00:04:44.400 I think they're coming back because of the election that took place on November 5th and because of the fact that they have to come back because the tariffs are forcing them to come back.

00:18:22.960 war powers, the courts are paralyzed to do anything, then that's a misreading of precedent.

00:18:35.020 And that can't be an unlawful intrusion on the president's powers.

00:18:43.300 The president has to comply with the Constitution and laws like everybody else.

00:18:54.540 So, Alicia, today was an argument about certain issues in the case, but not others.
00:18:58.700 So let's first set the table about what it wasn't about.
00:19:01.000 It wasn't about whether the president lawfully used the Alien Enemies Act or whether, for
00:19:07.460 example, it applies in peacetime.
00:19:10.440 It wasn't about that.
00:19:11.540 It wasn't about whether the Trump administration has violated the orders that Judge Bosberg
00:19:16.280 set into place.
00:19:17.180 And it certainly wasn't about what the remedy is for that.
00:19:20.260 The question here today was, does a court have any role when a president invokes the Alien
00:19:27.460 Enemies Act through a proclamation and then takes action to implement it?
00:19:31.000 As the Trump administration did with those two flights of alleged Venezuelan migrants
00:19:36.460 who are members of Tendejo Agua.
00:19:38.340 And today, you heard two very different interpretations of that.
00:19:42.660 You heard the administration saying, really, there is no role for the court here to play
00:19:46.220 unless and until those who have already been placed in custody bring what's called a habeas
00:19:52.040 petition.
00:19:52.560 That's a fancy way of saying a petition for their release from U.S.
00:19:55.920 custody.
00:19:56.920 Then you have the plaintiffs represented by legal learns of the ACLU saying that can't
00:20:01.320 be the only way that we can contest this.
00:20:03.700 People are entitled to an individualized determination of whether or not they are, in fact, members
00:20:11.580 of Tendejo Agua, which is what you were talking about at the top.
00:20:14.820 But it wasn't a question, for example, of whether or not we are at war with the Venezuelan
00:20:20.820 government, whether Tendejo Agua is an extension of the Venezuelan government.
00:20:25.620 And I think the most interesting part of all of this came at the end when Judge Patricia
00:20:29.900 Millett, who you just quoted with that respect to saying that Nazis were treated better than
00:20:35.200 some of the Venezuelans here, really forced the government to acknowledge the government
00:20:39.880 was in complete control of who was on the plane.
00:20:42.520 And she asked them, given that, aren't these people entitled to some form of notice and
00:20:47.720 a chance to contest that they are who you say they are before you deport them to El Salvador
00:20:53.260 and put them in a notorious Salvadoran prison?
00:20:55.760 And the answer, of course, the government was trying to weave around it.
00:20:59.440 But eventually he finally conceded, if you lifted this TRO, yes, there would be no limitations
00:21:06.000 on what we could do.
00:21:07.140 We would be within our rights to start these plane flights immediately again, and we could
00:21:13.500 pack more Venezuelan migrants who are alleged members of Tendejo Agua on a plane before they
00:21:19.260 could even file a habeas petition or anything else.
00:21:22.640 And that's a chilling thing for the government to acknowledge.
00:21:25.100 But of course, that is exactly what they want to do and why they want the TRO lifted.
00:21:31.640 Chilling?
00:21:32.280 I don't know if the American people think it's chilling.
00:21:34.040 I think it's what they want, what they demand and what they deserve.
00:21:37.440 And President Trump's going to give it to them.

00:22:11.660 presidential immunity oral arguments for a three-judge panel of the D.C.
00:22:16.500 Appellate Court.
00:22:17.060 Remember when she said, does this mean the president can use SEAL Team 6 to go kill his
00:22:22.400 political opponents, and that became the headline.
00:22:25.660 So Patricia Millett picking up on her fellow Democratic appointee and then throwing this
00:22:31.080 chum in the water that somehow these illegal Venezuelans who are tied to Trente Aragua are
00:22:39.480 treated worse than Nazis.
00:22:41.420 Now, I'm not sure the American people, number one, would view it that way, or number two,
00:22:45.860 have a big problem with terrorists here in America illegally tied to a very dangerous,
00:22:53.360 deadly gang cartel in Central and South America.
00:22:59.160 I don't know that they would have such a big problem with them being removed without what
00:23:04.020 they call due process.
00:23:05.880 I actually think Lisa Rubin gave a pretty good summary without her editorializing there of
00:23:12.800 what happened today.
00:23:13.820 And look, these are very complicated issues that Judge Bosberg should have been more careful
00:23:21.480 in his handling of.
00:23:23.400 But of course, he wasn't, Steve.
00:23:25.260 He leapt into action last Saturday.
00:23:28.600 This lawsuit we found out today by the ACLU, the lawsuit that was filed to stop these deportations

00:23:48.120 However, it was not published until Saturday afternoon on March 15, around 3 o'clock.

00:24:13.440 But then Judge Bosberg, he said at 8 o'clock on Saturday morning, this is last Saturday,
00:24:19.300 the 15th, then jumped into action, called both sides, the Department of Justice and the ACLU,
00:24:26.360 immediately entered a temporary restraining order, halting the deportation of five of the unnamed
00:24:35.580 Venezuelan illegals who were plaintiffs in the ACLU lawsuit, filed that temporary restraining order
00:24:43.360 immediately and then called a 5 p.m.
00:24:47.400 hearing, status hearing for Saturday evening, after which he entered another TRO, turning
00:24:54.560 those five plaintiffs, those five Venezuelan illegals into a class action lawsuit that covered
00:25:01.040 every single Venezuelan illegal who would have been subject to the president's Alien Enemies
00:25:08.520 Act proclamation.
00:25:10.120 So here we are, you know, eight days later, this has been rushed through the process.
00:25:15.580 And these three judges on the appellate panel, including Patricia Millett, trying to figure
00:25:20.720 out whether that temporary restraining order, which is usually not appealable, will this three
00:25:27.220 judge panel vacate or put a stay on that temporary restraining order as some of these more what
00:25:34.980 what the Democrats and the activists and the judges have made very complicated related to
00:25:40.300 the president's obvious president, his authority, executive authority in issuing that proclamation.

00:25:53.260 but on this one, they actually want to have the president reverse.

00:26:07.500 perpetuity as they work through the due process rights for thousands of these people, eventually

00:33:32.440 And then, frankly, there's the broader issue of all these judges' injunctions and then decisions like Judge Boasberg, what he's trying to do and how that case is working.
00:33:43.280 We're going to have hearings on all of that because particularly when you look at Judge Boasberg, it starts to look like this is getting totally political from this guy,
00:33:52.800 particularly when you remember he's also the judge who was part of the whole Trump-Russia-FISA court granting those warrants that allowed the Comey FBI to spy on President Trump's campaign.
