Bannon's War Room - Episode 2946： The Raid On A Utah Man; Slavic Warfare

00:00:00.000 this is the primal scream of a dying regime pray for our enemies because we're going medieval on

00:00:10.020 these people here's not got a free shot all these networks lying about the people the people have

00:00:16.620 had a belly full of it i know you don't like hearing that i know you try to do everything

00:00:20.380 in the world to stop that but you're not going to stop it it's going to happen and where do

00:00:23.760 people like that go to share the big line mega media i wish in my soul i wish that any of these

00:00:31.460 people had a conscience ask yourself what is my task and what is my purpose if that answer is to

00:00:39.040 save my country this country will be saved war room here's your host stephen k band

00:00:53.760 and jackie again talking about what the tragedy that happened in utah um it's not it's it's really

00:01:21.860 it's not just the conspiracy against against joe biden and against democrats that's so deadly here

00:01:30.660 it's this constant attack against the fbi since the fbi has been forced to investigate

00:01:38.600 donald trump getting his documents you know they tried to get the fbi agents named so

00:01:44.560 they could be threatened um and um there was you know news stories about this fevered pitch hunt

00:01:52.320 to unmask the fbi agents that actually did the search right but doesn't this show the cost

00:01:58.580 of of telling people whether it's on fox news or coming from donald trump that the fbi is coming

00:02:05.520 after you they're coming to knock down the doors of your home and they're coming to shoot you so

00:02:10.680 you hear that time and time and time again when you make a threat against the president of the

00:02:15.880 united states and the fbi comes to check it out you know your gun's up like again hard not to look

00:02:23.740 at all of these lies and these conspiracy theories against the fbi and not say they were responsible

00:02:28.360 for the death of this man i think it's really smart and necessary to look at all of these attacks

00:02:34.100 in that context of no one comes into donald trump's incinerator without being uh tarnished in some

00:02:41.840 way from the insurrectionists who were all charged for uh going and storming the capitol on january

00:02:47.820 6th trump's behest to now the weaponization uh campaign that that congress is running in order to

00:02:55.160 defend trump against the fbi and the justice department all of these have real life consequences

00:02:59.940 i mean talking about defunding the fbi i mean it's anathema to the republican party right and and

00:03:06.520 everything that that conservatives have have stood for for quite some time up until trump um but i mean

00:03:14.060 when you look at at the trail that trump has left in his wake it's really important i think to talk

00:03:19.180 about these sorts of cases and and kind of lump them in and and show that rhetoric matters at the end of

00:03:26.460 the day you know leveling all of these threats against alvin bragg fanny willis uh we're just

00:03:32.320 waiting for tanya chucken to get thrown into the mix there they have consequences uh and the fbi is

00:03:37.680 just trying to do their jobs here despite whatever spin we're probably inevitably going to hear in

00:03:43.020 right-wing media uh today about sort of how again these talking points that that the fbi is uh you know

00:03:51.600 a tool of the biden administration and has been weaponized there's been some question over whether

00:03:56.440 or not the governor of the state of utah would welcome the president of a different party

00:04:00.160 i think it's insane okay that we are having those i can't i can't i can't i can't i can't take the

00:04:06.360 governor of utah slobbering all over biden uh friday 11 august year of our lord 2023 uh jack

00:04:12.540 posobik they're just trying to do their job you're seeing now a full-on full-court press

00:04:19.680 uh by corporate media to basically cover up let me be blunt a cold-blooded assassination

00:04:29.160 of an elderly kind of hapless guy who yes talk smack on facebook and says some things are quite

00:04:38.860 inappropriate on facebook a cold-blooded assassination by the regime in the administrative

00:04:47.200 states gestapo the fbi and if this does not cause these guys to be defunded and let biden shut the

00:04:55.360 government down on midnight september 30th because of this and other things we're going to get into

00:05:00.080 today jack posobik walk us through the details about this because you're the first guy really

00:05:06.340 to get you and i talked we didn't believe it when it first happened that this was totally was legit

00:05:11.260 you were the first guy that really went out yesterday started walking people through it

00:05:14.920 just for people who are not up to speed on the story just tell us what happened here so we have

00:05:19.440 at least the facts that the neighbors have talked about we know and because the fbi is holding back

00:05:24.940 any information sir that's right steve so i've got the affidavit that was filed by the department of

00:05:32.180 justice the criminal complaint i've got these witness statements from the neighbors obviously the video

00:05:38.020 you just played very harrowing video there uh in a basically a sleepy neighborhood of provo utah

00:05:46.300 uh provo utah not exactly known as a hotbed of extremism um this is this a lds area this is a pretty calm

00:05:54.420 area uh middle class well-to-do type folks um at 6 15 in the morning the fbi mountain time uh two days ago

00:06:04.900 now conducted a pre-dawn raid of the 75 year old 300 pound man who we now know is largely homebound

00:06:15.000 uh has trouble walking without a cane he actually has a cane that he designed for himself a churchgoer

00:06:21.120 he's a frequent member of his local church uh and he's known for making um as it works in in carpentry

00:06:28.220 and so he makes uh ramps for disabled folks in in the neighborhood like a woman that lived down the 0.98

00:06:34.900 street he organized some folks together to help him put together a ramp which by the way is is a very

00:06:40.100 common thing within the lds community uh to do building something for someone in the community it's

00:06:45.160 very very common very community focused and uh the fbi raided his home serving search warrants on

00:06:53.520 uh essentially threat search and arrest warrants for threats against the president interstate threats

00:06:59.720 against federal officials and showed up there you can hear banging on the door screaming a flash bang

00:07:07.880 or smoke grenade goes off it's kind of hard to tell exactly what it is just from the footage that we

00:07:12.940 have the footage then cuts off the witnesses then tell us that a hail of bullets a barrage of bullets

00:07:18.140 was then fired by the fbi squad and you can see in that video that is an fbi swat vehicle a bearcat

00:07:25.480 that's come up with them they're they are rolling uh in a in a very strong heavy force operation

00:07:32.400 into this area but when you go through the actual details of this it shows that this man had been

00:07:39.440 identified to law enforcement all the way back in march for some posts that he had been making

00:07:44.960 and and to be clear the post that he was making extremely inflammatory they are the type of posts

00:07:50.240 where you would expect a knock on the door all right you're gonna expect a knock on the door

00:07:54.140 you're gonna get a visit posts like this you're gonna get a visit and they did visit him they followed

00:07:58.420 him to church they saw that he got into his vehicle with another man from church they drove out

00:08:03.280 afterwards he wore a suit to church but then it says they spoke to him at his home after church

00:08:09.460 that day back in march when they confronted him and he yelled at them but at this end said they were

00:08:15.620 just posts i was talking about a dream i had uh and then slammed the door in their faces and so there

00:08:21.660 was no violence in that earlier interaction whatsoever and then you have the fbi show up like this

00:08:29.080 triggering a reaction that they got where they tell them they they've now said later that he was showing

00:08:36.840 a gun brandishing a gun when they showed up at his house in this pre-dawn raid and after they saw that

00:08:42.880 firearm they opened fire it's the it's the neighbors that have said this was over the top it scared the

00:08:50.500 neighbors they said they couldn't believe the show of force i think one of the neighbors said hundreds

00:08:55.240 but hundreds go ahead and not only that steve um after we're told that after he was shot and killed

00:09:03.100 inside his home uh they drug his body outside into the street attempted to resuscitate him it was

00:09:10.580 unsuccessful and then they left his body lying there in the street and there there are some photos of

00:09:16.080 this uh some that have been blurred that have been released where his body was was bled out and late

00:09:21.600 left on the street there with this is a neighborhood with children uh for over two hours

00:09:26.400 two hours uh the the some of the things he said were so inflammatory i think there's a report that

00:09:33.840 even true the true social team actually alerted the fbi we're not making any excuses for the

00:09:41.220 inflammatory language he used he did use inflammatory language um and he was visited by the fbi which he

00:09:48.140 told him hey i'm just posting stuff you know i had a dream um he's 300 pounds he's totally immobile

00:09:55.680 one of the neighbors mocked the fbi saying to think that this guy could go down and shoot joe biden is

00:10:02.740 ridiculous he came to get out of the house the pictures you see uh the photos you see that he's

00:10:09.100 taking his time to build ramps for people he can barely stand every picture you got he's leaning over 0.87

00:10:14.800 something this guy is almost completely he's completely immobile and and and why is the fbi what we need

00:10:21.800 immediately is we need the we need the body cams because here's what's odd they say he came after

00:10:27.160 the flashbang he came to the door he was brandishing a weapon and the neighbors say then a hail of gunfire

00:10:32.680 that shocked the neighborhood took this guy down but then they had to go to get the body in the in in the

00:10:40.260 house does that mean he got shot and fell back in the house that mean he was still in the house

00:10:44.380 then they dragged him out they tried to resuscitate him we don't know how how long and it looked like

00:10:50.080 he got hit by so many weapons so many bullets he's probably dead immediately they try to resuscitate

00:10:54.700 then to desecrate the body they allowed the body to stay right there on the pavement in a neighborhood

00:11:03.000 with children they put a they put a a a blanket or something over it but he bled out all over that

00:11:08.320 desecrated by let him just lay there for two hours jack basovic well we're also told that uh the uh

00:11:17.780 the gentleman has a blind son obviously an older blind son now um that is disabled that he takes care

00:11:24.200 of uh some of the neighbors reaching out and and really the the one of the biggest pieces of this

00:11:29.500 is the neighbors and their statements that have all come forward saying that this this was actually a

00:11:35.240 very beloved man within the community they said sure he posted cranky stuff we all knew about it

00:11:39.820 but he was the first guy to help you out if you needed something uh he made uh because of his

00:11:44.780 carpentry skills he made toys for kids in the in the area around christmas time uh was well known

00:11:50.180 well liked at his church was could be seen helping his blind son uh find a place to sit that he helps

00:11:55.640 him out get him around uh not sure exactly what's going to happen with that son he's got a couple of

00:12:00.000 other kids wife pre-deceased and the so the neighbors have almost unilaterally um just every

00:12:06.620 single one of them every single one of them or i should say um unanimously um reached out and said

00:12:12.720 they can't believe that the fbi would have targeted a guy like this because they said these were these

00:12:18.900 were you know obviously inflammatory statements but he would never actually do anything like this

00:12:23.940 um even even so far as the family releasing a statement last a very lengthy statement last night

00:12:30.280 which i posted up on all my social media uh essentially attesting to the exact same kind of

00:12:36.240 kind of character of the man who was involved and and another piece of this steve that's very

00:12:40.120 that would do anything people that and i and i would i would respond to what what morning joe was

00:12:45.400 saying they were they're because they're blaming this on donald trump they're saying it's all trump

00:12:48.900 well he'd actually been posting like this for over a decade believe it or not on facebook

00:12:53.400 um he had he had posts like this about obama he had posts like this about a numerous other

00:12:58.700 individuals and and i don't think they were you know very um you're very not a lot of engagement

00:13:04.120 we would say in the social media community um not exactly uh running uh you know raising an army

00:13:09.260 behind him to do whatever it is that he was saying that he was doing in these in these no he couldn't

00:13:13.640 even physically so couldn't he physically do it and what happened to change the stance of the fbi

00:13:19.900 from this entire decade to rolling up the way they did now it's it's very simple they use this as

00:13:28.540 a show of force this is exactly what they're trying to do the catholics they're trying to put america 0.92

00:13:33.180 on notice right you get out of line you're going to be bleeding you're going to bleed out on that

00:13:38.600 you're going to bleed out on that uh on that uh on the uh on the sidewalk in front of your house

00:13:43.960 this was a cold-blooded assassination and ray ought to be called in they should not approve any fbi

00:13:49.880 budgets they get to the bottom of all this this was a angry guy uh he put up a lot of stuff over a

00:13:55.700 lot of years that was inappropriate totally inappropriate that doesn't mean you send a

00:14:00.020 massive up-armored swat team and assassinate him it's assassination the assassination that's

00:14:05.680 where they will release the body cam you're gonna see this guy taken out this is unacceptable

00:14:11.140 and this is i said yesterday yeah go ahead no i i said yesterday on the show that just just my

00:14:17.100 opinion here is that this was a show of force and that this was a message being sent if you threaten

00:14:22.340 us if you come for us if you say you're going to take us out we're going to take you out something's

00:14:28.840 changed steve something is absolutely changed no connect this to what the the catholic situation

00:14:35.400 that that ray lied about perjured himself about short break we're going to keep poso

00:14:41.840 20 billion dollars to ukraine i'm not kidding you the ukraine thing ukraine can't even find

00:14:48.140 their own young men to fight at the front now because they know it's a slaughterhouse

00:14:52.280 the churnal house 20 billion dollars of your money is about to go over there additionally next

00:16:25.320 just been handed some uh polling from um from about from the um rasmussen guys mark mitchell team

00:16:31.960 about merrick garland the american people don't think very highly of him let me summarize let me

00:16:36.920 give you the news flash uh we'll try to get into that maybe a little later jack basobiec this is quite

00:16:42.120 serious um the left's response on this the joyous response of the left on this walk me through what

00:16:51.720 are they trying to do here well steve it's it's very clear so not only is this a message not only

00:16:58.680 was this a massive show of force of the regime but steve if if you've been out there on twitter if

00:17:05.160 you've been out there on social media looking at this the left is cheering the left is celebrating this

00:17:10.280 right they they have uh they have uh an acronym that i'm not going to spell out for people but it's

00:17:15.400 f-a-f-o f-a-f-o that's every response i'm seeing to this uh these were posts and they're saying you

00:17:23.080 know and i've seen people saying stuff like you see what they did to craig robertson you see what

00:17:27.480 they did to ashley babbitt you're next okay this is what the left wants the furthest of the left

00:17:35.320 they're not interested in making uh policy making good plans for the country this is tribal warfare

00:17:45.320 they want to defeat the right they want to see the biggest names on the right names like steve bannon

00:17:53.000 names like jack basobiec like charlie kirk etc alex jones etc they would love if the headline were to

00:17:59.800 come out the next day that the fbi had rolled up to the war room to human events or any of these

00:18:05.240 places and one of us mark hauck look what they did to mark hauck you know what if he had been

00:18:09.480 brandishing an extremist rosary right they would be celebrating this and they say it's so sad it's so

00:18:15.160 sad that we had to do this right uh you know joe up there warning joe it's so sad that the fbi the

00:18:21.480 poor fbi had to do this to the very dangerous community uh community threat of this 75 year

00:18:29.160 old 300 pound man no steve what they're doing is they're going full mask off this is the same left

00:18:36.760 that just said andy no can't get any type any type of legal resolution for the attacks the harassment

00:18:45.160 the slander the actual violence that's done to him and then we'll turn and bring state violence

00:18:51.160 right into your house right up in your grill at 6 15 in the morning you're getting woken up you

00:18:57.720 have no idea what's going on at your front door all right they could have stopped this guy

00:19:02.360 any time they could have stopped him when he was going to church they could have pulled him

00:19:05.240 they could have done a number of things right they could have done plenty of things

00:19:08.040 which by the way would have been safer for the fbi too and safer for the neighborhood you

00:19:12.920 and the neighbors thank god there was no kids running around you know at 6 15.

00:19:17.000 no but they're they want but hold it they want to do they want to do it because they want the

00:19:20.520 neighbor they want to know it's a point to it they they want they want the neighbors they want the

00:19:24.040 neighbors to understand you you you you get cranky you get assassinated i want and not just the 0.61

00:19:30.680 charlie kirk steve bannon's jack basovic as more importantly it's the it's the hawks in the uh

00:19:36.280 in the traditional catholics right you saw the memo which they lied about it the hobbits this is

00:19:41.880 about the hobbits they're sending a signal to the hobbits you get out of the line you you you put

00:19:46.760 up some inflammatory rhetoric this is what's going to happen to you're going to bleed out on that

00:19:51.560 sidewalk right and by the way when we're told the 300 pound 75 year old guy could yeah go ahead you

00:19:58.280 want to connect it let's say oh so the fbi is running operations in richmond the fbi is running

00:20:02.760 operations of portland the fbi is running operations uh in multiple field offices around the country

00:20:08.760 targeting traditional catholics now we've got the fbi saying that they tailed him to an lds

00:20:14.920 church service well are they going to be looking at that service are they going to be slipping people

00:20:19.960 into that service are they going to be looking around for other craig robertson so now now you

00:20:24.600 got the mormons involved right now they're going after the mormons too see steve this is what how it

00:20:28.920 always starts they always say it's the churches first they come for the churches we went out to la when

00:20:34.120 they were coming for the sisters when they were coming for the nuns you are getting to a situation

00:20:38.680 where we have a bolshevik revolution a spanish civil war situation coming under color of law

00:20:43.800 amen amen by the way we don't have time for it maybe later morning joe for i think seven or nine

00:20:49.940 minutes goes after the evangelical christians today right there's a nationalist right it's all

00:20:55.480 christian nationalists christian christian nationalists and they're good evangelicals these liberals

00:20:59.920 i want i've only got you for so much time i want to go i've got a couple minutes because i want to

00:21:04.520 play this great song that just came out from uh from farmville virginia my beloved commonwealth

00:21:09.380 virginia song is amazing jack it's amazing jack um new anthem ukraine everything that is the spring

00:21:20.220 offensive is collapsing the battlefield commanders are stopping it because the kids are getting

00:21:24.460 slaughtered in the ukrainian army this is not happening and biden sits there and says 20 billion

00:21:30.300 13 billion for military aid eight billion dollars to pay their bills to pay their pensions that you

00:21:35.940 ain't getting at home right to pay the full medical you're not getting at home jack basoba give me your

00:21:40.800 assessment give me a couple minutes on this ukraine situation and the fiat the tar baby that the biden

00:21:46.300 regime has now look steve and people need to understand that if you go back to those early days

00:21:53.300 of the war room those early days of human events when we were talking about this we explained that if

00:21:59.580 you escalate this situation it will turn into a charnel house it will turn into an absolute meat grinder

00:22:06.680 these are the bloodlands of eastern europe this is slavic warfare uh neither side's going to quit 0.99

00:22:14.900 neither side's going to go easy they're going to keep fighting they're going to keep throwing young men

00:22:19.640 into this until there is there is no one left right this is how that warfare goes in that part of the world

00:22:26.160 and it's been going on for hundreds of years if not longer uh we explained very early on very early on

00:22:33.440 that this is what was going to happen that the russians would come in establish concrete lines they would

00:22:41.100 set up their defenses and then they would turn it into what a war of attrition and you had all these planners

00:22:46.820 all these geniuses all the bean counters in the pentagon saying how come they're not fighting

00:22:51.340 like us how come not doing the thunder runs the blitzkrieg operations that we would be doing in

00:22:56.320 iraq etc why aren't they doing this that's not how they fight all right they fight inch by inch by inch

00:23:03.020 and they're just going to slowly roll it up anaconda boa constrictor style to take what is coming because

00:23:10.180 at the end of the day if you get into a war of attrition it just comes down to numbers and because

00:23:15.640 russia has done something that the united is the which is the opposite of the united states

00:23:19.760 because for 30 years we've taken away the production element of our country we've done this really

00:23:27.160 throughout almost all of the eu as well all the all the nato nations uh germany was the only one

00:23:33.060 holding on to a little bit of a manufacturing base but now without the cheap gas they were getting

00:23:37.020 through nordstrom let's see how long that stays um you know they're going to lose their auto industry

00:23:40.740 next right the great mercedes nowdy and all that that's all going away or just going off to china

00:23:45.060 which of course the chinese love uh no but russia has said we're not just going to be a consumption

00:23:50.280 service economy we're going to have the natural resources we're going to maintain manufacturing

00:23:54.280 we're going to do it all in house so when the sanctions hit they didn't understand what was

00:23:58.920 going on because russia had been planning for this for 30 years they put their economy on this footing

00:24:05.000 where they could become autonomous we are the ones we are the ones who are sucked into this we are the

00:24:11.640 ones depleting getting depleted right now they're the ones that are actually let me just give a

00:24:15.700 let me give you a note let me let me give you a note right now bloomberg's reporting the russian

00:24:20.980 economy is going to grow 4.6 percent this quarter that is going to complete by the end of the year

00:24:26.480 completely rebound to pre-war levels and this is when we try to take down their central bank this is

00:24:31.760 when we try to destroy the currency this is when we swept all of their dollar reserves that were held

00:24:36.700 in american money center banks with all that 18 months ago we went to full war we went to more

00:24:42.220 economic war against the russians than we ever did against the nazis or imperial japan ever ever

00:30:01.520 okay uh we've got a lot going on and we're moving pieces around on the chessboard this morning we've

00:30:09.520 got tara down on the border we got uh ben burkwams in kiev uh we've got to go there he just finished a

00:30:15.120 meeting with a member of the zelinski uh administration so we'll go there at the top of

00:30:20.440 the hour also i think we're at cary lakes at the iowa state fair president trump will be there tomorrow

00:30:25.640 president trump's bringing an entire contingent of the florida congressional delegation uh the uh matt

00:30:31.840 gates's um in the um uh and others brian donnell's and others i don't think uh anna plena luna can

00:30:39.600 make it because of her uh i think she's eight months uh pregnant so i don't think she can make it 1.00

00:30:44.500 tomorrow but the whole that whole crew is going up there so a lot going on um but i we got to focus

00:30:50.920 on signal here there's an individual professor alan dershowitz has dedicated his life to the

00:30:57.880 teaching of the constitution to the law students at harvard law school which is arguably the finest

00:31:04.840 law school in the country and many of his um students are now federal judges or or you see

00:31:11.700 they're prosecutors and quite frankly some of them have come up in some of these controversial

00:31:15.540 attacks on president trump uh dershowitz is a democrat i would say a liberal democrat uh he's

00:31:22.300 been ostracized in his own community for a brave stand he took to defend the constitution of this

00:31:27.280 country in president trump's first impeachment to defend the constitution he was eviscerated and

00:31:33.500 shredded personally uh he took a courageous stand he said look yes i'm a liberal democrat and i didn't

00:31:40.140 vote for donald trump and i don't support donald trump but i'm standing for the constitution

00:31:44.160 uh he's then written a book get trump which is i still think the the if you want to understand

00:31:51.020 the legal attacks against donald trump this is the book that are it should be the primer so if you want

00:31:56.960 to get caught up to speed from one of the most brilliant legal minds in our nation and someone

00:32:01.740 who knows the constitution i think as good as or better than anyone and has taken a principled and

00:32:07.820 courageous stand to defend it i would recommend this book so professor dershowitz and i want to thank

00:32:13.520 tony lyons at skyhorse for for connectness i've got to ask you i've seen this piece come out and

00:32:19.200 drudge links to it and it's all over it's a couple of a couple of conservative uh professors

00:32:25.100 i guess i would say they're conservative they're federalist society uh one is at the university of

00:32:31.160 i think the virgin islands or saint thomas not exactly harvard law school but you know he's a

00:32:35.720 federal society member and they write this art this piece and everybody's raving about it

00:32:41.040 federal society guys are coming i remember the federal society is where we got the you know

00:32:46.280 that's kind of where we they kind of curated the people we would look at as as trump judges so it's

00:32:52.880 on the right it's a very prominent institution and you have these people slobbering all over this

00:32:58.800 it essentially says and i'm an amateur in this i'm not i never try to pretend to lawyer that the the

00:33:04.420 trump's an insurrectionist so by the 14th amendment if you saw the movie lincoln this is what that whole

00:33:10.720 fight was about the the because in the civil war era thing of insurrectionist trump's an insurrectionist

00:33:17.240 and therefore is not eligible to run for president united states so we call a professor dershowitz has

00:33:24.080 already given so much to his country in defense of the constitution for your analysis and observations

00:33:30.220 sir well thank you so much look i've read the article it's a an article that's well researched and

00:33:37.420 well written but completely wrong and completely ahistorical uh the 14th amendment was part of

00:33:43.840 kind of the treaty of peace of the civil war it was designed to react to the civil war and when it uses the

00:33:51.260 word uh insurrection or rebellion it means specifically the insurrection and rebellion uh between 1860 and

00:33:58.420 1865 and and the proof of that is the very same amendment that cited uh talks about the united states

00:34:07.460 not accepting any claim for the loss or emancipation of any slave now obviously there were no slaves at

00:34:15.340 the end after the civil war so this clearly had to do with the civil war it also creates no criteria for

00:34:22.040 who decides who was involved in an insurrection who makes that decision is it the current president is it the

00:34:28.220 supreme court is it congress we just don't know and to show you the hypocrisy of the people who are

00:34:34.960 pushing this some of the very same people the very same people radical law professors on the left

00:34:41.560 particularly i don't know about these two guys have argued that the 14th amendment is only restricted to

00:34:47.980 the civil war for example the 14th amendment talks about the equal protection of the laws now the equal

00:34:52.540 protection of the laws would say that you can't use race as an additional factor in allowing people

00:34:59.700 to be admitted to colleges but a number of law professors on the left have said no no no you don't

00:35:04.600 understand the equal protection of the law was written to protect enslaved black people it has no 0.99

00:35:10.420 application to uh white people who are trying to get equal protection in universities so people look at the

00:35:19.180 14th amendment both ways they say look either it applied only to uh the civil war that's the argument

00:35:25.960 that equal protection doesn't protect white people or it applies to everybody even in the year 2023

00:35:32.940 if you can if somebody concludes that there was an insurrection and a rebellion and that somebody

00:35:40.160 was part of it you know it could have excluded uh it could have excluded uh previous presidents

00:35:46.200 as well who participated in demonstrations who opposed wars things of that kind it's such a vague and

00:35:53.980 loose term and so i just don't think that there is a plausible case under the constitution for denying

00:36:01.740 uh donald trump the ability to run for president i think i have a constitutional right to vote against

00:36:07.180 him for the third time which i fully intend to do and i don't want some law professor to deny me that

00:36:13.460 essential constitutional right by a stretched reading of the 14th amendment so you're going to

00:36:20.380 get a lot of support for it a lot of professors um who will do anything to stop trump will suddenly

00:36:26.460 jump on this bandwagon but it's just not historically accurate that's what i want to ask you you wrote the

00:36:34.600 book get trump right is this just another because this thing's getting this thing's getting real momentum

00:36:39.520 and and this shows you in the election interference they don't they're so freaked out trump's you know

00:36:44.860 the presumptive nominee now in the republican party because he's dominating that he's leading biden on

00:36:49.040 all these polls they're freaking out you know jack smith came out yesterday and says he wants to start the

00:36:54.300 trial to january 2024 uh right before iowa and you've got this now it's getting why is it getting

00:37:00.980 traction are they that desperate i think it's getting traction because it's part of the get trump

00:37:06.080 movement uh there are people and by the way a lot of conservatives a part of this movement get trump a

00:37:11.240 lot of my friends are moderate conservatives who hate trump who think trump is the equivalent of hitler

00:37:17.320 i've heard that analogy made over and over again not only by liberals but by federalist conservatives

00:37:23.180 because remember federalist conservatives generally are are are very very true to conservative values and

00:37:32.340 they argue that donald trump is not true to conservative values he's something very different

00:37:37.140 and and so lots of conservatives are opposed to him and opposed to him with with real real animosity

00:37:44.000 and so it doesn't surprise me that this article is written by conservatives it makes it more credible the

00:37:50.000 fact that it's written by conservatives my question that i would ask them maybe they won't answer it

00:37:54.620 who did they vote for in 2020 did they vote for trump or did they vote against trump

00:37:59.300 being a conservative doesn't mean you're fair about donald trump um as i say as you said i voted

00:38:05.780 against trump twice but i cannot read the 14th amendment to give somebody and we don't even know who

00:38:12.080 the power to declare that a person who has 45 percent of the vote in current polls can't run for president

00:38:19.700 you know what a radical step that would be to deny 45 percent of the american public or even more perhaps

00:38:26.440 the right to vote for somebody because of a stretched interpretation of the constitution that doesn't

00:38:32.920 even provide who should make that decision and i would challenge i would love to have one of you invite

00:38:37.900 professors on your show to debate me uh i hereby challenge those professors to debate me in any form

00:38:44.900 in any context and to answer the question first who makes that decision is it you is it a group of

00:38:51.360 platonic guardians elitist professors who decide well we think he engaged in rebellion therefore we think

00:38:58.240 he can't run for president there's nothing in the 14th amendment that tells us who makes that decision

00:39:03.100 so there's a question now about our institutions i want you go i want to go back to comment by the way

00:39:11.040 we will work very hard to get that debate going it's a debate that needs to happen and the american

00:39:15.140 people need to hear it we need to debate this out the the radical step when you look at a lot of your

00:39:21.080 students and people that are judges and what you fought for in the defending the constitution where

00:39:25.700 do we actually stand this get trump movement seems to be so out of control it's like that scene in uh

00:39:32.260 in uh in man for all seasons where the guy says hey i would cut down every law in england to get the

00:39:37.760 devil and thomas moore says yeah when the devil when you turn around the devil's there what's going to

00:39:41.820 protect you because only the law that protects you where are we right now this get the radical

00:39:47.300 nature of this get trump movement yeah no i agree with you and i'm not concerned like uh the man for

00:39:53.100 all seasons about who will protect me i can protect myself i'm concerned about who will protect you and

00:39:57.880 the american public because once we eliminate the constitution once we start stretching the constitution

00:40:03.600 to mean what we want it to say it means you know the best proof that it was designed for only the

00:40:09.660 civil war is the fact that nobody indicates who makes the decision why because post-civil war everybody

00:40:16.240 knew who was a rebel they wore gray hats you know they they they had confederate flags there was no

00:40:22.460 doubt who was a rebel and there was no dispute about it but if you try to use that statute that 14th

00:40:29.200 amendment going forward to 2023 you would need to have a decision maker and the fact that there is no

00:40:35.140 decision maker in the 14th amendment is absolute proof that it was intended to apply to that dispute

00:40:43.120 that rebellion that uh upheaval only and it was not intended to be a debt general prohibition because

00:40:50.260 if it were a general prohibition there would be a process by which it gets determined who's guilty

00:40:56.500 of a rebellion and who's not you can't just have a criteria of exclusion without having some institution

00:41:04.380 that makes that decision unless it's so obvious as it was after the civil war

00:41:09.040 where do we stand with all the rest is fanny willis is now leaking to cnn she's going to indict 12 people 0.99

00:41:17.100 on numerous charges next week in uh in georgia the focus groups are saying the american people have no

00:41:23.080 earthy idea what's going on i mean they've been doing these focus groups american people are kind of

00:41:26.360 overwhelmed the polling show they may have jumped the shark but just rule of law legally constitution

00:41:31.860 constitutionally where do we stand all this professor i think there are two issues one

00:41:36.840 technically are there crimes technically but we know that what 90 of crimes that are committed and

00:41:43.420 have a prosecuted prosecutorial discretion determines who gets prosecuted and i think when you have

00:41:49.160 the president of the united states telling friends and then it being leaked to the new york times

00:41:53.680 we think that garland is going too slow he's acting like a ponderous judge we want this is the

00:42:00.440 president saying we want trump prosecuted for january 6th when you have a prosecution that is initiated by

00:42:07.240 the president against the leading candidate against him it has to be caesar's wife it has to be the

00:42:14.980 strongest case possible in front of the fairest jury and the fairest judge everything is the opposite

00:42:21.620 of that this is an extraordinarily weak case in a jurisdiction that is 90 percent 95 percent anti-trump

00:42:29.580 in front of a judge who should be recused because of her prior connections to hunter biden to a law firm 0.95

00:42:36.060 that has been conflicted out of cases and has a long history of corrupt identification with one party

00:42:44.100 this is the worst possible combination of circumstances you know on my podcast i give bananas out

00:42:51.340 we're up to two bananas now uh ecuador is 10 bananas they just murdered a man running for

00:42:57.500 for uh president there we're up to two bananas but we're getting close to three and four bananas

00:43:03.080 on a banana republic scale we're not there and i want to preserve uh our rule of law and the integrity

00:43:09.580 of our legal system but when the president of the united states tells friends he wants the primary

00:43:14.920 person running against him to be indicted quickly and forcefully you get a banana for that

00:43:20.700 because he said he's a danger to the democracy remember the new york times leak was a very

00:43:27.120 targeted leak mike davis and i went through this it's brilliant you bring that up there's a very

00:43:30.900 targeted leak to make sure garland knew that he wanted a prosecution professor if you just hang

00:43:35.420 for a second we'll take a short commercial break professor alan dershowitz the book is get trump

00:43:40.880 it is kind of your primer to this um banana republic uh attack on an individual who happens to be

00:43:49.440 leading the presidential race right now short commercial break back in the warm in just a moment

00:43:52.860 covidtaxrelief.org got a small retail business almost eighty thousand dollars covidtaxrelief.org got a

00:44:08.260 manufacturing business nearly two hundred and fifty grand and covidtaxrelief.org just got a large

00:44:17.360 distribution business almost nine hundred thousand dollars if you run a business church or non-profit

00:44:25.460 and paid your employees through all or part of the pandemic you could qualify for up to twenty six

00:44:33.420 thousand dollars per employee through the government's cares act but beware of clickbait

00:44:40.100 or pay upfront companies who make you do the work and take a huge percentage of your refund

00:44:45.640 covidtaxrelief.org receives a low reasonable commission only after you receive your refund

00:44:52.860 and with 300 cpas and tax experts no one is better at getting you the maximum benefit than covidtaxrelief.org

00:45:01.860 visit covidtaxrelief.org now because this plan expires soon that's covidtaxrelief.org

00:45:11.200 covidtaxrelief.org the refund examples are not a guarantee and not all businesses qualify

00:45:18.800 that's what you have to check today with covidtaxrelief.org

00:45:24.320 professor dursalief.org you said there were two issues one are there crimes what's the second issue

00:45:34.980 well the best way to illustrate that is to look at the florida case in the florida case there was

00:45:40.960 apparently a crime that is trump waving documents which the government claims were classified in front

00:45:48.740 of unauthorized people and saying i could have declassified this when i was president i didn't

00:45:54.200 they're still secret that technically is a crime but it should not be prosecuted when the person

00:46:00.180 commencing the prosecution is the president and the person who is being prosecuted is the leading

00:46:06.160 candidate against them it's not a serious enough crime to warrant prosecutorial discretion remember

00:46:11.460 ninety percent of crimes that are committed in america are not prosecuted our statute books are

00:46:16.280 filled filled filled filled with crimes that are committed every day we rely on prosecutors to

00:46:21.580 exercise common sense judgment discretion and political savvy and when you have a presidential race

00:46:28.300 and one person in the race is the incumbent president who appoints the attorney general who serves at his

00:46:35.640 pleasure and who communicates indirectly to him that he wants the case prosecuted and the other person is

00:46:40.960 running neck and neck with him you do not prosecute technical crimes like the possession of

00:46:46.100 classified material and you don't prosecute crimes where the evidence is as weak as it is in the

00:46:52.040 washington case or the new york case which is even worse the worst indictment i've ever seen so i think there

00:46:58.260 are those two criteria under either of those criteria trump should not be prosecuted reasonable people could

00:47:04.100 disagree with that but that's my strong view based on 60 years of experience as a criminal law professor

00:47:10.420 and as a criminal lawyer uh professor dershowitz how we get to your podcast how they get the book uh get

00:47:17.980 trump which really lays out the information people need to kind of get their sea legs

00:47:21.700 well there's only one way to get the book the book has been banned at book fairs for example in chillmark

00:47:28.780 where i live martha's vineyard i am the best-selling author in the history of chillmark i've written the most

00:47:35.400 books sold the most books of anybody who was invited to appear at the book fair where books are sold but

00:47:41.400 they banned me and they said no we're not going to have trump get trump sold in martha's vineyard and i
