data and she has uncovered this astonishing fact um that 400 around 400 non-citizens have voted uh

they've cast in fact around a thousand or so ballots going back since 2019 over the last five years

coming on the show firstly tell me um in response to this data and i congratulate you on your research

here um i can't have been easy going through all this voting data but my first question to you is

how large then so you've uncovered this 400 or so non-citizens voting how large in a in a state i

think has a population around six million how lot how large could this phenomenon potentially be

well uh thank you for having us on ben uh we're very happy to be here yes epic is a is a we're a

non-profit we we voter participation is our main goal and our charitable mission so to answer your

question based on our initial research of what we're finding and we do many other things this is just one

facet of what we looked into uh on the voter rolls uh our initial take is probably about 20 percent

of the non-citizens that are being flowed off the rolls as as determined non-citizens as in they

self-declared that they're non-citizens and should be taken off or they might have failed a jury duty

questionnaire for example and so um we're we're finding about a 20 percent average but that's unofficial

so this is um so this the self-declared which is only sort of 20 percent the rest of it you

mentioned people being summoned for jury service so some of this are accidental discoveries that sort

of forced the situation to light and it was kind of joined up notification within the system that that

has alerted this fact is that correct well yes if i could just give you a little backstory about how

it works in virginia with the department of elections as a non-profit uh mission and non-profit that is

devoted to voter participation we qualify to receive the monthly update service so-called must from the

department of elections which is called elect in virginia as as an acronym and so we get a monthly
00:06:40.500
update each month today we got the month of september for example and so it'll it'll give you a sense of

how they're complying with the the national voter registration act the nvra we get a sense of their
00:06:51.520
voter uh list maintenance who's coming off how many have come on um who's died who's no longer going to

be with us for this election and so among those codes that you receive for the reasons is declared

non-citizen and so we're left to kind of discern and and go piece through it and and and query the

registrars to get some reasons why why were they declared but generally the default is that they have

declared themselves a non-citizen either on a jury duty questionnaire where they're supposed to attest

under penalty of perjury that they're a citizen or not and as you know non-citizens are not allowed to

serve on jury duties and so that that data flows into the um the department of elections in addition the

department of motor vehicles has the legal presence codes of many of these non-citizens that are being

awarded driver's license driver's licenses by the dmv so those codes can often flow in and and be made

aware to the uh department of elections but it's never quite clear so just to give you uh just to

make it clear as mud for you that uh there's a bit of reporting and discerning and research that that

goes on once we find out that they've been self-declared but the the common the common default is is that

they have most of these non-citizens coming off the roles are known to be or have admitted that

they're not citizens so the ones that may not have uh that may have flowed onto the roles either

lending their good faith to astonishing stories like this now something that came out on this show

had you know and this was news to me but she said that it's actually the onus is on the state itself

to uh confirm that people on the registered uh elections voter list have eligibility to vote

the legal onus is on is on the state and if they don't do that they can be sued so following and

uncovering your research here in the commonwealth of virginia tell me um it seems to me that some

legal challenges and lawsuits could now be brought against election officials in virginia because

they have not fulfilled their statutory duty oh that's very that's a very big trend happening

across many states right now and there's a history of of these lawsuits such as uh litigation firms

judicial watch comes to mind public interest legal foundation also they where they've had to sue

the states to get access to the their process of how they maintain voter rolls which is a key

consideration under the national voter registration act the so-called motor voter that passed in

1993 it went into implementation in 94 so um so to answer your question ben yes there are groups that

have been looking into whether they should file a tip you know to send a strongly worded letter to the

department of elections and then perhaps uh consider litigation to force compliance with the nvra in

in in these areas where it it it basically is their uh their uh responsibility and their duty under

section 8 of nvra to maintain accurate voter list i know we have all these other sections about um about

working with um of how you are registered and how uh citizens that are eligible to vote um can ensure that

they are able to vote and that their franchise is not is not uh hurt in any way but um but generally

the first order of business for the nvra the reason that it exists is to maintain accurate voter rolls

and so we often overlook that in all this um in all the narratives and all the argumentation over

whether non-citizens are voting they are in fact voting they're getting on the voter rolls and there's a

lot that states could do to remove them such as working with the dmv codes looking at other

databases that the federal government keeps to to filter out the non-citizens and then send them

the appropriate documentation so they can attest yes or no i'm a citizen and uh and and so that that

are our civil rights uh as marley hornick and others are asserting that are that citizen civil rights are

not being uh damaged because a non-citizen is cancelling out their vote potentially of course

individuals who were removed from the voting lists in fairfax county yes and in that group um

according now so just to back up a little bit in august um governor glenn young can put out what's known

as executive order 35 um and that was got a ton of coverage because he was basically affirming that
00:12:16.840
virginia does use paper ballots i think it was reported out that oh look virginia is going to
00:12:21.180
paper ballots they've been using paper ballots for quite some time except for the except for the ada
00:12:26.240
compliant machines which are an express uh touchscreen device but generally speaking across the commonwealth

virginia they are they are paper ballots but in that executive order he also affirmed and reminded
00:12:37.920
uh the electoral officials across the state that they have a duty to maintain accurate voter rolls they
00:12:43.420
also have a duty to report to law enforcement if uh if they find evidence of felony voting violations or

misdemeanor voting violations and so voting in virginia if you are a non-citizen or enticing others to vote

knowing that they're non-citizens is a class 6 felony in virginia so in the executive order he he's reminded

that the electoral boards and registrars of their duty and so fairfax county recently voted to send the
00:13:12.160
names of these of these non-citizens that were removed from the voter rolls which governor

youngkin i think you you might have recalled that he had announced about 6 000 non-citizens that they removed over a
00:13:22.980
two-year period and this is after we had already done our work and found non-citizens voting
00:13:28.000
so fairfax county uh looked at the research as well the electoral board and found that

there was appeared to be of the 900 or so in fairfax county alone um anywhere from 100 between 100 and
00:13:41.560
just 200 may have been casting ballots over the years they have a voting history before they were removed

and so to their credit and tend to the credit of other localities and counties around virginia

they voted to put a new policy in place that says when we get these lists from the department of
00:13:58.880
elections that explains that non-citizens have been taken off the voter rolls we will report that to our

commonwealth attorney at virginia's way of saying da and um the uh attorney general of virginia as well

so fairfax county has now a policy that basically says if you are found to be taken off the voter rolls

as a non-citizen you may be under investigation for felony voter violation and we think that has a

very important deterrent effect and is also an important i think um educational um effect as well

because many non-citizens may be confused when they're at the dm fee there's a lot to be improved

with the way that form works where you just check a box whether or not you're a non-citizen

and they may just want a driver's license they want to get on with it but if they're accidentally

what you've uncovered here about non-citizens voting one thing that emerged due to your research i think

this is important for the posse um is that uh of 21 percent of non-citizens uh they voted at the

primary voted for a democrat um voting democrat ballots excuse me oh that compares to two percent

of non-citizens voting in republican primaries that's a huge difference right yes it is it's i mean it's

you could extrapolate out on that because it's a fairly small sample but yes what we did were

we took the 400 or so 435 or so non-citizens in this small time frame of about a year now we're

not going back six years we're just looking at one slice of a year and all the non-citizens who came off

and found over 400 with a voting record who had cast about a thousand ballots over the years going back

to 2019 and then we looked at whether they took ballots in the um primary for the republican and

democrat primaries in virginia and your your audience may want may not be aware so we'll

mention that virginia is a non-partisan state when you register to vote you do not select a political

party so people have to do some discerning so we just looked at the um the subsector a subsection

of the 400 or so who took a ballot in the primaries of the republican and democrat parties and yes as you

said ben 22 percent uh took democrat ballots and about two percent took republican ballots and um

maybe i think about one or two percent took uh uh we're sort of fell in the independent category where

they didn't did not take a ballot so that is a clear preference and that is something that we'll be

watching as well um as we continue to look back at the at the voting voting histories of these of these

non-citizens who are taken off the rolls so because when they come off the rolls you know non non-partisan

and non-profit groups who do voter participation can go and look and department of elections can do

this as well can go and look to see when were they registered and so their voting histories go back to

when they were registered some going back to the mid-90s and so um so we're keeping an eye on that

because we think that there's a lot of public education that should be done to make sure that people

that are coming into this country and are receiving all kinds of federal aid and maybe uh being

incentivized to vote because of the white house's executive order one four zero one nine which

basically federalizes or it's you know that's being called um biden bucks like the zec bucks that

flooded money into um local registrar's offices to kind of influence it was basically a get out the vote

um effort that targeted just one voting group the democrats so there's a lot of concern that

executive order one four zero one nine is going to have similar effect where it's micro targeting

just democrat populations with the u.s tax dollar um that is uh probably unconstitutional and certainly

a violation of the hatch act when you put political appointees of the president in in the business of

registering voters well how those voters vote will have an impact on their job which is why the hatch act

exists so we're watching all kinds of things like that um as well as what the impact of helene may be on

on the southwestern portion of virginia and other states but those are our findings right now and um

we we do many other things and we try to work very closely with the registrars and and the public and

volunteers to help people understand how this process works and how it can be improved so we're blessed to

declared that elections are critical infrastructure and yet the processes that are in place

um are kind of shocking and so i i find it to be uh frustrating at times to answer your question

what the emotions were um but we're we're so clinical about what we're doing in terms of documenting our

findings and working with registrars we're not trying to play gotcha but we do have a duty to educate

the public so we do publish uh but we um we find a lot of uh shock and dismay that the lack of

best practices across the board in many states um and that includes some registrars in virginia

some are doing great you know some are really modernizing and some have been very responsive

non-citizens they have they have every right to check and see if the non-citizens that are coming
