Transcript

00:00:00.000 I've witnessed so far in my couple hours in there.
00:00:03.220 First of all, Michael Cohen is the prosecution's star witness.
00:00:07.140 This guy is a convicted felon who admitted in his testimony that he secretly recorded
00:00:12.620 his former employer, that he only did it once, allegedly, and that this was supposed to help
00:00:17.340 Donald Trump.
00:00:18.160 Does any reasonable, sensible person believe anything that Michael Cohen says?
00:00:23.700 I don't think that they should, and I actually think that his testimony is going to hurt
00:00:27.140 with any reasonable juror, and hopefully we have a few of those.
00:00:30.720 I want to say two other things here very quickly.
00:00:33.640 Number one, the thing that the president is prevented from saying, which is a disgrace,
00:00:38.980 is that every single person involved in this prosecution is practically a Democratic political
00:00:44.920 operative.
00:00:45.380 The judge inside, his daughter, is making millions of dollars running against Donald Trump, raising
00:00:52.780 money for Donald Trump's political opponents.
00:00:54.700 The number three person in the Department of Justice, Biden's Department of Justice, left
00:00:59.320 to become a local prosecutor to go after Donald Trump.
00:01:02.580 And of course, there's Alvin Bragg, a Soros-funded prosecutor who promised to go after Donald Trump
00:01:08.060 and now is doing exactly that.
00:01:10.060 Now look, whether you love Donald Trump, whether you like Donald Trump, or whether you're a Democrat
00:01:14.600 or don't care about politics, what's going on inside that courtroom is a threat to American
00:01:20.300 democracy, ladies and gentlemen.
00:01:22.040 We cannot have a country where you get to prosecute your political opponents instead of persuading
00:01:28.100 voters.
00:01:28.920 Joe Biden's entire strategy is to try to distract from inflation at home and war overseas with
00:01:35.760 this sham trial.
00:01:37.000 I just want to live in a reasonable country where we try to persuade voters in our politics.
00:01:42.600 We don't try to throw our political opponents in jail.
00:01:44.600 So this is a disgrace.
00:01:45.900 And I wanted to be here to show some support from my friend and speak.
00:01:49.640 First of all, I'm disappointed in the courtroom.
00:01:52.000 I'm hearing Mr. Trump, Mr. Trump, he is former President Trump.
00:01:57.780 Give him some respect.
00:01:59.900 I mean, that's what that place is in there.
00:02:01.680 It's no respect.
00:02:03.580 Here's what I'm seeing too.
00:02:04.880 It is depressing.
00:02:06.140 That courtroom is depressing.
00:02:07.580 This is New York City, the icon of our country.
00:02:12.320 And we've got a courtroom that's the most depressing thing I've ever been in.
00:02:16.940 Mental anguish is trying to be pushed on the Republican candidate for the president of the United States this year.
00:02:23.980 That's all this is.
00:02:24.860 He's been here a month.
00:02:26.280 He's been here a month.
00:02:27.080 I am disappointed in looking at the Americans, supposedly American citizens in that courtroom that the D.A. comes in and he acts like it is his Super Bowl.
00:02:37.720 And I guess it is, to be noticed.
00:02:40.360 But that's what's happening in this country.
00:02:42.840 The Republican candidate for president of the United States is going through mental anguish in a courtroom that's very depressing.
00:02:50.940 Very depressing.
00:02:52.760 I'm glad to stand by President Trump.
00:02:55.260 I'm a friend of his.
00:02:56.420 I'm here more as a friend than backing him as candidate, as president.
00:03:02.020 For the country, it's sad for New York.
00:03:04.020 I mean, New York, that a judge who's highly conflicted at a level that nobody's seen before can possibly just think of it.
00:03:13.320 And you should go out and check it out.
00:03:15.780 But we have a corrupt judge.
00:03:18.140 And we have a judge who's highly conflicted.
00:03:20.880 And he's keeping me from campaigning.
00:03:23.300 He's an appointed New York judge.
00:03:26.120 He's appointed.
00:03:28.200 You know who appointed him?
00:03:30.120 Democrat politicians.
00:03:31.860 He's appointed.
00:03:32.640 He's a corrupt judge and he's a conflicted judge.
00:03:36.380 And he ought to let us go out and campaign and get rid of this scam.
00:03:40.480 Every single legal analyst, even CNN, even MSDNC, is saying, there's no case here.
00:03:49.940 Thank you very much.
00:03:51.720 What's the next time you're going to be on the campaign show instead of wiggling with wealthy donors?
00:03:55.460 This is the primal scream of a dying regime.
00:04:08.340 Pray for our enemies.
00:04:09.520 Because we're going medieval on these people.
00:04:12.180 I got a free shot at all these networks lying about the people.
00:04:17.820 The people have had a belly full of it.
00:04:19.820 I know you don't like hearing that.
00:04:21.240 I know you try to do everything in the world to stop that.
00:04:22.920 But you're not going to stop it.
00:04:23.860 It's going to happen.
00:04:24.900 And where do people like that go to share the big line?
00:04:28.520 MAGA Media.
00:04:29.860 I wish in my soul, I wish that any of these people had a conscience.
00:04:35.300 Ask yourself, what is my task and what is my purpose?
00:04:39.060 If that answer is to save my country, this country will be saved.
00:04:45.440 War Room.
00:04:46.260 Here's your host, Stephen K. Band.
00:04:48.600 It's Monday, 13 May, the year of our Lord, 2024.
00:04:57.840 Another day that we'll live in a legal system.
00:05:01.300 Let's go directly outside the courthouse in Manhattan.
00:05:04.980 Our own Andrew Giuliani.
00:05:07.080 Andrew, this is a trial.
00:05:12.100 It's in search of a crime.
00:05:13.240 And today you had the chief clown, Michael Cohen, in there for about, I guess, six, seven, eight hours.
00:05:20.100 Give us an update.
00:05:22.840 Steve, you had the prosecution right from the very beginning of the day call Michael Cohen.
00:05:28.540 There was some talk about whether they'd call a witness before him.
00:05:31.120 Michael Cohen came out.
00:05:32.680 And the prosecution has yet to rebuild Cohen's credibility.
00:05:36.360 They've asked Cohen all different kinds of questions with regard to his relationship with President Trump,
00:05:41.160 what he did for President Trump, all different things regarding the alleged repayment of Karen McDougal,
00:05:49.280 the Playboy Playmate, all different things regarding the repayment for Stormy Daniels.
00:05:55.020 They tried to back it up with text messages, with call logs.
00:06:00.040 But the thing that we've seen so far up until this point, Steve, is that it still relies on the word of Michael Cohen connecting Donald Trump to these alleged repayments at this point.
00:06:14.100 Also, a couple notes here, and a colleague pointed this out, and I thought it was very, very, very, very good.
00:06:19.000 I mentioned to you this morning that President Trump was recorded by Michael Cohen on a voice memo.
00:06:25.440 That President Trump did not know about Michael Cohen coming into his office regarding the $150,000 payment to Karen McDougal.
00:06:33.520 That would certainly be a violation of the attorney-client privilege.
00:06:37.280 But even with that being said, that voice memo did not actually, in my opinion, have anything incriminating on there.
00:06:45.140 It was a little bit inaudible.
00:06:46.460 But President Trump didn't seem to say anything that in any way would have incriminated him.
00:06:52.580 On top of this, the alleged questioning was something that the statute of limitations had expired on, and it was an underlying misdemeanor.
00:07:02.220 Later this afternoon, Mr. Cohen presented, the district attorney presented a piece of evidence that Michael Cohen claimed.
00:07:08.700 Alan Weisselberg wrote saying that he was going to gross up his repayment to Michael Cohen to $360,000 because Cohen was owed $180,000.
00:07:19.180 Think about the taxes that would be taken out there.
00:07:21.700 Cohen says that that's from Weisselberg.
00:07:23.840 But again, it depends on the word of convicted felon, perjurer to Congress, and serial liar Michael Cohen.
00:07:32.460 And right now, the prosecution has not done anything to show any evidence where Cohen is not the linchpin.
00:07:40.820 Cohen's word is not the linchpin in this entire case.
00:07:44.800 Andrew, talk to us about Tommy Tuberville.
00:07:46.900 J.D. Vance and Tommy Tuberville came to the sticks afterwards to make some comments.
00:07:53.900 J.D. went through the logical deconstruction of this bogus case.
00:07:59.340 Tell me, Senator Tuberville took a very different direction and talked about the psychological warfare against President Trump in this dingy courtroom, the lack of respect, kind of the arrogance of the prosecutor.
00:08:12.560 Your thoughts?
00:08:14.120 Yeah, I made a note on exactly what Senator Tuberville ended up saying at the sticks, as a matter of fact, earlier this morning.
00:08:19.840 I had noticed that every time that Mershon greets President Trump, good morning, Mr. Trump, Todd Blanche ends up saying, before Mershon comes out as they are making the introductions, saying who they are representing, Todd Blanche, Emile Beauvais, Susan Nicholas, attorneys for President Trump.
00:08:39.320 Mershon responds by saying, good morning, good morning, Mr. Trump.
00:08:42.640 And to me, it's the exact point that Tommy Tuberville is making.
00:08:47.320 It's a backhanded slap at President Trump.
00:08:50.040 It's a backhanded slap at the tens of millions of people that elected President Trump.
00:08:55.340 And sadly, it's in line, I believe, with Mershon and his family, how they have profited, how his family has profited.
00:09:02.640 His daughter making over $90 million for the consulting firm off of Democratic candidates and PACs, including Kamala Harris, $37 million from Adam Schiff and from Joe Biden as well.
00:09:16.760 So I think that's a great point by Tommy Tuberville.
00:09:19.280 Do you see Bragg in this crowd, Colangelo?
00:09:24.840 Are they circling around the crime now?
00:09:26.920 Are they trying to narrow it down on Cohen's testimony about exactly what they're going to focus on as far as election interference goes in the 2016?
00:09:38.180 Because this is like the most ludicrous thing I've ever heard.
00:09:40.220 But do you see some sort of strategy from the prosecution here?
00:09:44.520 Yeah, you do.
00:09:45.040 And you heard a couple of different times this afternoon Michael Cohen saying the reason why this was repaid was because there was a presidential election coming up.
00:09:55.960 So you can see that that's exactly what they're trying to do.
00:09:59.000 They're trying to make that connection.
00:10:00.440 They're trying to say that there was election interference here.
00:10:04.520 And the payment would not have been made without that.
00:10:06.840 Now, that goes in contrast to Pecker's testimony, David Pecker, who ended up saying that they had done this for hundreds of celebrities.
00:10:14.480 Right. Talking about celebrity, not talking about anything with politics.
00:10:18.100 It goes in contrast with Hope Hicks, who said that this would have been embarrassing for the Trump family.
00:10:24.440 Talking about how President Trump's motive of the alleged payment was actually family and keeping them out of the press and keeping himself out of the press because it would be embarrassing.
00:10:34.300 Michael Cohen is obviously trying to say that the reason why the motive for President Trump making this payment was because of the presidency.
00:10:42.120 In terms of Alvin Bragg, he has been in the courtroom this morning.
00:10:46.880 He was in there.
00:10:47.620 He was not in this afternoon.
00:10:48.940 And this is two days in a row that Bragg was in there.
00:10:51.320 The first time that Alvin Bragg has been in the courtroom with a witness of note.
00:10:56.420 He wasn't in with Hope Hicks, wasn't in with Keith Davidson or with Stormy Daniels.
00:11:00.840 He came in on Friday, but he was there front row with the district attorneys, with the assistant district attorneys for Michael Cohen.
00:11:09.860 Let's do some scheduling here.
00:11:12.260 President Trump, court is out on Wednesday.
00:11:14.260 President Trump is going to his son's barons graduation, I think, on Friday.
00:11:19.840 Do you think the prosecution keeps going up tomorrow and Thursday?
00:11:23.920 Is it another two days of testimony by the prosecution to lay out their case?
00:11:28.220 Mershon actually asked the prosecution that as we were leaving, the prosecution said that we will probably go into it some point tomorrow.
00:11:37.240 That's what they said. At some point tomorrow, questioning will likely wrap up.
00:11:41.940 Doesn't mean it's a commitment that it will, but it will likely wrap up, at which point the Trump defense team will then start questioning Michael Cohen.
00:11:49.640 So that could happen at some point tomorrow, late morning, could be late after, could be in the afternoon.
00:11:55.320 It could be until Thursday when the defense gets the opportunity to cross-examine.
00:12:00.660 But, Steve, you probably know this as well as I do.
00:12:05.660 I wonder just how many documents are going to be presented by the defense team showing Michael Cohen had lied in the past.
00:12:14.580 I can imagine this could be a very, very long cross-examination just because I think it's very important that the defense shows the jury that Michael Cohen had been caught in so many lies in the past.
00:12:27.740 It'll be very interesting to see if Judge Mershon tries to move that along or allows the defense to continue to present all the different lies that Michael Cohen caught himself in.
00:12:38.640 Well, it's also your point that they haven't tried to build up his credibility at all in front of the jury.
00:12:44.440 They're just starting cold with the facts. That's what I find quite interesting.
00:12:47.840 And if they're telling the judge they may wrap up tomorrow before the Wednesday or before the Tuesday evening court break that doesn't come back to Thursday, I find that pretty surprising.
00:12:59.040 Since this guy's the linchpin, I don't believe they're calling Miss December the playmate bunny.
00:13:05.200 I think they've already said they probably are not going to call her.
00:13:07.920 With only two days up of Cohen, I'm kind of shocked by that, and particularly the fact that they haven't tried to rehabilitate this guy from what people think is a—
00:13:16.940 Now, they will get a chance after the cross-examination. Any thoughts on that before we bounce, Andrew?
00:13:23.300 Yeah, you're right. Karen McDougal won't be called. I think it may just be an impossible task.
00:13:27.960 Again, Cohen, just a few short days ago on his podcast, had a white shirt of President Trump behind bars.
00:13:35.860 And the judge, just on Friday, was begging with the prosecution to get Cohen to be quiet.
00:13:41.500 The prosecution said they've reached out many times, and Cohen just won't listen to them.
00:13:46.000 So the prosecution might just realize that it's an impossible task, and they may seem disingenuous to the jury trying to do that.
00:13:53.500 So they may just be presenting Michael Cohen, warts and all, for what he is to the jury,
00:13:58.940 and hoping that the jury is so biased going into this that they look beyond Michael Cohen, perjurer to the United States Congress.
00:14:08.780 Andrew, where do we get you? What's all your touch points on social media?
00:14:12.820 Yeah, at Andrew H. Giuliani. We're live tweeting. We're live truthing from the courtroom there,
00:14:18.640 and we'll continue to do it here as this Trump show trial continues.
00:14:23.180 We'll be there for the show trial tomorrow. Thank you, Andrew Giuliani.
00:14:27.960 Okay, times of turbulence. You've got President Trump up in every poll.
00:14:31.580 You've got President Trump up in every crosstab.
00:14:34.240 You've got President Trump up with every demographic in all the battleground states.
00:14:38.460 They're getting more and more desperate.
00:14:40.680 Times of turbulence are upon us, particularly if you look forward for the next year,
00:14:44.820 to the election, between the election and the inauguration day,
00:14:47.640 and then the first hundred days of President Trump's second term.
00:14:51.140 You know what a hedge against turbulence is? Gold.

00:15:02.840 Think about what you've put away for the future.
00:15:05.900 Inflation can render cash worthless.
00:15:09.720 Real estate can crash like in 2008.
00:15:12.340 Economies built on a mountain of debt can fall like a house of cards.
00:15:16.000 There are very few physical assets you can invest in that can stand the test of time.
00:15:22.460 Gold has withstood this as a valued form of money for millennia.
00:15:27.340 I actually think for 8,000 years of man's recorded history.
00:15:31.220 It's why people are flocking to it now.
00:15:33.000 Why Birchgold is busier than ever.

00:16:19.780 I think calling a bimbo porn star is pretty offensive.
00:16:23.960 And I'd like to ask you what you make of the trial in terms of the possibility
00:16:30.020 that actually, in a way, that Donald Trump could benefit, you know, from his, certainly
00:16:36.140 from his base, but benefit, because you might have heard Anthony Zurcher saying that it is
00:16:40.920 having an impact on the campaign, but it may not be a negative one.
00:16:44.100 You just had a bimbo porn star come out and accuse President Trump of trying to have a
00:16:48.660 threesome with Stormy Daniels.
00:16:50.720 This woman is so credible that the prosecutor doesn't want to call her in to be a witness.
00:16:55.400 Let me just be quite clear.
00:16:57.180 Let me just ask you a question.
00:16:58.860 You think.
00:17:00.720 Okay, we cut that too tight.
00:17:02.680 I got to have that longer where she calls when Mike Davis says, well, what do you think
00:17:06.920 she is?
00:17:07.440 And the response is a film actress star, Mike Davis.
00:17:11.680 I tell you, Mike, it's a guilty pleasure of mine.
00:17:14.160 I watched that over and over again.
00:17:16.120 That is, I think, go down in the annals of British Broadcasting Corporation as maybe
00:17:21.760 the greatest trolling on an interview ever.
00:17:25.400 But I digress.
00:17:26.740 I digress.
00:17:27.320 Although, it's a joke.
00:17:29.020 This trial's a joke.
00:17:30.120 I mean, how can you take it seriously when you see the great Michael Cohen up there today
00:17:34.240 babbling on the witness stand?
00:17:36.800 And Tommy Tuberville, the great senator from Alabama, summed it up.
00:17:39.960 This is just a farce.
00:17:41.720 It's a sigh up on President Trump.
00:17:43.880 This is a guy that they have in this, basically this cage four days a week, and he still goes
00:17:49.200 to Wildwood, New Jersey and draws 100,000 people on a chilly and very windy Saturday afternoon,
00:17:57.320 Mike Davis.
00:17:58.180 Yeah, Steve.
00:17:59.260 So we've said for 22 months since the Mar-a-Lago raid that this election interference, this law
00:18:05.120 fair and election interference by President Biden and these Biden Democrats would backfire.
00:18:10.560 And what, we're in week five of this bogus criminal trial in New York, and you have New York Times
00:18:17.880 polling coming out that shows President Trump is crushing Biden in every swing state.
00:18:23.920 This is going to be a tsunami election if we continue down this path.
00:18:28.700 These Democrats thought that they were going to meddle in the Republican primary and get
00:18:34.420 the Republicans to nominate a weakened, wounded Trump and destroy him on November 5th.
00:18:39.920 And we've made that backfire.
00:18:42.300 We've made that backfire badly on these Democrats.
00:18:45.720 Now Trump is going to beat Biden like a drum on November 5th, as we've predicted and made
00:18:52.460 happen over the last 22 months.
00:18:55.180 Okay, Mike, so the federal judge is jumping in the Mar-a-Lago raid, as you call the appellate
00:19:02.380 courts jumping in to hold us, Fannie Willis, accountable.
00:19:06.720 But now finally, with enough bandits to the back, we have a weaponization committee on Wednesday
00:19:12.860 bringing in a couple of lawyers.
00:19:14.700 And now we're hearing that they're doing a markup right now of a contempt for Garland for
00:19:20.080 the Biden videos on his deposition, not turning him over to the House.
00:19:24.800 Walk me through exactly.
00:19:26.220 The House should be taking massive action and you're having kind of fits and starts and sharply
00:19:30.900 worded letters and and reports and all this.
00:19:34.020 It's not cohesive.
00:19:35.300 It's not a coherent plan right now.
00:19:37.180 But you maybe you can see the makeup or the outline of a plan.
00:19:40.640 What's going on in particularly these two events this week?
00:19:43.200 Well, yeah, I mean, they're nice, but what needs to happen is you have these Biden Democrats
00:19:50.820 have President Trump in a Manhattan courtroom for the last month instead of the campaign
00:19:58.080 trail.
00:19:59.140 Why aren't these House Republicans putting Alvin Bragg and Matthew Colangelo and Big Tish James
00:20:07.200 at Big Fannie Willis and her dumb, unqualified boyfriend, Nathan Wade and Jay Bratt and Jack
00:20:13.680 Smith and Jonathan Suh and all these other Democrat operatives, these Biden Democrats who are running
00:20:22.060 this republic ending election interference in lawfare.
00:20:26.200 This is a criminal conspiracy under 18 U.S.C.
00:20:30.100 Section 241, conspiracy against rights.
00:20:34.380 And these Democrats, these Biden Democrats, have walked through an open door for the last
00:20:38.900 two years.
00:20:39.920 And the reason they've opened through, walked through an open door is because Republicans
00:20:44.840 have not put up a fight.
00:20:46.560 House Republicans have not put up an effective fight, right?
00:20:50.440 You have two U.S. senators taking the time to go up to New York today to provide their support
00:20:57.340 of President Trump.
00:20:59.180 Yet House Republicans can't put these Biden Democrat operatives in a chair.
00:21:04.380 For a staff deposition and get their documents.
00:21:07.480 And God forbid they hold a public hearing.
00:21:10.240 What is the excuse for not calling in Matthew Colangelo to sit in a chair for a staff deposition,
00:21:17.460 for example?
00:21:18.120 What is the excuse for that?
00:21:19.780 He was deployed from the number three office in the Biden Justice Department.
00:21:24.680 If President Trump talks about the fact that Matthew Colangelo got deployed from the number
00:21:30.780 three office in the Biden Justice Department.
00:21:32.380 If President Trump merely posts a news story that mentions Matthew Colangelo's name, this
00:21:37.400 corrupt Manhattan judge, Juan Mershon, who donated to Biden and whose adult daughter is raising
00:21:43.040 millions off of this unprecedented criminal trial over which her corrupt father is presiding,
00:21:48.820 Trump goes to jail.
00:21:49.740 Trump can't mention Trump can't respond to Stormy Daniels, a porn star who's changed her story more
00:21:56.660 than her sex partners in her porn scenes.
00:21:58.820 And Michael Cohen, this disbarred, convicted perjurer and felon who's changed his story,
00:22:06.780 they are online trashing Trump as the star witnesses.
00:22:10.080 They're raising money on TikTok with Michael Cohen.
00:22:13.600 Michael Cohen's peddling his book.
00:22:15.620 Stormy Daniels is peddling her porn sites on Twitter.
00:22:19.140 They're trashing Trump.
00:22:20.200 If Trump responds, he goes to jail.
00:22:23.000 If Trump talks about Lauren Mershon, the judge's daughter, raising millions of dollars off this
00:22:28.600 case, requiring Judge Mershon's recusal under New York statute, Trump goes to jail.
00:22:33.560 If Trump even mentions that this Manhattan jury pool voted 87 percent for Biden, Trump goes to jail.
00:22:40.200 This is an illegal, unconstitutional gag order on a criminal defendant who happens to be a former
00:22:46.320 president and the leading presidential candidates.
00:22:49.400 And where the hell are the House Republicans?
00:22:51.320 Why are they not issuing subpoenas for witnesses and documents right now?
00:22:57.180 We are in week five of this trial.
00:22:58.920 Where the hell are they?
00:23:00.420 Tell me about Andrew Giuliani said at the beginning that Cohen was up on TikTok the other night
00:23:06.280 trashing Trump with a, he had a t-shirt on that showed President Trump, I think, an orange jumpsuit
00:23:11.840 behind bars.
00:23:13.240 And the prosecution said, well, we can't control him.
00:23:16.020 I thought that's what a gag order was about.
00:23:17.800 So the prosecution couldn't have witnesses out trashing somebody to the general public.
00:23:23.100 How does that work?
00:23:24.160 That Cohen could go out and the prosecution go, well, we tried.
00:23:27.120 Tell the judge what we tried.
00:23:28.100 We can't control him.
00:23:29.440 The judge should have issued a gag order on Stormy Daniels and Michael Cohen, the witnesses
00:23:33.980 in this case.
00:23:35.660 The whole point of a gag order is to protect the criminal defendant.
00:23:39.760 It is a limited time, place, and manner restrictions on free speech rights to ensure that a criminal
00:23:46.660 defendant has his constitutional rights protected during a criminal trial.
00:23:51.280 These Biden Democrats have turned the Constitution on its head by gagging criminal defendants.
00:23:57.260 If Trump obstructs justice by tampering with witnesses, there are statutes that you can charge.
00:24:02.980 You can charge him under the criminal statutes.
00:24:04.780 But to put this vague and overbroad gag order, prior restraint on his constitutional rights
00:24:11.200 to speak out, especially during a presidential campaign, is clearly illegal.
00:24:16.600 It's clearly unconstitutional.
00:24:19.460 It is a criminal conspiracy against rights under 18 U.S.C.
00:24:25.800 Section 241.
00:24:27.140 And it's not like it'd be hard for the judge to issue a gag order for someone like Stormy
00:24:31.880 Daniels.
00:24:32.380 I mean, let's just face it.
00:24:33.660 She's used to gag orders.
00:24:36.600 Mike Davis, how can people get you an article there?
00:24:39.280 I want to tell the audience, we're going to be pounding every day and we're pounding
00:24:41.720 behind the scenes to make sure that the House, you know, Johnson's like, oh, it's nothing
00:24:47.260 I can do.
00:24:48.120 I can't shut down the FBI.
00:24:49.560 I can't defund anybody.
00:24:50.720 There's a lot you can do.
00:24:51.900 And we're going to continue to pound and pound and pound this Wednesday.
00:24:54.900 Weaponization is just the first step.
00:24:56.360 But we hope quite soon we're going to have a real House Judiciary Committee come forward
00:25:03.120 and start letting subpoenas fly and start to have the back of President Trump, because
00:25:07.040 what's happening right now is destroying our system.
00:25:10.060 And the American people are telling you through the polls that they've had a belly full of
00:25:14.240 they're fed up with it.
00:25:15.720 Mike Davis, Article 3, your action, action, action.
00:25:19.240 You got any other observations, Mike?
00:25:21.520 Yeah, we're in what?
00:25:22.320 We're in week five and Jim Jordan's weaponization committee is just putting lawyers on the on
00:25:27.780 the stand who have just opinions about the case.
00:25:30.620 Like, give me a break, Jim Jordan.
00:25:32.540 Get the real witnesses on the stand.
00:25:34.220 Get Matthew Colangelo and Gary Stern at the National Archives and Jay Bratt and Jonathan
00:25:40.740 Su.
00:25:41.160 Let's get the real witnesses on the stand instead of this show trial that you want to have among
00:25:45.780 House Republicans.
00:25:46.660 We already have a show trial in New York.
00:25:48.740 We don't need a show trial in Washington, D.C.
00:25:51.260 People can go to Article3Project.org.
00:25:54.640 You can donate there.
00:25:56.160 You can take action there.
00:25:57.460 One of the action items you can take is supporting Congressman Andrew Clyde's appropriation writers,
00:26:03.300 champions by Article3 projects, to light up both of your home state senators and your
00:26:09.320 House representative and tell them to pause all this funding, federal funding for Jack
00:26:14.480 Smith and these three state and local prosecutions of Trump.
00:26:17.900 They waited seven years for this Brad case.
00:26:21.440 They waited three years for these other three cases.
00:26:23.860 They're timing these trials for the presidential election.
00:26:26.940 They can wait until after the election to go after Trump.
00:26:30.040 This is lawfare and election interference.
00:26:31.540 If they want to prosecute Trump, do it after the election.
00:26:34.880 Let the American people, instead of these Democrat prosecutors and judges and witnesses
00:26:39.400 and operatives in these Democrat hellholes of New York, D.C. and Atlanta, decide this
00:26:44.100 next presidential election.
00:26:45.460 You can also get our social media on Article3Project.org and let's turn up the heat on House Republicans.
00:26:53.760 No, we have to have a massive investigation here, all the way from Arizona to Michigan to Georgia.
00:26:59.300 And of course, the federal cases, the federal cases also.
00:27:03.820 Mike Davis, thank you for coming on.
00:27:05.240 Thank you for being on Point on this.
00:27:07.160 Thank you.
00:27:07.540 This is a disgrace.
00:27:11.420 There should be so much action taking place in the House.
00:27:14.100 The counter narrative here is the vast criminal conspiracy against President Trump, and it's
00:27:20.140 up in your grill.
00:27:21.600 Whether it's the number three, you know, Lisa Monaco, the number three to Lisa Monaco and
00:27:25.780 Merrick Garland seconded up there.
00:27:28.680 Matthew Colangelo, whether it's Jack Smith, what he did to entrap President Trump on the
00:27:34.440 classified documents from Arizona to Michigan, what the state AGs did, all the coordination,
00:27:40.280 all the coordination with MSNBC and all the commentators and observers up there, all of
00:27:45.960 it.
00:27:46.460 And it's quite simple to get this rolling.
00:27:48.620 And we need this rolling.
00:27:50.060 We need it rolling now.
00:27:50.980 We need the subpoenas to fly.
00:27:52.900 Wednesday is a kickoff.
00:27:54.220 But once again, that's just lawyers talking about what their thoughts are on the case.
00:27:57.760 It's fantastic.
00:27:59.100 But it's got to be a lot more than that.
00:28:00.720 And the markup on Garland's about the audio is fine, but it's not enough.
00:28:05.740 And we're not going to just sit here and have some sort of performative effort satisfies.
00:28:11.740 It does not.
00:28:13.500 Short break.
00:28:14.020 Back in the warm in a minute.
00:28:19.760 Most emergencies come without warning.

00:29:32.100 MyPatriotSupply.com.
00:29:33.160 Here's your host, Stephen K. Band.
00:29:39.020 I really want to give this audience a shout-out.
00:29:42.300 If you heard this morning, Patrick K. O'Donnell.
00:29:45.720 Now, Patrick K. has, I don't know, he's written 10, 12, 15 books.
00:29:49.980 Tons of bestsellers.
00:29:51.420 He's kicking off his book launch for The Young Vanquish.
00:29:55.940 And then he had this, he said one of the most important book launches he's ever had at Appomattox.
00:30:01.180 They gave a talk.
00:30:02.020 And there were War Room Posse members up there that went to dinner afterwards.
00:30:05.360 Somebody came up to him after the event.
00:30:08.620 They're just so nice, so interested, so really dialed in.
00:30:16.240 And then he heard Field of Greenish.
00:30:17.540 Remember, one of the things we do when we have sponsors, we want to make sure you have access to the CEOs.
00:30:22.080 So we had Miles Grimard on.
00:30:24.380 And, you know, Miles, these people have sponsored so many shows.
00:30:29.060 And they had a staff meeting the other day.
00:30:30.740 And the staff brought up that when people call in or people are emailing them, making contact with them,
00:30:39.160 when they use the promo code for War Room, promo code for Bannon, he says these people are the nicest people.
00:30:44.320 They want more information.
00:30:46.020 They're just fantastic.
00:30:47.280 The other night, I gave a speech, honored to give a speech in front of the Palm Beach Republican Club.
00:30:53.020 And I think 80% of the audience were War Room Posse listeners.
00:30:58.180 It was just incredible afterwards, the feedback on the show and how interested you guys are in the information and continue to put out information.
00:31:04.840 And so just honored to do this.
00:31:07.480 We're building a huge and vast community, not just across the country, but across the world.
00:31:12.880 And it's really all about you.
00:31:15.160 We provide a platform to give you information and analysis you're not going to get anywhere else.
00:31:21.480 We combine, as you know, capital markets, macroeconomics, geopolitics, national security, the details of grassroots politics here,
00:31:29.860 all the way to the deck plates of the precinct strategy and school boards.
00:31:33.820 Also, we bring in the top thinkers in the MAGA movement.
00:31:37.300 One's going to join us in a minute, Dr. Carol Swain.
00:31:39.720 But to talk to you about the most important, not just issues of the day, but how they drive things going forward.
00:31:45.480 Because we're just not here to report kind of what's hot and to do hot takes on the news today.
00:31:50.380 But I really appreciate this audience, and particularly when we get feedback from our sponsors all the time,
00:31:56.260 that said these guys are so, they want to immerse themselves in information.
00:31:58.920 They're so polite, they're so nice, but they have, they're curious, they're curious.
00:32:05.060 And that's one of the great things about this audience.
00:32:06.960 Birch Gold, we're going to announce something a little different on Birch Gold on the end of the dollar empire.
00:32:12.400 We've had such a huge demand for it.
00:32:14.160 Now we've got five free installments.
00:32:16.500 Remember, we go out of our way to make sure all the content here in the worm is free and ubiquitous,
00:32:21.620 so you can get it and share it.
00:32:23.060 Jane Zirkel is going to be talking about polling in a second.
00:32:25.080 One of the ways we've changed the narrative with President Trump is you guys being force-multipliers.
00:32:30.980 What does that mean?
00:32:32.160 Just getting information and sharing it.
00:32:34.140 This is one of the things I told Palm Beach, the Palm Beach crowd the other night,
00:32:36.980 and there were a lot of big donors there and a lot of very successful people and a lot of people that had money.
00:32:43.580 And I told them, right now, it's not your money.
00:32:45.660 It's your engagement.
00:32:47.060 It's your engagement of self and your being into this fight.
00:32:50.520 And to become a force-multiply and change the people in your circle around you.
00:32:54.480 Now, as I keep saying, get up in people's grills.
00:32:56.300 Show them the information.
00:32:57.300 Do not back down.
00:32:58.640 It's having a massive impact.
00:33:00.240 This is the whole tectonic plate shift against the corporate media,
00:33:04.700 against all the cultural institutions, against the universities, against all of it.
00:33:08.600 It's working.
00:33:09.820 It's working, and they know it's working.
00:33:11.500 That's why one of their smartest guys, Fareed Saqqara, was on CNN yesterday on his weekly show,
00:33:17.140 and he said, hey, look, I was dead wrong.
00:33:19.020 I didn't think we'd be here with Trump.
00:33:20.920 But we're wrong, and this is not working.
00:33:23.340 And right now, Biden's not going to beat Trump.
00:33:25.660 And if there's not major course corrections, be prepared for a second Trump presidency.
00:33:30.680 He said it in a little classier way than what Jim Carville said.
00:33:34.500 And these are some of the smartest guys on their side of the football.
00:33:36.880 Mark Penn, huge article, I think it was up in the Hill the other day, just said, hey, this is not working.
00:33:42.500 There needs to be a major course correction.
00:33:44.400 Why?
00:33:45.400 Because you, this audience, we are relentless about putting this information out.
00:33:49.220 So make sure you go to birchgold.com slash Bannon.
00:33:52.540 Get the end of the dollar empire, all five free installments.
00:33:55.120 And talk to Philip Patrick.
00:33:56.860 We lay at the macro case here, but you've got to talk to people that know the details.
00:34:01.920 Not just know the instruments, but know the microeconomics of it.
00:34:04.640 So talk to Philip Patrick and the team, why gold has been a hedge for, I don't know, 8,000 years, 8,000 years, I think it is, of man's recorded history.
00:34:12.780 Dr. Carol Swain, one of the smartest public intellectuals we have on the side.
00:34:17.400 You've been in a firefight.
00:34:18.980 You're an Ivy leaguer and have had a firefight with the Ivy League.
00:34:22.000 My question is, you're seeing right now, you're seeing the payback of having Marxist professors, Marxist faculty senates, Marxists that get tenured, these administrators that are even worse than Marxists combined with the Sharia supremacists to have a witch's bruise in these college campuses.
00:34:40.180 They even walked out, poor Jerry Seinfeld tried to give a commencement at Duke, and I think, I don't know, 10 percent of the students walked out the pro-Palestinian, which is the most anti-American movement I've ever seen.
00:34:52.000 Your thoughts, Dr. Carol Swain?
00:34:54.380 Well, I mean, this revolution that we see playing out on the college campuses, it's been a long time coming.
00:35:01.380 I think back to my Princeton years in the 1990s, when there was so much about critical theory and postmodernism and people talking about, you know, the critical race theory, we saw that all these theories during the Obama administration, that they literally took over the colleges and universities.
00:35:23.580 And the parents that complained about critical race theory at DEI, they became aware in 2020, it was going on much longer than 2020, and what I saw gradually happen was that the conservative professors, they were either ousted or circumstances were made so difficult that many chose to leave.
00:35:45.860 I believe I was among the ones that decided to take early retirement in 2017, I don't regret that, because I believe, being part of the war room, being part of this vast army, that I have far more influence in the world now than I would have had on that college campus where I was being stifled.
00:36:08.800 There's no doubt.
00:36:09.860 I mean, you're one of our leaders.
00:36:11.240 You've particularly singled out Professor Gay at, I think it is, at Harvard.
00:36:19.320 You're going to pursue that.
00:36:20.400 You think that's a combination of anti-Semitism, plagiarism?
00:36:24.540 Tell me about your fight.
00:36:25.960 You continue your fight at Harvard.
00:36:27.500 You were actually the first to bring up the plagiarism situation there.
00:36:32.120 Where do we stand with this?
00:36:33.280 Because if you can't get the intellectual integrity of these Ivy League universities, particularly at the highest levels, correct?
00:36:41.240 Then you're not going to have a university.
00:36:43.360 Well, first of all, my pursuit of academic integrity is bigger than Claudine Gay.
00:36:49.820 I mean, she's just a pawn in something that's much larger.
00:36:54.080 We know that all the college and universities, the major ones, have plagiarists on their faculty.
00:37:01.280 Not all of them are racial and ethnic minorities, but quite a few that Chris Rufo has exposed are racial and ethnic minorities.
00:37:09.280 And what's happening is that the colleges and university administrators are trying to make the argument that everyone plagiarizes, that it's common.
00:37:17.640 And it is not common.
00:37:20.000 And what they are doing in the process is lowering academic standards for everyone.
00:37:26.200 There will be a negative ripple effect that will hurt K-12 education unless people stand up.
00:37:32.280 And I am standing up.
00:37:34.160 I have a legal team.
00:37:36.140 They did contact Harvard University.
00:37:38.300 Harvard University responded that the pleasurism of my work was fair use and that if I pursued it, it would be a frivolous lawsuit and I would have to pay court costs.
00:37:50.440 And I intend to pursue it.
00:37:53.620 I've also been told that a successful case will cost more than $100,000.
00:37:58.420 So I'm using Give, Send, Go, a Christian platform to raise money for the legal expenses that I've already invested part of mine.
00:38:09.560 But there will be a lawsuit against Harvard.
00:38:12.040 I believe we will win it.
00:38:13.820 And they tried to bully people, especially, you know, people like me.
00:38:18.340 I don't think they've done that homework.
00:38:20.800 Obviously, they don't know who I am.
00:38:22.700 They have not read my work.
00:38:24.380 They have not read my work and compared it to her work.
00:38:27.440 And it's so much that I cannot walk away from it.
00:38:31.040 So it's the wrong person they're dealing with.
00:38:34.000 No, they got the wrong person.
00:38:35.760 Dr. Carol Sweeney is tough as boot leather.
00:38:38.100 Here's why.
00:38:38.940 When they use that excuse, when everybody plagiarizes something, nobody ever accused you of plagiarizing.
00:38:44.560 They plagiarized your work because you had belt and suspenders and great original research.
00:38:49.680 That's why she used your work, correct?
00:38:52.000 Well, you know something.
00:38:53.060 If you look at Roland Fryer, Glenn Lowry, Thomas Sowell, all of us are racial and ethnic minorities that came from the underclass.
00:39:05.040 You know, we were the poor ones.
00:39:07.040 But we have creativity.
00:39:09.180 And so we were successful.
00:39:10.520 We worked hard.
00:39:11.860 Claudine Gay went to Phillips Exeter Academy.
00:39:15.120 She has an undergrad degree from Stanford.
00:39:17.020 She has the Ph.D. from Harvard.
00:39:19.760 And it's not clear she ever had an original idea in her life.
00:39:23.480 And it's been my experience that universities have favored racial and ethnic minorities who had the right pedigree.
00:39:30.740 The rest of us, I guess, were too rough around the edges for them.
00:39:33.980 And as I pursue, as I pursue, you know, a lawsuit against Harvard, it really isn't about me.
00:39:42.740 It's not about Claudine Gay.
00:39:44.000 It's about something much bigger.
00:39:45.700 Harvard University needs to be held accountable because they've done so much damage in the world and they don't seem to care about the anti-Semitism.
00:39:53.420 And if you think back about Harvard's history, the quotas against Jews in the 1930s, you know, that sort of came out of Harvard.
00:40:01.820 Harvard has always had a problem with anti-Semitism.
00:40:05.380 And right now, they have just—the Marxism has taken over.
00:40:09.440 The standards have been ejected.
00:40:11.820 If people care about Harvard and institutions of higher education, now is a moment that we can turn it around.
00:40:20.180 And we are winning because it was announced today that the University of North Carolina at Chapel Hill, they're ending their DEI programs, and they're going to use the money for campus police.
00:40:32.960 And I believe other places will—go ahead.
00:40:37.420 University of North Carolina at Chapel Hill, unanimous board of trustees, $2.5 million left in the pool for DEI.
00:40:44.580 I said, hey, we're going to give this to public safety, campus safety, and no more DEI program.
00:40:50.460 Boom.
00:40:50.820 Now, I'd like to see them going to the faculty.
00:40:52.620 I want to go back.
00:40:53.460 How can they argue fair use?
00:40:55.640 They took your original research, which is renowned, but technically that research did back in the 90s that changed so much.
00:41:03.260 She took your original research and basically used it as her own and never mentioned you.
00:41:08.400 How could they say that's fair use, Dr. Swain?
00:41:11.760 They have not read my book, Black Faces, Black Interest, the Representation of African Americans in Congress.
00:41:18.540 And what Claudine Gay did was basically frame her dissertation around ideas in my book, and she was trying to write a canter.
00:41:27.100 And so there are about five places in her dissertation where she's drawing on my work and my ideas and not citing me.
00:41:37.340 But I would argue that had it not been for my prize-winning book, Black Faces, Black Interest, the Representation of African Americans in Congress,
00:41:46.320 cited three times by the Supreme Court, had a huge impact on the field of representation, she would not have been writing that dissertation.
00:41:53.480 Her early work was based on my ideas, and some of the work she has the obligatory cite in the bibliography, but she did not acknowledge the work.
00:42:04.740 And there's no way that the people at Harvard read my prize-winning book and her dissertation and would argue that, you know, it's fair use.
00:42:14.820 What I think is that they just try to bully people.
00:42:17.720 They never want to settle, but they run into the wrong Negro.
00:42:23.480 First of all, can I hear the deplorables again?
00:42:27.300 You just named Dr. Lowry Thomas Sowell.
00:42:30.280 Who are the deplorables you just named?
00:42:32.880 I'm going to hold you to the break.
00:42:33.780 We've got 30 seconds.
00:42:35.160 Who?
00:42:35.960 Roland Fryer, the brilliant economist there that she tried to destroy him.
00:42:40.580 He's still there.
00:42:42.100 And it's just so many other bright minorities.
00:42:44.940 And I know some that, you know, that that work was stolen by people like Claudine Gay, got away with it.
00:42:50.900 They tried to pursue it.
00:42:52.800 They were told to be quiet.
00:42:54.280 And most of the people that Claudine Gay plagiarized, I believe there are about 20, they all said it was okay, except one anonymous person and me.
00:43:02.900 It is not okay.
00:43:04.240 It's never okay.
00:43:05.340 And I don't go away quietly, but I do need people, you know, that follow me on Twitter and places.
00:43:12.040 If they want to donate, there's a way to donate tax-free for larger amounts.
00:43:17.880 But also the Give, Send, Go can take smaller donations or it can take larger donor-sized funds.
00:43:26.580 Hang on one second.
00:43:27.620 We're going to hold you through the break.
00:43:28.560 They clearly don't know your life story.
00:43:31.320 You're tough as boot leather.
00:43:32.560 Short break.
00:43:34.160 Have you heard of cancer-fighting foods?
00:43:36.340 The American Cancer Society discovered diets rich in fruits and veggies may actually lower, let me repeat that, lower your risk of cancer.
00:43:46.680 Now, hopefully, you're motivated enough to run out the store and get five full servings of fruits and veggies.
00:43:51.460 Okay, let's get back to reality.
00:43:53.240 You're not going to do that.

00:45:47.260 I don't think they know your integrity.
00:45:49.260 And I certainly don't think they know your fight, ma'am.
00:45:51.960 We're going to have you back on.
00:45:53.020 I think I got an idea how to get this thing rolling.

00:45:58.780 books, where they go to your social media, all of it, because you're putting up great

00:46:04.000 Well, I'm engaging with people on X, but I'm also on Getter Truth Social and Facebook.
00:46:12.420 And my website is bethepeoplenews.com, carolmswain.com.
00:46:18.700 But the excitement happens on X, because it allows a lot of give and take.
00:46:26.580 And you can give as good as you can take.
00:46:29.300 Dr. Carol Swain, look forward to talking.
00:46:31.420 I'll talk to you later tonight.
00:46:32.680 Thank you, man.
00:46:33.300 Love you.
00:46:33.720 That woman is a flat-out public intellectual fighter that will never back down.
00:46:40.440 She's truly a jewel.
00:46:41.600 She's like a Phyllis Schlafly type.
00:46:43.360 They only come along a couple every generation.
00:46:46.260 Jane Zirkle, this all manifests itself in numbers.
00:46:49.640 This is why Donald Trump is leading among young people, all these demographics.
00:46:52.840 Walk me through some math.
00:46:53.700 Yes, well, this is devastating for the Democrat Party, because this is what they have been
00:47:00.800 relying on for decades.
00:47:03.160 President Trump is leading in five critical swing states, all swing states, which President
00:47:08.440 Biden won back in 2020.
00:47:11.220 And I say won with quotation marks.
00:47:13.920 However, he is tied with 18 to 29-year-olds now.
00:47:18.140 We have been talking about this youth vote coming around for quite some time, and we're really
00:47:22.800 starting to see that manifested here.
00:47:25.180 He is also tied among Hispanic voters.
00:47:28.160 That Hispanic red wave is really strong right now for President Trump.
00:47:32.980 And the big news here, this is the highest number of support for Republican candidates
00:47:38.120 since the 1964 Civil Rights Act.
00:47:41.500 President Trump is up more than 20 percent with Black voters, and that is absolutely historic.
00:47:48.180 And this polling comes right off of what we saw last month with the Harvard Youth Poll,
00:47:54.240 where only 9 percent of young people approved of the direction of the country.
00:47:59.000 Across the board in swing states, voters strongly disapprove of the job that Joe Biden is doing.
00:48:05.240 And that's largely being driven by the economy, the lived experience.
00:48:09.800 And listen, no amount of student loan debt forgiveness is going to sway young voters here,
00:48:14.700 because it is that lived experience.
00:48:16.380 It's the fact that they can't afford to buy a home, that they can't afford to put food
00:48:20.260 on the table, that they can't afford to put gas in their car.
00:48:23.400 And so it's going to be quite an interesting race to the finish line,
00:48:27.820 because the Democrat base is absolutely imploding here.
00:48:32.640 Jane, we have you go all around the country.
00:48:34.360 I know you're just down at the border.
00:48:35.400 Give me your sense just of, because you hang with young people all the time,
00:48:38.700 your sense beyond the numbers.
00:48:40.500 Are you getting this sense also from young people?
00:48:42.540 Oh, 100 percent.
00:48:45.180 I mean, it's really discouraging to look at college campuses.
00:48:48.580 I know in particular we were just talking about George Washington University,
00:48:52.440 and I believe it was a day after I was on with you that we saw this absolutely awful video
00:48:57.400 of the faculty walking hand in hand with students to walk out and protest in support of Palestine.
00:49:04.560 But the reality is, I mean, well, of course, George Soros is, A, paying a lot of these protesters.
00:49:09.020 But these outrage culture issues are just not taking precedent with young people anymore
00:49:14.360 because of the economic issues, the inflation, the taxation, everything.
00:49:19.520 It's sort of the young people's awakening to the real world here.
00:49:23.380 And I think it goes beyond colleges, too, because, of course, college really isn't the real world,
00:49:28.740 as we see young people half the time don't even know what they're actually protesting for.
00:49:32.920 And it's nice to see that my generation is stepping away from the climate cult,
00:49:38.320 the outrage culture of everything, that this fad really is just sort of the next left-wing thing.
00:49:43.720 But it is a very far left-wing thing because, particularly with the Israel issue,
00:49:48.200 it showed in the Times-Siena polling that when it comes to Biden voters who plan to not vote for him again,
00:49:55.880 it's because of the Israel issue, and particularly with young voters,
00:50:00.180 the Israel issue was really towards the bottom of what they cared about.
00:50:05.040 Jane, where do people go to get you on social media?
00:50:08.340 You can find me on Twitter, Instagram, Getter, and YouTube at Jane Zirkle.
00:50:14.240 Jane, thank you so much, Jane.

00:50:31.020 He's going to be back on with Natalie at 6.
00:50:33.240 I think they're going to talk about Foreign Policy Magazine has a big story about how
00:50:36.700 the far right in the European parliamentary election in June being driven by, wait for it, young people.
00:50:44.140 Hope they get to it tonight. If not, we'll tackle it tomorrow morning.
00:50:46.720 Mike Lindell, we had Murderer's Row on this morning on Election Integrity.
