00:08:53.540 but they don't they they say they're going to have an agreement to deal with chinese access and being
00:08:59.420 on our markets but they don't enforce the deals whether it's a a deal that's you know bilateral

00:21:17.140 justice which is you know uh truly wokeism come to environmental policy and it's the kind of thing
00:21:24.120 the left does where they in 1984 fashion in winston uh you know fashion they redefine words right so
00:21:30.920 environmental justice i would submit is neither justice nor classic environmentalism it's essentially
00:21:37.100 about creating these kinds of giant pots of money and then moving them to your favorite constituencies
00:21:42.620 and then using that to build more political power and undermine traditional industries in the united states

00:21:55.040 this radical rule change they just decided to change the rules it's not it hasn't gone back to
00:22:00.760 congress they're not trying to get a statutory change here uh the rule change on environmental
00:22:05.760 then i want to talk about the power plants another bombshell kind of this morning on the power plants
00:22:10.280 walk me through the ev first and let's go to the plants sure so on the uh on the ev side um you know
00:22:17.260 they're going to ramp up the standards starting in model year uh 2026 they've already done a rule
00:22:22.260 making this area it basically reduces greenhouse gas emissions and that's the equivalent of driving up
00:22:28.100 fuel economy and if you make the standards stringent enough steve right the only way you can hit the
00:22:33.600 standards is by having so-called zero emission vehicles which are electric cars so they recognize
00:22:39.860 that and then their modeling sort of showing if you want to hit our super aggressive standards
00:22:44.020 by model year 2032 we're going to have to have 70 percent electric vehicles and at the moment we
00:22:49.840 only have seven percent so that's a 900 percent increase in about an eight-year period because
00:22:55.540 model year 2032 starts in in 2031 and i think that's you know a big issue under this supreme court
00:23:02.660 case from last term about the major questions doctrine because there's been no new vote on this i don't
00:23:09.420 think there's any clear indication of the clean air act in section 202 where this authority
00:23:13.840 ostensibly comes from to put us on a battery electric vehicle mandate and as i started to say but
00:23:21.020 we ran out of time on saturday you know i've been litigating in this area for a long time so going
00:23:25.760 back to the early 2000s before i joined the bush administration uh we managed to get a two percent
00:23:32.560 electric vehicle mandate that california had pioneered it always starts in california and was traveling
00:23:38.540 to the northeastern states we got the one in massachusetts struck down not only did we get
00:23:42.900 it struck down we got it struck down and we got our attorney's fees for winning that case in the
00:23:47.300 first circuit steve why is uh i i said at the time the west virginia case about going after the
00:23:55.000 administrative state i said the time that that actually may have a bigger impact than the dobbs
00:23:59.680 decision walk our audience through why was that such important uh because you know gorsuch and these guys
00:24:05.840 were were essentially selected because of their outlook on the administrative state and the feeling
00:24:12.020 that the administrative state had gotten too powerful that's where kavanaugh and uh and gorsuch
00:24:16.540 are uh are similar and gorsuch i think being one of the leading thinkers about this walk me through walk the
00:24:22.080 audience through why that's such an important decision and why they're 24 hours a day figuring out to do
00:24:27.520 work arounds on that decision right so steve basically the decision uh the west virginia decision
00:24:34.380 is a uh an attempt to start reviving the non-delegation doctrine so article one uh section
00:24:41.780 one of the u.s constitution vests congress with the lawmaking power it doesn't vest the executive
00:24:47.440 branch with the lawmaking power it says that all laws are to be made by congress and so that led to
00:24:53.700 you know a long period of our republic where the supreme court recognized that you can't just you
00:24:58.460 know willy-nilly hand off vast amounts of authority over the national economy over anything to unelected
00:25:05.080 bureaucrats who serve in the administrative state and uh you know that culminated in the 1930s when
00:25:11.940 you know a couple statutes were struck down in these famous cases called the hot oil case and the sick
00:25:16.900 chicken case uh but then you know roosevelt very angry fdr he threatened the uh them with court packing
00:25:24.100 and you know uh they started to buckle at the knees and they started to allow more and more delegations
00:25:30.500 um in the 70s you know we had uh you know in 80s we had at least some revival of that doctrine with
00:25:37.280 the court saying look you know the osha statutes are going too far we have to read them more narrowly
00:25:42.300 so they don't create non-delegation doctrine problems but this latest major questions doctrine
00:25:47.800 is another way to try to skin the cat in the same pro-constitutional direction and say look
00:25:52.740 if there is a major question of economic or political significance then there has to be a
00:25:58.080 clear statement in a statute by congress that the agency has the power to do what it purports to do
00:26:04.680 and if there's no clear statement and and the spring court found that was lacking in the west
00:26:09.280 virginia case in the clean air act as to setting greenhouse gas emission standards in the way they
00:26:13.980 were trying to do it from power plants and generation shift then it's unlawful they struck it down
00:26:19.180 so uh and then justice gorsuch whom you mentioned he is a big progenitor of this revival he wrote
00:26:26.160 separately his concurrence is excellent and it argues that the major questions doctrine shouldn't just
00:26:32.100 embrace major questions as a matter of economic or political significance but also ones that are major
00:26:38.780 questions in terms of the separation of powers and federalism so this is a major you know milestone
00:26:44.320 in supreme court history and it's why they're trying desperately to get around it and one of the ways
00:26:49.980 they've tried to get around it steve is by embedding various little things sneakily into the so-called
00:26:55.460 inflation reduction act which is like the stealth green new deal and that's why one of the things just
00:27:02.520 to go back to the budget and the debt ceiling the uh pulling back the inflation reduction act and
00:27:07.860 everything they're doing here on uh net zero carbon and everything they're doing the environment is a
00:27:12.260 very high priority as part of the big fight that we're going to have it's not just about the cash
00:27:16.640 out of pocket on that is what it means i'm if you can hold on for a second because i want to say
00:27:20.800 when they're stopped by the supreme court and the rule of law and you heard hey you know people are
00:27:25.340 saying hey if they'd come out uh against this abortion pill today we're just not going to enforce it
00:27:30.260 i mean the radicals and and congress are just sitting there going hey if the courts go give us
00:27:34.520 something we don't like we're just not going to force it that's the beginning of anarchy
00:27:37.680 but the bide administration's also slick this this executive order when they're stopped and they
00:27:43.180 know that we control the house they can't get statutory changes he's just going to sign an executive order
00:27:48.300 that gives these broad incredible powers and and when you look at it this environmental justice
00:27:53.860 executive order is about as radical as anything that's ever been signed by president united states
00:27:58.440 jeff clark's going to break it down for a short commercial break we also have reggie littlejohn

00:33:58.560 minorities and that so therefore environmental policy is racist i mean ignoring the fact obviously right

00:34:10.080 where you have access to markets you know where land is cheap and we even have a brownsfield policy
00:34:15.700 that says let's build on places that already have contamination rather than contaminating green
00:34:21.460 fields but all that you know would fall under the chopping block of uh of environmental justice
00:34:27.380 and look the the left the marxist legal theorists steve are really big on this term indeterminacy
00:34:33.880 they say that all law is indeterminate the judges can do what they want it's just a disguised form of
00:34:38.980 politics yeah but this is worse than that this is like bootstrapped indeterminism nobody knows
00:34:45.000 exactly what environmental justice truly entails but now every agency in the government is being
00:34:51.520 ordered by joe biden to use environmental justice to maximum effect in order to make policy changes

00:36:32.300 starting at about the fall um they may be like 10 million dollars and you know the a local government
00:36:38.500 could affiliate with a local non-profit that east palestine formed i mean look if there's going to
00:36:43.680 be this money sloshing around and you know it doesn't get eliminated or cut back then certainly
00:36:49.620 i think the uh the the devastated folks in east palestine should be able to get access to that
00:36:55.500 um there are some other things going on as well look i mean time magazine just did a piece on earth

00:37:52.400 plaintiff's bar is on trying to get relief uh for people and clearly uh norfolk southern is feeling the
00:37:59.420 heat of all the litigation uh that they're facing and then the last update i had for you was uh that
00:38:05.940 um you know something i hadn't noticed initially in looking at the inspector general of epa uh indication
00:38:13.020 that they're going to do an investigation there are actually 34 individuals copied on his letter so
00:38:18.480 you know uh we'll see whether this turns out to be an effort to sweep it under the rug but if you just
00:38:23.620 went by the number of people who got cc'd on the letter it looks like it's going to be
00:38:27.360 quite a sprawling investigation of what went wrong in that situation with epa uh on the scene response

00:41:19.420 instruments these instruments are officially coming up for a vote in may of 2024 however they can
00:41:26.120 consider sections of them and pass them even in may of 2023 they did that in 2022 they passed sections
00:41:34.200 okay what we're worried about with respect to our national sovereignty is these agreements would
00:41:39.960 make world the health world health organization become um a binding regulatory and enforcement agency
00:41:47.040 with sovereignty over our health care and it would also establish a biotech surveillance state and i can
00:41:54.460 go into chapter and verse on this and according to article 35 of the treaty once it passes any or any
00:42:03.500 section of it a country can send them a notification and say we're just we're going to enforce it right
00:42:09.600 now we're going to implement it right now this could happen and so what frank gaffney and i are trying to do
00:42:16.560 is to get a press conference at least on capitol hill from our representative saying we don't want this
00:42:23.500 to happen we don't want to cede our sovereignty the world health organization and we have this the
00:42:29.200 sovereignty coalition we've got the american sovereignty declaration we've got about i don't know 200 to
00:42:35.080 300 000 actions taken including 70 000 phone calls apparently that's not enough for our congress because
