00:01:50.000Talk to us about what's going to happen in the court today on this historic argument about presidential immunity.
00:01:57.000So this is oral arguments in Donald J. Trump versus the U.S.
00:02:02.000And this relates to lower court rulings in Washington, D.C., one by Tanya Chutkin, an Obama appointee,
00:02:09.000and another three-judge panel, which had two Biden appointees on it, that for the first time argued and concluded that it's a ban-based criminal prosecution in the office.
00:02:22.000So this has been a litigation release since last October.
00:02:27.000Donald Trump's lawyers filed a motion to dismiss last October.
00:02:31.000Jack Smith's four-count indictment related to the events of January 6th and overturned the 2020 election.
00:02:38.000Two months later, Judge Chutkin handed down her historical ruling saying that presidents are not protected by immunity to hand-based prosecution.
00:02:48.000That was the appellate court in January.
00:02:51.000And a month later, this is how quickly this has all transpired.
00:02:55.000A month later, this three-judge panel, two Biden appointees, upheld Chutkin's decision.
00:03:00.000And that is what the justices will hear about today.
00:03:06.000Okay, Julie's going to join us at five with her assessment.
00:03:09.000You're coming in a little broken on the phone, so we'll let you...
00:03:11.000Julie, where do people go right now to follow your Twitter feed?
00:03:14.000You're going to be giving real-time, because you can hear the arguments on the audio, but obviously no cameras.
00:03:20.000You're going to be giving real-time commentary.
00:03:24.000So people can follow along on my Twitter, Julie underscore Kelly too.
00:03:29.000And that's where I will be live tweeting.
00:03:32.000The proceedings are available on C-SPAN and also the Supreme Court website.
00:03:36.000And then I will get you guys up to speed later tonight about what the arguments involved.
00:03:41.000Last thing before we go, the true criminal, the heart of the criminal conspiracy as you've unveiled it, a center of that is Jack Smith in this Florida situation.
00:03:54.000Have you heard any Republican voices at all coming out to go buck wild on this as a criminal conspiracy?
00:04:01.000Has anybody backed your or asked you for your, you know, the unredacted version that you've been putting out that's so powerful?
00:15:11.500The cost of goods continues to rise despite interest rate controls by the Fed.
00:15:17.500Since January 2021, cost of living is up 18%.
00:15:21.500The national debt continues to skyrocket now significantly north of $34 trillion, causing many to worry when the House of Cards will come crashing down.
00:15:33.500And a presidential election year that will have massive implications on the future of this country.
00:15:39.500All this adds up to instability and uncertainty.
00:15:43.500And that is why so many Americans are turning to Birch Gold Group.
00:15:46.500Have you diversified your savings yet?
00:15:49.500Secure a portion of them with gold from Birch Gold Group.
00:15:53.500Secure a portion of your savings now with gold and do it from Birch Gold.
00:15:58.500Text BANNON to 989898 and get your free information kit.
00:16:04.500You'll learn how to convert an existing IRA or 401k into a tax sheltered IRA in gold.
00:16:11.500And it doesn't cost you a penny out of your pocket.
00:16:15.500With an A-plus rating with the Better Business Bureau and tens of thousands of happy customers.
00:18:24.500It looks like an MSNBC correspondent behind me.
00:18:29.500We are reporting today for the Supreme Court on this historic case before the Supreme Court on whether the President of the United States is immune from criminal prosecution for his official acts.
00:18:41.500And so it's going to be a monumental case.
00:18:44.500The case is going to affect many more presidents than President Trump.
00:18:48.500This is what these Democrat operatives need to understand, is that if President Trump is not immune from criminal prosecution for his official acts, does that mean the Trump 47 Justice Department can prosecute President O'Biden for his extrajudicial drone strike on two American citizens, including a minor?
00:19:09.500Does that mean the Trump 47 Justice Department can prosecute now Judge David Barron on the First Circuit Court of Appeals, who was President Obama's legal advisor at the time for assisting President Obama with that drone strike?
00:19:24.500Can the Trump 47 Justice Department prosecute President Biden for his illegal mass parole of 10 million illegal immigrants into our country and the resulting crimes?
00:19:36.500Can the Trump 47 Justice Department prosecute President Bush 43 and Vice President Cheney for their reckless reliance on faulty, reckless reliance on faulty intel at best, most charitably, and the resulting murder of 100,000 Iraqis?
00:19:56.500And this is why it's critically important that the Supreme Court holds that presidents of the United States, like members of Congress, like federal judges, are immune from prosecution for their official acts.
00:20:09.400We're in a lot of our audience is also doing two screens today.
00:20:15.800They're watching Julie Kelly's Twitter feed as you hear the audio of the arguments.
00:20:21.620Just can you summarize, what is the government going to argue?
00:20:24.320Why are they going to argue that Trump doesn't have immunity and has to stand trial for J6?
00:20:31.680Well, I couldn't hear you over our friend behind me, but I – so I think what – Julie Kelly, is she talking about the Fisher case?
00:20:40.480Or is she talking about how the immunity is so –
00:20:42.480No, no, no. What is the government – yeah, what is the government going to argue today about why Trump doesn't have immunity?
00:20:48.740What is their – what is their central argument?
00:20:50.780Well, their central argument is that there's not immunity spelled out in the Constitution explicitly or by statute.
00:20:58.860But my response to that would be there's not immunity spelled out explicitly for federal judges in the Constitution or the statute.
00:21:06.740It is part of – it is part of the separation of powers.
00:21:12.020And if you allow a – if you allow a president of the United States to indict his predecessor for his official acts, you're going to destroy the presidency and therefore destroy our country.
00:21:24.060Mike, I tell you what, we're going to – we're going to go to David's ear.
00:21:29.780I'm going to come back to you later when things maybe slow down a little bit.
00:21:32.920I've got to ask you about why the House is still not moving on any criminal conspiracy given what happened last night in Arizona.
00:21:43.280Obviously, these things, you always have protesters.
00:21:45.340Remember, every time I walk outside of a courtroom, you've got folks there trying to use their First Amendment rights.
00:21:52.820Of course, that doesn't go for shouting down TV broadcasts or otherwise people would be there trying to shout down MSNBC and CNN all the time.
00:22:37.480I think between Gavin Wax and Vish Burra, who I interviewed again this morning – by the way, they should make Gavin Wax the New York GOP leader for the state.
00:22:48.840I'm telling you, these guys are on to something here.
00:22:51.680They're picking winners and great locations to resonate with the American people on what everyday people are going through.
00:23:02.420I don't know if that rally would take place in the Bronx or MSG, but I interviewed social media influencer Lou Valentino today from the Bronx, AOC's district, where 90% went for Biden.
00:23:14.720And they're begging for Trump to come up there.
00:23:34.300And listen, even if he can't win New York State, which is two-to-one Democrat, you know, it's a clarion call for the other inner cities in the battleground states.
00:23:44.740And it could make a difference in this election.
00:23:46.700And while Trump is locked up in this courtroom here, he can only campaign two or three days a week, while Joe Biden's crisscrossing the South, Florida, North Carolina, he raised $2.5 million the other day in Raleigh, North Carolina.
00:24:04.200And that's the election interference going on right now.
00:24:07.980The people of New York saw those incredible images last night of Jim McCarthy, the assistant police chief, had to take refuge in an open door at NYU as throngs of people who were intimidating cops and berating them here.
00:24:26.120So, you know, it's unraveled here in New York City.
00:25:20.320With all the massive federal spending, a trillion dollars every hundred days, the biggest Keynesian stimulus and with the Fed doing the exact same thing and Treasury trying to trying to juice liquidity with all forces, fiscal, monetary, Keynesian, all of it.
00:26:13.040Because he was in New York City yesterday up at Columbia, and then he went on Jesse Waters last night to tell us once again that he's got the smallest majority except when Nancy Pelosi had it and got everything done that she wanted.
00:26:26.040Was Mike Johnson there today, or did he go down to the sticks?
00:26:28.880Was he in front of the microphones to support President Trump in the court case?
00:26:34.800No, and it's a different mindset because Trump goes down the streets.
00:26:41.460When he was on the construction sites and all these epic properties that he built in New York City, along with his father back in the heyday of the Trump organization, you know, they interacted with the construction workers.
00:26:53.380They would stop and ask the concrete workers.
00:28:40.040I want to warn you of a huge change that could be coming to our money and our bank accounts.
00:28:49.580First, think back to 9-11, shortly after the government pushed through the Patriot Act.
00:28:54.000This gave the government power to spy on innocent Americans by monitoring our phone and email and tracking our movement across the Internet.
00:29:01.580Now, Jim Rickards, editor of the independent financial newsletter Strategic Intelligence and New York Times bestselling author, is warning about a coming event that could elevate this governmental surveillance to a terrifying new level.
00:29:15.640In fact, some of the guests I've had on the war room believe that the government will soon expand their powers to track our every move.
00:29:23.040If we say the wrong things on social media, donate to the wrong causes, buy firearms, or even vote MAGA, the government may be able to shut us out of our bank accounts.
00:29:34.060I can't say for sure if this will happen, but it's an interesting and dire warning.
00:29:39.600Fortunately, Jim Rickards, an American patriot and friend of mine, has made it his mission to educate us on what he believes is coming and how to protect yourself from the possibility of programmable money.
00:29:51.920Watch Jim's warning video now, before it's censored like I've been in the past.
00:30:08.300Count two is, and I like this, fraudulent schemes and artifices.
00:30:12.760Count three is fraudulent schemes and practices.
00:30:15.700And counts four through nine are forgery.
00:30:18.140Those last counts having to do, and this is something that we've seen in other places, these individuals, plain as day, attested to something in a document we have access to that they sent to the National Archives that was just simply not true.
00:30:34.540Okay, the criminal conspiracy, and by the way, if we can grab the morning Joe, I want to play that because he was even more, you got to hang her for one second.
00:30:44.460I just want to get Abe in here for a second.
00:30:46.660Abe, this fake attorney general, the phony attorney general in Arizona that is still only up on you by 208 votes, and I think it's what, 9,000 votes they refused to count?
00:31:00.200Is it 9,000 or is it more? They refused to count.
00:31:05.180That 9,000 uncounted ballots, and just last week we had the Court of Appeals deny us a new trial, but we actually had one brave judge who said that we should get a new trial because the government withheld the evidence.
00:31:17.080So we are still fighting that lawsuit.
00:31:19.060We're going to be filing to the Supreme Court very shortly, but we've seen what a weaponized legal system does, and it's a tragedy to the law.
00:31:26.300This is part of the criminal – is there any doubt in your mind, as someone that is actually the legitimate attorney general of the state of Arizona and now is running for the House, is there any doubt in your mind that this is part of a broader criminal conspiracy to basically have election interference against MAGA, MAGA candidates, and MAGA – people that support MAGA?
00:31:51.640Yeah, you'd have to be living under a rock to not know what's going on.
00:31:56.420I mean, this is clearly a fake, illegitimate attorney general.
00:32:00.020I mean, look at how brazen they are, Steve.
00:32:02.320You've got to respect it in some ways.
00:32:04.440She's not even legitimate, and yet she is going after these alternate electors, and now not just them, but going after Trump's team.
00:32:12.840I mean, it's very brazen what's happening.
00:32:15.840I mean, these are high-level felonies, Steve, in Arizona, and almost all of these felonies – I read through the indictments – I mean, these are such broad statutes.
00:32:24.100You know, if somebody wanted to weaponize the legal system, this is exactly what you would do.
00:32:28.600And the timing of all of this is, you know, predictable.
00:32:32.780It's during an election year, right when President Trump's in trial in New York.
00:32:37.240And this is Chris Mays trying to get her fame right now, like Fonnie Willis, like Alvin Bragg, like Jack Smith, like Letitia James.
00:32:45.500So this is a perversion of the rule of law, Steve.
00:32:49.500The reason why I ran for attorney general in the first place at such a young age – remember, I was 30 years old.
00:32:55.700I was running the youngest statewide candidate in the country.
00:32:58.180I would have been the youngest AG since Bill Clinton.
00:33:00.240The reason why I was running is because I predicted this.
00:33:03.420You know, where are these Republicans?
00:34:35.520She's charging these guys in the primary in Arizona, I think, is like three or four months away, where 100 days are just outside of 100 days.
00:34:43.700This is in your grill because they play for keeps.
00:34:48.100When Soros cuts on the check, he wants results.
00:34:50.500He wants Trump in a courtroom in New York.
00:34:53.280Lawfare is working for them, and the reason it's working, as Abe Hommadee said, it's gutless, feckless Republicans that have been the controlled opposition.
00:35:01.460The reason the country's in this shape is in.
00:35:03.200We got a bunch of Marxists as these global elites have taken over the institutions, and you've had nothing but gutless Republicans that have just gone along with it, and they're going along with it right now.
00:35:13.940And Mike Johnson and Jim Jordan, of course, Jim Jordan's staff is saying, oh, please, we've done so much.
00:35:33.860Arizona now becomes the fourth state to file criminal charges against the so-called fake electors that sought to undermine President Biden's victory over Trump.
00:35:46.160They also signed a fake certificate that they posted to social media.
00:35:49.960I mean, they were breaking the law, pretending they were the state's electors when they weren't because Joe Biden had one narrowly bit one broadcasting exactly what they were doing.
00:38:29.300They're the ones who are constantly bringing it up, and they're doing it because they know what they did to the American people.
00:38:34.780And without accountability from Republicans in Congress, I mean, this is why you elect us to the federal government.
00:38:40.900You elect us to the halls of power in Congress, you know, the most powerful legislative body on the face of this earth.
00:38:48.120And if they don't have the ability to put a rein in on this bureaucratic state and this lawfare that's going on with these county prosecutors,
00:38:55.300these are county prosecutors, these are state prosecutors, then what is the point of the federal government?
00:41:26.860Lawfare continues, and it's working, quite frankly, out in Arizona, the vast criminal conspiracy that we'll have more to say about in the second hour.
00:42:36.320We're looking for a number almost a full percentage point higher.
00:42:40.6601.6% of the weakest growth on a quarterly basis going back to the second quarter of 22 when it was negative, minus six-tenths of a percent.
00:42:51.040Consumption, a half a percent weaker than expected at 2.5%.
00:42:55.9002.5% would be the weakest since, by the second quarter of last year when it was 0.8.
00:43:03.240If we look at the price index, it's higher, 3.1%.
00:48:17.160Your sense about how even the numbers they're putting forward are gundect.
00:48:21.060Well, Steve, those weekly numbers that have the unemployment, both initial claims and then also continuing claims,
00:48:29.180they just simply aren't adding up when we look at all of the businesses across the economy that are announcing layoffs on almost a daily basis at this point.
00:48:38.560And there are a couple of theories behind that, one of which is most of the people who are getting laid off are not eligible for unemployment
00:48:45.220because so many of the people that have been hired lately are foreign-born workers who haven't been here long enough to qualify for those unemployment benefits.
00:48:54.460But then there's also the possibility that essentially the models that the Department of Labor are using are just completely wrong.
00:49:01.820And so they're not representing reality.
00:49:04.240But one other thing, Steve, that no one really seems to be talking about, and I'm not sure why, because it's such a big deal.
00:49:09.620The monthly job numbers from the Bureau of Labor Statistics last year estimated that in the third quarter, the economy added some 640,000 jobs.
00:49:20.040But the quarterly survey results that we just got yesterday show over that same period about 190,000 jobs were actually lost on net.
00:49:29.580In other words, job gains were overestimated by over 800,000.
00:49:55.980But basically $600 billion in additional debt to get $300 billion of increased GDP.
00:50:03.140It's not even close to being worth it.
00:50:04.880To even get the phony 1.6, which is anemic growth, there's really no growth, they had to buy that by adding on debt.
00:50:13.440They had to buy that with deficit spending.
00:50:15.180This is the scam that you're currently in.
00:50:18.080And by the way, having to refinance this debt, one-third of that $35 trillion, as EJ and Tony tells you, at higher interest rates with higher inflation, the inflation is only going to get worse.
00:50:28.800This is not going to go – we now have a structural stagflation.
00:50:33.300This is teeing up for a lost decade or more at minimum.
00:50:37.300Minimum, until President Trump comes in and people come in that are hard-headed and say this madness has to stop, it's not going to get – it's not going to stop and it's only going to get worse.
00:50:47.220It's – this is now going to pick up at an accelerating rate.
00:50:50.260EJ and Tony, your closing thoughts and observations, brother.
00:50:53.400Well, Steve, if we look at the difference between how much the federal debt has increased during Biden's tenure versus how much GDP has increased, the debt has grown by 110 percent of the increase in GDP.
00:51:07.680So exactly what you were just saying, all of this supposed economic growth is nothing more than the government borrowing from the future where we're going to have to confiscate an incredibly large amount in taxes in order to make up for, again, the alleged growth that we have today.
00:51:24.860And that's a formula for getting a lost decade as you described it.
00:51:50.360I post all of my daily analyses there of all this data in plain English, and I also post all of the op-eds and articles that I write as well.
00:52:00.060I think I can say the church's loss is the country's gain in this, EJ, the great job you've done.
00:52:04.900I think the Lord's work here, explaining the people, the American economy, and quite frankly, the destruction of this republic through this vast spending.
