00:10:57.680 Uh, Michael, first off, people want to know why, why have you, why have you left Tennessee, your beloved Tennessee to go up to Columbus today?
00:11:04.420 Well, this is where the action is. And I'm in Columbus, Ohio, as we speak. Um, I spoke earlier today with governor, uh, DeWine spokesperson, Dan Turney, and he gave us an exclusive interview on the phone.
00:11:19.240 And he said the following, Steve, this is our story. Um, spokesperson at the Ohio star right now published about 10 minutes ago, spokesperson, Ohio governor DeWine agreed with the decision to execute East Palestine controlled burn, but did not give order.
00:11:35.620 Here's the story in our exclusive interview. Uh, DeWine's a spokesperson, Dan Tierney said he was unaware that legal authority was required to execute the February 6th controlled burn of vinyl.
00:11:49.240 The city of chloride from five carriages of the Norfolk Southern train that derailed in East Palestine, Ohio on February 3rd. He added, this is the key part of it.
00:11:58.460 He added, this is the key part of it. The Norfolk Southern executed the controlled burn after consultation with representatives from the U S EPA and the Ohio EPA.
00:12:10.920 and that DeWine agreed with the decision to execute a controlled Byrne
00:12:17.440 but was not the person who gave the order to execute the controlled Byrne.

00:13:20.620 that the legal authority to execute the controlled Byrne
00:13:25.960 was with the EPA on-site coordinator.

00:13:30.120 that is not inconsistent with what I understand happened, end quote.
00:13:36.620 So, according to the spokesperson, first, the spokesperson said he was unaware
00:13:43.220 that legal authority was required.
00:13:45.080 This is a spokesperson, not the governor.
00:13:47.300 But then he said that it was not inconsistent that the on-site coordinator
00:13:53.400 from EPA issued the directive.
00:13:56.220 So, that's what we have from the spokesperson for the governor of Ohio.
00:14:00.960 But the EPA, so they're saying Norfolk Southern executed it.

00:19:03.680 at least five class action lawsuits have been filed against the railroad,
00:19:06.900 and the state of Ohio has raised the possibility
00:19:08.800 of filing a suit of its own.

00:19:17.680 Given the letter that you did write to Norfolk Southern in recent days,
00:19:22.780 are you still considering a lawsuit here,
00:19:25.800 and how are you thinking about that
00:19:28.140 as more information does unfold on a daily basis?
00:19:33.440 Well, we actively are considering litigation
00:19:37.540 and what form that will take.
00:19:39.440 There are significant federal preemption issues
00:19:43.040 that we are researching.
00:19:44.320 But, yeah, we believe that Norfolk and Southern
00:19:49.320 needs to be held accountable for this.
00:19:52.600 That's why we sent the litigation bold letter.

00:19:57.500 And to what you just touched on,
00:19:59.340 it is a tricky thing because the freight railroads,
00:20:01.620 the Class 1 railroads, are federally regulated.
00:20:04.360 They are a common carrier.
00:20:06.100 They do have certain carve-outs within the law
00:20:08.760 based on those regulations and how they operate
00:20:10.980 and the types of materials they're essentially,
00:20:13.160 I don't want to use the word forced,
00:20:15.160 but they're forced to carry and transport around the country.
00:20:18.620 And so, thus, there are some precedents
00:20:20.180 from a Supreme Court standpoint
00:20:21.760 about what litigation could look like.
00:20:24.980 Just walk me through how you're thinking about it
00:20:29.320 on behalf of the state,
00:20:31.240 on behalf of residents of East Palestine,
00:20:32.980 as more information has yet to be revealed.
00:20:35.960 So, obviously, as you mentioned,
00:20:40.240 we're still finding the facts.
00:20:42.420 And facts are important to a lawsuit.
00:20:44.560 You've got to produce evidence, not just law.
00:20:48.420 That being said,
00:20:49.540 we think that the state of Ohio
00:20:51.300 probably has several causes of action,
00:20:53.580 including nuisance and trespass.
00:20:56.440 Where that goes at this point
00:20:59.280 is going to be partly dependent
00:21:01.640 on the legal landscape.
00:21:04.060 It's also going to be dependent
00:21:05.220 on what facts are found.
00:21:07.340 So, right now, Governor DeWine has his EPA,
00:21:11.500 his Ohio Emergency Management Agency,
00:21:14.940 on the scene and doing their fact-finding.
