In this episode, we discuss the Supreme Court's ruling in the Trump v. Trump impeachment case, and what it means for the future of the case and the possibility of a future Supreme Court case against President Donald Trump.
00:06:52.520And this is what, knowing they couldn't beat Trump, this is what they depended upon.
00:06:57.960And because of heroes, and these people are heroes, the Julie Kellys, the Mike Davises, the Jeff Clarks, and our first guest up this morning, the Mark Paoletas.
00:07:11.520These heroes that put their shoulder to the wheel and say, no, no, no, no, no, no.
00:08:02.680When immunity, when the Clarks and the Paoletas and the Mike Davises, people started working on this immunity thing months ago, you've got to remember, we would play you the highlight reel every night.
00:08:20.780Even the concept of this was mocked and ridiculed.
00:08:25.500You should have seen during the arguments yesterday the faces on the radical left media.
00:08:31.960Because all of a sudden, they got mugged by reality.
00:08:37.420On the 14th Amendment case, they're going to get mugged by reality.
00:08:40.780On the Fisher case, they got mugged in reality yesterday.
00:08:43.380And then, of course, we forced out this report, this interim report, which the President just mentioned when he walked in, he has not had a chance to read it, on Jordan's first cut of just New York, of just having Colangelo and DOJ hardwired into the case, running the case, the architects of the case.
00:09:04.740And Congressman Gooden from Texas, I think, was on Fox this morning.
00:09:07.340Now, he's kind of a backbencher, but he's at least a voice saying, hey, what in the hell is going on here?
00:09:13.380That's, once again, the Jeff Clarks of the world, the Mike Davises of the world, the Mark Paolettas of the world.
00:09:18.800And it was against the longest of long odds.
00:09:22.820And now you're seeing the results of this.
00:09:25.520This is a war to the knife to November, to 5 November, because they win, they steal this and win.
00:09:35.820You are going to see a radical transformation of the federal judiciary.
00:09:47.420One of the fighters that have had the back of so many people and been to the tip of the spear over at Sierra.
00:09:52.560Just give us your assessment, first off, of what happened yesterday and then the full total meltdown of the left-wing media that really focuses.
00:10:01.480And remember, Ari Melber, O'Donnell, Rachel Maddow.
00:10:14.340Great day for the president yesterday, Steve.
00:10:17.100You know, I think the Supreme Court looked at this crazy argument.
00:10:20.640You know, the fact that this is even being argued, the fact that the president's even being prosecuted for this is just deranged, left warfare.
00:10:26.980But this Supreme Court and the justices up there, most of them, said this is going down a dangerous road.
00:10:33.280Of course presidents have immunity for their official act.
00:10:36.080That's been since Marbury v. Madison, this has been established.
00:10:40.260The constitutional structure where they have an impeachment clause that says after impeachment and conviction, then you can be prosecuted.
00:10:46.860But nothing, you know, in terms of your official acts, that is immune and protected, just like the Supreme Court established in 1982, you know, sort of made clear with respect to immunity for in civil actions.
00:11:00.940So I think what as you as you talk about, remember, the left even didn't want the Supreme Court to take this case up.
00:11:08.200Right. They went ballistic when they decided to grant cert on this on this case from the D.C. Circuit.
00:11:12.780And what I find astonishing that even Chief Justice Roberts yesterday absolutely blasted the D.C. Circuit case and, quite frankly, the district court for doing no work and short shrifting this entire argument.
00:11:24.220Right. So they are afraid of the truth. They are afraid of being held accountable by the Constitution.
00:11:30.640And that's what this meltdown is about. You're right. They you know, all the geniuses said it was a slam dunk on the 14th Amendment Section three argument.
00:11:40.460Right. Nine zero. They lost. OK. I think it's at least going to be six three.
00:11:44.740I could even see it's insane to say that the president doesn't have it.
00:11:48.900As the D.C. Circuit said, the president doesn't have any immunity for his official acts for criminal prosecution.
00:11:55.540So, again, thank God, actually. Right. Also for for President Trump appointing those three justices, as I pointed out,
00:12:02.180and you saw Justice Kavanaugh mentioned yesterday in the argument, one of the worst cases.
00:12:07.820Right. One of the worst decisions of the Supreme Court was Morrison v.
00:12:11.640Olson, which allowed federal judges. This is a Congress mechanism to get President Reagan.
00:12:16.960Right. Federal judges to appoint a special prosecutor to investigate the president and prosecute.
00:12:23.540That's the most insane structure and destruction of our separation of powers that the judiciary is setting up prosecutors that are unaccountable to anybody.
00:12:31.240OK. And that law, once it bit the Democrats. Right.
00:12:35.460And Bill Clinton, they wanted it gone and they let it lapse. Right.
00:12:38.760But it was an eight to one decision to uphold that structure.
00:12:42.080And that opinion was written by Chief Justice Rehnquist.
00:12:44.440You had so many Republicans, terrible justices, certainly in terms of their jurisprudence, upholding something like that.
00:12:51.540Flash forward to yesterday and, you know, a Supreme Court with three Trump appointees, Justice Thomas, our greatest justice, our greatest living American, Sam Alito on there.
00:13:03.420They all recognize that this is a rule of law country. The Constitution does protect presidents.
00:13:09.860They want the founders set it up that presidents would be protected in their official actions, what what they're doing in office.
00:13:16.520These split second decisions, these weighty decisions to protect our liberty, our country and the idea that presidents would have to worry.
00:13:25.620As you're seeing today, it couldn't have been a better split screen of a crazy, out of control prosecutor in New York with a bogus case that nobody would bring because it was there was no case there to bring it up during the election year.
00:13:39.780Driven, as you said, this great report by Jim Jordan that just got released yesterday that documents the maniacal single focus effort to get a person, not to enforce the laws, to get a person, that person being President Trump, to destroy him.
00:13:58.220This is the thuggery. This is the Democrats project. Right.
00:14:02.140That's what they do. This is what they do. They use the law. They weaponize the law.
00:14:06.900They weaponize the Justice Department. The Justice Department was weaponized against conservatives, even under a Republican president.
00:14:12.920OK, so, you know, there needs to be a reckoning. OK, the left is out of control with these prosecutions.
00:14:20.680I thought it was a great day as going back to yesterday's argument. I listened to the whole thing.
00:14:24.940You're right. The media was thunderstruck that that actually the Constitution protects the president from his official acts.
00:15:01.620Hey, folks, if you watch War Room, you know, we talk every day about the geopolitical and other forces driving the price of gold.
00:15:07.600There are actually a couple of reasons this is happening. Let me walk through them.
00:15:11.780The cost of goods continues to rise despite interest rate controls by the Fed since January 2021.
00:15:18.940Cost of living is up 18 percent. The national debt continues to skyrocket now significantly north of 34 trillion dollars, causing many to worry when the House of Cards will come crashing down and a presidential election year that will have massive implications on the future of this country.
00:15:39.720All this adds up to instability and uncertainty. And that is why so many Americans are turning to Birch Gold Group.

00:17:19.580And we have a vast conspiracy here that Mike Johnson, you know, Polly Pockets has got to step up.
00:17:25.780You don't need to be running around giving all these speeches and trying to raise money.
00:17:28.880What you need to do is contact a guy named Jim Jordan because their staff is saying that you're suppressing, that you suppress this report.
00:18:21.720And quite frankly, if we hadn't have been, you know, our typical jerk selves here, hammering people every day, not that we want to spend time on that, but sometimes you have to, it would have never seen the light of day.
00:18:36.700So what does Polly Pockets have as an explanation?
00:18:40.960When the president supports him 100 percent, did he mention to the president he had this and he was suppressing it?
00:18:46.060When he briefed the president of Mar-a-Lago, did he ever mention to the president that the Judiciary Committee had a 300-page report that showed, at least in that aspect, a criminal conspiracy to go after, to persecute him?
00:19:01.460I think that's what the headline, I think that's what the title of the report is.
00:19:07.980When he met at Mar-a-Lago, behind closed doors, did Johnson mention to the president what actually Judiciary had and why it had not come out yet?
00:19:18.880Did he mention that he was suppressing it?
00:19:20.740Did he mention that he had other ideas and maybe it shouldn't come forward?
00:19:25.780And curious, inquiring minds want to know because therein lies the rub.
00:19:31.120The Republican establishment does not want Donald Trump to return as president of the United States full stop.
00:19:39.700Their plan is to pick up a couple of seats and control the Senate, to hold the House and pick up a couple of seats, control the House.
00:19:46.280And then in their mind, hey, as bad as Biden is, we got him blocked.
00:19:57.060And then and they look at Pennsylvania with those votes for Nikki Haley.
00:19:59.720They said we can rebuild the traditional neoliberal neocon because we got Fox and we got the stupid talking points and we got still got the RNC.
00:20:07.980We got the stupid talking points and we can just go out there and tell people.
00:20:11.300And eventually, MAGA will acquiesce and people go about their lives of being the proletariat they are and just, you know, working and paying taxes and giving some money to the RNC and giving money to Nikki Haley's 2028 campaign.
00:20:52.400Mark Pallietto is one of the most reasoned, calm guys.
00:20:55.200He was I was honored to be part of this five man committee working group that was were selecting the judges and invading the judges.
00:21:02.680Mark Pallietto is and you truly see he is in the lineage of Justice Thomas and those guys.
00:21:11.340And if you look at the coaching trees like they're doing the NFL, those all those clerks and people that are associated with Justice Thomas, there's something special about these guys.
00:22:31.880But interestingly, Jamie Raskin in for, I think, three or four years, four or five years, didn't disclose that his wife had about a million dollar asset.
00:22:42.700And, you know, and there's the CRA has filed a complaint.
00:25:30.100We're seeing the weaponization of the law like we've never seen before from, you know, Tish James, Alvin Bragg, Fonnie Willis down in down in Georgia.
00:25:39.160All of these people have one intent to destroy one person.
00:25:50.640The Jordan report that just came out exposes that this guy Pomerantz, right, has been obsessed with getting this one man using the law, using the criminal laws to destroy a person.
00:26:03.520Actually, that is the complete opposite of the rule of law.
00:26:07.360Now, this I want to go over one more time for you, Bounce.
00:26:13.280This liberal is putting it up there on Twitter and they're all backing it.
00:26:16.800They are now it's it's no holds barred, even if you thought it was crazy before, because now they realize yesterday was a shock to them, an absolute reality check.
00:26:29.240And now they are maniacally focused that they have to destroy the Supreme Court as it exists.
00:26:37.420You had on MSNBC last night calling the current justices criminals, criminals.
00:26:43.880They are going to go after the Supreme Court.
00:26:45.920And if they if they steal this on November 5th, they will immediately start the packing.
00:26:50.340You see this in the tweet and you've seen it all on these TV shows today as we told you was coming.
00:26:54.760That is the tell when they feel like there's a chance for victory to slip away from them.
00:27:00.800They're immediately going to try to get all of their all of their all of their hop lights fired up that this is all about the Supreme Court and about packing the Supreme Court.
00:27:10.760Mark, where do people go to get your writings?
00:27:18.940I have a great Web site, Mark Payaletta dot com.
00:27:20.900That's got tons of articles, op eds that I've written in defending the court, defending President Trump, you know, testimony before Congress.
00:27:28.940And you can check out my book, Created Equal, Clarence Thomas in His Own Words, which is a follow on to the great documentary on Justice Thomas.
00:27:37.200Every American should read this book, watch that movie and read Justice Thomas's memoirs.
00:27:43.180My grandfather's son, he's our greatest living American.
00:27:47.480Thank God he's on the Supreme Court and thank God he's willing to take the slings and arrows to do his job as a justice on the Supreme Court.
00:28:40.900Are you tired of progressive corporations and exhausted trying to keep up with all the virtue signaling when you're simply trying to buy products?
00:28:54.100Progressive corporate America continues to push messaging that further alienates conservative Americans, all while eroding the future of the American dream.

00:30:36.380Remember, either as a consumer or a business owner, download the app now.
00:30:49.840I'll get into this a little bit later, but the reason you should go to Birch Gold is that Business Insider, which is no MAGA site,
00:31:01.080has come out with a huge – their lead story today is about how – wait for this, we're in posse, because I think you've heard this a couple or three times –
00:31:09.840Now, stagflation is actually worse than a recession, in that we are beginning a serious – what do I say – endeavor into stagflation.
00:31:21.320Now, I say we've been there for a while, and you're going to have lost decades.
00:31:26.980Another report out, the lowest birth rate in the history of the republic, this country.
00:32:30.560You're going to have the same type of lost decades that the Japanese had after the big asset bubble collapse in the early 1990s.
00:32:41.440And it's going to take some very tough decisions from some very tough people to be able to take the political heat when you have to get this thing sorted,
00:32:50.760like Reagan did with Paul Volcker back in the early 1980s.
00:32:56.700And remember, we were a manufacturing superpower at the time.
00:33:01.140We didn't – we had virtually no debt on our balance sheet.
00:33:04.060We had a much different working population that were either better craftsmen or really better educated.
00:34:00.380But they had this theory of the case they put forward on the basic why it's better to rent and lease than to own a home.
00:34:08.120I disagree with that for the social aspects.
00:34:10.420I may actually disagree with when we look at the hard numbers on the net present value of the homes.
00:34:15.540But what I love is the audience actually put forward the bigger case that even on the margins, it may be worse theoretically if you do all these net present value calculations and add everything in.
00:34:27.140Maybe it's better to own bonds or stocks over time and you don't get locked into a house.
00:34:32.280The arguments I heard in the chat and on comments up on Getter and Rumble were just fantastic.
00:34:38.220And what really impressed me is the level of sophistication this audience has that no other audience in media has about tough economic questions when you put it forward.
00:35:31.660They're complete – because remember, the key thing in Nazi Germany and the Bolsheviks is to take over the courts.
00:35:37.800The show – that's why I say this – what's happening up in New York is a Moscow show trial, like the show trials in 1935, where you give the performative Potemkin village of all the form of the rule of law, but it's just to get – you know, give me – it's Stalin.
00:35:54.100Give me the man, and I'll give you the crime.
00:36:11.800I remember, you know, diagnosing this back when I was in college and in law school when I would have debates with the people on the left who are my classmates is that they're soft on debate because they're not used to having to defend their positions.
00:36:24.420They're used to being in an echo chamber where everyone just agrees with them.
00:36:27.920And so when you hit them with hard ideas and hard questions and hard facts and hard legal theories, they, you know, tend to recede a little bit, although, you know, back in my day at least, they gave me begrudging respect.
00:36:41.580I think now the colleges and law schools have gotten so bad that, you know, you've got a target on your back if you're a conservative.
00:36:48.980You're lucky to get out of there alive.
00:36:50.380So after all of their MSNBC, you know, kind of, you know, patting themselves on the back about how they've designed the perfect disqualification theory under the 14th Amendment, Section 3, and how Trump doesn't have any immunity, etc.,
00:37:06.280they see the actual arguments unfold and the decision, at least on one of those, come out.
00:37:13.780They can't believe what they're seeing because they've led their audiences to believe and they've led themselves to believe through their echo chamber that, you know, that President Trump had no chance on these issues.
00:37:24.080And that was, you know, it just shows that they can't discern lies from the truth anymore.
00:37:29.120They can't discern good arguments from bad legal arguments, and they can't even see the weaknesses in their own arguments.
00:37:35.360And that's like the worst kind of feature for a lawyer.
00:37:38.160You need to be able to interrogate your own arguments so that you can beef them up.
00:37:42.220And it seems like they've lost the capacity to do that, Steve.
00:37:49.720Before I get to the Jordan report and what's happening at the show trial in Manhattan, because you're one of the guys that have warned about this, they are now brazen.
00:38:00.760They've been pushing this recusal situation, and now they're brazen about calling the justice as criminal.
00:38:05.720Wait till the immunity decision comes out in June.
00:38:08.220Folks, I can tell you around June 17th, around that second or third week of June before the court punches out, you wait to – I know around the – everything around the court is going to have the barriers up.
00:38:21.740You wait for a full and total meltdown when they come back with the immunity decision that kicks it back to Trump and makes sure that – ensures essentially there's no trial of Trump before the election.
00:38:46.060And look, first let me say on the security front that the Supreme Court right now should be preparing with the U.S. Marshals to protect them.
00:38:54.780You know, we had an attempt on Justice Kavanaugh's life, and, you know, he was very muscular yesterday at the oral argument on the immunity case.
00:39:03.120You mentioned Lavrenti Beria, you know, find me – show me the man and I'll find you the crime.
00:39:08.860Same thing as what Justice Jackson said, which is actually a quotation used, you know, to the gist of that at the start of this Jordan report that you're going to talk about.
00:39:19.140And Scalia observed that in his dissent in Marson v. Olson.
00:39:24.260And Justice Kavanaugh – that's why it came to mind yesterday – he stressed that at oral argument.
00:39:28.920And remember, he was, you know, the chief legal lieutenant for Ken Starr in the Independent Council investigation of the Clintons.
00:39:36.340But he's come to realize that there are serious issues with giving one prosecutor the task of going after a particular person.
00:39:46.100It has all sorts of constitutional dysfunctionality, Steve.
00:39:49.760And so, you know, the fact that the Supreme Court now seems to be, you know, coming around to Justice Scalia's view and Marson v. Olson, you know, much later than it should have.
00:40:02.800And I think it is going to put a lot of security demands and need for security for the justices.
00:40:08.840And, you know, it used to be taught in law school, right, that the so-called stitch in time that saved nine, that Roosevelt's court-packing plan was illegitimate.
00:40:19.400And, you know, he managed through, you know, that kind of threat maybe to change the minds of some of the so-called four horsemen of the apocalypse who were blocking New Deal programs.
00:40:30.480But they never taught that it was a good idea to pack the court.
00:40:33.780Now, consistent with the drift of academia to the left into true Marxist territory, they're openly saying that they want to pack the court.
00:40:42.740And that is dangerous, Steve, because that means that you would eviscerate that branch, which is the true balancing mechanism, the kind of, you know, the stabilizer that creates equilibrium is that you have the ability to go to the courts.
00:40:56.620And the other two branches, the political branches, can fight with each other there and the people's rights can be protected.
00:41:03.400You'd mentioned, you know, the Soviet system and Russian courts, et cetera.
00:41:08.700You mean, yes, you know, they had show trials, but we've never had anything like the English and American court system, right?
00:41:15.380The Anglo-Saxon system of justice that the framers learned themselves, oftentimes self-taught, you know, from Blackstone and imported over into the U.S. and then perfected it in our written constitution, Steve.
00:41:27.720That is something that has to be defended at all costs or America will no longer be a republic.
00:41:45.980This is – they've weaponized the entire system at every level to basically make lawyers criminals if you defend this, to destroy lawyers, to take – tell law firms that if you continue on to have the clients put pressure on the law firms not to do this.
00:42:01.140This entire system right now has been taken over by the most radical.
00:42:06.180The Jamie Raskin's just – he's the most presentable.
00:42:09.020But it's been taken over by absolute radicals that want to see the Rudy Giuliani's, the Jeff Clarks.
00:42:16.140Look out in Arizona, a bunch of lawyers out there.
00:42:18.500They want to see these people – John Eastman.
00:42:20.660They want to see them not just bankrupt and disbarred and try to be humiliated in the legal profession.
00:43:24.980I thought perhaps the most remarkable moment yesterday at the argument was when Justice Ketanji Brown Jackson started talking about the White House becoming a crime center.
00:43:36.420That is exactly the kind of comment that comes straight out of being placed into MSNBC fluid and marinating over a year period or being steep like wine and all that stuff.
00:43:51.760I mean, it's just not the kind of thing you would ever hear coming from the Supreme Court before.
00:43:58.480Look, I don't even think the term lawfare, we've got to come up with another term like really gets to it.
00:44:03.480It's more like at this point, we're talking about legal warfare.
00:44:06.620It's like scorched earth legal warfare, right?
00:44:09.820It's not just lawyers kind of came out of a knightly tradition in England, right?
00:44:14.760So trial by combat turned to new trial by brief.
