Bannon's War Room - Episode 3593： Happy Talk From Speaker Judge Cannon Refuses To Set New Trial Date

00:00:00.000 But one of the things that is also in jeopardy right now is our judicial branch, and it's our system of government itself.

00:00:08.680 And I don't think we can say often enough here how much that has been abused under this administration and with local prosecutors, state prosecutors, and at the federal level who are using lawfare.

00:00:22.340 They're using our judicial system to go after political opponents. 0.87

00:00:24.920 The most obvious example of that, and I think the most egregious one in history, is what is being done to Donald Trump right now.

00:00:30.920 This is yet another week where cable TV has a split-screen image, right?

00:00:35.320 On one side, turn on any news station, you see the partisan prosecutors and the double-standard DOJ going after President Trump.

00:00:42.420 And on the other side, college campuses being wrecked by anti-Semitic mobs.

00:00:47.220 In Manhattan, in the New York case, I mean, it's play-by-play on all the stations, right?

00:00:51.280 That case should never have been brought.

00:00:54.300 If there's ever been an example of lawfare, everybody can look at that and see.

00:00:59.080 The trial is being orchestrated by Democrat supporters of President Biden who are trying to make a name for themselves.

00:01:04.440 I mean, they're pretty open about that.

00:01:05.960 They used it in their campaign pledges.

00:01:08.540 We've got a Democrat district attorney, a Biden donor judge, whose daughter is a Democratic political consultant

00:01:15.220 and has clients that use the case in their solicitation emails to raise money.

00:01:19.400 And now we've learned there's an assistant DA who was recently a top man at the DOJ

00:01:25.260 and received over $10,000 in payments from the Democratic National Committee.

00:01:31.020 This is all wrong.

00:01:32.580 It doesn't matter what political party you're in.

00:01:34.820 You have to look at this.

00:01:36.060 If you look at this objectively, you know, you know deep down that this is wrong.

00:01:40.900 And think about all this in the context of New York.

00:01:44.440 Assaults in New York are at their highest level ever.

00:01:47.120 Crime is through the roof. 0.91

00:01:48.580 The DA has decided to bring an eight-year-old bookkeeping charge that rests on the testimony of a long-proven liar and perjurer.

00:01:58.360 And the judge, who is a well-known Democrat, is pursuing an indefensible gag order on President Trump.

00:02:04.460 Now, just think about that.

00:02:05.720 Think about the magnitude of that.

00:02:08.500 But he's trying to override President Trump's constitutional right to defend himself against the constant smears of his political opponents in an election year.

00:02:18.280 But not just any election year.

00:02:19.980 The election year that most everyone understands is the most fateful one of our lifetimes.

00:02:24.480 You cannot call yourself a serious judge and threaten a presidential candidate with jail time when he defends his reputation in public in the middle of a campaign.

00:02:33.060 And I think everybody of good conscience understands that.

00:02:36.640 Then we have the classified documents case where President Trump is being treated completely differently from President Biden.

00:02:42.700 Again, this is something that is just obvious that everybody can see.

00:02:46.240 Biden, of course, willfully retained and disclosed classified material.

00:02:49.940 But because he is, quote, an elderly man with a poor memory, unquote, it was decided the DOJ would not be bringing charges.

00:02:59.180 What the American people see, and I mean this is across the country, this isn't just red states, it's blue states as well.

00:03:04.080 They look at this and they see an incredible double standard.

00:03:06.600 It's just blatantly on display.

00:03:08.760 It's the weaponization of our justice system. 0.74

00:03:11.080 And every single person of good conscience and common sense can see that clearly.

00:03:15.320 And it's disturbing to them.

00:03:16.620 Why? Because in our system, in a constitutional republic, if the people do not believe that the justice system is fair, that you really do have equal justice under law, then they throw their hands up and they say, what is there to believe in?

00:03:29.780 It's critical.

00:03:30.840 It's a foundational component of maintaining a republic.

00:03:34.400 And they are jeopardizing this for political purposes.

00:03:37.780 Now we're learning that the prosecutors in the Jack Smith case have even engaged in evidence tampering during the raid at Mar-a-Lago.

00:03:44.060 But here's the point.

00:03:45.700 The entire case turns on what happened with those documents.

00:03:49.060 And Jack Smith has admitted that things were not as they should be with the boxes.

00:03:52.240 It just raises very serious questions.

00:03:56.000 And these cases are coordinated political attack, plain and simple.

00:03:59.040 They are a clear attempt to keep Donald Trump in the courtroom and off the campaign trail.

00:04:03.540 That's what this is.

00:04:05.460 It's an election interference.

00:04:07.100 It is borderline criminal conspiracy.

00:04:08.920 And the American people see right through it.

00:04:10.840 President Trump has done nothing wrong here and he continues to be the target of endless lawfare.

00:04:16.620 It has to stop.

00:04:18.100 And you're going to see the United States Congress address this in every possible way that we can because we need accountability ultimately at the end of the day.

00:04:24.500 It's bigger than President Trump.

00:04:26.260 It's about the people's faith in our system of justice.

00:04:29.900 And we're going to get down to the bottom of it.

00:04:31.180 All these cases need to be dropped because they are a threat to our entire system.

00:04:34.620 We've had discussions in the Speaker's office and right now the ball is in Mike Johnson's court.

00:04:40.780 He understands that he's going to be our Republican Speaker of the House.

00:04:44.840 The things that we've discussed about that got leaked out to the press are very simple.

00:04:49.660 And they serve the American people.

00:04:51.820 They serve the people that gave us the majority.

00:04:54.220 And we're interested to see his actions, not his words.

00:04:57.720 But what is the time frame here?

00:04:59.080 That's up to Mike Johnson.

00:05:01.900 And it can't drag out.

00:05:03.500 These are things that have to be done.

00:05:05.000 He's already delivered Joe Biden's agenda.

00:05:07.340 He's delivered everything that Chuck Schumer's asked.

00:05:09.800 If he's capable of doing that with a majority of Republicans controlling the House, I think he's extremely capable about doing the things.

00:05:17.180 This is the primal scream of a dying regime.

00:05:25.520 Pray for our enemies.

00:05:26.700 Because we're going medieval on these people.

00:05:30.740 Here's the time I got a free shot at all these networks lying about the people.

00:05:35.000 The people have had a belly full of it.

00:05:36.920 I know you don't like hearing that.

00:05:38.340 I know you've tried to do everything in the world to stop that.

00:05:40.100 But you're not going to stop it.

00:05:41.040 It's going to happen.

00:05:42.300 And where do people like that go to share the big lie?

00:05:45.700 Mega media.

00:05:47.060 I wish in my soul, I wish that any of these people had a conscience.

00:05:52.400 Ask yourself, what is my task and what is my purpose?

00:05:55.620 If that answer is to save my country, this country will be saved.

00:06:02.540 War Room.

00:06:03.440 Here's your host, Stephen K.

00:06:05.520 Bannon.

00:06:05.840 It's Tuesday, 7 May, Eurovalor 2024.

00:06:12.760 You just heard Mike Johnson go through the litany we've been telling you guys about for the last, I don't know, year or two.

00:06:20.340 And it's fine.

00:06:21.140 He gets up there and reiterates it.

00:06:22.900 We think that's great.

00:06:23.960 But then he says it comes close to a criminal conspiracy and we're going to be doing anything. 1.00

00:06:26.940 No, it is a criminal conspiracy and you've got to get off your ass and get to work. 0.99

00:06:30.980 We want to see subpoenas flying. 0.99

00:06:32.680 We're tired of it.

00:06:34.040 And sitting up there and more happy talk.

00:06:36.100 All of this is happy talk.

00:06:37.920 Where is the action?

00:06:39.340 Where are the subpoenas?

00:06:41.100 Where is the beginning of the investigation into the vast criminal conspiracy?

00:06:45.740 And two things today.

00:06:47.380 Reemphasize my point.

00:06:48.500 What has happened with the judge in Florida about to bring Julie Kelly on for breaking news and what has gone on in this travesty, this travesty in Manhattan.

00:06:58.500 First, Julie Kelly, the great Julie Kelly.

00:07:00.560 Julie, you've got breaking news in the classified documents case.

00:07:04.740 Ma'am, what is it?

00:07:07.040 Oh, sorry.

00:07:08.080 I was typing this out.

00:07:08.980 I'm posting it right now.

00:07:09.920 This is breaking news.

00:07:11.000 So Judge Aileen Cannon has officially vacated the May 20th trial date.

00:07:15.860 We knew that was coming.

00:07:17.020 But she is now refusing to set a new trial date, calling it imprudent.

00:07:23.760 And, Steve, in the meantime, though, she is setting key hearings that will make Jack Smith's—what should we say?

00:07:33.720 Give him some sleepless nights, I believe.

00:07:35.920 She is going to be holding hearings on Trump's co-defendant Walt Nauta's motion to dismiss based on selective and vindictive prosecution.

00:07:44.300 She is going to hold a hearing on a motion to dismiss based on the unlawful appointment of Jack Smith.

00:07:51.820 She is also going to hold a hearing, and this is something that DOJ and Jack Smith was really hoping to avoid.

00:07:57.620 And that is a partial evidentiary hearing on the scope of the prosecution team.

00:08:03.480 This is where we got all the bombshell revelations related to co-work collusion with the Biden White House, the DOJ, and the National Archives.

00:08:11.880 She will be holding a partial evidentiary hearing to hear the defense team's argument as to why entities like the archives, the DOJ, FBI counterintelligence, and the Biden White House, including his general counsel, should be considered part of the prosecution team.

00:08:31.700 Meaning then that all of their records related to this investigation from the very beginning would be considered discovery material that has to be produced to the defense.

00:08:44.120 She is, in her own way, going on a scorched-earth campaign now against Jack Smith.

00:08:51.840 Okay, let's go back for a couple—just pull the camera back. 0.53

00:08:54.840 And a lot of times we have motions to dismiss, the judge just takes it and he rules on.

00:09:01.040 Are you saying making it a hearing is raising it up in a more serious context?

00:09:07.240 Yes, because there are several defense motions that are outstanding.

00:09:11.340 So you've got three defendants, Trump and his two co-defendants.

00:09:14.520 And they are filing really similar motions, but they're different in their own form.

00:09:20.580 So this is motions to dismiss based on selective vindictive prosecution.

00:09:25.040 Donald Trump has a motion like that.

00:09:26.680 His co-defendant has one as well.

00:09:29.220 And then, of course, the scope of the prosecution team.

00:09:31.920 So to your point, a lot of times a judge can just look at these motions.

00:09:36.240 She doesn't really have to hold a hearing, although she should, and then go ahead and just, you know, deny the motion to dismiss. 0.99

00:09:44.380 That is not what she's doing here. 0.99

00:09:45.960 She's already held some of these hearings. 0.94

00:09:47.860 We've seen these hearings, Donald Trump, for his motion to dismiss based on the Presidential Records Act and the unconstitutional vagueness of the statutes against him.

00:10:00.200 We had a similar hearing a few weeks ago for his co-defendants, the same sort of motion to dismiss.

00:10:06.680 So what she's doing is very helpful and instructive and informative because she's telling both sides, you're going to come into my courtroom.

00:10:15.400 You're going to duke this out.

00:10:16.580 I want to hear both sides, not just read your motions.

00:10:18.940 You're going to have to defend it.

00:10:20.560 And then I will make present my order.

00:10:22.580 So with this May 20th trial date now officially vacated, she is going to hold these evidentiary hearings on these existing outstanding defense motions.

00:10:32.700 And she is going to put Jack Smith and Jay Barrett, his lead prosecutor, their feet to the fire and have to explain publicly, defend the selective vindictive prosecution, the potentially unlawful appointment of Jack Smith.

00:10:47.100 And now this bigger issue, I believe, will be a public vetting of the full scope of the prosecution team and all of these federal agencies and the Biden White House involved in this.

00:10:59.940 Has she said dates?

00:11:02.680 So first off, people should understand, the May 20th trial, which we knew was going to be bumped, is now bumped, but there's no new trial date.

00:11:09.260 She says, OK, we can't get it in May, but I think you can get it at the end of August or September.

00:11:13.320 So it comes before the election.

00:11:15.400 She didn't put a trial date.

00:11:16.800 Is there a schedule that she's put these other either evidentiary hearings or hearings on motions to dismiss as she laid that out and given them dates?

00:11:24.780 Yes, she did.

00:11:25.860 So I'm posting that right now.

00:11:27.360 That's what I was doing before we went on, because this is literally just broke five minutes ago.

00:11:33.660 So she has set those hearings.

00:11:35.940 I'll be posting that on X.

00:11:37.780 And these hearings will take take place over the next few months.

00:11:41.680 I will be covering them.

00:11:43.480 There's one May 22nd.

00:11:44.760 Another one, I believe the special counsel one is June 21st.

00:11:48.120 And then the big one, the evidentiary hearing about the scope of the prosecution team.

00:11:53.260 So all of those motions have already been filed.

00:11:55.980 I've already reported on several of them.

00:11:59.360 And she's also going to be holding a sealed hearing tomorrow on the grand jury materials that were not disclosed out of Washington, D.C., transferred to her court.

00:12:09.760 She wants to see all of those materials and then see which ones she believes can also be made public on the docket for the American people to see.

00:12:18.840 The evidentiary hearing, which to me is the most explosive, talking about the team and who's on the team, that is scheduled now.

00:12:26.340 Has she scheduled that?

00:12:27.260 Is that scheduled for July or August?

00:12:29.360 So if you will give me one moment, that hearing is scheduled for between June 24th and June 26th.

00:12:37.840 Wow.

00:12:38.840 So that will be.

00:12:39.760 So in your because they're going to have melt.

00:12:42.420 They're going to meltdown.

00:12:43.520 Andrew Weissman is going to literally, you know, may want to throw himself off a building tonight on MSNEC complete because they're going to say Judge Cannon ought to be removed.

00:12:50.840 Ought to be removed.

00:12:52.160 Ought to be removed.

00:12:53.000 Given where she's laying out the schedule and not putting in a not putting in a trial date, is there any possibility that this really starts before the November 5th election?

00:13:06.260 Well, her last date here for the CIPA, which is this Classified Information Procedures Act, which really has been driving really a lot of the grind to this because there are special rules related to how defendants can and their attorneys can access classified information in espionage cases.

00:13:26.080 So this has helped really slow down the process.

00:13:29.340 So the last hearing for it on her schedule that she just posted is July 10th.

00:13:35.260 So, you know, after that, would she set a trial date?

00:13:40.780 Will she grant a motion to dismiss?

00:13:43.600 Will she grant the motion to dismiss based on selective vindictive prosecution?

00:13:49.400 Will she?

00:13:50.520 We're waiting now for a separate order related to her stay on one of these key hearings that she just issued last night. 0.69

00:13:58.480 And she's going to be issuing another order.

00:14:01.180 And this will relate to, Steve, what we've been talking about the last few days, what I've been reporting at my substack, is missing evidence, doctored evidence, tampering with evidence that these defense attorneys cannot access the materials that they need.

00:14:18.280 And that the DOJ has intentionally misrepresented to both the defense attorneys and now Judge Cannon exactly the form of the contents of the boxes that were taken from Mar-a-Lago, how these cover sheets, which we'll talk about, were used as props and then as replacements.

00:14:35.760 And not being able, believe it or not, Steve, in some instances, to match up the replacement cover sheet that they used to take out the classified documents and put that cover sheet in.

00:14:46.400 They're saying in some instances they can't match up that cover sheet with the classified record that they took out of the box.

00:14:52.380 Julie, just hang on. 0.96

00:14:53.640 We're going to take a short commercial break.

00:16:42.080 We're going to get back into what's happening in this fiasco against President Trump in Florida.

00:16:47.480 The classified documents case.

00:16:49.420 We're then going to go to Andrew Giuliani.

00:16:51.580 One of the most shameful days in the history of American jurisprudence took today in the New York court.

00:17:42.160 Tom Fitton.

00:17:42.740 I mean, you guys have done extraordinary work.

00:17:45.240 Help me out here because I'm not a lawyer.

00:17:46.620 Judge Cannon has put a shot across the bow of Jack Smith, like the Judiciary Committee in the House, Mike Johnson, Kevin McCarthy.

00:17:58.920 Nobody's done.

00:17:59.760 This today was a throwdown to say, hey, look, tough guys, we're going to have some hearings here.

00:18:06.400 You're going to have to roll out some evidence.

00:18:07.540 We may have a three-day evidentiary hearing, but you're going to explain to me as a federal judge exactly what in the hell is going on here and what you guys have been doing.

00:18:15.980 Am I overstating her case, ma'am?

00:18:20.080 Absolutely not.

00:18:21.360 She is doing the heavy lifting. 0.98

00:18:23.440 She is taking the slings and arrows.

00:18:26.640 She has to endure not only serious death threats that resulted in the imprisonment of a woman who made such serious death threats that now she's in jail for three years for it, but the constant drumbeat.

00:18:38.500 And you're going to hear this tonight.

00:18:39.720 Everyone on MSNBC, CNN, Andrew Weissman, Barbara McQuaid, Joyce Vance, everyone is going to just be caterwauling.

00:18:48.460 Judge Cannon needs to step down.

00:18:50.240 She won't set this trial date.

00:18:52.260 Well, no.

00:18:53.140 We know why they've wanted since the very beginning to get her off of this case because they suspected, and she continued to hint and suggest, and that has accelerated over the past few months,

00:19:04.720 that she was going to use her position, do her job, actually, Steve, as a judge should, number one, make sure that the interests of both parties are balanced, that the rights of the defendants are protected,

00:19:17.160 and that she prevents the government from abusing its authority and overreach.

00:19:22.160 And so with this shot across the bow today, and there's more to come this week, as I said, vacating the trial date, saying she won't set a new one, but what looks like a steady drip of a mini trial where Jack Smith is going to be the defendant and not Donald Trump.

00:19:42.320 He now, she, it appears, is in a way, and I'm not saying this is her motive, because I'm not in her head, I don't talk to her, I don't know her, but this is her way of putting the government, DOJ, Jack Smith, and Jay Brett on the hot seat.

00:19:57.480 You have to explain to me, Judge Cannon, why I should not consider the National Archives, the Biden White House, including his general counsel, the counterintelligence unit of the FBI, other entities.

00:20:10.840 You have to tell me why they're not part of the prosecution team, when we have records dating back from May of 2021, about how this was all coming together.

00:20:19.580 She specifically asked, and this is why she is very good at what she does, she specifically asked Jay Brett at a hearing in March,

00:20:27.800 can you tell me when the DOJ started their investigation into this?

00:20:32.020 And Jay Brett said, February of 2022, that's not true, because the DOJ, now we know from this prosecution, the scope of prosecution team motion, that will, this is, will be the source of this hearing in June.

00:20:46.320 We now know that the DOJ was involved beginning in the spring of 2021, that the National Archives General Counsel, Gary Stern, was already in informal talks with the DOJ,

00:20:57.860 so they could concoct this case against Donald Trump before he even turned over boxes to the National Archives.

00:21:06.040 So, now they have all these records, so he flat out, again, just like he did at the last hearing, lied to Judge Cannon.

00:21:14.680 She knows that he's lying.

00:21:17.120 One of my favorite moments, Steve, this is how much Judge Cannon is on to Jay Brett and Jack Smith.

00:21:22.520 Jay Brett was about to answer a question, and she looked at him, cut him off, and said, try not to say something sarcastic.

00:21:28.040 And he said, oh, I would never say anything sarcastic.

00:21:32.040 And she just gave him a glare like you wouldn't believe. 0.88

00:21:34.940 She is fed up with this.

00:21:36.740 She knows how bad this case is.

00:21:38.380 It's getting worse related to tampering with evidence, missing evidence, doctored evidence.

00:21:44.720 And so, now she is, she's turning the tables. 0.98

00:21:48.940 You're right.

00:21:50.020 This is what the House Republicans should have been doing to the extent that they can.

00:21:54.220 They have completely put this in Judge Cannon's lap.

00:21:56.980 But she is, she's handling it as well as she can.

00:22:00.860 But it does highlight the abdication of duty that House Republicans have been engaged in since, you know, they took power now a year and a half ago.

00:22:10.800 Look, you're a steady pair of hands.

00:22:12.680 You know, I'm a mick that gets a little hot on this topic.

00:22:15.720 But it's not the judge's response to go through.

00:22:19.420 The House Judiciary Committee is supposed to have oversight.

00:22:22.900 The Weaponization Committee is supposed to very specifically have oversight.

00:22:26.080 Even the Oversight Committee of the federal agency.

00:22:28.640 But Judiciary, it is in their charter.

00:22:31.240 Why was this not done a year ago?

00:22:34.180 We could have been a year ahead of this and brought this up about what a dirty case is and how corrupt these individuals are.

00:22:40.420 Judge Cannon is, I think, proving right now she's one of the most spectacular judges and fair judges on the entire federal bench. 0.54

00:22:47.460 But why is the burden, why is the burden put on her? 0.88

00:22:50.920 Why didn't we?

00:22:51.980 And why?

00:22:52.460 You heard Johnson today.

00:22:53.720 He's going, well, it looks like a criminal conspiracy.

00:22:56.060 It's obviously a criminal conspiracy.

00:22:57.680 But the way you show that is to investigate and subpoena people, Julie Kelly.

00:23:02.800 That's exactly right.

00:23:03.960 Right. I mean, I know that now they have subpoenaed Dana Remus, the general counsel, who was meeting with National Archive officials through 2021.

00:23:12.800 So they finally subpoenaed her.

00:23:15.060 They've also subpoenaed other Biden White House officials or not subpoenaed, asked them to sit for a transcribed interview.

00:23:21.480 OK, so then they don't.

00:23:23.520 The DOJ is, of course, naturally in the Biden White House, is naturally objecting to that, refusing to allow these officials to sit for interviews or respond to a subpoena.

00:23:35.540 But that seems to be the most of what what we get.

00:23:39.220 And so, yes, you're right.

00:23:41.380 Why is it defense attorneys who are uncovering and having to FOIA federal agencies to get some of these exhibits that were used in this motion, this this critical motion about the scope of the prosecution team?

00:23:53.700 Why haven't Republicans forced that sort of information to be produced to investigative committees?

00:24:00.920 Why is it Julie Kelly, Tom Fenton, Mike Davis, John Solomon, these independent investigators, they're doing it because they want to present the American people to what the actual facts are in the news is.

00:24:14.080 But people have, you know, institutions talk about institutionalists.

00:24:19.360 Institutions are supposed to do this to make sure that the institution goes forward and does its job.

00:24:25.540 This is the problem.

00:24:26.320 The problem is that people have taken this on outside and been able to present this.

00:24:32.140 It's why we know what the facts are in this heroic judge down in Florida.

00:24:36.440 Thank God she exists.

00:24:37.460 And tonight she's going to get eviscerated, eviscerated on MSNBC. 1.00

00:24:42.300 Andrew Weissman on.

00:24:43.260 We'll cut clips from our Julie Yeoman's work as usual.

00:24:47.140 Where can people go to get all your sub stacks, your Twitter, everything, because you're breaking news nonstop in this.

00:24:53.080 Thank you, Steve.

00:24:54.040 Thanks for having me on again.

00:24:55.120 Declassified with Julie Kelly is my sub stack.

00:24:58.440 I also have a very detailed report at Real Clear Investigations about the timeline in 2021 leading up to this classified documents case.

00:25:07.740 And, of course, I'm on Twitter a lot, Julie underscore Kelly, too, where I post a lot of breaking news, like I just posted this new order by Judge Cannon.

00:25:14.960 And we'll be waiting for her next order in response to Jack Smith's confession about tampered, tampered evidence and even in some cases missing evidence.

00:25:27.060 Unbelievable.

00:25:27.540 Julie Kelly, we look forward to having you back on about the evidence, the tampered, the tampered evidence and missing evidence.

00:25:34.540 Outrageous.

00:25:34.940 I told you times of turbulence is only yet worse between now and Election Day.

00:25:41.620 This is why MyPatriotSupply.

00:26:03.820 Let's go and play.

00:26:04.380 We've got Andrew Juliana's place cold open.

00:26:06.620 As we're describing this as, you know, some kind of an intercourt street brawl, the words that were used to get a grilling and heated.

00:26:13.900 All I can think of, Amy, is if Susan Necklace is being aggressive, Donald Trump is enjoying it.

00:26:21.120 Oh, yeah.

00:26:21.860 He's really enjoying it.

00:26:23.280 And he's saying, OK, this is what I came here for.

00:26:25.800 This is what I want.

00:26:26.960 This is sort of rallying his base like he loves to do.

00:26:30.180 He loves to say, you know, this is all BS.

00:26:33.380 I'm not here.

00:26:34.440 You know, this is political.

00:26:36.400 You know, this is what they did to me.

00:26:38.500 And he is, like, letting them roll the tape and show that he is in the right.

00:26:43.900 And all of the circus, if you will, is sort of playing out.

00:26:46.960 And he's going to use that to his benefit, as he always does, and say, look, look what happened today.

00:26:52.100 She wasn't even supposed to talk about this stuff.

00:26:54.280 She talked about it.

00:26:55.520 And here we are.

00:26:57.080 And so I think all of this, he's going to use that to his benefit.

00:27:00.760 There should be an absolute mistrial this afternoon on this.

00:27:03.660 And it was right.

00:27:04.360 It was a brawl inside the courtroom.

00:27:05.880 President Trump's defense team really went at it with the judge and with the prosecution.

00:27:10.860 Andrew Giuliani, we've got about 30 seconds.

00:27:13.080 Tee us up.

00:27:13.520 You're going to hold through the break.

00:27:14.700 Tee us up.

00:27:15.180 What happened today?

00:27:16.200 The street brawl inside of Manhattan court.

00:27:19.520 Yeah, exactly.

00:27:20.300 You even had, coming right out of the break, Blanche, the president's attorney, asking for a mistrial,

00:27:25.760 saying that they completely went off the guardrails.

00:27:28.380 And also the judge stopped it at a very inopportune time for Stormy Daniels and the prosecution's case.

00:27:35.040 I'll bring that right to you on the other side of this, Steve.

00:27:38.040 Hang with me, Andrew Giuliani.

00:27:39.740 Andrew is down.

00:29:35.960 Here's your host, Stephen K.

00:29:38.540 Bannon.

00:29:38.860 Okay, so for Mike Johnson and all the people that are around Mike Johnson, understand something.

00:29:44.000 We're not going to relent.

00:29:46.160 We're not going to relent.

00:29:47.860 Look at what's happening in this case in Florida.

00:29:50.300 It's a disgrace.

00:29:52.300 Look what's happening in the case in Georgia.

00:29:54.160 It's a disgrace.

00:29:54.960 Look at the J6, and we're going to get Cash on here in the next hour to talk about the New York Times article about the National Guard. 0.86

00:30:03.860 When you hear what Cash has to say, the whole J6 committee, everything on the insurrection, Trump's insurrection, is a joke, a sick joke.

00:30:10.920 And what happened in Manhattan today may be the most perverted and sick of all because this is to destroy a man, one of the greatest presidents this country's ever had.

00:30:22.540 They unveiled their strategy.

00:30:25.140 There's no crime.

00:30:25.940 There hasn't been any talk of any crime.

00:30:28.780 I really want to thank Parker Sigg and Rob Sigg and Real America's Voice for providing this.

00:30:33.400 Harry, the entire team, you've got David Zier, Ben Berkham, doing an amazing job.

00:30:37.480 Andrew Giuliani's with us.

00:30:38.720 Andrew, you're a New Yorker through and through.

00:30:41.800 I never thought that a courtroom, particularly, forget that he's president of the United States, a courtroom would turn into basically a brawl because of what the prosecution is trying to do.

00:30:53.360 They don't have a case, and they're trying to smear Trump in front of the nation.

00:30:57.120 Andrew Giuliani.

00:30:58.820 Yeah, this is a complete smear trial.

00:31:01.680 And that's actually right when the court resumed in the afternoon.

00:31:06.720 That's exactly what Blanche said when he was asking for a mistrial.

00:31:11.300 Steve, I rarely read, but I think this is very important.

00:31:14.640 Blanche said that the alleged incident in 2006 is so far outside the realm of the case, has nothing to do with this case, is extraordinarily prejudicial.

00:31:24.780 And the only reason the prosecution asked the question is to smear the defendant, Donald Trump.

00:31:31.240 Blanche continued. 1.00

00:31:32.200 Stormy Daniels has inserted safety concerns in a case about business records, again, about business records.

00:31:38.820 And Blanche, when requesting the mistrial, also said, I think you, the judge, knew there could be prejudicial testimony.

00:31:47.120 Hence, you put up the guardrails.

00:31:48.440 This is not what we heard today from Stormy Daniels.

00:31:51.020 The prosecution has completely gone off the rails, and there is no remedy for the defense.

00:31:57.180 The judge said that he agreed that Daniels had gone outside some of those guardrails that he had set, but disagreed that mistrial was warranted at this point, saying the cross-examination would be the best opportunity here for the defense to make their case.

00:32:14.640 And I have to tell you, at the very end of the day, you had probably the best part of cross-examination that I've seen so far by Susan Necklace when she got Stormy Daniels to admit that Stormy Daniels, to be honest, if I could get the story out and make some money doing it, then yes, I would.

00:32:34.100 It's the first time that Stormy Daniels showed a motive, a monetary motive.

00:32:38.340 Steve, as soon as she said that, within 30 seconds, the judge said, we've had enough for today.

00:32:44.940 Excuse the jury.

00:32:46.420 I thought that was a real opportunity.

00:32:48.300 That was at 426 in the afternoon.

00:32:50.480 It could have gone on for another half hour.

00:32:52.060 There was a real opportunity for the defense to actually go and continue to make that point and make that case.

00:32:57.560 The jury will have to sleep on that.

00:32:59.080 The defense will have to sleep on that.

00:33:00.780 And they'll continue to cross-examine Stormy Daniels tomorrow morning.

00:33:03.740 I just want to, for the audience that doesn't follow this as closely as we do, is that this commercial transaction or this alleged business thing in the ledger, part of it has to do around Stormy Daniels.

00:33:16.160 Obviously, part of it allegedly has to do with Stormy Daniels, allegedly has to do with the Playmate Bunny.

00:33:21.100 But the judge actually told the – correct me if I'm wrong.

00:33:23.520 The judge told the prosecution none of the details of the alleged event are actually mean anything to the – is he guilty or not, to actually the facts of the trial.

00:33:35.440 She went out of her way, and the prosecution had to guard her way to try to put salacious detail in there. 0.85

00:33:41.260 And the judge, even a couple of times, realizing this was heading to a mistrial, didn't he jump in a couple of times during the day and say, whoa, you can't say this, you can't do this?

00:33:49.920 Yeah, he did. In the morning when the prosecution called Stormy Daniels, they basically went into all of the alleged salacious detail that Stormy Daniels claimed happened back in 2006,

00:34:01.840 far beyond the guardrails that the judge immediately cited, the judge set, actually, for this case.

00:34:08.440 And that was what Blanche's mistrial request was based off of right there, Steve.

00:34:14.280 So the judge realized that Stormy Daniels went way beyond this.

00:34:17.800 Blanche even said that we have no remedy for the jury right now.

00:34:22.960 You would have to rule a mistrial, and if you were to have another trial, you'd have to exclude this witness.

00:34:28.120 The judge agreed that they went outside those guardrails that he set, didn't think a mistrial was actually warranted.

00:34:34.940 But, Steve, I have to tell you, in looking at all this in big picture, and while I keep my eye on this jury,

00:34:39.900 hoping that there are a couple of unbiased jurors in there, if there are no unbiased jurors,

00:34:45.220 and they've all made their decision before any fact was presented,

00:34:50.200 I think what Blanche did today and Stormy Daniels' testimony to the prosecution speaks very, very strongly on appeal.

00:34:58.680 Let me ask you, the prosecution's been working with Stormy Daniels for a year for this testimony.

00:35:06.700 Do you believe, and I'm asking for a judgment call, that they wanted this to get in there,

00:35:11.620 or do you think Stormy Daniels is just too hard to control? 1.00

00:35:15.120 No, the prosecution absolutely wanted this to get in there.

00:35:18.020 They want to, for lack of a better term, smut-shame Donald Trump.

00:35:22.520 That's exactly what everything that the prosecution has basically asked at this point,

00:35:27.380 outside of some of the records, some of the phone records that they asked Davidson.

00:35:32.520 But with regards to Stormy Daniels, they want all the salacious details,

00:35:36.800 and they want to present to the jury basically a sexual encounter,

00:35:41.660 and instead of actually any type of a criminal case.

00:35:46.860 And I think they want the jury to make a morality call rather than actually a call on the facts of the case here.

00:35:55.600 And the truth is, the American people made a morality call on November 8th of 2016.

00:36:01.500 Steve, I think you had a pretty darn good view, because I saw you standing right next to President Trump

00:36:05.540 when he walked down the Hilton, or the Sheridan, I forget which one it was, as the 45th President of the United States.

00:36:11.880 It was the Hilton, and people didn't care about this other stuff.

00:36:15.020 They cared they were losing their country.

00:36:16.860 Real quickly, I just want to repeat, because we're all over Mike Johnson, these guys, about these terrible trials.

00:36:24.340 They're totally rigged. 1.00

00:36:25.300 But the prosecutors not having a crime are building a narrative that Trump's a terrible person, he's a scumbag, 0.99

00:36:33.180 and to present it and make sure enough of it gets out so the American people, 0.99

00:36:36.880 particularly the women in suburbs, can see that he's unworthy to be the president. 1.00

00:36:42.060 That is the entire direction here that you're seeing from the prosecution?

00:36:46.060 One hundred percent.

00:36:48.700 This is not a case trying to explain to a jury why a defendant has committed a particular crime.

00:36:56.680 I mean, Steve, there still is no underlying felony in all of this.

00:37:00.440 Whatever is alleged is a potential misdemeanor.

00:37:02.720 And the statute of limitations has expired on this.

00:37:05.420 What this is all about, Steve, is getting this information out there for the suburban moms

00:37:10.680 and trying to basically paint President Trump as the serial philanderer, somebody that is not worthy of their vote.

00:37:19.180 We know that the judge will not allow Tara Reads to be named to be made up,

00:37:24.180 but it is a pretty interesting comparison when you think about what she has actually claimed

00:37:29.420 and how the media has no concerns whatsoever.

00:37:32.740 Steve, one other point from my perspective that I found really fascinating.

00:37:36.240 As Stormy Daniels was making the salacious claims that she was, 0.98

00:37:41.660 you could hear the clicking of the keyboards was nonstop.

00:37:45.440 You could hear from all of the media.

00:37:46.800 Once the cross-examination began and it got into more of the detail of asking about actually

00:37:53.660 what she had said in this point versus what she had said in that point,

00:37:57.120 what her motivations were,

00:37:59.500 there was a fraction of the actual clicking of the keyboard from the mainstream media

00:38:04.940 than was when the salacious detail was out there.

00:38:08.400 I think that tells you everything that you need to know,

00:38:10.420 and it lets you know that the media is a very key player in what the prosecution is doing.

00:38:15.020 This is so important why we got you in the courtroom.

00:38:18.380 Andrew Giuliani, what's your social media?

00:38:20.200 Where do they go?

00:38:20.800 How do they follow you?

00:38:21.440 How do they get to your new show?

00:38:23.520 At Andrew H. Giuliani, and we were live tweeting everything.

00:38:26.180 I don't know, Steve, we must have sent out 150, 200 tweets already just this afternoon.

00:38:30.640 So feel free to keep an eye on that.

00:38:32.880 We'll do the same thing tomorrow and keep doing it as this Moscow show trial continues.

00:38:40.160 Andrew, thank you so much for doing this.

00:38:41.620 Make sure Grace and Captain Ben, everybody,

00:38:43.460 let's get Andrew's Twitter feed up so everybody can see it.

00:38:46.880 Incredible.

00:38:48.300 Thank you, brother.

00:38:49.080 This is why, come on.

00:38:50.480 This is open and shut.

00:38:52.380 Johnson, and we're going to keep the bandit to the back. 0.92

00:38:54.660 We're not going to let up.

00:38:56.640 Either get it done or let's call the vote this afternoon.

00:38:58.700 Let's call it tonight.

00:38:59.540 Let's call it tomorrow morning.

00:39:01.300 This is outrageous.

00:39:02.620 President Trump's being crucified across the nation,

00:39:05.220 and nobody is stepping up and having his back except for independent investigators.

00:39:10.340 Why is that?

00:39:11.740 And, yes, they're doing something.

00:39:13.020 Jordan's doing something.

00:39:14.000 You see another letter, another sternly worded letter, bang, bang, bang.

00:39:17.060 We need an official investigation.

00:39:20.000 We need the subpoenas to fly.

00:39:21.340 We need it to fly today.

00:39:23.500 You know why?

00:39:24.280 This illegitimate regime that is now holding 1600 Pennsylvania Avenue hostage.

00:39:32.680 Let's bring in Todd Benson.

00:39:33.820 Do I have Todd?

00:39:34.620 Todd, major story up in the New York Post by you.

00:39:37.320 My head blew up when I read it.

00:39:39.820 Tell me exactly what the Biden regime is trying to do in Gaza and to bring Gaza here to the United States of America, sir.

00:39:46.840 They're pitching this idea to bring a bunch of Gaza war refugees into the United States.

00:39:52.200 I'm thinking they're doing this because they're trying to appease this alienated, hard, progressive left wing that's mad at them right now over Israel's retaliatory war against Hamas.

00:40:06.660 But my point in the article today in the editorial is that these are exactly the kind of population that you do not ever want to bring into the United States for any reason whatsoever. 1.00

00:40:20.420 Because from cradle to grave, Hamas at every level of civil society in the strip has been indoctrinating them in murder, death, sub-dehumanizing Jews and Christians, U.S. hate, especially right now.

00:40:40.200 This is a terrible time to be bringing in a population that has been so thoroughly for decades indoctrinated in the dark arts of murder and jihad. 0.96

00:40:53.460 And I'm talking about children going to summer camps where they learn how to shoot weapons and prepare to be conscripted into Hamas' armed forces and watching children's television shows that feature big stuffed animals that are teaching them how to kill and murder and encouraging them to become suicide bombers.

00:41:19.220 The whole society is structured to teach its population to kill.

00:41:26.900 And that's just a huge problem, not to mention that all the polling of Gazans, and I mean independent good polling, shows that they absolutely hate America at huge, overwhelming majorities. 0.96

00:41:41.620 I'm not saying that every Gazan is a terrible person.

00:41:45.240 I say that it's just a matter of probabilities and numbers, and you have to consider those sort of things when you're assessing homeland security.

00:41:56.460 By the way, you know this.

00:41:58.560 You've worked in intelligence down there.

00:42:01.120 You've dedicated your life to the southern border and stopping these.

00:42:03.520 You wrote the best book on jihad and the southern border.

00:42:05.940 What is the mechanism that Biden hopes to use, and at what scale are we talking about?

00:42:10.000 Let's talk about the mechanism.

00:42:10.980 How does he, because you're the one that's out of them on everything they've tried to do in advance.

00:42:15.660 What are they going to try to do here?

00:42:18.180 Well, they're going to bring, what they want to do is use a longstanding law, refugee law, to anoint individuals, mostly families, especially people who might have a relative already in the U.S.

00:42:35.900 The way the White House spokesman put it a couple days ago was he framed it as we're going to be bringing sick Gazan children here for medical treatment, but not mentioning that they're also going to be bringing that little sick child's whole family in with them as a refugee.

00:42:55.500 Now, refugees, when you get that status, qualify for a green card within a year, and then that counts towards citizenship, so they get four more years before they get U.S. citizenship.

00:43:10.980 My argument is, you know, why do you have to do this?

00:43:14.780 It's unnecessary.

00:43:16.480 They hate America by and large.

00:43:18.580 They're indoctrinated in all of these dark families. 1.00

00:43:23.140 Todd, just hang on one second.

00:43:25.660 We're going to take a short commercial break.

00:43:26.880 Todd Benzman, they're trying to bring Gazans here to the United States as refugees. 0.95

00:43:34.760 Have you heard of cancer-fighting foods?

00:43:36.960 The American Cancer Society discovered diets rich in fruits and veggies may actually lower, let me repeat that, lower your risk of cancer.

00:43:47.040 Now, hopefully, you're motivated enough to run out to the store and get five full servings of fruits and veggies.

00:43:51.920 Okay, let's get back to reality.

00:43:53.820 You're not going to do that.

00:43:55.040 That's why you must consider adding Field of Greens to your daily health regimen.

00:44:01.700 Each fruit and veggie in Field of Greens was doctor-selected for studied health benefits.

00:44:07.640 There's a heart health group, lungs, kidneys, metabolism groups, even healthy weight.

00:44:14.200 What your body needs is in each scoop of delicious Field of Greens.

00:44:19.080 Will Field of Greens prevent or cure cancer?

00:44:22.260 No.

00:44:22.940 But it's so powerful, it promises at your next checkup that your doctor will notice your improved health or you get your money back.

00:44:32.040 Let me repeat that.

00:44:33.040 If your doctor can't sit there and say, hey, I can see that you're actually in better health, you're improving, you get your money back.

00:44:40.360 I got you 15% off and free rush shipping.

00:44:45.180 So visit FieldofGreens.com today and use promo code Bannon for your discount.

00:44:50.280 That's promo code Bannon at FieldofGreens.com.

00:44:54.220 FieldofGreens.com and you get a money back guarantee.

00:44:57.720 The pre-kinetic part, the pre-kinetic part of the Third World War is happening on these campuses right now.

00:45:06.700 It's starting to spill over into Times Square.

00:45:09.460 The other areas of the cities is going to be the Democratic Convention.

00:45:12.100 You're going to have a whole hot summer funded by the Tides organization, Soros, the CCP, Qatar.

00:45:17.760 You see what's going on.

00:45:18.840 Now, Biden's finally revealing they're going to bring, from war-torn Gaza, people who absolutely despise the United States.

00:45:25.440 And I'm not blaming these little kids.

00:45:27.860 They're formed. 0.99

00:45:29.400 The formation is to hate the Jews and to take down Israel and the great Satan, the United States of America. 0.99

00:45:35.980 Those are just the facts. 0.97

00:45:38.060 You cannot bring that here to the United States.

00:45:40.200 We've got enough problems right now.

00:45:42.140 Americans are struggling enough.

00:45:43.540 We don't need that.

00:45:44.260 And I've got to tell you, this is another reason they should cut these budgets.

00:45:48.600 Another reason they should tell Biden and these guys right now, you're not getting a penny for any of this.

00:45:53.060 None.

00:45:53.520 Zero.

00:45:55.360 Todd, what scale are they going to try to do it?

00:45:57.020 Because they're going to pull every lever in the world.

00:45:59.540 Now, I think you make a good point.

00:46:01.120 The reason you wrote this piece in the New York Post, they're trying to raise a trial balloon.

00:46:05.020 And Todd Benzman and others are going to try to shoot it down right now and let people know they take a hard line.

00:46:11.120 How dangerous is this situation?

00:46:13.220 You wrote the number one book on jihad to bring the Gazan War, the Muslim Brotherhood War, here to the United States, sir. 0.99

00:46:21.300 Right.

00:46:21.860 Well, we don't really know.

00:46:23.440 They're not telling us how many they're thinking of bringing in.

00:46:26.160 I mean, but they could bring in thousands, ultimately.

00:46:29.820 I have reports in my email basket right now from people who say that they're seeing Gazans come in right now.

00:46:37.320 They could already.

00:46:38.100 I don't have that confirmed.

00:46:39.100 I'm just saying that it could be happening already, which might be another reason why they are announcing this, quote, quote, proposal.

00:46:47.960 And they talked about it, the White House press secretary, yesterday.

00:46:53.580 And, you know, listen, the point here is that you can help the Gazan war refugees from afar very well.

00:47:01.780 Send the mercy ship over there. 1.00

00:47:04.420 Send doctors.

00:47:05.460 Send aid.

00:47:06.140 Send humanitarian aid.

00:47:07.220 You don't have to bring – help facilitate their transfer to safer neighborhoods like in Jordan.

00:47:16.180 This – hold on.

00:47:17.340 Hang on.

00:47:18.040 This is the whole reason that pier is being built.

00:47:20.440 The pier is being built not just to get supplies in.

00:47:22.560 It's to get people out away from the Israelis stopping it. 1.00

00:47:26.160 But this is where you're going to start to see the refugees in Europe, and they're coming to the United States.

00:47:31.300 So, Todd, what would you argue that the Republican House has to do immediately?

00:47:34.540 They can't sit around and be feckless and hapless like they have been.

00:47:38.260 They've underwritten all of this, all of the NGOs, all of it.

00:47:42.400 As Todd Benzman has gone through time and time again, the invasion of the country is underwritten by the taxpayers, the very people it's set to destroy.

00:47:49.500 What would be – if you got 30 seconds or a minute with Johnson, what would you tell him?

00:47:54.040 Well, first of all, if it's a trial balloon and they're not already bringing in, fire at it.

00:48:01.600 Let people know that this is going to be a problem.

00:48:04.420 If you think it's a problem, then it's got to – you've got to let it be known that this is a national security problem on the one hand.

00:48:11.940 And on the other hand, if people hate America, which all the polling – there's independent good polling that goes back years and years on that population – that the overwhelming majority hates America.

00:48:26.780 Probably not 100 percent, but you can't vet for that sort of thing.

00:48:31.120 People that hate you, you don't want to bring them in.

00:48:34.540 I'm sorry.

00:48:35.120 You don't have to bring them in.

00:48:36.380 And there's the purse strings.

00:48:38.820 So try to find a way to work the purse strings, withhold this or that, stand in the way, gum things up if you don't like the proposal.

00:48:48.800 There are some things that you can do.

00:48:50.740 But ultimately, it is a White House prerogative to – they've lifted the refugee cap already.

00:48:56.720 That's already done.

00:48:58.280 They plan to bring in more and more refugees.

00:49:01.500 Okay, this is another reason Biden should be turfed out.

00:49:05.760 If you want any other reason for the African-American, the Hispanic community, the Asian-American community, these inner cities to bring these refugees in, it's going to be your problem, and they don't care. 1.00

00:49:14.220 Todd, you wrote the number one book on jihad at the border.

00:49:17.440 Walk me through, where do people get your writings?

00:49:19.340 Where do they get this article that just came up, the editorial on the New York Post, and where do they get your social media?

00:49:23.640 Well, the piece in the post just went up about an hour ago.

00:49:28.080 It's fresh, so you can probably see it up there on their site.

00:49:31.960 I'm at toddbensman.com.

00:49:34.460 I work for the Center for Immigration Studies, cis.org, great organization.

00:49:53.820 Doing an amazing job.

00:49:55.440 We're all over this.

00:49:56.860 We knew Biden was going to try to pull this out.

00:49:58.440 Todd, thank you.

00:49:59.120 Thank you for coming on as soon as you got the article up.

00:50:01.640 Thank you.

00:50:01.840 We always like to be the firstest with the mostest.

00:50:25.100 It's going to get so much worse before it gets better, and it's only going to get better if you keep your shoulder to the wheel.

00:50:29.780 Look at what you've just done in the last couple of days about getting the focus on the vast criminal conspiracy against President Trump.

00:50:38.180 You saw it.

00:50:38.640 Peter Navarro, a guy in for a misdemeanor in a federal prison.

00:50:43.300 They won't let Gates talk to him because he's too notorious.
