.
00:11:16.500 And the DOJ has to reply why there should not be a special master in this case,
00:11:20.980 a special master being judicial oversight over all the property that was taken, how it was taken,
00:11:27.440 and most importantly, pursuant to what statutes it was taken,
00:11:31.460 the only statute applying to President Trump being the Presidential Records Act,
00:11:36.440 which he has been in full compliance with, and has consistently been in full cooperation
00:11:40.580 with the Department of Justice and all other applicable agencies.
00:11:45.180 You know, I just asked Mike a second ago, you've had all these articles,
00:11:48.600 you know, you had the New York Times article, and if you watch, if you monitor as we do MSNBC or CNN,
00:11:53.980 they continue to go on.
00:11:55.160 And, you know, people like Mike Davis continue to cite precedent regarding, you know,
00:12:00.920 the case against the Navy, you know, whether it's the President's ability to declassify anything,
00:12:05.720 or it's all this, you know, the structural issues regarding what is presidential material
00:12:12.900 and how the President can deem what's presidential material or not.
00:12:16.360 Why does it seem like the left just, in dismissing it out of hand,
00:12:21.260 they never really come back and actually address any things that Mike keeps talking about.
00:12:25.240 Mike keeps citing precedent.
00:12:26.400 Mike keeps talking about this.
00:12:27.420 But you never see that, you never see that, you never see the pushback come back on those specific details.
00:12:35.000 The reason, Steve, is because the other side doesn't have an argument.
00:12:40.000 They know that the Presidential Records Act, which President Trump has been in full compliance with,
00:12:44.420 does not have an enforcement mechanism.
00:12:47.560 And what they did, what we know from the limited amount of the affidavit we've seen,
00:12:51.940 is that they took the PRA, the Presidential Records Act,
00:12:54.900 and they try to bolt onto it, Steve, bolt onto it, enforcement mechanisms from these other statutes,
00:13:01.020 which simply do not apply.
00:13:03.280 And they've got another huge problem, which is the Fourth Amendment.
00:13:06.460 This was an overbroad warrant, which is a general warrant, which, as you know very well, Steve,
00:13:12.760 is completely unconstitutional under the Fourth Amendment.
00:13:15.080 There's a reason that the Fourth Amendment is there, and it's because the British used to issue these,
00:13:19.740 you know, the king would issue these general warrants, and the Brits would go into the houses of the folks in the colonies
00:13:26.080 and just take anything they wanted.
00:13:27.760 Well, this is exactly what happened in this raid, exactly what happened in this break-in of the President's home,
00:13:33.040 a beautiful Mar-a-Lago, Palm Beach, Florida.
00:13:35.320 And the DOJ, as they try to leak things here and there, right, first they try to leak nuclear.
00:13:39.500 What we now know from the classifications, again, in the limited affidavit,
00:13:43.840 that the nuclear queue is nowhere in there.
00:13:46.900 Then they try to leak, oh, there's these super, you know, important documents,
00:13:50.540 and they're super classified.
00:13:52.500 Not there either.
00:13:53.740 Now they're trying to move the goalposts and say, well, that's actually classifications don't even matter.
00:13:57.940 It's any defense-related document.
00:14:00.520 All of that, Steve, has no application here whatsoever,
00:14:03.580 because the Presidential Records Act is the statute that applies to dot, dot, dot, the President,
00:14:09.500 and the President, President Trump, has been in full compliance with that act
00:14:13.940 and actually has gone above and beyond to interact and be cordial to NARA and then the DOJ
00:14:20.320 and telling them on June 3rd, hey, let us know what else you need.
00:14:23.820 And by the way, if you look at that redacted affidavit,
00:14:26.200 you won't see any mention of June 3rd, at least in the unredacted parts that we,
00:14:30.320 the merely public, are allowed to see.

00:43:27.900 I mean, this is the Baghdad that you're seeing there, and many of us, I, and many watched this experience many, many times.
00:43:36.540 I see it's almost 1 o'clock in the morning there, and there's almost no moon.

00:43:41.900 Normally, on this late at night, with a really dark moon, they'll start to go home.

00:43:51.000 They're getting more and more mortars fired into the green zone.
