00:00:31.740 And it relates to the point I was going to make to the Chief Justice about the breadth

00:00:35.520 The kind of built-in limitations or the things that I think would potentially suggest that
00:00:40.020 many of those things wouldn't be something the government could charge or prove as 1512
00:00:44.340 C2 beyond a reasonable doubt would include the fact that the actus reus does require obstruction,
00:00:49.520 which we understand to be a meaningful interference.
00:00:52.180 So that means that if you have some minor disruption or delay or some minimal outburst, we don't
00:00:57.180 think it falls within the actus reus to begin with.
00:00:59.180 My outbursts require the court to reconvene after the proceeding has been brought back
00:01:07.740 into line.
00:01:09.900 Or the pulling of the fire alarm, the vote has to be rescheduled.
00:01:15.840 Or the protest outside of a courthouse makes it inaccessible for a period of time.
00:01:22.840 Are those all federal felonies subject to 20 years in prison?
00:01:25.840 So with some of them, it would be necessary to show nexus.
00:01:28.840 So with respect to the protest outside the courthouse, we'd have to show that yes, they
00:01:32.840 were aiming at a proceeding.
00:01:33.840 Yeah, they were trying to stop the proceeding.
00:01:35.840 Yes.
00:01:36.840 And then we'd also have to be able to prove that they acted corruptly.
00:01:38.840 And this sets a stringent mens rea.
00:01:40.840 It's not even just the mere intent to obstruct.
00:01:42.840 We have to show that also.
00:01:43.840 But we have to show that they had corrupt intent in acting in that way.
00:01:47.840 We went around that tree yesterday.
00:01:48.840 I know.
00:01:49.840 I heard the argument yesterday.
00:01:51.840 But I guess what I would say is that to the extent that your hypotheticals are pressing
00:01:55.840 on the idea of a peaceful protest, even one that's quite disruptive, it's not clear to
00:02:00.840 me that the government would be able to show that each of those protesters had corrupt intent.
00:02:03.840 So mostly peaceful protests that actually obstructs and impedes an official proceeding
00:02:09.840 for an indefinite period would not be covered?
00:02:11.840 Not necessarily.
00:02:12.840 We would just have to have the evidence of intent.
00:02:14.840 And that's a high bar.
00:02:15.840 They intend to do it all right.
00:02:20.840 This is the primal scream of a dying regime.

00:03:34.840 Julie, your assessment on Fisher, was it Fisher versus the United States?
00:03:38.840 Give me your assessment.

00:03:40.840 So Joseph Fisher, one of 350 J6ers now charged with what they call obstruction of an official
00:03:47.840 proceeding, 1512 C2.
00:03:48.840 This case finally made it to the Supreme Court.
00:03:51.840 Oral arguments were this morning.
00:03:54.840 I was a little disappointed in the representation for the J6ers.
00:03:59.840 I think he kind of stumbled out of the gate on one of these terms in this fake statute.
00:04:04.840 Otherwise, kind of separating part one of the statute to part two, which is 1512 C2.
00:04:12.840 But look, the government, the DOJ, has weaponized the statute.
00:04:16.840 It's post Enron, Arthur Anderson scandal, destruction of evidence or destruction of records statute
00:04:26.840 that now is trying to, the DOJ is trying to turn these protesters into lifelong felons.
00:04:33.840 And they've been very successful and throw them behind bars.
00:04:35.840 So anyway, oral arguments today.
00:04:37.840 I think the majority of justices expressed a great deal of skepticism as to how DOJ has
00:04:46.840 misinterpreted intentionally the vague language of this statute.
00:04:50.840 And hopefully, the Supreme Court will come back and overturn how the DOJ has used this,
00:04:56.840 not just 350 J6ers, but of course Donald Trump as well, that this statute was never intended
00:05:02.840 to be used in the way it has been.
00:05:05.840 It never has been before.
00:05:07.840 And as Elizabeth Preligar there said, it won't be in the future.
00:05:12.840 This only relates to Americans who protested Joe Biden's election for a few hours more than
00:05:17.840 three years ago.
00:05:20.840 How did the how did we actually get here?
00:05:23.840 Walk me through.
00:05:24.840 Give me a minute on how they actually took this post Enron about destroying documents.
00:05:30.840 What backflips did they have to do to actually make this one of the biggest charges they brought
00:05:36.840 against the J6ers?
00:05:39.840 Well, you will recall, of course, Steve, that 1512C2 is an Andrew Weissman specialty.
00:05:45.840 This is the obstruction charge that represented about half of Robert Mueller's final report
00:05:51.840 in 2019 for imaginary Russia collusion and that Andrew Weissman sort of wanted the DOJ to
00:05:58.840 pursue obstruction of an official proceeding, meaning various investigations, meaning the
00:06:04.840 Robert Mueller probe against Donald Trump and others.
00:06:07.840 And others that was unsuccessful.
00:06:09.840 But they were very successful here.
00:06:11.840 And I'll tell you why, Steve, because you have at least 17 judges, D.C.
00:06:16.840 judges on the district and appellate court who have put their imprimatur on the DOJ's intentional
00:06:23.840 abuse of this statute.
00:06:25.840 And I really want to emphasize that the judges here are the villains.
00:06:30.840 There was only one judge, Trump appointee Carl Nichols, who dismissed this count against
00:06:36.840 Joseph Fisher and two other J6 defendants saying that, you know, parsing various parts of the
00:06:43.840 statute, but basically saying it was never intended to be used this way, which, of course, it wasn't.
00:06:47.840 So this is how this case finally got to the Supreme Court.
00:06:51.840 But every other judge who considered a motion to dismiss filed by a defendant denied those motions,
00:06:58.840 giving the green light to DOJ to continue to bring this charge.
00:07:02.840 Steve, even in the face of the Supreme Court oral arguments today,
00:07:07.840 Matthew Graves, the D.C. U.S. attorney, indicted a man from California on this count just last week.
00:07:12.840 So they are completely thumbing their nose at the Supreme Court.
00:07:16.840 And I hope that that's some consideration that the justices will give in terms of how
00:07:23.840 they are going to overturn and reverse this.
00:07:26.840 Or will they, too, put their imprimatur on this then escalating the slippery slope of taking
00:07:33.840 vague criminal federal statutes to, you know, criminalize political dissent, especially only, really,
00:07:41.840 those on the right?
00:07:45.840 Julie, hang her for one second.
00:07:46.840 We're bringing Mike Davis into this conversation.
00:07:48.840 Mike, I noticed that Andrew Weissman is not wall to wall.
00:07:52.840 They're talking about Trump's trial.
00:07:53.840 They're not talking about this.
00:07:54.840 That means that MSNBC must not be totally happy with what happened to the Supreme Court today.
00:07:59.840 What's your assessment?
00:08:02.840 Well, first, I think we all owe a great deal of thanks to Julie Kelly for her constant
00:08:09.840 and dogged reporting on this for several years now.
00:08:12.840 It was really Julie Kelly who brought this to the forefront.
00:08:15.840 And I'll tell you, as a former clerk on the Supreme Court, they have discretionary review.
00:08:21.840 They don't have to take these cases.
00:08:23.840 And they don't take cases that are dogs.
00:08:26.840 This is an important case because what the Supreme Court is likely going to do is reverse these criminal convictions
00:08:33.840 for these January 6th defendants who have been persecuted.
00:08:39.840 They've been persecuted.
00:08:40.840 They have been persecuted by the Biden Justice Department.
00:08:44.840 The Biden Justice Department has intentionally misread this post-Enron statute,
00:08:49.840 this vague and overbroad statute that deals with destruction of records in the corporate setting.
00:08:56.840 And the Biden Justice Department has used this statute to go after political enemies.
00:09:02.840 These judges on the D.C. District Court, the judges on the D.C. Circuit are a disgrace.
00:09:09.840 And it's not just the Democrat judges.
00:09:11.840 It's both parties.
00:09:12.840 They have been a disgrace.
00:09:13.840 And even in the face of the imminent reversal of these criminal convictions by the Supreme Court,
00:09:20.840 which could be a six to three or more ruling, you're seeing these prosecutors like Matthew Graves.
00:09:27.840 You're seeing Jack Smith, who brought these obstruction charges, two of the four charges against Trump relate to 15-12.
00:09:34.840 You're seeing these judges, they're going to pretend like this reversal never happened.
00:09:39.840 They're going to come up with other ways to continue to go after these January 6th defendants with even harsher sentences.
00:09:46.840 And they're going to say, Jack Smith's going to say, he's already saying that the Supreme Court's reversal
00:09:51.840 that's probably going to happen before the end of June doesn't apply to Trump's charges.
00:09:55.840 The Supreme Court needs to very broadly and forcefully reverse these convictions.
00:10:00.840 I think the Supreme Court should strike the whole statute because it's so vague and overbroad,
00:10:05.840 and it's been politicized and weaponized against political enemies.
00:10:10.840 Hold it, give me that again.
00:10:12.840 You think they're already laying the groundwork for why they're just going to ignore what the Supreme Court rules here,
00:10:18.840 unless they're very broad and specific?
00:10:22.840 No question. These judges are...
00:10:25.840 The prosecutors, Matthew Graves, Jack Smith, these Biden prosecutors, along with these D.C. judges,
00:10:31.840 are making it very clear that even if the Supreme Court reverses several hundred criminal convictions
00:10:37.840 of these January 6th defendants under 1512, these prosecutors, these Biden Democrat prosecutors and these judges are going to find other ways to punish these January 6th defendants.
00:10:48.840 Julie Kelly can jump in here. She knows she's been reporting on this for a while.
00:10:53.840 Julie, your thoughts on that, on Mike's comment?
00:10:58.840 So, Mike, first, thank you. Mike's such a good friend, and thank you for your kind words there.
00:11:04.840 But Mike is exactly right, and we've been reporting on this.
00:11:07.840 Matthew Graves not only continues to bring indictments with this charge, but he and the other judges are trying to figure out how to further enhance, expand the prison sentences.
00:11:21.840 If this charge is dropped in most January 6th cases, and you have over 100 who have been sentenced to prison time, some are in prison right now.
00:11:29.840 A few judges have released them pending this Supreme Court reversal.
00:11:34.840 But what Matthew Graves and these judges are signaling is, okay, well, they'll come back.
00:11:39.840 They'll ask, you know, we're going to drop this count, which will dramatically reduce their prison time if they have other charges like misdemeanors or civil disorder.
00:11:49.840 This obstruction felony is the animating sentencing element that continues to add prison time.
00:11:57.840 So if it's dropped, then you have J6ers who are like, okay, well, six to 12 months in prison, oh, not so fast.
00:12:02.840 These judges are already warning, if you come back and ask to be resentenced for this, we're going to add what they call upward departures.
00:12:11.840 We're going to look at your social media and your comments that you have made since you either pleaded guilty or were convicted.
00:12:18.840 We're going to look at other sentencing enhancements.
00:12:21.840 The appellate court, Steve, just a few weeks ago, actually last month, overturned an enhancement that the government and these judges were adding to 1512C2 convictions.
00:12:32.840 The appellate court, believe it or not, Democrats came back and said, no, no, no.
00:12:36.840 This does not relate to obstruction of official proceeding.
00:12:40.840 So these judges are now signaling, okay, well, we'll have to drop that enhancement.
00:12:44.840 But they have a whole menu of options in terms of extending prison time.
00:12:50.840 So even if it's a misdemeanor, they can figure out a way, okay, this person has been sentenced to prison for 36, 40 months on the obstruction count.
00:12:59.840 We have to drop that.
00:13:00.840 He's got four other misdemeanors.
00:13:02.840 That should be six to 12 months.
00:13:04.840 But we're actually going to stack those sentences.
00:13:07.840 They're not going to be serving them at the same time, which is how they usually do it.
00:13:13.840 They're going to have to be stacked consecutive on top of each other so they can keep these people in prison.
00:13:19.840 Because, Steve, instead of coming clean these 17-plus judges and Matthew Graves and these prosecutors, instead of saying, yeah, you're right, okay, we're caught by the Supreme Court.
00:13:30.840 We made one of the biggest prosecutorial abuses in American history to do this and create this class of political prisoners and turn Trump supporters into lifelong felons, stripping them of their rights and putting them behind bars.
00:13:44.840 Oh, no.
00:13:45.840 They are not going to show any measure of apology or regret that they've done this.
00:13:53.840 They are already maneuvering how they are going to get away with this and how they're going to add other sentencing enhancements and maybe even add other charges if this charge is dropped.
00:14:05.840 It is really so evil and malicious what happens in this D.C. courthouse between these prosecutors and judges, and this includes Trump judges.
00:14:14.840 You had Judge Tim Kelly recently when this enhancement was dropped saying, well, but we still have to think of an obstruction enhancement.
00:14:24.840 We can't just let these people get away with it, actually flouting what the D.C. appellate court had said.
00:14:30.840 They are a rogue bench in Washington, D.C., and I hope the Supreme Court has been paying attention to how they are planning to get around a full reversal or overturning of how they've abused 1512C2.

00:17:24.840 Do you see the same type of thing, a kind of a conspiracy to basically punish people that were exercising their First Amendment right?
00:17:34.840 I mean, I would not be surprised whatsoever if there was extensive communication between these judges and their staff and the DOJ, particularly DCUS Attorney Matthew Graves' office.
00:17:48.840 It would not surprise me a bit.
00:17:50.840 But of course, we know that DOJ was working with the January 6th committee and sharing evidence.
00:17:57.840 And in some cases now the J6 committee concealing or destroying evidence.
00:18:02.840 So but the relationships, the cabal that exists in Washington, D.C., when you have, say, a judge, Florence Pan, who we've talked about, who it's her opinion that was discussed today in the Fisher case in a 2-1 decision.
00:18:19.840 She wrote the opinion upholding 1512 C2 in these J6 cases.
00:18:25.840 Her husband, Max Steyer, is not only a Brett Kavanaugh accuser, but he's a very influential Democrat Party activist who's working hand in glove with the Biden White House right now to prevent Donald Trump, if he wins, from instituting this civil service reform that you know about, that he wants to be able to fire at will thousands of government employees.

00:18:52.840 Then you have Matthew Graves, his wife, also a very influential left-wing Democrat Party activist.
00:19:01.840 She runs a $100 million nonprofit, the National Women's Law Center.

00:19:10.840 Her name, Fatima Goss Graves, as her husband is flouting, thumbing his nose at the Supreme Court oral arguments, continuing to bring this charge,
00:19:18.840 even though it might be reversed.
00:19:20.840 She's part of a broad coalition demanding that Clarence Thomas step down from the Supreme Court.
00:19:26.840 This is the kind of incestuousness that happens in the nation's capital.
00:19:31.840 I could think of probably another half dozen examples.
00:19:34.840 But, of course, the judiciary working hand in glove with Congress, working with the Department of Justice.
00:19:41.840 That has happened before.
00:19:43.840 It's happening before our very eyes.
00:19:46.840 And that's why it's imperative, like Mike Davis said, that the Supreme Court put an end to this.
00:19:53.840 And put an end to it in very strict, unwavering terms.
00:19:58.840 This is not what this statute was intended to do.
00:20:01.840 January 6th and congressional business is not a quote unquote official proceeding.
00:20:07.840 This does not apply to 1512.
00:20:10.840 The entire code right there deals with tampering with witnesses and informants and talks about judicial proceedings or investigations or trials.
00:20:20.840 It's not talking about certifying the electoral college.
00:20:23.840 They need to be extremely clear that this is not what the statute means and that January 6th was not an official proceeding.
00:20:32.840 There was no record destruction involved and that the second half of the statute relates to the first, which would support this record mutilation or destruction part of the statute.
00:20:45.840 They need to be extremely clear if they come out with a muddled opinion.
00:20:50.840 This will only embolden the Department of Justice, not just to keep this charge, but to punish anyone who has already been released from prison or has delayed their sentencing or delayed trials on this.
00:21:04.840 They are a vengeful, reckless, bloodthirsty cabal that exists there.
00:21:13.840 And I've seen it firsthand.
00:21:16.840 It's really sickening.
00:21:17.840 And they will punish these people if the Supreme Court gives even a little tiny inch to DOJ and the courts for related to the statute.
00:21:27.840 Julie, where do people keep up with your reporting?
00:21:31.840 Like Mike said, you have been the patriot that's been here for years doing this.
00:21:36.840 And so much of this would of the even possibility of setting these wrongs right would never have happened without your doggedness, stick-to-itiveness and just good old fashioned grit.

00:22:51.840 These are the people that looked at being on the Supreme Court one day.
00:22:54.840 Kavanaugh came out of here.

00:22:57.840 I mean, are you, as you look at it as a professional, is Julie Kelly right?

00:23:11.840 And I would say to these federal judges, particularly these federal judges in DC, when you take off your judicial robes and you climb into the political arena, expect to take political punches.
00:23:27.840 And we've been doing that at the Article III project with our judicial misconduct complaint against a federal judge like Reggie Walton, who thought it was a good idea to go on CNN, on Caitlin Collins' show, and trash a criminal defendant going through the criminal process.
00:23:46.840 You saw this with this Democrat judge, who used to be the chief judge, Elise Stefanik, the great congresswoman from New York, filed a judicial misconduct complaint for her for having some women's powwow speech, political speech, trashing Trump.
00:24:04.840 Trump, these judges in DC have crossed a red line by being political.
00:24:11.840 And what they've done to the January 6th defendants is inexcusable.
00:24:15.840 President Trump is a billionaire, former, and likely future president of the United States.
00:24:21.840 What they are doing to him is highly destructive to our country.
00:24:24.840 They've crossed the Rubicon, but President Trump has the resources to fight this.
00:24:29.840 These January 6th defendants do not.
00:24:32.840 And if they can do this to President Trump, just imagine what they can do to the rest of us.
00:24:36.840 Just see what they're doing to these January 6th defendants, where they are taking what was a lawful protest permitted by the National Park Service and devolved into a riot.
00:24:45.840 And the Biden Justice Department, along with these partisan Democrat judges and these cowardly, sanctimonious Republican judges in DC, have tried to destroy their lives.
00:24:57.840 They've contorted federal criminal law unconstitutionally illegally to go after them.
00:25:03.840 And this is a criminal conspiracy under federal law.

00:25:09.840 It's a criminal conspiracy against rights where these prosecutors, these judges, these other Democrat operatives, and frankly, even Republican operatives, these anti-Trump forces have gone after Trump.

00:34:12.840 And they used leftist talking points about how these people want to do the jobs that Americans don't want to do.
00:34:17.840 And then he started telling me that these, you know, third world invaders who don't even speak English were going to grow up to be the Elon Musks of the world.
00:34:24.840 So there really is a distortion of reality and delusions of grandeur among many of these invaders who are coming into our country.
00:34:32.840 They seem to think that they're all going to be intellectual geniuses and tech billionaires and that they're going to be, you know, making amazing advancements for Western civilization.
00:34:40.840 And it's the question I ask them is, well, if you're such a genius and you're, you know, you have such high expectations of yourself as an invader, why are all of your countries some of the poorest and most underdeveloped countries in the world?
00:34:52.840 Shouldn't you be staying where you came from and be fixing fixing your own country for your own children and your own grandchildren instead of polluting my country?
00:35:00.840 What is, tell me about this, there's another pro-Palestinian protest tomorrow.

00:40:14.060 Number two, it's terrible for Republican prospects this fall if the American people don't see us keeping our word and fighting for the border, if they don't see us fighting for them once again.

00:40:27.660 And we just laid it all out there, and we talked with him about what we see as the right path forward, which is to separate Israel aid and to prioritize that, pay for it.
