00:03:09.960 Ohio, are dealing with what one expert calls the fentanyl of chemicals.
00:03:14.640 I've spoken to families who've been sickened by the air they breathe.
00:03:19.000 I've met with people who live with toxic waste in their backyard,
00:03:22.480 and I've seen conditions that are simply unacceptable in the United States of America.

00:03:32.480 Questions still remain over who authorized a controlled burn following the Norfolk Southern
00:03:37.780 train derailment three months ago.
00:03:39.980 News Nation investigative correspondent Rich McHugh is on the ground tonight in East Palestine, Ohio.

00:03:48.920 The big lingering question here in this toxic disaster is who ordered the controlled release,
00:03:54.620 the slow burn of the vinyl chloride into the atmosphere here?
00:03:58.280 Norfolk Southern says it was a decision made with Ohio officials and the EPA.
00:04:02.360 The EPA says they were not consulted, and this was a decision that they did not sign off on.
00:04:09.960 Now, we're learning more on who drove this decision.
00:04:14.720 On February 7th, three days after the Norfolk Southern train derailment in East Palestine,
00:04:19.920 Norfolk Southern conducted what it called a controlled burn,
00:04:23.280 releasing 116,000 gallons of vinyl chloride into the air.
00:04:27.240 Former EPA Administrator Judith Enk.
00:04:29.700 I think that was a mistake.
00:04:31.260 I'm looking very closely at who made the decision to set the vinyl chloride on fire.
00:04:37.200 I think that decision will be a major factor in the lives of many communities in Pennsylvania
00:04:47.040 and Ohio, not just East Palestine.
00:04:49.860 On February 14th, Ohio Governor Mike DeWine said he was among those involved in the decision.
00:04:55.140 We then made the decision to go ahead with the second option, which was the controlled release.
00:05:01.760 But on March 9th, Norfolk Southern CEO Alan Shaw told Congress this.
00:05:06.220 That decision was made by Unified Command under the direction of the incident commander.
00:05:12.680 Who's that?
00:05:14.800 The incident commander was Fire Chief Drabeck.
00:05:17.260 News Nation has reached out to Fire Chief Drabeck, but he has not responded.
00:05:20.520 And it's unclear who had the legal authority to order a controlled burn.
00:05:24.460 Having him make that monumental decision doesn't seem logical to me.
00:05:30.960 Further, I was on a meeting with the EPA recently and asked them why they signed off on the decision
00:05:41.180 to do the open burn, and they told me they did not sign off.
00:05:46.900 The EPA told me that they were not asked about whether or not to do the open burn of vinyl chloride
00:05:54.380 and that they were not part of that decision.
00:05:57.120 And testimony from Eric Brewer, Director of Emergency Services for Beaver County,
00:06:02.000 suggests it was Norfolk Southern who recommended burning the vinyl chloride.
00:06:05.880 We learned that Norfolk Southern wanted to do a controlled detonation of the tank car in question.
00:06:10.580 We were assured this was the safest way to mitigate the problem.
00:06:14.280 During one of those planning meetings, we learned from Norfolk Southern
00:06:17.080 that they now wanted to do the controlled detonation on five of the tank cars rather than just the one.
00:06:22.860 This changed the entire plan as it would now impact a much larger area.
00:06:26.740 In a statement to News Nation, Norfolk Southern writes,
00:06:29.320 Norfolk Southern alerted incident command of the potential for a catastrophic explosion
00:06:33.380 and advised a controlled release as the safest option.
00:06:36.580 The final decision to execute their plan was made Monday morning by the incident commander
00:06:40.460 after discussions and consultation with Governor DeWine, Governor Shapiro,
00:06:44.780 Ohio state agencies, Pennsylvania state agencies, the U.S. EPA, us,
00:06:49.500 and, of course, those local first responders.
00:06:54.260 Now, I've spoken with the EPA, and we are expecting a statement from them.
00:06:57.800 But to reiterate, the EPA says they were not consulted and that they did not sign off on this.
00:07:03.000 The big question is why.

00:07:23.900 And Jeff was assistant attorney general in charge of this kind of entire area,
00:07:28.200 particularly refereeing with the EPA, and he was the one that laid out a couple of months ago
00:07:32.440 exactly what was supposed to happen.
00:07:34.800 There's still too much fuzziness in nomenclature.
00:07:40.160 There was a controlled release, quote-unquote, into the ditch of the liquid,
00:07:44.360 of which they added the different cars.
00:07:46.160 Because they said if you didn't do that, it was going to blow up and send shards everywhere of iron everywhere and steel.
00:07:53.500 And then once it was in the ditch, there was a, quote-unquote, controlled burn
00:07:57.360 to put it into the atmosphere.

00:08:00.820 They've got the, now they focus, as you said, Jeff Clark, in the incident commander,
00:08:04.320 but they're sticking it on the poor fire chief.

00:08:29.860 Let's take a step back and look at how this has evolved, right?
00:08:33.700 So Norfolk Southern says that the fire chief was the incident commander.
00:08:37.960 He made the call to do the controlled burn and the release to the ditch, okay?
00:08:42.760 That's questionable in and of itself, but that's what they said.
00:08:45.320 And that's what they also told the Senate, right?
00:08:47.780 Next, we had the folks from DOT, I think, you know, at Pete Buttigieg's attempt to kind of cover his ass,
00:08:57.720 telling CNN that the EPA administrator made the call to, and the EPA people made the call to do that controlled burn, okay?
00:09:04.920 Then we have the fact that EPA says they did not do it, that it was Norfolk Southern, okay?
00:09:13.720 And then we have the Pennsylvania witness you just showed at the end of the clips saying that Norfolk Southern did it, right?
00:09:19.760 So you have, like, a complete circular motion as to who supposedly did this.
00:09:24.720 They're all pointing fingers at each other, and there are two witnesses who say that it was Norfolk Southern who did this,
00:09:31.140 and then you have the agencies involved.

00:09:35.440 Norfolk Southern has no authority in this position whatsoever.
00:09:39.400 As soon as it crashes, it goes off the rail, you go to the National Response Center.

00:09:45.220 It goes to the National Response Center automatically, by definition, the National Response Center.

00:09:54.680 That incident commander, correct me if I'm wrong, is a senior EPA official.
00:09:58.860 I just want to walk through, that is the regulation in black and white, is it not, sir?

00:10:07.060 So there's a statute on point, as I pointed out before to you, Steve.
00:10:10.420 It's the Clean Water Act, Section 311C, and it specifically directs that the president shall direct all response actions,
00:10:20.600 federal, state, and private, and private.
00:10:24.080 And then there's an executive order that delegates that power either to the Coast Guard,
00:10:30.240 if you're talking about something that's, you know, off on the sea,
00:10:32.940 or to here, because you're talking about an inland water, to EPA.
00:10:36.980 So EPA is where the delegation rests.
00:10:40.220 EPA is in charge of how to do the response.
00:10:43.660 So EPA can't just sit back and let Norfolk Southern drive the train, as it were.
00:10:50.960 And you have this former EPA official, and now EPA itself, basically admitting that they did not follow the law,
00:10:58.360 that they let Norfolk Southern do that.
00:11:01.320 So that's expedient for them, because they can try to say, oh, it's Norfolk Southern, and point the finger at them.
00:11:07.500 But it's simultaneously admitting that they did not carry through with their duties under the law.
00:11:13.460 They violated their duties under the law.
00:11:15.820 And that former EPA official you saw in the clips, Judith, she needs to talk to the EPA IG as soon as possible
00:11:24.060 to give her perspective about how this should have happened and how the story makes no sense.
00:11:29.100 She also needs to be interviewed by the criminal lawyers that Governor Shapiro said he was going to sick on this.
00:11:36.300 So this is, you know, a bombshell piece of new information, Steve.
00:11:41.200 And whatever way you look at it, EPA either, you know, fell down under their duties under the law
00:11:48.080 or they're just trying to engage in a CYA exercise.
00:11:53.520 The point I was making in East Palestine is that you pay $6 trillion a year for this.
00:11:59.620 The EPA is going to be the biggest one that they come out whining about that you can't cut it, you can't cut it, you can't cut it.

00:12:06.660 This, I would argue, is their most important function among everything.
00:12:10.980 When a hazardous material event happens, the EPA is supposed to be the on-scene commander.

00:12:18.020 They're checking creeks all the time and, you know, checking all this environmental stuff, whether it makes sense or not.

00:12:25.340 But this is really – this is where they're called into action in the defining moment, right?
00:12:32.860 This is what they're supposed to be – the task and purpose of the EPA in the moment of a catastrophe and disaster is to be the on-scene commander.

00:20:11.740 1442, and Bragg, from that perspective, made the mistake of making his entire indictment about incidents, events that occurred after Donald Trump became president, and he has this still kind of not fully fleshed out theory of it being tied to getting elected to federal office.
00:20:31.180 So there's clearly a connection between his indictment and Donald Trump's holding of the highest office under the U.S. Constitution.
00:20:38.140 That gives Donald Trump and his team the right to remove that case to federal court, and based on New York Times reporting today, it looks like they're going to exercise that option, and they're going to pull the case out of the Manhattan court, local court there, and they're going to pull it into a federal court.
00:20:56.980 And I already saw Occupy Democrats whining about that on Twitter, you know, retweet if you disagree with this decision and think it's a maneuver, et cetera.

00:38:32.420 arguments wasn't of the Proud Boys.
00:38:34.960 It was the clip of Donald Trump from September 2020 in that presidential debate telling the
00:38:40.640 Proud Boys to stand back and stand by.
00:38:43.940 That was used by this DOJ as sort of a call to arms of sorts, where the president was instructing
00:38:51.680 the Proud Boys to plan for January 6th, even though nothing had been planned by that point.
00:38:57.340 But they stitched together this case, not to keep these men in jail for decades, which will
00:39:02.640 happen, but to eventually go after, as you said, the man Andrew Weissman has wanted in jail
00:39:09.020 now for more than seven years, and that man is Donald Trump.
