00:01:58.360 1798, which allows the government to deport certain nationals in times of war without trial.
00:02:07.080 The administration used the act to deport nearly 300 people that it alleges are members of a
00:02:14.400 Venezuelan gang flying them to El Salvador on Saturday. Before the flights, advocacy groups filed
00:02:22.340 a lawsuit against the administration on behalf of five men who were targeted in the deportation.
00:02:28.160 Late Saturday, a federal judge blocked the president's use of the Alien Enemies Act,
00:02:32.960 ordering any planes with people being deported under the president's executive order to be
00:02:38.480 returned to the United States, even if it meant turning the planes around. The big issue here is
00:02:45.240 the timing of the flights. Administration officials have not said when the deportation flights landed in
00:02:51.360 El Salvador. But the White House press secretary claimed yesterday that the migrants had already been
00:02:56.460 removed from U.S. territory at the time of the judge's order. As the New York Times points out,
00:03:03.340 the judge issued the order shortly before 7 p.m. in Washington. But video posted on social media
00:03:10.380 by the president of El Salvador shows the deportees disembarking the plane at night. And El Salvador
00:03:18.520 is two hours behind Washington in terms of time zones. Trying to make a point with people they
00:03:25.700 perceive as not particularly sympathetic victims. The student up at Columbia who was saying, you know,
00:03:32.500 siding with Hamas, it seemed, in some issues. And now these, at least some of them, are members of a
00:03:38.420 gang or there's, you know, who are accused of doing truly terrible things. But isn't what makes America
00:03:45.160 America? Is it no matter who you are, you're still entitled to free speech and due process,
00:03:50.820 no matter how unsympathetic or unsavory your views might be? Talk to us a little bit about
00:03:55.180 the slippery slope we may be on here. Well, that's why President Trump is invoking the
00:03:59.740 Alien Enemies Act of 1798, which gives the president extraordinary power to do this without
00:04:04.960 going through the immigration courts, without having real due process. The problem is the act says that
00:04:09.800 the president can only do it when the United States is at war with another country or if the foreign
00:04:15.020 country has invaded or threatened to invade the U.S. That hasn't happened here. And that's why I think
00:04:19.220 the courts are ultimately going to rule against the president. But the question is then, if the
00:04:24.420 president ignores the courts, then how does the court enforce its actions? Because they're under
00:04:29.680 the marshal's office. They have the marshal's office to enforce its rulings. And the marshal's
00:04:34.080 office is under the executive branch. So we could be headed for a constitutional crisis.
00:04:38.580 This is a completely different subject and another potential clash with the constitution.
00:04:42.940 The pardons that sleepy, as he put it, sleepy Joe Biden gave to the unselect committee of political
00:04:48.940 thugs and many others are hereby declared void, vacant and of no further force or effect. They
00:04:54.720 are subjected to investigation at the highest level. Can he do this? Can he say the pardons of void?
00:05:01.360 No. No. Legally, this is dead on arrival. This is a ridiculous sideshow. Yeah, right. There you go.
00:05:09.640 Look, the key question with the pardon power is what was the president's intent? We've had

00:06:00.200 president in history except for Trump. It took Joe Biden 221 days to see his favor. Building numbers go
00:06:06.500 negative. It took Trump about a month. So I don't think this is working for them either. The question
00:06:10.960 is, can Democrats create any kind of opposition or alternative that matters? That's one. But that's
00:06:17.680 really going to matter when you get near to an election. And in the meantime, the thing that
00:06:21.060 Democrats want from their party is some way of making it stop. They don't want a message. They
00:06:27.160 don't even just want to fact check. But I agree with Chris. It'd be good if facts were more relevant
00:06:30.940 right now. What they want is for Democrats to make it stop. And that's where the anger of the shutdown
00:06:34.640 comes in. That was the one piece of leverage Democrats had. Should they have shut down? Actually,

00:20:27.240 to try to issue a temporary restraining order, this lawless T.R.O., to tell the president of the United
00:20:35.240 States that he can't protect our country from foreign terrorists. He can't repel an invasion.
00:20:42.480 And even most dangerously, this goofball Jeb Bosberg, this Obama judge, ordered the president of the United
00:20:51.420 States to turn planes around carrying these terrorists from America to El Salvador. Thank God
00:21:00.100 that didn't happen, right? The president apparently didn't understand the order or whatever the hell he
00:21:07.220 needs to say to tell this judge, Jeb Bosberg, to piss off because he is the president of the United
00:21:13.900 States. And I don't say this lately. You don't ignore judges' orders.
00:21:17.700 Hold on. Yeah, I want to not nail you, but I want to bring up, you have been very, although the
00:21:24.880 viceroy in wanting to salt the earth around these people, you have been very conservative in saying,
00:21:32.440 hey, if they give you an injunction, if they enjoin your efforts, if you get a T.R.O., you have to comply
00:21:38.720 because not to do that, you're going to flip the appellate courts, which are all static answers,
00:21:43.160 but particularly, potentially the Supreme Court with ACB, Justice Coney Barrett and Roberts,
00:21:52.760 who will be, you know, taking a temperature here that you don't want to do it. Why are you flipping
00:21:57.800 in this case and saying, hey, I have no problem with continuing to ship the bad guys back to prisons
00:22:04.280 in El Salvador, sir? I'm not flipping in this case. I'm saying that you almost always fall a judge's
00:22:12.780 order. But when the judge's order is clearly lawless and a grave danger to our national security,
00:22:22.940 you have a duty as the president of the United States, as the commander in chief,
00:22:26.860 to ignore a lawless, dangerous order. This Obama judge, Jeb Bosberg, was, first of all, he had a
00:22:36.520 hearing during a national security operation where we're taking the most dangerous terrorist
00:22:43.200 in the Western Hemisphere out of America and into El Salvador. The president posted the video
00:22:49.180 of the handoff. This is not something that you want the terrorist to be tipped off to, right,
00:22:54.960 because you're going to put American lives and our allies' lives in grave danger if they know this
00:23:00.960 is happening. So this judge never should have held this hearing during the middle of this national
00:23:05.920 security operation, which could have tipped off this operation and killed Americans and killed
00:23:10.780 our allies. And then this judge thinks that he's going to order airplanes to turn around mid-flight
00:23:17.060 over the Gulf of America or wherever the hell these planes were. This judge is out of his mind.
00:23:21.540 And not only should this judge resign for this disgraceful, dangerous order, the House of
00:23:27.500 Representatives should impeach Jeb Bosberg immediately because this guy has horrific judgment.
00:23:35.220 He's a radical partisan, and he's let his Trump derangement endanger the lives of Americans and our
00:23:42.300 allies. Let me go on that. You're saying right now on War Room that you believe that Jeb Bosberg,
00:23:51.520 they should commit, the House Judiciary Committee should meet immediately and begin the whole
00:23:57.340 process of impeachment of a sitting federal judge, sir? There's no question. Look, I was the chief
00:24:03.940 counsel for nominations on the Senate Judiciary Committee. I had the oversight portfolio over the
00:24:09.600 federal judiciary, including not only just getting them confirmed, the nominations portfolio, I had the
00:24:14.420 oversight portfolio. I clerked on the Supreme Court. I clerked for the 10th Circuit. I respect federal
00:24:20.380 judges, no matter if they're appointed by Democrats or Republicans. But what Jeb Bosberg did in this
00:24:27.420 instance is so illegal. It's so reckless. It's so dangerous that you are ordering. First of all,
00:24:37.820 you are sabotaging the president of the United States during a national security operation.
00:24:42.760 You are you have that that has the potential of tipping off our enemies and getting Americans and
00:24:48.780 our allies killed. And then during the middle of this operation, you think you have the power
00:24:54.160 to issue a temporary restraining order to tell the president of the United States to turn around
00:25:00.080 planes full of international terrorists, foreign terrorists. These are designated foreign terrorists.
00:25:05.520 And Jeb Bosberg, this Democrat Obama clown judge in D.C. thinks he's the commander in chief or he can
00:25:12.640 second guess the commander in chief and turn around planes mid-flight. Did he did he check to see if
00:25:19.420 there's enough enough fuel on these planes? Does he understand that there's an entire operation on the
00:25:25.440 other end of El Salvador to make sure that there's a secure handoff? Maybe we didn't have that secure
00:25:30.720 handoff in America. And I would say this to Jeb Bosberg. I don't think that you're a trans black
00:25:37.320 woman. So I don't know if you're qualified to be an air traffic controller. This guy is a clown.
00:25:42.860 He should resign. And if he doesn't resign, the House should impeach him. And look, I don't care
00:25:48.220 if there aren't enough votes in the Senate to remove him. We need to put this guy through the
00:25:53.020 process. So these judges understand when you do these reckless, dangerous things, there are

00:26:06.000 impeach him. They go to trial in the Senate. It's quite remote that they would be removed from their

00:39:24.040 judges, I don't think you understand and appreciate how much momentum is growing right now to bring
00:39:30.820 major reforms to the DC district court, because let's look at it this way. The DC superior court,
00:39:39.340 is that constitutional? I'm not sure. That's not an article three court. That's that handles
00:39:43.920 essentially street crimes and civil disputes among the citizens of DC. And there are like
00:39:49.360 10 vacancies on the DC superior court right now. Maybe we can fix this problem by not feeling,
00:39:56.380 filling those vacancies on the DC superior court, having the DC district court with people like
00:40:02.960 Bozberg and judge Ali and all these other radical judges. Maybe we can change their jurisdiction to
00:40:10.460 the DC superior courts jurisdiction. We'll have Bozberg and Ali doing DC street crimes and doing civil
00:40:17.800 disputes between, you know, people in DC who are, who are fighting over whatever the hell they're
00:40:22.960 fighting over. And then we can bring in judges from around the country to handle the other cases.
00:40:29.760 So we have three lines of attack, right? We have three lines of attack. One is the continual
00:40:34.420 absolute evisceration of these radical law firms, right? By taking the security clearances away,
00:40:40.940 cutting out their business with the U S government. And that's the way you kind of break the

00:48:36.960 who said they want to compromise. Democrats do not want compromise at this point. They want a fighter.
