00:03:02.600 real quick about something I just learned about from the IG of the Department of Homeland
00:03:09.200 Security in a letter that he wrote to Secretary Mayorkas about seven days ago.
00:03:14.700 I know everybody's continuing to follow the investigation for the J-13 assassination attempt,
00:03:22.220 and this letter starts off from the DHS-OIG.
00:03:26.860 Dear Secretary Mayorkas, in accordance with 5-USC-504, I'm writing to report particularly
00:03:32.660 serious or flagrant problems, abuses, or deficiencies related to the administration of programs and
00:03:39.900 operation of the U.S. Secret Service.
00:03:42.000 He then goes in to talk about a whistleblower credibly alleges that in 2021, the Secret Service
00:03:49.880 imposed functional limitations on government phones issued to the Secret Service personnel
00:03:55.300 that eliminated the ability of a user to, one, initiate or participate in a group text limited
00:04:02.300 to users of Secret Service phones, and two, send or receive a photo attached to a text messages.
00:04:09.920 Steve, this is so important because if you look at the timeline, this was right after January 6th,
00:04:15.020 and we know that the Secret Service told investigators in Congress that we couldn't get access to their
00:04:22.000 communications because they had decided to do an upgrade of their phones right after January 6th,
00:04:29.000 this looks to me as if they doubled down in trying to prevent Congress and investigators
00:04:35.440 from conducting oversight by taking away the ability on Secret Service agents to send,
00:04:43.340 be in group chats or send photos.
00:04:46.080 And so what's going on is all of these Secret Service agents are now having to use their private
00:04:51.460 cell phones, even overseas at times.
00:04:55.280 And that obviously creates massive problems with hacking, trying to, you know, compartmentalize
00:05:02.460 data.
00:05:03.180 And I just wanted to bring the war room posse up to speed on that because I know information
00:05:09.720 is important and I know oversight is important to this audience.
00:05:12.760 So I wanted to bring that to your attention.
00:05:15.140 And it's one more thing.
00:05:16.660 It's one more reason why this election coming up in a couple of days is so important because
00:05:21.420 many of the bureaucracies within the federal government need an overhaul.
00:05:26.020 And it's clear that the Secret Service is up to their same old tricks in trying to prevent
00:05:31.280 investigations from going forward with Congress and other investigative bodies.

00:05:41.340 Are you saying that you think that this whole change in protocol, which they mentioned in
00:05:46.800 this letter, happened after January 6 to try to suppress information about January 6 or
00:05:54.440 to stop the Secret Service and going forward to be able to provide that information?
00:05:59.200 What is the link to January 6 and the date that's so important to you?
00:06:03.480 Well, as you remember, Steve, that was one thing that's been widely reported that after
00:06:10.080 January 6, the Secret Service took many of the of the agents phones and said that they
00:06:18.300 were conducting downloads and overhauls on their phones.
00:06:22.880 And so investigators weren't able to gain access to their communications in their investigations
00:06:29.260 to look into, you know, what the Secret Service, you know, was doing on January 6.
00:06:34.900 This comes after that.
00:06:36.900 So it appears to myself and many others who are investigating the J-13 investigation that
00:06:45.440 Secret Service is, again, trying to prevent oversight abilities because if they're communicating
00:06:51.240 on their personal phones when we go to investigate what's going on, it's a lot harder for us to get
00:06:56.560 access to their personal phones than their government phones.
00:06:59.700 But if, you know, if they can't send photos, if they can't, you know, have group chats like
00:07:04.700 many on J-13 were doing there on site, you know, these guys are just using their personal
00:07:11.980 phones.
00:07:12.560 And so I wanted to make sure that the posse knew that.
00:07:15.060 I wanted to make sure that you guys understood that the IG sent a letter to Secretary Mayorkas
00:07:21.140 seven days ago, giving Secretary Mayorkas seven days to report to Congress of this flagrant,
00:07:28.780 you know, problem within the Secret Service so that it could be it could be taken care of.
00:07:36.140 Are you anticipating in your oversight and investigation into the assassination attempt
00:07:43.200 that this is incompetence or malfeasance?
00:07:45.940 It's one or the other.
00:07:46.600 It's either gross incompetence, you know, reckless negligence, or do you think there was
00:07:50.900 malfeasance as you see it today?

00:07:56.440 But, you know, I do find it interesting that all other federal agents are required to use
00:08:04.540 their work phones when they're on the job at work so that if something, a mass casualty
00:08:10.100 event or a crisis happens, we can get the records and their transmissions and communications.
00:08:17.920 And once again, that we're seeing that it appears that the Secret Service is trying to
00:08:22.340 go around that by having agents use personal phones where we cannot then go and look at
00:08:28.540 their communications.

00:26:32.300 What this case really was about was obtaining a list of the individuals that are still on the rolls
00:26:38.700 that, based on the Secretary of State's own admissions to the EAC, the Election Administration Commission,

00:26:46.100 It's really around 1.9, but that 1.2 million figure was us giving every single concession that we could
00:26:51.620 to get the number down, and it was still at 1.2 million.
00:26:55.520 And these individual voters are people who, as of November 9, 2022, the day after the 2022 midterm,
00:27:02.420 should have been removed, or if they had voted in the 2020 election or the 2022 election under the NVRA,
00:27:09.340 the National Voter Registration Act, they were active.
00:27:12.860 So you either have active voters or they didn't vote in either of those, and they should have been removed.
00:27:17.760 But regardless, that 1.2 million figure should actually be zero,
00:27:21.160 and we wanted to get to the bottom of it to figure out how many of those voters should be on the rolls
00:27:25.340 and who shouldn't be, and that's what we can do now.

00:32:58.440 So walk me through specifically what happened here because I can't believe they got 1.2 million, quote-unquote, inactive voters.

00:33:09.460 But can those slots be used to steal an election, sir?

00:33:18.540 The applicable federal laws here require certain categories of voters to be removed from the rolls on an ongoing basis.
00:33:31.000 Those categories include people who have died, people who have been adjudicated insane, people who have been convicted of felonies, and people who have moved out of state.
00:33:39.340 Our client, Citizen AG, submitted a public records request about a month ago after Arizona had some other problems with the voter rolls saying, hey, Secretary Adrian Fontes, please tell us what you've been doing to comply with HAVA's requirements and the NVRA's requirements that these voters be removed from the rolls.
00:34:00.640 And he got a rather surprising answer back, and the answer that we got back was, I have no documentation at all.
00:34:09.660 I have no documents to show anything that I've been doing to take these folks off the rolls.
00:34:15.120 And that's why we went into court.

00:34:24.100 Yeah, that's why we had gone into court, and we had filed to request emergency relief that these documents be ordered to produce to our clients.

00:34:45.100 And we want to make sure that we have that data from the secretary of state to check against our own files and see if anybody who is unlawfully listed on the rolls votes or, as is more likely, whether somebody votes under their name.
00:35:01.620 Now, the court has awarded this relief, and we will have it.
00:35:05.780 And then we will be able to check, as I understand from my client, those two lists and see if we have unlawful votes.
00:35:12.620 But the total universe of people who, in the absence of documentation from the secretary of state, may be unlawfully listed on the rolls, is 1.2 million.
00:35:21.780 Now, I don't expect that it will be quite that large when we get the data, but it's still very significant in a state that's decided by margins, sometimes of 10,000, 20,000 votes.
00:35:32.960 Well, there's only a couple of million.
00:35:35.320 There's only a couple of million people that actually vote in Arizona, right?
00:35:39.920 So, I mean, 1.2 is like, I don't know, 20 percent of the total.
00:35:45.140 It's a massive number, and it's absolute, but it's even a bigger number when you look at the percentages.
00:35:52.160 Why did people wait until a month ago to ask this?
00:35:55.320 Isn't this something – I thought this was something people were on top of and bothering state officials for years.
00:36:03.300 So, people have been bothering the secretary of state about voter roll maintenance issues in Arizona for quite some time.
00:36:12.360 That's what actually had triggered this is, if you'll recall, about six weeks ago, it was announced that Secretary Fontes had not been checking to make sure that everybody on the rolls had documented proof of citizenship because of what was termed a DMV glitch.
00:36:30.920 And then kept moving around the number of people in that universe who are listed on the rolls without providing DPOC, as we call it.
00:36:38.940 When that happened, it triggered Citizen AG to inquire further as to what other voter list maintenance obligations the secretary might be ignoring.
00:36:49.240 And fortunately, the judge seemed to take this very seriously, strongly inquired of the attorney general's office why the secretary of state has appeared not to be doing his job in order of the records produced.
00:37:03.320 Okay, the first instance about the people that can't prove their citizenship, I think that's approximately 90 – is it correct?

00:38:19.780 Is anyone prepared or the court's prepared to back us up that these people that are either on these inactive lists or they haven't checked their citizenship, that we can come into this with a guarantee that those voter rolls that should have been – should have been cleansed years ago will be cleansed by Tuesday?
00:38:41.020 So, Steve, there's no guarantees in life, and there's certainly no guarantees in litigation, right?
00:38:46.980 But what I will say is the judge seemed to take this issue very seriously.
00:38:50.880 He, in fact, at one point inquired of the attorney general's office whether he ought not order the records produced to him specifically so that the judge himself could review the rolls and make sure that the secretary has been complying with his voter roll maintenance obligations.
00:39:07.180 So, while I can't say that the secretary is going to hurry up and purge all of these people from the rolls who shouldn't be on it by Tuesday, what I can say in light of the judge's order of release of the documents is that if he does not and if some of these ineligible voters do wind up voting, then it is quite likely that Citizen AG will be able to prove that those ineligible voters did vote in our election.
00:39:33.480 And hopefully knowing that and knowing that the federal courts are watching very carefully will make Secretary Fontes think twice before he tries to do anything too improper.
