00:00:33.120 Nevertheless, the procedural nicety you're talking about is two justices said, well, this is an administrative stay,
00:00:40.880 which means basically a stay to consider whether to grant a stay that the Fifth Circuit entered without any kind of reasoning.

00:00:52.920 That's questionable whether they don't normally review.
00:00:55.640 But the bigger answer is so what?
00:00:59.320 This is the Supreme Court of the United States.
00:01:01.480 They've left the situation on the ground that Texas can violate current constitutional law.

00:02:59.820 And we asked and we're honored to have Attorney General Ken Paxson from Texas.
00:03:04.460 So, General Paxson, we had Todd Benson on yesterday's morning.
00:03:08.460 And we spent a whole half hour, I guess, on the first day.
00:03:11.220 Then the Supreme Court puts this decision out in the afternoon.
00:03:14.460 They're melting down on MSMEC, as you saw.
00:03:16.800 Then later last night, another reversal by another appellate court.
00:03:21.920 I am now totally and completely corn-fused about this.

00:03:33.360 So, we originally, this law was passed and it went into effect March 4th.
00:03:38.400 Before that happened, Judge Ezra, a district court judge, where the Biden administration sued us to stop SB4 from going into effect, which allows us to deport people that come here illegally, because the federal government clearly is not doing that.

00:03:54.820 Then we appealed it to the Fifth Circuit.
00:03:57.080 The three-judge panel there took the stay off.
00:03:59.600 It was called an administrative stay.
00:04:01.880 So, there was still sort of a stay on, waiting for the Supreme Court to rule.
00:04:06.040 The Supreme Court then said, no, we're not going to keep the stay.
00:04:09.880 So, they took the stay off.
00:04:11.740 It goes back down to the Fifth Circuit.
00:04:13.260 A different three-judge panel, Priscilla Owen and a more liberal judge, took the stay back off and then asked us to argue the case this morning at 10 a.m.
00:04:23.360 So, it's going to happen in an hour.
00:04:27.180 We'll be arguing that case with less than, I think, 12 hours notice that we're arguing about the stay.
00:04:32.220 And I'm not quite sure exactly where we're at on that because they took it off and I'm not sure why we're arguing about it.

00:04:39.480 So, where does that put us – if you – let's say you argue today and they take the stay off.

00:05:37.460 And every state in this country, none of them would have joined the union if they were subject to being invaded and they were told, well, because the federal government's not going to do anything.

00:05:54.340 Just make the case why is what you're doing, which seems very practical to people, why is it constitutional?
00:06:01.700 So I believe that it's constitutional because the founding of our country, there's no way that Texas would have come into the union if they were told by the federal government, look, we have these laws.

00:06:13.980 But if we don't and we decide we're not going to protect you or we might even help the other side, we might help Mexico invade you, you can't do anything about it once we have these laws in place that say we're going to protect you.

00:06:29.420 There's no way that the original colonies come together and say, oh, yeah, if the federal government decides not to protect us for some crazy reason, which we have here, then we can't defend ourselves.

00:06:42.840 So it cannot be that the founders meant when they wrote the Constitution that if the federal government passes laws that somehow we're preempted from protecting ourselves, especially when you look at the damage that's being caused, the drugs and the potential terrorism and the crime, it's all proven.

00:07:01.740 Where do we actually stand now practically with Governor Abbott yourself, with the wire, the State National Guard, the Texas Rangers, the DPS?

00:07:33.040 But practically speaking, since that case, since the injunction got taken away, Border Patrol, federal government, none of them are cutting down our wire or fence, and we continue to put it up to protect our state.

00:07:54.140 But Biden, who's saying that he's doing everything possible he can to make sure he secures the border, that's his campaign pitch.
