00:06:31.440 Judge James Boasberg filed the opinion alongside a short one page order directing the government
00:06:37.740 to either voluntarily comply with his orders or to submit to the contempt finding and identify
00:06:43.960 who exactly in the administration made the decision to ignore a federal judge.
00:06:50.660 There are a lot more wrinkles here that we're going to have to iron out with some really smart
00:06:55.480 guests in a moment, including more from the opinion, which reads like an edge of your seat drama.
00:07:02.140 But the bigger question here and the one that stopped me in my tracks as I read this opinion
00:07:07.340 this morning is what happens if this goes to the Supreme Court?
00:07:12.140 Judge Boasberg sets the stakes as high as they possibly can be.
00:07:16.900 Quote, the Constitution does not tolerate willful disobedience of judicial orders,
00:07:23.440 especially by officials of a coordinate branch who have sworn an oath to uphold it.
00:07:28.440 To permit such officials to freely annul the judgments of the courts of the United States
00:07:34.140 would not just destroy the rights acquired under those judgments.
00:07:38.540 It would make a solemn mockery of the Constitution itself.
00:07:42.640 So fatal a result must be deprecated by all.
00:07:47.880 That, by the way, is Judge Boasberg quoting a Supreme Court opinion upholding judicial authority
00:07:54.380 back from 1809, a specific phrase that Chief Justice John Roberts has also cited in opinions
00:08:01.700 he's written arguing himself on the supremacy of the judiciary.
00:08:06.940 So if this goes to the Supreme Court, which it very well could, as the Trump administration
00:08:13.120 has already said it's going to appeal, how might that court decide?
00:08:17.680 And how big of a deal will it be?
00:08:19.760 Boasberg sets the stakes so high here, saying the administration defied him.
00:08:25.380 Criminal contempt.
00:08:26.340 If the Supreme Court gets this and doesn't agree with him, does that blow a hole in our Constitution?
00:08:33.380 I would think so, because Judge Boasberg is basically setting a dividing line between before and after.
00:08:41.440 So what he's saying is it doesn't matter that the Supreme Court later vacated his TROs and found...

00:08:49.580 And found that the appropriate metric of relief is to be found where folks are detained,
00:08:56.000 meaning they had to sue somewhere else other than in the District of Columbia.

00:09:04.640 in the Southern District of New York here in Manhattan and in Texas.

00:09:10.600 your willful violation of what I clearly directed you to do on March 15th,
00:09:16.460 and then your refusal to provide me any answers over a course of opportunities,
00:09:22.440 which he then goes through in detail, that can't be tolerated.
00:09:27.380 And it's hard for me to see a situation, Katie, in which the Supreme Court finds that tolerable as well.
00:09:33.000 It may be that they say, for example, Judge Boasberg should undergo some further fact-finding
00:09:37.580 before he gets to the point that there's probable cause for criminal contempt.
00:09:41.300 One of the things that he contemplated doing at that April 3rd hearing that he last had
00:09:46.320 in this case was having people come in and testify before there was a probable cause determination.
00:09:52.020 It was a little bit surprising to me that he issued this opinion today and said,
00:09:55.220 we're already there, and now I just want to know exactly who's to blame.
00:09:59.480 But I don't think we're at a place where the court is going to say, he's crazy,
00:10:04.520 this is not called for, because there was a clear order of the District Court
00:10:09.460 that was so willfully, flagrantly, clearly violated by the federal government
00:10:15.380 and specifically the executive branch that I don't know that the court can tolerate it
00:10:19.680 and yet uphold the rights of other district judges around the country
00:10:23.760 to declare what the law is and find remedies for when it's violated.

00:38:37.260 Look, the key for the dollar as global reserves since 1971 has been stability.
00:38:42.400 With huge money printing, huge debt, it doesn't make sense.

00:38:47.940 China have tripled their gold allocation over the last few years.
00:38:52.360 They just imported over 700 metric tons from the United Kingdom, from the Bank of England.
00:38:57.760 And for some context, 700 metric tons is the entire gold reserves of India.
00:39:03.360 China are specifically, but other central banks as well, they're diversifying out of U.S. government debt into gold.
00:39:10.420 And the reality is, since 2022, it has been a good trade.
00:39:15.460 If you bought gold and a 10-year government debt back in 2021, you'd be up 80% in gold.

00:44:58.100 What did Bosberg do today?
00:44:59.700 And how dangerous is this for the president and the folks around him, ma'am?
00:45:03.900 So what Bosberg found and what he's been signaling and threatening for the last few weeks, really since he got this case on March 15th, is accusing the Trump administration, specifically the Department of Justice, of defying two written temporary orders that were handed down on March 15th.
00:45:25.000 What those temporary restraining orders did was first prevent the deportation removal of five unnamed illegal Venezuelans who were covered by the president's Alien Enemies Act proclamation.
00:45:40.560 Then he said a hearing for five o'clock that day was a Saturday on March 15th.
00:45:47.300 This lawsuit filed by the ACLU on behalf of these unnamed five illegals.
00:45:52.560 What the ACLU was asking Judge Bosberg to do was convert those five into a class action lawsuit covering any illegal Venezuelan in custody suspected of having ties to Trente de Aragua and subject to immediate removal.
00:46:11.600 Judge Bosberg held that hearing at five o'clock.
00:46:13.960 He put he recessed at about 522, which is important because about four minutes later, one plane carrying the Alien Enemies Act subjects left Southern Texas.
00:46:29.520 And about 10 minutes later, another plane carrying AEA, Alien Enemies Act subjects, left Southern Texas for Central America.
00:46:39.060 As we have talked about and I reported at my substack, I believe that Judge Bosberg knew those planes were planning to take off.
00:46:48.620 He called a recess right at that moment, instructing the DOJ attorney to make calls and find out the status of flights that were leaving again a Saturday night, March 15th.
00:47:01.760 DOJ return DOJ attorney returns to the hearing.
00:47:05.480 It is resumed at six o'clock.
00:47:07.640 He tells Judge Bosberg, I can't get any details on these flights.
00:47:12.940 Bosberg doesn't care.
00:47:14.940 Then makes an extraordinary what he calls an oral command.
00:47:20.120 That's how he referred to it in his opinion today.
00:47:23.400 Oral command instructing the DOJ lawyer to tell his clients, this would be DHS, DOJ,
00:47:29.620 to immediately return planes that were in the air headed to Central America with these subjects, illegals covered by a presidential proclamation over which Judge Bosberg said he did not have authority to review.
00:47:45.920 Nonetheless, he takes this extraordinary oral command telling him to return flights that at that point were already out of U.S. airspace.
00:47:56.140 He then says, Steve, and this timeline is super important.
00:48:00.280 He then tells the ACLU and DOJ attorney, don't write any of this down.
00:48:05.640 I'm going to put this in a written order shortly.
00:48:08.920 He publishes a written order at about 726, so roughly 40 minutes after this so-called oral command.
00:48:17.240 And he turns the five unnamed plaintiffs, illegals, into a class action suit and prohibits their removal.
00:48:25.600 He does not, however, include what he said, his oral command, to return planes.
00:48:32.740 So that on itself, very confusing.
00:48:35.920 He then continued over the past few weeks to push for details about those flights.
00:48:42.680 Attorney General Pam Bondi, Secretary of State Rubio, DHS.
00:48:46.480 But hang on, hold on, hold on, hold on, slow down, slow down, slow down, full stop.
00:48:50.320 But there you're telling me from the bench on a Saturday afternoon and a Saturday evening.

00:48:55.740 And from a court in D.C. or by Zoom, he's actually intruding into the decisions of the commander-in-chief of the United States military on what he's doing in a military maneuver.
00:49:08.680 This guy is actually intruding right there, asking his questions and wanting planes to turn back.
00:49:13.080 That's what this judge is doing?
00:49:14.460 They ought to arrest this judge.
00:49:16.300 Is that what he's doing?
00:49:17.960 That's exactly what he did.
00:49:20.080 And, Steve, all this happened very quickly on this Saturday, March 15th.
00:49:24.880 Without any meaningful input or briefing by the Department of Justice or Trump administration, nonetheless, and Bosberg has repeatedly admitted how quickly the proceedings advanced that day, that it was out of the norm for him to do what he did.
00:49:41.740 But nonetheless, he stepped in and not only prohibited these flights, but then ordered them to be returned.
00:49:50.880 And then when the Department of Justice attorney couldn't get information, this is when he started setting what I call this contempt trap for the Trump administration.
00:50:02.900 Now, what also happened that day, and this is important, is that the DOJ immediately appealed his first order for those five unnamed illegals.
00:50:12.240 So Heardy knew this was going to be on appeal.
00:50:14.860 He also admitted numerous times that the jurisdiction, Washington, D.C., could be improper, that this would have required a habeas petition in the venue or jurisdiction where these illegals were in custody, which was Southern Texas, not Washington, D.C.,
00:50:34.860 which is why the Supreme Court last week, the main reason why the Supreme Court, vacated his two written temporary restraining orders.
00:50:44.860 So I don't know on what basis he made this contempt.
