00:02:51.080 This week marks one year of Ukrainians fighting tirelessly for their right to exist. The sheer
00:02:57.200 cost of this war is almost unfathomable. The United Nations Refugee Agency says over 18 million people
00:03:02.960 have been forced to flee that country since the war began, and more than 7,000 Ukrainian civilians
00:03:08.240 have died, including hundreds of children. An Associated Press investigation estimates the
00:03:12.940 death toll to be significantly higher. It found as many as 25,000 people may have died in Mariupol
00:03:17.920 alone. Measuring losses on the battlefield also proves difficulty. The Zelensky government says
00:03:25.200 as many as 13,000 troops have been killed in action, while the UK's Ministry of Defense
00:03:28.880 estimates as many as 60,000 Russians could have died. Western countries stepped up their support
00:03:34.900 to Ukraine over the past year. In the early days of the war, Americans, ordinary Americans' desire to
00:03:40.240 help was unending. Blue and yellow Ukrainian flags were in the windows of cars and homes across the
00:03:45.500 country. And so far, the US has pledged more than $29 billion of military aid. But we are a country
00:03:51.760 well familiar with and fatigued by forever wars of our own, and so that support for Ukraine seems to
00:03:57.260 have waned in recent months. In fact, House Republicans recently co-signed a Ukraine fatigue resolution
00:04:02.720 calling for the US to end military and financial aid to Ukraine. And a new AP poll finds that 48% of
00:04:10.060 all Americans support providing weapons to Ukraine, down from 60% in May of last year.
00:04:15.700 Crossing a red line the US has set. Blinken met face-to-face this week with his Chinese counterpart
00:04:21.480 in Munich. The two officials spoke for just over an hour, where the State Department says
00:04:25.940 Blinken warned of the, quote, implications and consequences if China provides support to Russia.
00:04:33.580 Saturday's meeting was also the first between the two sides since the United States
00:04:37.420 shot down a suspected Chinese spy balloon off the coast of South Carolina earlier this month.
00:04:44.160 According to the State Department, Blinken told his counterpart on Saturday that the US will not
00:04:50.040 stand for any violation of our sovereignty. China, for its part, continues to deny the balloon was sent
00:04:56.580 for surveillance purposes. During Saturday's meeting, the State Department said China also made
00:05:02.120 irresponsible and unfounded accusations against the US. Also, no apology for that balloon.
00:05:09.400 And we're learning more about the path of that suspected spy balloon. According to one current
00:05:14.960 and one former US official familiar with the matter, the balloon was launched from China's
00:05:19.960 Hienan Island in the southern part of the country. The island is an important hub for China's military,
00:05:26.360 housing a large submarine base and a spaceport. After being launched, the balloon entered US
00:05:32.600 airspace over Alaska before eventually floating across the country, ultimately being brought down
00:05:38.200 just off the coast of South Carolina. And while we're learning more about that suspected Chinese
00:05:44.440 spy balloon, the Department of Defense has called off efforts to recover debris from the other
00:05:50.040 unidentified flying objects shot down earlier this month. After a week of searching, defense officials have
00:05:55.800 ended operations off the coast of Alaska and near Lake Huron. No debris from the objects were found, with
00:06:02.760 officials citing harsh weather conditions in the regions. Another object was also shot down in Canada's
00:06:08.920 Yukon territory. Defense officials have not provided update on that particular search.
00:06:14.440 We've had about $85 billion worth of assistance poured in immediately for housing, water and food and
00:06:25.960 medicine and clothing. All that in the immediate days following the earthquake. Today, I can announce
00:06:32.280 that we will be putting in another $100 million to assist those who are so desperately in need.
00:06:39.160 I'm trying to have it both ways. Publicly, they present themselves as a country striving for peace in
00:06:47.240 Ukraine. But privately, as I said, we've seen already over these past months, the provision of
00:06:54.680 nonlethal assistance that does go directly to aiding and abetting Russia's war effort. And some further
00:07:01.800 information that we are sharing today, and that I think will be out there soon, that indicates that
00:07:09.000 they are strongly considering providing lethal assistance to Russia.
00:07:17.800 Now, no further details on what the US means by that lethal assistance. I was speaking to a Ukrainian
00:07:25.480 official for his take on the support there at the Munich Security Conference. He said that he was very
00:07:31.960 pleased with that show of support from Ukraine's allies. He said he heard from ally after ally saying
00:07:39.160 that they will support Ukraine to the end. But the big question in his mind and many Ukrainians' minds is
00:07:46.120 what do the allies mean when they say they're going to support Ukraine to the end? What is the end in the eyes of
00:07:52.760 of the Western world? This as war continues to rage on in the east? There's that much vaunted Russian
00:08:03.560 offensive. Although this Ukrainian official telling me that at this point, it's unclear if Russia has
00:08:09.880 enough manpower, if Russia has enough equipment there in the east to wage a serious offensive. He said that

00:19:43.800 that is in February 5th, the day before they did the controlled burn, he was in the meeting when the
00:19:50.860 decision was made. Where was the meeting? Was it in Atlanta, where he, where his headquarters are? Was it in
00:19:59.160 Columbus, Ohio, where Governor DeWine has his offices? Was it in East Palestine, Ohio? Was the on-site EPA
00:20:07.560 coordinator, who has the legal authority to make that decision, was he there as well? Imprecision. So we're going to
00:20:16.160 want to find out where that meeting was held. My guess, it was probably in Columbus, Ohio, but we'll
00:20:21.320 find that out. Well, we know that he was not in East Palestine on the 5th. That's a, that's a,
00:20:27.360 that's demonstrable fact. I know the days he was there. And he says, oh, I know why it's gotten
00:20:31.380 national attention. Well, dude, if you knew what's getting national attention, if you had camped out
00:20:35.120 there and gotten on top of things, there wouldn't be this problem, right? You wouldn't be this
00:20:40.160 problem. And if you had the evidence and the math, would Steve Cortez show us your work? Lay he hang on for a

00:22:33.760 situation in which the federal on-scene coordinator, who typically becomes the incident commander
00:22:41.020 at the top of a unified command, is not for something land-based like this EPA. In doing some
00:22:49.340 hunting around, I was able to find that Governor Shapiro in Pennsylvania actually had referenced
00:22:55.920 that a unified command was set up. And Daniel Patrick Leahy, he's probably seen this quotation.
00:23:01.540 This is from Shapiro's press release. He said that officials from Norfolk Southern separated
00:23:09.180 themselves from local agencies at the scene to act independently, which caused the unified command
00:23:15.340 to experience issues throughout the emergency response. And that makes it pretty clear to me
00:23:21.960 that what was in the Daily Mail story, where the CEO of Norfolk Southern was admitting that he made this
00:23:29.900 call, that somehow they pulled themselves away from the unified command, and they made this decision.
00:23:35.960 And that raises not just serious issues for Norfolk Southern. That's going to be a big liability bill
00:23:40.880 at the end of the day for what he admitted. And I can't believe they let him admit that to the Daily Mail.
00:23:45.860 But also, it raises serious concerns about the competence of the EPA officials. Why are there EPA officials
00:23:53.740 who didn't immediately say, no, no, no, no, no, no, you can't go off and make this decision on your
00:23:58.380 own? You know, a kind of classic Al Haig, but Al Haig with with legal authority. I'm the one who's in
00:24:04.120 charge here. Me, you know, we at EPA. And it doesn't seem like that happened. And Shapiro seems to know
00:24:10.960 where the bodies are buried on that, Steve.
00:24:14.800 Clark, let me ask you a question, because you had to tussle with these guys every day.
00:24:18.240 Does the EPA, in your dealing with them, ever back off situations dealing with the environment or dealing
00:24:24.620 with these type of hazardous materials or what could be hazardous, turn, take materials and turn them

00:24:35.240 off when they have jurisdiction? That's their jurisdiction, correct, sir?

00:25:27.600 decision was made by executives of Norfolk Southern that had no jurisdiction to make this
00:25:33.180 decision for the citizens of East Palestine, Ohio, the rest of the citizens of Ohio, the citizens of the
00:25:40.340 Commonwealth of Pennsylvania, and anybody living in the Ohio River Valley, or quite frankly, the eastern
00:25:46.320 United States where this stuff's going to blow. Am I incorrect in that, sir?
00:25:50.840 We don't have any straight answers on who made that decision, ultimately. Jeffrey Clark, as always,
00:25:57.380 had some great information there from Governor Shapiro, who stated that the unified command
00:26:04.440 was apparently somewhere in East Palestine area and that Norfolk Southern, he claims, separated from
00:26:10.900 them. But then we have on tape the CEO of Norfolk Southern, Alan Shaw, saying on Saturday he was in
00:26:20.540 the room on the Monday, February 5th, when the decision to take the controlled burn of vinyl chloride
00:26:29.240 was made. Where was that room? And who made that decision? A follow-up on the EPA, Steve, we've been
00:26:39.400 asking them now since last Tuesday for the name of the on-site coordinator who made that decision,
00:26:47.660 who was responsible for that, and for the document. I checked just this morning with our reporter there,
00:26:54.280 Hannah Poling. On Saturday, they acknowledged once again they'd received our inquiry, but no response
00:27:00.940 from them as of Saturday. And of course, it's the President's Day, so they have the day off today.
00:27:06.080 So we're not going to get a response from them today either on that.
00:27:11.580 Hang on for one second. Let me bring in Cortez. We're trying to get Jeff Clark back up.
00:27:15.660 Cortez, this is a big screw you, right? The reason that we're running around trying to get it is nobody

00:27:52.340 of them should be living and working right now in East Palestine. And they should be drinking the
00:27:57.500 water if they tell us that it's safe and doing it on camera.

00:30:32.100 on Shapiro's case from day one. Shapiro, the only thing he thinks of every day is his inaugural
00:30:38.460 address when he's president of the United States. So this guy's got wild ambitions. And this
00:30:43.220 is a big deal. And he knows it's a big deal, right? He's treating it like a big deal, as he
00:30:48.300 should. Walk me through his press release, which we call distancing, right, Jeff Clark.

00:31:07.180 then I have three, four other paragraphs that are worth reading from the same press release. It's up on
00:31:11.760 the governor's website. So he says, officials said Norfolk Southern personnel separated themselves
00:31:18.620 from local agencies at the scene to act independently, which caused the unified command
00:31:24.200 to experience issues throughout the emergency response. And it gets even better, actually.
00:31:30.200 He said that Norfolk Southern, this is from the press release again, a quotation, Norfolk Southern
00:31:35.060 staff made their own plan without coordinating with state agencies, forcing those agencies to react
00:31:40.700 without knowing the plan's details. He then wrote that Norfolk Southern gave inaccurate information
00:31:46.340 and conflicting modeling about the impact of the controlled release of chemicals, which made it
00:31:51.520 harder for the state to protect people in the immediate aftermath of the derailment. He was
00:31:56.580 particularly critical of information. This is all from a letter the government wrote that's being
00:32:00.560 recounted in this press release. Particularly critical of information provided about the controlled
00:32:06.000 explosion on February 6th. He said the company didn't forewarn agencies initially of
00:32:10.680 the intention to vent and burn all five rail cars that contained vinyl chloride, or inform local or
00:32:16.720 state authorities how many rail cars contributed to the hazardous chemical.

00:33:23.560 made the decision, which is really bad for North Norfolk Southern. But also, obviously it's terrible
00:33:28.780 for EPA. Why is EPA not running the unified command? And if they try to get fenced out by Norfolk
00:33:34.660 Southern, why don't they butt back in and say, you don't realize, you know, we're the government,
00:33:38.540 we're in charge here. It boggles the mind.
00:33:42.740 Let me, and I realized we got to get to Leahy and Cortez. We got to get to the bottom of the chain
00:33:47.460 of command in the timeline. But, but Clark, you were over at justice for president Trump. This was your
00:33:53.140 lineup. This is your line of country. When is it? There's one thing about civil liability and open
00:33:59.180 ended when you're just this kind of reckless endangerment. But when does this cross over
00:34:04.860 right there? Shapiro's line is brutal. If they hid that in, in taking, in taking responsibility and

00:35:42.580 understand how, if you have EPA on, on site within five hours or so, then why is an EPA running this?

00:37:26.960 of Norfolk Southern. So, you know, who is he and what is he doing so far? Well, Alan Shaw made,
00:37:32.220 according to the Daily Mail, $4.3 million as a CEO last year. He lives in a $4 million house in
00:37:39.140 Georgia. They say he owns 20 total properties in Georgia and the surrounding area. Now, I have no
00:37:43.740 problems, of course, with his success, but I have enormous problems with him ignoring his
00:37:49.420 responsibilities because attendant to those rewards and the perquisites that come with being the CEO of
00:37:55.540 this major public company, attendant to that are grave responsibilities when your company is in the
00:38:01.140 middle of a crisis like this. And pontificating from hundreds of miles away outside of your
00:38:08.360 mansion and saying, I'm going to give the people of East Palestine $1,000 each is simply not going to
00:38:14.860 cut it. You know, Steve, let me give some free, I'm in the realm of communications, let me give some
00:38:18.980 free comms advice to Alan Shaw. Get on the ground there. Get serious, full transparency. Stop making

00:38:58.280 bear the ultimate primary responsibility for what has happened there. They are sure not acting like
00:39:03.440 it right now, especially the leader, CEO, Alan Shaw. You know, Merrick Garland, he would have, you know,
00:39:10.180 he has, he has the FBI, the Gestapo kicking down doors of every person that prayed a rosary outside of
00:39:15.520 an abortion center or parents going to school board meetings because they don't want freaks,
00:39:21.000 uh, you know, grooming their children. Right. But because those parents would happen to be
00:39:25.980 domestic terrorists. So we can't expect anything out of him, but Hey, let me get Cortez just gave

00:41:53.340 the tankers emptied and burn it. Okay. He asked his guys, what's the course they do? I said, we'll dump
00:41:58.360 and dig a ditch. We'll unload it from a ditch, burn, put it in the ditch and we'll light it on fire. And
00:42:03.100 he's got the gall to sit there and go, I knew we were successful when I saw the black plume that looked
00:42:08.900 like the end of days. It looked like the end of St. John's, uh, the, the, the apocalypse or book of

00:48:36.340 types of ambulance chasing lawyers that are now going to descend on East Palestine, Ohio, because
00:48:41.880 they're going to, they're going to read the note that Clark's reading from Jeff Shapiro and go,

00:48:57.560 reason, because, uh, in general, they have just been leeches upon the economy and prosperity of
00:49:02.080 the United States. But there are times when trial lawyers, right? And their, their incentives can be
00:49:06.740 very helpful to us. For example, I believe in time, big pharma is going to ultimately be held
00:49:12.140 liable. Even if they're not at the federal level, I think they will at the state level. Florida's
00:49:15.780 already going down that path. And I have talked personally to some very significant trial lawyers

00:49:26.840 in East Palestine, Ohio, the trial lawyers who, again, I'm not a fan of generally the tort bar,

00:49:37.500 comes to justice for the people of East Palestine. So this story is in the very, very early stages,
00:49:43.280 clearly. And let me also connect this back to politics in Washington when it comes to impeachments.

00:49:52.300 the right way, not like that sham Jan 6 committee. But I believe there must be several impeachments.

00:51:28.560 won't tell us where it is or who made the decision. The governor of Ohio says,
00:51:33.280 uh, I approved of it, but I didn't make the decision. And then the closer on this, uh, Josh
00:51:39.620 Shapiro, the governor of Pennsylvania is saying, well, uh, Northern, uh, Norfolk Southern didn't tell
00:51:45.720 us all the details about this initially. So none of these stories add up. We're going to go to all
00:51:52.520 four of those and the department of justice to ask for the detailed timeline between February 3rd,
00:51:59.320 the derailment and February 6th, the control burned. And we're going to lay that out in great detail
