00:05:47.060 decision involves uh the clean water act and the whole issue of protecting wetlands and how they're

00:05:54.020 regulated it turns out that the jurisdiction that epa and the army corps of engineers it's a strange regime

00:06:06.820 united states but there's always been a fight about what does that term mean exactly i think it really

00:06:12.260 originally was intended to mean that the navigable waters but it's expanded past that but it clearly has

00:06:17.220 to be you know some kind of uh traditional water that you would recognize as such not a damp patch in

00:06:24.180 your backyard uh you know not a not a vernal pool uh and i have been working on this issue for

00:06:31.780 more than 20 years going back to like 1999 2000 before i joined the justice department the first time

00:06:37.700 and there was a case that went to the supreme court that was truly ridiculous and caused the

00:06:41.540 supreme court to push back on this over regulation and it involved the army corps of engineers having

00:06:47.540 an interpretation of the cleaned water act that said they can regulate your wetlands if a migratory

00:06:54.100 bird lands on the wetlands so it doesn't have to be a you know a a river a lake a stream uh it can

00:07:02.020 just be a damp patch and if migratory birds use it uh then there's federal jurisdiction and you know

00:07:08.740 that was super radical the supreme court struck that down said that posed serious problems under the

00:07:13.620 commerce clause power because it's state and localities that have powers to regulate land generally

00:07:19.220 not the uh the federal government the federal government can regulate waters but not land and

00:07:23.300 on the army corps interpretation they basically had converted it into we can regulate a lot of things

00:07:29.460 that that congress never intended and then i think that and they and the decision it was a case called

00:07:34.820 swank um invited the epa and the army corps of engineers to uh fix the statute and so then i you know

00:08:26.980 waterway involved and justice kennedy was squishier and he said you can regulate wetlands if they have a

00:08:33.060 significant nexus which is just replicating the weird problem of what exactly is a wetland that you

00:08:38.420 have uh jurisdiction over so finally after a lot of falderall there's a you know couple who just want

00:08:44.660 to build a home out in california and there's not a traditional water there there's just a ditch

00:08:50.020 and they you know are blocked from from building on their home and the supreme court uh finally stepped

00:08:55.220 forward and and seeing that the political branch the executive branch wasn't doing the job with the

00:08:59.780 regulations they came in and they clearly said that uh epa was massively overreaching and trying to say

00:09:06.660 that these were wetlands that could block this uh you know new home uh uh for the for the plaintiffs
