00:08:20.840 over fears he'd be killed by another inmate.
00:08:23.240 He was moved to a closed wing at Woodhill after intelligence suggested a prisoner serving life there was planning to attack him.
00:08:30.600 His lawyers argued his isolation breaches human rights and is harming his mental health.
00:08:36.200 But the court heard he enjoys various privileges behind bars and has no arguable claim.
00:08:41.340 Robinson's real name, Stephen Yaxley-Lennon, is serving 18 months for breaching a court injunction.

00:08:55.320 Peter, am I to hear this right because there was a guy there that was going to kill Tommy Robinson
00:09:00.980 or they found out it was going to kill him, a person serving a life sentence.
00:09:04.820 The solution was to put Tommy Robinson in solitary confinement.

00:09:11.080 He's in solitary confinement for the rest of his imprisonment, sir?

00:09:18.680 That is what the courts have said.
00:09:22.700 He has been in solitary confinement for about 140 days, maybe 138 days as I join you.
00:09:31.340 He was arrested for showing a film.
00:09:34.620 He was the lowest level prisoner.
00:09:37.300 That is a civil offence, Category D offence.
00:09:40.600 He was originally put in the Category A prison, Belmarsh, the top security prison in the UK.
00:09:48.240 And I had gone to visit him when he was there back two and a half years ago.
00:09:54.660 He was then moved in the middle of the night to another prison, a Category B prison,
00:09:59.660 but held in the maximum containment unit of that prison.
00:10:05.380 And yeah, he is held in solitary confinement.
00:10:09.820 I know the government refused to call it solitary confinement.
00:10:14.460 They call it containment or restricted access.
00:10:17.960 But that basically is 22 hours a day in a cell.
00:10:21.800 He doesn't see anyone.
00:10:23.100 He is allowed out by one guard.
00:10:25.540 He goes and he is allowed in the gym by himself for two hours and then back in the cell.
00:10:31.480 That is it.
00:10:32.480 He doesn't see anyone except the individual, the guard, who walks him to the gym and back again.
00:10:41.920 So that is solitary confinement.
00:10:44.900 The court yesterday, so he was in court yesterday,
00:10:48.600 and they have said he is in solitary confinement for his own protection.
00:10:52.400 He is never asked to be in solitary confinement.
00:10:54.760 He shouldn't actually be in a Category B prison for a minimal offense.
00:11:01.220 He should be a slap on the wrist and a fine.
00:11:04.240 That's another issue.
00:11:05.920 The third issue is he is in solitary confinement.
00:11:08.900 The prison authorities have put him in a prison that's 35% Muslim.
00:11:13.000 Now, Tommy has spent his time speaking up against that clash that Islam has with the West.
00:11:19.000 He has spoken out of the Muslim rape gangs, the grooming gangs that we have had in the UK since at least 1975 for 50 years.
00:11:28.640 So, of course, if you put him in a prison of 35% Muslims, they're going to be a bit pissed off and they're going to possibly take it into their own hands to deal out their own justice.
00:11:40.900 But why has the British establishment put him in a prison where actually a third of the prison is Muslims and it's highly likely actually he would be endangered?
00:11:51.580 So, the government are arguing a situation that they put him in and he doesn't need to be in.
00:11:58.740 And showing a film is not a 18-month solitary confinement prison sentence.
00:12:08.040 And I don't know anyone who is in for contempt of court for that length of time and is normally a slap on the wrist, maybe a fine few thousand pounds.
00:12:19.420 But because Tommy is the enemy of the state, there is no one like Tommy Robinson.
00:12:24.080 And from the 1st of January, when Elon Musk posted, free Tommy Robinson, the world is aware of the work that Tommy has done and the pressure that has been put on him by the UK establishment, by the UK state, by the police, by the courts, by the politicians.
00:12:42.540 And we only have two politicians that speak up for Tommy.
00:12:46.500 In the House of Commons, it's Rupert Lowe MP.
00:12:49.780 And in the House of Lords, it is Lord Pearson of Rannock.
00:12:52.880 Those are the two people in nearly 3,000 people in Parliament that actually will speak up for Tommy.

00:13:05.360 Why has no one picked up the cause of Tommy Robinson, particularly what he's done about the rape gangs and about the radical Islam in the heartland of the United Kingdom?

00:13:20.040 And that was why the police said they didn't get involved in the grooming gangs because they were worried about a race riot.
00:13:25.660 So you don't want to touch on this issue because it has religious and racial connotations.
00:13:32.980 And as we saw in the Danish cartoons, you don't want to point the finger at Islam and critique Islam because you have huge violence in the streets if you do.
00:13:42.260 So it is much easier and makes more common sense in a multicultural society to keep your head down, to keep quiet, to allow these hundreds of thousands of white girls, white young girls to be raped by Muslim gangs.

00:14:02.160 And the girls that are actually being targeted, they are deemed as lower class, not only by the Muslim or grooming gangs, but actually by the establishment.

00:16:16.820 Bosberg is still waiting, by the way, for answers to his questions about last Saturday's deportation flights.

00:16:32.940 The DOJ is denying this, instead calling Bosberg's request for information, quote, inappropriate judicial overreach.
00:16:41.040 Joining us now, MSNBC legal correspondent Lisa Rubin.
00:16:44.440 What's happening in court right now?
00:16:46.380 So there's been a lot of conversation, Katie.
00:16:48.340 First of all, we are not going to get answers today about those flights.
00:16:52.660 And that's because Judge Bosberg has given the administration until the 25th to determine definitively whether or not they're going to invoke something called the state secrets privilege.
00:17:03.200 If they do, that will be a legal argument by them that they never have to provide that information, that they are justified in withholding that, even from a judge who has a top-level security clearance.
00:17:13.960 But what they are talking about right now is the judge's power to determine whether or not the people who are part of the first two flights that left on Saturday are appropriately within the ambit of the Alien Enemies Act to begin with.
00:17:28.100 You noted at the beginning that the Trump administration has argued repeatedly this is a judge who has overstepped his boundaries.
00:17:35.480 And Judge Bosberg fighting back a little bit with the government's lawyer today, noting that there is a bunch of case law from earlier world wars that sets up quite nicely the fact that courts do have a role to play here
00:17:49.680 and determining whether somebody is, for example, a foreign enemy at war with the United States or somebody who is part of an actual or attempted invasion against the territory of the United States by a foreign nation or government,
00:18:06.240 which are important words here because Tren de Aragua is not formally any country or government.
00:18:11.920 The Trump administration's argument is that essentially it is an arm of the Venezuelan government.
00:18:17.420 But there's some real stretching there that has to take place in order to bring what they are trying to do within the plain language of the Alien Enemies Act,
00:18:26.060 which is the legal predicate for the deportation flight.
00:18:31.480 OK, Julie Kelly, we've seen there in this narrative war how the left portrays this and MSNBC is all over this with their top legal correspondents.

00:18:41.920 So I also listened to the hearing today before Judge Bosberg was about an hour and a half.
00:18:48.160 He opened the hearing by blasting the Department of Justice, saying that their responses to him have been intemperate and disrespectful and that he has this is something he rarely sees in responses by the government.
00:19:03.740 So he is really offended at some of the words that the DOJ has used while at the same time going out of his way extrajudicial steps to protect what he described today as the due process rights of illegal Venezuelans who are here and suspected members of what has been designated a foreign terrorist organization, TDA.
00:19:28.060 So he repeatedly condemned the DOJ, accused them of not being forthcoming with him, said that they have not been cooperative.
00:19:40.480 At one point, he scolded the DOJ attorney and Bosberg said, you know, I tell my clerks when they leave my office to go out into the world that the one thing that they really have is their integrity and their reputation.
00:19:55.700 And I think this is something that you need to remind yourself of, he said to the DOJ attorney, because, of course, what he's trying to do is set up this contempt trap that we've been talking about all week.
00:20:07.840 Whether those two flights that took off during the hearing that began at five o'clock, whether those flights were able to be turned around explanation as to why they were not turned around, which he gave in a weird verbal order.
00:20:23.680 He said at six forty eight on Saturday night, the flights had already left Texas an hour beforehand, but also then this third flight that took off after he posted his minute order and what he seems to want to do is not just find someone in contempt of his order, but then also establish due process relief for these Venezuelans accused of being members of TDA.
00:20:52.800 So they make sure that they have their rights covered, something he was not too concerned about in 70 plus J6 cases that he handled.
00:21:04.720 This is heading, he did give them to the 25th, though, to say if they were going to exert not executive privilege, but state secrets act.

00:21:19.020 That's something that the Department of Justice in a filing this week suggested that they said that they were considering to keep these granular details about these flights away from Jeb Bosworth.

00:21:40.740 The DOJ has told him we have abided by your orders.

00:21:45.060 So when he asked for today, Steve, that Deputy Attorney General Todd Blanche, as if he doesn't have more important things to do,
00:21:53.040 had to sign a sworn statement filed before Judge Bosworth this morning, saying that yes,
00:21:59.180 confirming there are cabinet level discussions about invoking state secret privilege to keep this national security
00:22:07.320 and foreign policy decisions away from this reckless partisan hack, Jeb Bosworth.
00:22:21.680 Do you think that the effort that's out there publicly to impeach him has gotten to this guy?
00:22:26.660 That's why he's dug in even harder, because both sides seem implacable, right?
00:22:30.700 There's a gulf there.
00:22:32.260 You can see it, and it only gets deeper every day.
00:22:34.440 It may not get wider, but it's getting deeper.
00:22:36.260 Well, he did say, because, of course, the public line has now been reopened for all of these proceedings.

00:22:49.700 But all of a sudden now, the public, including reporters like myself, can phone in and listen to what's happening in the courtrooms.
00:22:56.220 And he did say at one point, I understand that there is great, unusual public interest in this case.
00:23:03.440 And he was asking the DOJ to confirm that, basically, he's not defending all terrorists.
00:23:10.000 He just has concerns about this certain proclamation by the president and who it specifically covers.
00:23:18.620 So he's well aware of the bad press that he's getting.

00:34:59.240 But I want to address, we just had Julie Kelly on here about this fiasco this afternoon in a federal court about President Trump, the commander-in-chief, trying to get rid of and get out of the country a terrorist-designated organization of Venezuelan criminals and having a judge step in the middle of that.
00:35:19.120 You've been very vocal about different alternatives.
00:35:23.440 Can you give us your assessment of where we stand now with this judicial insurrection, given your career as a prosecutor, sir?
00:35:30.720 Yeah.
00:35:31.280 What's gone on is the judiciary is utterly out of control, Steve.
00:35:37.120 So when you think that there's been something north of 130 lawsuits filed to stop President Trump and any of his actions, you know that the federal judiciary is out of control.
00:35:49.640 So let me give you some examples of what needs to happen.
00:35:52.540 First of all, we have the checkbook.
00:35:54.840 We can defund them.
00:35:55.660 Second of all, under Article 3, Section 1 of the Constitution, we create all federal courts other than the U.S. Supreme Court.
00:36:05.260 And we grant or remove jurisdiction from all those courts.
00:36:09.340 So we need to remove jurisdiction from place to place so you don't get these nationwide injunctions.
00:36:16.180 Piece of legislation I've got pending right now needs to get a hearing, needs to go forward, needs to get off the floor and get over to the Senate.
00:36:22.460 But I'm going to give you—and then people say, well, let's impeach.
00:36:26.820 That's an Article 2, Section 6 issue.
00:36:29.600 And you can impeach.
00:36:32.280 Your standard of proof is going to be different.
00:36:35.140 You're going to have to prove some stuff.
00:36:37.140 You can get them out of the House.
00:36:38.280 And I have no doubt that we can come close to impeaching in the House.
00:36:41.080 But you won't get the conviction.
00:36:42.360 You're not going to get removal.
00:36:43.400 I'm going to tell you now how I think we can remove these judges.
00:36:47.760 Everybody thinks that these judges have lifetime tenure.
00:36:50.480 Everybody's told that, but that's not accurate.
00:36:53.140 Article 3, Section 1 says these federal judges, all federal judges, including U.S. Supreme Court justices, only can serve a tenure of good behavior if they are found to be in good behavior.
00:37:06.880 So let me tell you what I think needs to happen.
00:37:08.600 This has never been approached in the entire history of the United States, but this is different than impeachment.
00:37:15.340 And I am asserting that Congress should actually pass a resolution saying, judge, you are not in good behavior.
00:37:26.220 You're not consistent with the Constitution anymore, Article 3, Section 1.
00:37:30.300 And thus, you are terminated.
00:37:33.360 You are fired.
00:37:34.580 That does not require an impeachment.
00:37:37.840 It doesn't require the supermajorities that impeachment does.
00:37:40.880 What it does is it says, we've resolved.
00:37:44.360 You are in bad conduct.
00:37:46.300 And you need to go.

00:40:18.720 And so today I sent a letter joined by a number of my colleagues to FBI Director Cash Patel.
00:40:24.780 And I've reminded him what U.S.C. Section 18, 18 U.S.C. Section 2335 says about domestic terrorism.
00:40:34.500 And that's what's happening here.
00:40:35.960 And domestic terrorism includes people who are inciting.
00:40:40.240 And they're using this domestic terrorism to actually try to intimidate government officials to change policy.
00:40:49.240 That is what you are seeing happening here.
00:40:51.400 And these members of Congress, they're just as culpable criminally, quite frankly, as, in my opinion, as those that are actually throwing the Molotov cocktails at the Teslas and are doxing people just simply because they own cars.
00:41:07.980 What they are saying is that they want to see these people punished physically and violently.
00:41:14.860 That is contrary to law.

00:41:18.520 I think Pam Bondi and Cash Patel, I think, want to get on this.

00:42:37.280 I hope he opens an inquiry and begins looking to see the connection between these individuals who are fomenting violence or fomenting vandalism and determining whether they should be appropriately referred for charging to Attorney General Bondi for violation of 18 U.S.C. 233.5A.

00:47:09.340 Tom Massey is right, and he's kind of putting it up to where his House Freedom Caucus brothers and sisters are going to get serious about this, sir.

00:47:20.960 What we were told and what I believe is certainly going to happen is impoundments, and I believe that's going to happen very quickly.
00:47:29.100 And what an impoundment is for folks to understand is that's when the executive branch, in this case President Trump, says, yeah, the legislature gave us this much authority to spend, but I'm not going to spend that much money.
00:47:44.060 That's the impoundment President Trump is going to follow with – he's been working on with Russ Vogt, and others of us have had a little bit of input in that.
00:47:56.560 So you're going to see the impoundments.
00:47:57.820 I think that's very short order.
00:48:00.240 And when I say short order, I don't mind saying I expect it to be in the next couple weeks because that's what I was told would happen.
00:48:07.420 The other thing is rescission's package.
00:48:10.420 The rescission's package, Steve, that's where you go in and you actually rescind programs, and there are ways to do it.
00:48:19.340 So there's a couple ways to do it.
00:48:21.000 One, the president could give us a letter saying, rescind all this stuff here, and then we'd have to vote on it.
00:48:26.740 And there's something else, you know, there's other procedures where we won't even have to vote, and he could actually rescind programs, agencies, and departments.
00:48:35.540 And I anticipate that will happen, but that's probably not going to happen until later this summer.
00:48:40.740 That's a little bit later in the summer.
00:48:43.820 The rescissions might not, but the impoundments, you expect that we're going to have to maybe litigate that, sir, probably?
00:48:50.940 Yeah, I think you're going to get stuck litigating both just because of the litigious nature of the left now.
00:48:58.480 But the impoundments, because you have the 1972 Budget Control and Impound Act, there will be folks that come in and say, wait a second, you can't – let's – this is the absurdity of the argument they're about to make.
00:49:12.700 They're going to say, if the legislature gave you $100 million and you found a way to do the exact program that you were authorized to do and you could do it for only $2 million, we still want you to spend the other $98 million.
00:49:26.720 That's what the people who are going to come in and file the lawsuits are.
00:49:30.680 But, yeah, that's going to be litigated for sure.
00:49:32.840 Don't be surprised if you see the rescissions package get litigated as well.
00:49:37.960 That's why we get back to what you and I were originally talking about, which is the judiciary and how it's run amok, and they need to know that they can no longer be judicial activists, try to be super legislature from the bench.
00:49:51.220 They have to invoke – they have to follow the law.
00:49:54.280 They have to – they're not supposed to interpret the law.
00:49:56.560 They're supposed to apply the law.
00:49:58.840 That's what the courts are supposed to do.
