00:04:16.480 on the show this morning has been going through the data in the commonwealth of virginia the voting

00:04:23.540 data and she has uncovered this astonishing fact um that 400 around 400 non-citizens have voted uh

00:04:32.660 they've cast in fact around a thousand or so ballots going back since 2019 over the last five years

00:04:40.560 um so erin marie joyce from the electoral process education corp good morning to you thank you for

00:04:47.460 coming on the show firstly tell me um in response to this data and i congratulate you on your research

00:04:53.480 here um i can't have been easy going through all this voting data but my first question to you is

00:04:58.240 how large then so you've uncovered this 400 or so non-citizens voting how large in a in a state i

00:05:06.520 think has a population around six million how lot how large could this phenomenon potentially be

00:05:13.100 well uh thank you for having us on ben uh we're very happy to be here yes epic is a is a we're a

00:05:19.780 non-profit we we voter participation is our main goal and our charitable mission so to answer your

00:05:25.760 question based on our initial research of what we're finding and we do many other things this is just one

00:05:31.640 facet of what we looked into uh on the voter rolls uh our initial take is probably about 20 percent

00:05:37.940 of the non-citizens that are being flowed off the rolls as as determined non-citizens as in they

00:05:44.360 self-declared that they're non-citizens and should be taken off or they might have failed a jury duty

00:05:50.080 questionnaire for example and so um we're we're finding about a 20 percent average but that's unofficial

00:05:56.800 so this is um so this the self-declared which is only sort of 20 percent the rest of it you

00:06:03.000 mentioned people being summoned for jury service so some of this are accidental discoveries that sort

00:06:08.020 of forced the situation to light and it was kind of joined up notification within the system that that

00:06:14.660 has alerted this fact is that correct well yes if i could just give you a little backstory about how

00:06:20.640 it works in virginia with the department of elections as a non-profit uh mission and non-profit that is

00:06:26.520 devoted to voter participation we qualify to receive the monthly update service so-called must from the

00:06:34.060 department of elections which is called elect in virginia as as an acronym and so we get a monthly

00:06:40.500 update each month today we got the month of september for example and so it'll it'll give you a sense of

00:06:46.760 how they're complying with the the national voter registration act the nvra we get a sense of their

00:06:51.520 voter uh list maintenance who's coming off how many have come on um who's died who's no longer going to

00:06:57.540 be with us for this election and so among those codes that you receive for the reasons is declared

00:07:03.860 non-citizen and so we're left to kind of discern and and go piece through it and and and query the

00:07:11.400 registrars to get some reasons why why were they declared but generally the default is that they have

00:07:17.720 declared themselves a non-citizen either on a jury duty questionnaire where they're supposed to attest

00:07:22.460 under penalty of perjury that they're a citizen or not and as you know non-citizens are not allowed to 0.85

00:07:28.080 serve on jury duties and so that that data flows into the um the department of elections in addition the

00:07:34.700 department of motor vehicles has the legal presence codes of many of these non-citizens that are being 1.00

00:07:39.820 awarded driver's license driver's licenses by the dmv so those codes can often flow in and and be made

00:07:47.100 aware to the uh department of elections but it's never quite clear so just to give you uh just to

00:07:53.140 make it clear as mud for you that uh there's a bit of reporting and discerning and research that that

00:07:58.420 goes on once we find out that they've been self-declared but the the common the common default is is that

00:08:04.720 they have most of these non-citizens coming off the roles are known to be or have admitted that

00:08:10.300 they're not citizens so the ones that may not have uh that may have flowed onto the roles either

00:08:15.140 they're confused and think they can register or have been automatically registered by dmv um that that's

00:08:21.620 another that's another subsector altogether if that makes sense well well later on in the show we're

00:08:26.760 actually going to have the legendary todd bensman on um with his uh research that's actually sort of

00:08:32.200 uncovering and this is something we've been we've following on the on the show now for many years

00:08:36.580 but uncovering the fact that illegals are being shipped right across america um so there's these

00:08:42.080 two things are definitely related together and it's not accidental and americans can no longer be

00:08:47.440 lending their good faith to astonishing stories like this now something that came out on this show

00:08:53.320 in a couple about a month or so ago we had a marley hornicon from united sovereign americans and she

00:08:59.000 had you know and this was news to me but she said that it's actually the onus is on the state itself

00:09:06.780 to uh confirm that people on the registered uh elections voter list have eligibility to vote

00:09:14.680 the legal onus is on is on the state and if they don't do that they can be sued so following and

00:09:19.840 uncovering your research here in the commonwealth of virginia tell me um it seems to me that some

00:09:25.540 legal challenges and lawsuits could now be brought against election officials in virginia because

00:09:32.600 they have not fulfilled their statutory duty oh that's very that's a very big trend happening

00:09:40.720 across many states right now and there's a history of of these lawsuits such as uh litigation firms

00:09:46.760 judicial watch comes to mind public interest legal foundation also they where they've had to sue

00:09:51.720 the states to get access to the their process of how they maintain voter rolls which is a key

00:10:00.560 consideration under the national voter registration act the so-called motor voter that passed in

00:10:05.660 1993 it went into implementation in 94 so um so to answer your question ben yes there are groups that

00:10:13.200 have been looking into whether they should file a tip you know to send a strongly worded letter to the

00:10:18.740 department of elections and then perhaps uh consider litigation to force compliance with the nvra in

00:10:25.620 in in these areas where it it it basically is their uh their uh responsibility and their duty under

00:10:32.820 section 8 of nvra to maintain accurate voter list i know we have all these other sections about um about

00:10:40.200 working with um of how you are registered and how uh citizens that are eligible to vote um can ensure that

00:10:48.320 they are able to vote and that their franchise is not is not uh hurt in any way but um but generally

00:10:56.020 the first order of business for the nvra the reason that it exists is to maintain accurate voter rolls

00:11:01.860 and so we often overlook that in all this um in all the narratives and all the argumentation over

00:11:07.140 whether non-citizens are voting they are in fact voting they're getting on the voter rolls and there's a

00:11:12.580 lot that states could do to remove them such as working with the dmv codes looking at other

00:11:17.720 databases that the federal government keeps to to filter out the non-citizens and then send them 0.99

00:11:23.720 the appropriate documentation so they can attest yes or no i'm a citizen and uh and and so that that

00:11:29.960 are our civil rights uh as marley hornick and others are asserting that are that citizen civil rights are

00:11:35.980 not being uh damaged because a non-citizen is cancelling out their vote potentially of course

00:11:41.480 of course look you very kindly agreed to to hang on um and come back later on in the show but uh we've

00:11:49.120 got three minutes left before we head to the break just very quickly tell me about the the 985

00:11:54.480 individuals who were removed from the voting lists in fairfax county yes and in that group um

00:12:03.100 according now so just to back up a little bit in august um governor glenn young can put out what's known

00:12:08.840 as executive order 35 um and that was got a ton of coverage because he was basically affirming that

00:12:16.840 virginia does use paper ballots i think it was reported out that oh look virginia is going to

00:12:21.180 paper ballots they've been using paper ballots for quite some time except for the except for the ada

00:12:26.240 compliant machines which are an express uh touchscreen device but generally speaking across the commonwealth

00:12:32.100 virginia they are they are paper ballots but in that executive order he also affirmed and reminded

00:12:37.920 uh the electoral officials across the state that they have a duty to maintain accurate voter rolls they

00:12:43.420 also have a duty to report to law enforcement if uh if they find evidence of felony voting violations or

00:12:50.600 misdemeanor voting violations and so voting in virginia if you are a non-citizen or enticing others to vote

00:12:57.840 knowing that they're non-citizens is a class 6 felony in virginia so in the executive order he he's reminded

00:13:04.620 that the electoral boards and registrars of their duty and so fairfax county recently voted to send the

00:13:12.160 names of these of these non-citizens that were removed from the voter rolls which governor

00:13:16.840 youngkin i think you you might have recalled that he had announced about 6 000 non-citizens that they removed over a

00:13:22.980 two-year period and this is after we had already done our work and found non-citizens voting

00:13:28.000 so fairfax county uh looked at the research as well the electoral board and found that

00:13:33.680 there was appeared to be of the 900 or so in fairfax county alone um anywhere from 100 between 100 and

00:13:41.560 just 200 may have been casting ballots over the years they have a voting history before they were removed

00:13:47.780 and so to their credit and tend to the credit of other localities and counties around virginia

00:13:53.460 they voted to put a new policy in place that says when we get these lists from the department of

00:13:58.880 elections that explains that non-citizens have been taken off the voter rolls we will report that to our

00:14:05.180 commonwealth attorney at virginia's way of saying da and um the uh attorney general of virginia as well

00:14:12.740 so fairfax county has now a policy that basically says if you are found to be taken off the voter rolls

00:14:19.080 as a non-citizen you may be under investigation for felony voter violation and we think that has a

00:14:25.000 very important deterrent effect and is also an important i think um educational um effect as well

00:14:31.700 because many non-citizens may be confused when they're at the dm fee there's a lot to be improved

00:14:37.240 with the way that form works where you just check a box whether or not you're a non-citizen

00:14:41.120 and they may just want a driver's license they want to get on with it but if they're accidentally

00:14:45.420 on the voter rolls they need to know that there are serious consequences and that their ability

00:14:50.040 to someday become a citizen may be at risk so those are my thoughts

00:19:50.460 something that we're watching very carefully in southwestern virginia as well as other states so

00:19:55.660 uh we hope we hope and pray that they will get through this yeah absolutely and in fact if you have

00:20:15.820 it's an existential election every vote counts this is why obviously we're talking about the these votes

00:20:20.720 what you've uncovered here about non-citizens voting one thing that emerged due to your research i think

00:20:26.520 this is important for the posse um is that uh of 21 percent of non-citizens uh they voted at the

00:20:35.340 primary voted for a democrat um voting democrat ballots excuse me oh that compares to two percent

00:20:43.520 of non-citizens voting in republican primaries that's a huge difference right yes it is it's i mean it's

00:20:53.700 you could extrapolate out on that because it's a fairly small sample but yes what we did were

00:20:58.720 we took the 400 or so 435 or so non-citizens in this small time frame of about a year now we're

00:21:05.380 not going back six years we're just looking at one slice of a year and all the non-citizens who came off 1.00

00:21:10.280 and found over 400 with a voting record who had cast about a thousand ballots over the years going back

00:21:15.840 to 2019 and then we looked at whether they took ballots in the um primary for the republican and

00:21:22.080 democrat primaries in virginia and your your audience may want may not be aware so we'll

00:21:27.140 mention that virginia is a non-partisan state when you register to vote you do not select a political

00:21:31.480 party so people have to do some discerning so we just looked at the um the subsector a subsection

00:21:38.120 of the 400 or so who took a ballot in the primaries of the republican and democrat parties and yes as you

00:21:44.040 said ben 22 percent uh took democrat ballots and about two percent took republican ballots and um

00:21:52.220 maybe i think about one or two percent took uh uh we're sort of fell in the independent category where

00:21:58.160 they didn't did not take a ballot so that is a clear preference and that is something that we'll be

00:22:03.920 watching as well um as we continue to look back at the at the voting voting histories of these of these

00:22:10.340 non-citizens who are taken off the rolls so because when they come off the rolls you know non non-partisan 0.84

00:22:16.080 and non-profit groups who do voter participation can go and look and department of elections can do

00:22:21.560 this as well can go and look to see when were they registered and so their voting histories go back to

00:22:26.580 when they were registered some going back to the mid-90s and so um so we're keeping an eye on that

00:22:32.540 because we think that there's a lot of public education that should be done to make sure that people

00:22:37.580 that are coming into this country and are receiving all kinds of federal aid and maybe uh being

00:22:43.040 incentivized to vote because of the white house's executive order one four zero one nine which

00:22:47.940 basically federalizes or it's you know that's being called um biden bucks like the zec bucks that

00:22:53.920 flooded money into um local registrar's offices to kind of influence it was basically a get out the vote

00:23:01.060 um effort that targeted just one voting group the democrats so there's a lot of concern that

00:23:06.280 executive order one four zero one nine is going to have similar effect where it's micro targeting

00:23:11.280 just democrat populations with the u.s tax dollar um that is uh probably unconstitutional and certainly

00:23:18.420 a violation of the hatch act when you put political appointees of the president in in the business of

00:23:24.460 registering voters well how those voters vote will have an impact on their job which is why the hatch act

00:23:29.800 exists so we're watching all kinds of things like that um as well as what the impact of helene may be on

00:23:35.200 on the southwestern portion of virginia and other states but those are our findings right now and um

00:23:42.060 we we do many other things and we try to work very closely with the registrars and and the public and

00:23:48.180 volunteers to help people understand how this process works and how it can be improved so we're blessed to

00:23:53.900 have brilliant technical people our executive director john laroe is absolutely brilliant um he's the

00:24:00.340 brains behind the operation i'm i'm just the comms person and um and so he he leads us to in this

00:24:06.480 mission which we think is is quite important that we make sure that what's going on on the voter rolls

00:24:11.860 is transparent and that we know who's rolling on and who isn't and so that's how we found the

00:24:16.200 non-citizens and also did the work of finding whether they were voting and indeed they are so

00:24:21.080 um tell me something tell me something erin what is your emotional reaction when you're looking

00:24:27.420 through the results of your research and you're confronting it with the official line on non-citizens

00:24:34.360 voting which is that inverted commas it almost never happens what is the emotional reaction when you

00:24:39.480 confront these two different realities side by side two minutes please sure well i could quote um my

00:24:47.240 colleagues who are uh technical experts and understand and work at a very high level with

00:24:52.140 database and and the and and deploy the best practices in technology some of whom uh you know

00:24:59.640 are working in in areas of of defense and you know our election infrastructure is considered critical

00:25:05.940 infrastructure there was an executive order i think when president obama was leaving office that

00:25:10.360 declared that elections are critical infrastructure and yet the processes that are in place

00:25:16.060 um are kind of shocking and so i i find it to be uh frustrating at times to answer your question

00:25:22.940 what the emotions were um but we're we're so clinical about what we're doing in terms of documenting our

00:25:28.420 findings and working with registrars we're not trying to play gotcha but we do have a duty to educate

00:25:34.080 the public so we do publish uh but we um we find a lot of uh shock and dismay that the lack of

00:25:41.780 best practices across the board in many states um and that includes some registrars in virginia

00:25:48.740 some are doing great you know some are really modernizing and some have been very responsive

00:25:52.600 so we it's a it's a county by county process but department of elections could have found these

00:25:58.000 non-citizens they have they have every right to check and see if the non-citizens that are coming 1.00

00:26:04.160 off the rolls have a voting history and could be quietly just sending those names over to the

00:26:08.240 attorney general to investigate so it took it took a little you know we call ourselves the non-profit

00:26:13.560 with the big name um electoral process education corporation to do this work and to let registrars

00:26:20.100 know this was a problem and that they could be doing better to to clean up the voter rolls so that
