00:02:04.460 Well, first of all, I spent the 1970s in the Soviet Union defending dissidents like Sharansky and Sakharov and others
00:02:12.780 against the excesses of the Bolshevik regime, the regime in which the head of the KGB could say to Stalin,

00:02:23.480 And today we have law students at Stanford and at Yale and at Georgetown who are emulating the Bolsheviks.

00:03:49.360 How do you pull this out of a nosedive when even classic liberals are overwhelmed and, quite frankly, too afraid?
00:03:55.660 I have many, having gone to Harvard and gone to Georgetown and worked on Wall Street and lived in New York City,
00:04:01.380 I have many, many, many liberal friends, even when I was saying progressive friends,
00:04:05.200 that do not agree at all with what's going on, but they're afraid to speak up of being ostracized.
00:04:11.740 How do you pull out of this nosedive?
00:04:13.720 Well, I don't blame them.
00:04:15.000 Look what happened.
00:04:15.760 To me, I'm the perfect example.
00:04:17.800 I was the person on Martha's Vineyard who was most respected.
00:04:23.940 I was the person who was always asked to speak, to conduct weddings, to do everything.
00:04:28.320 And then I made the horrible mistake, according to these radicals,
00:04:34.120 of actually defending the Constitution in front of the United States Senate on behalf of President Trump.
00:04:39.520 I was the oldest American in history ever to defend the president from an impeachment, an unconstitutional impeachment.
00:04:47.140 Suddenly, I was now the most unpopular person on the vineyard.
00:04:51.340 Caroline Kennedy sat next to me at a dinner party and said if she knew I'd been invited, she wouldn't come.
00:04:55.980 People walked out of a gym where my wife was working out.
00:05:00.820 Can you imagine that in New York City and Manhattan?
00:05:04.200 If you think that was bad, if a judge in New York City and Manhattan ever, ever made a decision to release Donald Trump,
00:05:13.420 that judge would never, ever be promoted, would never again be accepted in New York circles,

00:05:22.780 You don't expect judges to have the kind of courage to buck this kind of fanaticism.
00:05:29.280 Or if a juror in Manhattan became the juror that hung the jury or the juror that resulted in acquittal,
00:05:35.760 and that juror had to go back to his family and say,
00:05:38.220 I'm the juror who freed Donald Trump in Manhattan, that would destroy that juror's life.
00:05:44.600 So, you know, today we live in a world of pressure, not in a world of law.
00:05:49.640 Even Bragg made a decision to follow his predecessor.
00:05:52.840 No, there's no evidence.
00:05:53.800 I'm not going to go after Trump.
00:05:55.000 I know I promised to, but I've looked at the evidence.

00:05:58.100 The New York Times reported on Sunday, when he initially made that decision,
00:06:02.620 he was subject to such pushback, such pressure, such hatred, such animosity.
00:06:08.840 He knew he would never again be elected to any office unless he followed through on his campaign pledge to get Trump.

00:06:24.240 How can you have a fair trial in Manhattan when that occurs?

00:06:35.920 It's a phony democracy, and if anybody tries to stand up to Putin, immediately you're in jail.

00:06:43.720 Not just in New York City, but because you have somebody that you have – it's just not Soros.

00:06:50.360 It's much of the elite in this country are the ones that are telling Bragg or giving the money that are pushing this.
00:06:57.880 It's the American elites that want to – because they fear what Trump – not just Trump, what Trump stands for in the Trump movement, sir.

00:07:06.840 But the brilliance of the founders of our republic is they anticipated this problem, and they created a system of federalism, of checks and balances.
00:07:15.380 We have the United States Supreme Court to stop that from happening.
00:07:19.200 We have other states who can play a role in stopping that from happening.
00:07:23.580 We have a House of Representatives that's controlled by one party and a Senate controlled by the other party.
00:07:29.260 We have what the former Soviet Union and what many other countries in the world don't have.
00:07:35.100 We have a system which imposes checks even on majority rule, and I'm hoping that system isn't weakened.
00:07:43.480 It has been horribly weakened in the borough of Manhattan in New York.
00:07:47.820 But I hope this case will be moved from the borough of Manhattan, where there's no chance, no chance.
00:07:54.260 You know, not Jesus, Mohammed, Moses – this is Holy Week – none of them could have won a case in Manhattan if they were defending Donald Trump in a Manhattan jury, a Manhattan judge.

00:08:08.880 Nobody could win that case in Manhattan.
00:08:11.500 It has to be moved to Staten Island, to Rockland County, to upstate New York, somewhere where a fair trial is at least theoretically possible, where a judge wouldn't face the kind of ostracism he faced or I faced for simply defending – remember, I faced the ostracism for simply defending Trump.
00:08:30.600 Imagine what a judge would face if he actually ruled in Trump's favor.
00:08:35.200 Now, the judge is going to rule in Trump's favor on one matter this morning.
00:08:38.940 He's not going to be foolish enough to impose a gag order, because if he imposed a gag order, I would put together the greatest collection of First Amendment lawyers, if there are any of us left in this country, to take that case right up to the Supreme Court.
00:08:52.320 Because a gag order would not only deny Donald Trump's right of free speech, it would deny your right of free speech, my right of free speech, because the right of free speech also includes the right to listen to speakers.

00:09:05.980 But hang on, because you – look, you're revered in the fact that you've – I think it was in the Chicago suburbs, you've represented the Nazis for free speech.
00:09:14.220 You've made free speech paramount, even against going somewhere of your underlying beliefs.
00:09:20.840 But let's go back to what you just said about federalism, and let's say about the founders.
00:09:25.040 The founders predicated on – predicated all of that on the rule of law, on men and women of courage who would step up in the deciding moment and step forward.
00:09:36.780 You're the perfect example of why people are cowed, and particularly people that are liberals and progressives that understand the value of – like the ACL used to be, of the value of defending free speech and defending the First Amendment right now.

00:09:55.220 The Republicans in the House are terrified.
00:09:58.340 They just are.
00:09:59.020 There are some stepping from – the fearless ones like MTG and Matt Gaetz and some that have a little rough around the edges.

00:10:12.120 The Supreme Court, look at what they did in the confirmation hearings of the Supreme Court.
00:10:15.580 I was actually in Italy the day that Kavanaugh got confirmed, and you saw what's happened.
00:10:22.400 They ran across the Supreme Court.
00:10:24.040 It looked like revolutionary France.
00:10:25.600 They were banging on the doors.
00:10:26.760 These are not normal times, and what they've done is they've gone after people's courage and their core beings.
00:10:32.340 Can the system, the framers set up, can it work without men and women of courage stepping forward and say, hey, I'm going to sacrifice my career.

00:10:43.520 I saw what they did to Dershowitz, but I've got to step up here.
00:10:46.780 Where do you see that, Professor Dershowitz?
00:10:49.480 Well, you know, James Madison foresaw that, and he said if men or women were angels, we wouldn't need the laws to protect us.
00:10:57.340 Madison contemplated a situation where people didn't have the courage of George Washington and Benjamin Franklin and Thomas Jefferson.
00:11:06.040 He saw a time when we couldn't count on individual courage, as we couldn't count on individual courage in Nazi Germany or in the Soviet Union.
00:11:18.540 That's why we need the rule of law, and the rule of law has been weakened.

00:11:23.480 The rule of law has been weakened.
00:11:24.880 And we have an obligation to keep it strong, which is why I'm going to continue writing.

00:11:41.500 For my 80th birthday, I had like 100 people coming to celebrate with me on Martha's Vineyard.

00:11:48.180 If I can get 10 people on Martha's Vineyard to come and celebrate my 85th birthday, that would be remarkable.
00:11:55.060 Even my family's Seder, which we're having on Wednesday night, I used to have, you know, 20, 30 people.
00:12:01.160 Today we're just having the immediate family because even members of my family are attacking me.
00:12:06.540 How dare you do anything that enables this new Adolf Hitler?
00:12:10.420 That's the way they think of Donald Trump.
00:12:12.520 Now, if you think of him that way, then you don't care about the rule of law.
00:12:17.320 So many liberals, so many progressives, so many left-wingers have told me they know they're sacrificing the rule of law, but it's worth it to get Trump.
00:12:26.440 If we don't get Trump, it'll be worse.
00:12:29.420 And the thesis of my book, I say that right in my first chapter, it's much more dangerous and much more of a negative precedent in the future.
00:12:38.420 If we compromise our rule of law in order to prevent somebody who you think is dangerous, people disagree.
00:12:44.940 That's up to the American public.

00:12:48.560 But you're willing to sacrifice the rule of law to affect the election results because you think Trump is so dangerous.
00:12:55.900 People on the other side will do the opposite.
00:12:57.980 They will defy the rule of law against people you like.

00:13:03.640 Tomorrow it's a Democrat.
00:13:04.960 The day after tomorrow it's Uncle Charlie and your niece.
00:13:07.300 And we need the rule of law because men and women are not angels.

00:13:16.920 It takes courage away because most judges have life appointments.

00:13:26.520 And that's why in a borough like Manhattan, do not expect justice.

00:13:31.600 I don't think this judge will rule in favor of Trump on statute of limitations or on change of venue, even though those are so obvious.
00:13:40.680 And I don't think a jury will rule in favor of Trump, even though there's no evidence.
00:13:46.020 The evidence comes from a sworn liar.

00:13:48.940 There's not even a misdemeanor here or a felony.
00:13:51.280 This is the easiest case any first-year student couldn't lose if the name of the defendant wasn't Trump and the name of the borough wasn't Manhattan.
