00:03:57.480 this case to further and fatally delay criminal court proceedings against Donald Trump before

00:04:05.260 Rather than reject his claims of immunity from prosecution, like all the federal judges who
00:04:11.120 have considered this matter before them have done, they instead will carve out some newly
00:04:16.480 specified class of actions that are immune from prosecution if you're a president.
00:04:21.980 And they will invent a test for deciding what counts as that kind of action by a president.
00:04:27.760 And then they will send Trump's indictment, Trump's federal January 6th case, back through
00:04:33.080 a whole new cycle in the lower federal courts to run his attempted overthrow of the government

00:04:43.940 case, which, yes, will take forever, because in the meantime, of course, he will get a chance
00:04:50.280 to get back into the White House in order to shut the whole thing down.

00:11:12.780 And what I find astonishing that even Chief Justice Roberts yesterday absolutely blasted the D.C. Circuit case and, quite frankly, the district court for doing no work and short shrifting this entire argument.

00:39:03.120 You mentioned Lavrenti Beria, you know, find me – show me the man and I'll find you the crime.
00:39:08.860 Same thing as what Justice Jackson said, which is actually a quotation used, you know, to the gist of that at the start of this Jordan report that you're going to talk about.
00:39:19.140 And Scalia observed that in his dissent in Marson v. Olson.
00:39:24.260 And Justice Kavanaugh – that's why it came to mind yesterday – he stressed that at oral argument.
00:39:28.920 And remember, he was, you know, the chief legal lieutenant for Ken Starr in the Independent Council investigation of the Clintons.
00:39:36.340 But he's come to realize that there are serious issues with giving one prosecutor the task of going after a particular person.
