Donald Trump is on trial in New York for fraud and conspiracy to defraud. But is it fair to ban him from doing business in the state of New York because of the 63-12 Statute passed by the Supreme Court in 1896?
00:00:00.000They went back over 70 years and looked at all the cases that have been tried under this rule, 63-12, which is used here, which doesn't have to show harm done.
00:00:11.860That's not the burden. You don't have to show that anybody was hurt by your practices. There's nobody you defrauded specifically.
00:00:19.800But they went back and they looked at cases over 70 years, I believe it was about 150 cases, and found that there was no case where there was a ban on doing business.
00:00:30.000Where there wasn't harm shown. So even though the threshold is harm shown, in the past, it has only been used to ban someone doing business when it's been shown that somebody was hurt.
00:00:42.640Say you're selling cosmetics that are poisoning you. There's somebody that was hurt there. The cosmetics company gets banned.
00:00:50.580Is this fair to go after Donald Trump like this in this environment? Is my question.
00:00:56.300Well, look, I think what you said about the statute is absolutely true.
00:01:00.780Kristen Snell, who just joined us at the table, and has used the statute.
00:01:03.300I was going to introduce him, but we can introduce him now as well.
00:01:05.860Kristen Snell is here. He's used the statute.
00:01:08.540Well, let's ask Kristen. You used this, 63-12, in the Trump University, a university that was scamming people, wasn't actually giving them useful information for them to do business.
00:01:20.400And wasn't licensed and wasn't a university, etc. Yes.
00:02:00.860And the legislature in New York made a public policy choice to say that that was an important weapon for the AG's office to have to vindicate the public good in this situation.
00:02:14.200Donald Trump's name is tainted here in New York.
00:02:16.460There's also the problem that we're facing in this city right now, which is that post-pandemic, people aren't working in offices at the same rate as they used to.
00:02:23.840And he owns or has a stake in office buildings.
00:02:26.520So how much are those office buildings now worth?
00:02:28.520He might have been able to sell them for a lot 10 years ago.
00:02:33.380Those are in a partnership that he has no management control over, but they are really the most valuable thing he owns.
00:02:39.320And when I talk to, on the brand issue, I've talked to branding experts, and some of them don't even rank him anymore because they see him as a political figure now.
00:02:47.680He really is not a brand like he used to be.
00:02:50.300There was a time when his brand did command a premium, and now it's just not.
00:02:55.360It might command a premium somewhere other than New York City, which is...
00:03:56.660It's Friday, 16 February, Year of the Lord, 2024.
00:03:59.520To show you how much you're hated and how much the powers that be in this nation and throughout the globe want to make sure that you, that would be this audience, have no access to take over the executive branch of the government and to set things right starting this November.
00:04:21.260However, today, one of the great travesty, not a tragedy, a travesty took place in our country.
00:04:27.280That is, in this New York, it was a Moscow show trial.
00:04:33.700And today he came out with all the calculations about what happened.
00:05:02.240What, what, what, just break down what happened and what is, how did this judge, how does he have the ability to basically try to essentially bankrupt President Trump?
00:05:14.020President Trump putting out a powerhouse statement just in the last several minutes.
00:05:18.740This case was, A, done and over with when the appellate division ruled on statute of limitations last summer and took Ivanka Trump out of the case.
00:05:28.480This case should have been in the commercial division in New York where it would have been put out of its misery.
00:05:33.820This case showed that the banks were happy.
00:14:03.420And just a slap in the face to every single citizen here in East Palestine.
00:14:08.880If you listen to those comments that Joe Biden, and in particular what the EPA, the director of EPA said, just an absolute slap in the face.
00:14:16.900Patting their own back as this community has been destroyed.
00:14:24.800Tell the folks we're going to be right back.
00:14:26.200We're going to return to East Palestine for this fiasco with the illegitimate Biden regime.
00:14:32.000Of course, they'd roll him out there because he hasn't gone before.
00:14:34.720Remember, when you look back in the history of this, the inflection point of President Trump's return to the White House was East Palestine, Ohio,
00:14:42.980when President Trump went out there and actually spent time with the people and heard their concerns and offered all the assistance he possibly could.
00:14:50.320Big assistance is returning to the White House.
00:14:53.360Short break, back to East Palestine, Ohio, in a moment.
00:14:59.440As we head toward a presidential election in November, one thing you can be sure of, 2024 will be a tumultuous year like no other.
00:15:08.740How will your hard-earned savings fare during this year?
00:15:11.860You're already seeing the impacts of inflation at the pump, the grocery store.
00:15:16.320The dollar continues to lose buying power quicker than your wages can increase.
00:23:41.260But we have to fight them for them to make it right.
00:23:44.320I don't know what I expected today, but I had a light little bit of hope, you know, that something would be done here instead of just speaking to an empty fire department for 10 minutes or whatever it was.
00:23:58.560And then they made us move several times so we wouldn't even be near the motorcade or anywhere near it.
00:31:48.780It is sad and tragic to see people there who are desperate for help and guidance and leadership be given the runaround by by puppet politicians.
00:32:01.120You your theory of the case, you've been saying for a while, you've got to stop calling people Republicans and Democrats, even conservatives and liberals.
00:32:07.860You've got to look at globalists versus nationalists and populists versus elitists.
00:32:11.840How is this this tragedy that continues to unfold on Capitol Hill and particularly now you've got all the all the senators are all over the Munich defense conference and they're and they're putting massive pressure on us to figure out how to get that money to Ukraine.
00:32:34.060I mean, I think our three priorities in the MAGA movement have to be the border, the debt, the forever wars.
00:32:39.180We've got to close the border. We've got to pay the debt. We've got to stop the forever wars.
00:32:42.460These people seem to want to do it all in reverse.
00:32:44.960And it's very, very simple to identify who's who when when you boil it down to those three issues.
00:32:50.000And I don't care if they say the Republican, Democrat, liberal, conservative, Christian, it doesn't really matter to me.
00:32:55.320But, you know, the bottom line is the American people don't want to send thirteen hundred dollars per household to fight for the territorial integrity of a border halfway around the world when our own is wide open.
00:33:07.560And we don't want the two issues to be, you know, conflated in legislation.
00:33:13.820Anybody who doesn't want to bifurcate the two issues tells you exactly who they are.
00:33:17.920They're warmongering neocons and we're sick of it.
00:33:20.480Your assessment of what happened in New York today, this judgment, three hundred and what, fifty five million dollars against President Trump,
00:33:29.580broken down in different tranches, banning him from doing business for three years,
00:33:33.900but putting people into his companies, run his company so he can't even run it.
00:33:43.800I help coach high school basketball and my own son, seventh grade team, the little platoons, as as they call it, that make this country go.
00:33:50.500But, you know, you know, I'm very critical of our own team because our team has been been charged with the duty of saving this republic.
00:33:57.400So we've got to be real about the flaws on our team.
00:34:00.160And one of the huge flaws of the conservative movement is we have this blind faith in the concept of rule of law.
00:34:06.240There is no rule of law when your lawmakers are corrupt.
00:34:16.880And the first thing that really pops to my mind is all of these claims that Donald Trump plans to be this dictator on day one.
00:34:23.740Well, I say a lot of what I hope he does on day one does make these people uncomfortable,
00:34:28.040does seem like a deviation from the status quo.
00:34:31.940Look, the supply chains are a matter of national security.
00:34:36.580The debt is a matter of national security.
00:34:38.780The border is obviously a matter of national security.
00:34:41.200But most importantly, these district attorneys and judges that have been planted by foreign interests and globalist agendas like George Soros' is a matter of national security.
00:36:56.020Dr. Sean and the guys over at Jace Medical have set up a business around the threat of the supply chains.
00:37:01.680But the Chinese Communist Party, don't get caught sideways at all about your medicine, and particularly about active pharmaceutical ingredients.
00:37:09.580Remember, the Chinese Communist Party are quite strategic.
00:37:12.080They got the grip on that, and they know they got the grip on it.
00:38:01.700I'm going to autograph all these books, and if you order, your orders today that you do to help all my employees, my call center employees,
00:38:10.200if you order by phone, I'm going to send this to you free with your order, and then your whole order is going to also ship for free.
00:38:19.880So this call-in special is just exclusive to the War Room.
00:38:23.240You guys have had my back and have my company's back, and we're so grateful.
00:38:28.120And so call in all those operators at home.
00:38:31.000These are stay-at-home moms and fathers across our country, and you guys, they've thanked you over and over, and this is a way we can thank you.
00:41:08.180So make sure before you leave, make sure you tell the president the war room's got his back and the war room posse's really worked up about this.
00:41:14.360And you know, he's always upbeat, you guys.
00:41:36.460There you have the, that's the, for those of you who had not had the pleasure of going to Mar-a-Lago, that is right there.
00:41:43.920Those are those huge doors when you come around the, kind of gets the circular driveway up to the front.
00:41:49.520That's where President Xi of China, that's where the dignitaries all get dropped off.
00:41:54.460And President Trump meets them right there.
00:41:56.280And then you go into this foyer and then you go into this magnificent kind of reception hall.
00:42:00.680It is one of the most extraordinary pieces of architecture in this country.
00:42:07.000It is like it was, you think you're in something that was built in Florence at the height of the Middle Ages with all the craftsmanship that came from the Renaissance.
00:42:18.120I mean, it's just, it is absolutely a stunning building.
00:42:20.940And it kind of goes back to what happened today.
00:42:23.080Remember the geniuses at, that did this.
00:42:38.400And that's a crime, not just about our form of a free market capitalism.
00:42:42.980It's just not against the customs and traditions of this country.
00:42:46.880I mean, even Katie Turr and we knew Katie from the 16 campaign and then the White House.
00:42:52.340And, you know, Katie's, I think she's the first to admit she's a liberal progressive, but she's a, she's a pretty good newscaster, got a good show.
00:43:00.040I mean, Katie Turr sat there and she goes, hey, hang on for a second.
00:43:03.340How much time has this law really been applied to anybody in at this scale?
00:43:24.740No, the banks could have made more money.
00:43:27.300Well, that's still, you know, as a guy that came out of that profession, I don't think that's been proven.
00:43:32.980And I got to tell you, I don't know any banker that would say that it's really proven because it would actually be a breach of fiduciary responsibility by the banks not to have their due diligence.
00:43:44.860Remember, when President Trump and those guys give a valuation, and my point is, the judge here valued Mar-a-Lago at, what, $18 million?
00:43:53.920This is an irreplaceable jewel of American architecture in Palm Beach.
00:44:00.680I mean, the setting is absolutely stunning.
00:44:02.760It's on this beautiful, it's right on the beach as you come down from Palm Beach proper, and then you kind of go around the circle where Mar-a-Lago really is the pivot.
00:44:11.320And then you go down all the way to the Four Seasons and the other hotels.
00:44:16.260In fact, many billionaires live right there on the, right there, you know, one of the billionaires, Ken Griffin, has, I think, bought five houses and trying to put them together for something that will never be what Mar-a-Lago is, will never be what Mar-a-Lago is.
00:44:30.840And I think they valued that, it's, I don't know, $500 or $600 million, $700 million.
00:44:35.480This just shows you how much out for President Trump is, but just in the logic of it, if the banks are doing their due diligence, because remember, they all had consultants, they all have advisors, and the bankers themselves do the due diligence.
00:44:48.140When you're doing these type of transactions, of course, the company presents you with all types of things.
00:44:55.220They're ideas of what things are valued at, real estate valuations, asset valuations.
00:45:00.200You get that when you do financings, this is exactly what you do, and what do you do is you get some consultants, you get advisors, but you also do your own work and run your own numbers, and you run perturbations, one perturbation after other after other.
00:45:13.580And you do all the discounted cash flows, you argue, you look at contemporary what's going on.
00:45:18.260These banks were not a bunch of rube community banks.
00:45:21.600These are the most sophisticated banks in the world that did these types of transactions all the time.
00:45:26.940No, it is just a bald-faced lie, and even when they do the calculations, no banker complained here.
00:45:34.200No banker gave testimony that they get ripped off.
00:45:45.980They took what is normal course of business that happens every day in every major city in this country,
00:45:51.520in the valuation of real estate properties and the financing of record – is that a 10-minute – okay, I'm getting a sign of 10 minutes.
00:46:00.280But, hey, we're on Mar-a-Lago time, so it might be 10 minutes, it might not.
00:46:06.360He may be timing it because Tish James, big Tish James, the boss of New York, and she is the boss.
00:46:14.080She's supposed to be on 6 o'clock live.
00:46:17.380We're going to be taking that on our follow-up show.
00:46:19.520I want to really thank Real America's Voice, particularly Real America's Voice that's laying its blow brakes here when we have these kind of live things.
00:46:26.300Also, I've got to give a shout-out to Rob Sick.
00:46:29.840It kind of got buried today when we made the announcement.
00:46:32.140We're very honored to make the announcement here today on the morning show.
00:46:36.400But the vice presidential poll – remember, CPAC's known as having a presidential poll.
00:46:40.760And this year, I think Matt Schlapp and Mercedes – and maybe I recommended it – I know some other people talked to them.
00:46:46.060They came to the decision that, hey, maybe we had the VP poll this year because, obviously, you don't need to – the primary was over before it started.
00:46:53.800In fact, the phony primary is one of the reasons that Ronna McDaniel – now, I think, the Washington Post had the definitive story out by Josh Dawsey.
00:47:02.800And I think Ashley Parker did a story this morning, and it gave – went to a lot of insights, quite frankly, what the war room had done to take the trenching tool and dig her out with Charlie Kirk and Turning Point Doves and, of course, many, many, many others.
00:47:16.320But in getting lost in that, I think – and by the way, so Rob Sick and these guys are doing the VP situation.
00:47:23.180They're going to back the poll, and I think that's just tremendous.
00:47:25.780I just really want to thank Real America's Voice for stepping up here because you're going to have every – I think virtually all the vice presidential candidates are going to speak at CPAC.
00:47:34.820And what we're going to try to do is corral as many as possible and be on our live show.
00:47:38.440If we can't get them, they'll be up there for Charlie Kirk and Post and other people that will happen with them.
00:47:47.660As we go to the top of the hour, when we come back, we're going to have two.
00:47:52.160We're going to have Tish James, and we're going to have President Trump, of course, we're going to take President Trump and hear his remarks.
00:47:58.160I would hope if he's running a few minutes late, he might let us all see what Tish James had to say, and then he could jump in there and respond.
00:48:06.380I know he's probably very worked up on this.
00:48:08.900And the reason is, like I said, this is normal course of business.
00:48:12.000This is absolutely, without a doubt, absolutely, without a doubt, one of the worst things that I've seen.
00:48:19.200Is that Ben – did I say Ben Berquam?
00:56:05.980I got an emergency medication kit from them.
00:56:09.660The FDA just declared a global shortage of medication and warned that critical antibiotics are in extreme short supply across the United States.
00:56:16.980But you know that because you're a viewer or listener of this show.
00:56:21.900Now, here's the action you can take to correct.
00:56:24.860Do yourself and your family a favor and get your Jace case right now.
00:56:29.080It's a pack of five prescription antibiotics you'll have on hand for common emergencies.
