00:03:50.600 Powell has said in public on camera that he cannot be fired by Donald Trump.

00:16:17.660 Now, this case centered on a group of Venezuelan men being held in Texas.
00:16:21.520 The White House wants to deport them without due process, but the court temporarily blocked that in an apparent 7-2 decision.

00:16:33.040 Yeah, Gail, for now, the high court has halted more of these Alien Enemies Act deportations,
00:16:39.900 but it's unclear how long that halt's going to last.
00:16:42.540 But it is clear the Trump administration is welcoming this fight.
00:16:47.860 The Trump administration is asking the Supreme Court to roll back its decision temporarily blocking the deportation of Venezuelan migrants being held in Texas.
00:16:56.740 The high court's order came in the early hours Saturday after the ACLU said the migrants got this paper saying,
00:17:02.740 saying you've been determined to be an alien enemy subject to apprehension, restraint and removal from the United States.
00:17:08.740 But Justices Clarence Thomas and Sam Alito dissented from the majority, Alito writing,
00:17:14.360 the court issued unprecedented and legally questionable relief among those deported last month using the Alien Enemies Act was Kilmar Abrego Garcia,
00:17:23.460 who was mistakenly put on the flight despite having protected status.
00:17:28.460 Maryland Senator Chris Van Hollen met with him last week.
00:17:30.460 I was there to make sure that he was still alive and check on his health.
00:17:35.460 Sunday, Van Hollen dominated the airwaves, blasting the Trump administration for defying a Supreme Court order to facilitate Abrego Garcia's return.
00:17:43.460 My focus is not on one man. It's on making sure one man's rights are secured so that we can uphold the rule of law.
00:17:53.460 The administration continues to argue Abrego Garcia is in Salvadoran custody and denies it's defying the court.
00:18:00.460 I stand by the fact I think we did the right thing here. We removed the public safety threat, a national security threat.
00:18:06.460 While some Republican lawmakers acknowledge the mistake.
00:18:09.460 The administration won't admit it, but this was a screw up. Mr. Garcia was not supposed to be sent to El Salvador.
00:18:16.460 A surprise over the weekend, Senator Van Hollen revealed before the Trump administration did, Abrego Garcia has been transferred from that terror prison to a nearby detention facility in El Salvador.
00:18:28.460 Tony, the administration says even if released back into U.S. custody, Abrego Garcia is not coming back to the U.S.
00:18:35.460 Yeah, I'm not crazy about the not being a Seacott either there. You're not there.

00:18:45.460 Here's my concern, Davis, and you called this with Judge Thomas and or Justice Thomas and Alito.

00:18:56.460 First off, it was released at one o'clock in the morning on something that's important.
00:19:00.460 That sounded odd.
00:19:01.460 Number two, I'm not sure. I'm not a lawyer. I don't pretend to play one, although I've got a major case of a review en banc at the appellate court.
00:19:13.460 It sounded odd. It didn't. It seemed like there were some pieces missing.
00:19:17.460 And then he had Alito come out with this kind of sharp edge through a couple of elbows on his.
00:19:23.460 And that's not really his style that much, I don't think.
00:19:26.460 Are we have brewing a civil war on the Supreme Court about the direction of this country and the direction of the Trump presidency, sir?
00:19:36.460 This is a very disappointing ruling by the Supreme Court.
00:19:41.460 Now, remember, it's just a temporary order saying that the government can't ship out these Trendy Aragua and MS-13 terrorists until the court further rules.
00:19:52.460 But I don't know how the court even thinks it had jurisdiction to do what it did late on Friday night, on Good Friday.
00:20:00.460 You had these ACLU plaintiffs who essentially put a self-imposed deadline on the district court in Texas, giving the district court 45 minutes on Friday to rule.
00:20:14.460 And then the ACLU moved forward with an appeal to the Fifth Circuit, which divests the district court of jurisdiction.
00:20:21.460 And then the Fifth Circuit has indicated it was getting ready to rule on this matter.
00:20:26.460 And then the Supreme Court used the emergency docket impermissibly.
00:20:31.460 They didn't have jurisdiction to issue this stay under the All Writs Act.
00:20:36.460 I mean, Justice Alito's opinion is spot on, that the opinion that Justice Thomas joined, to me, it is a total head-scratcher that the three Trump justices who made many assurances to the Trump administration that they're going to be constitutionalists and originalists and they're going to follow the law, I don't think they did that on Good Friday.
00:20:58.460 I don't think they did that when they failed to join this opinion.
00:21:02.460 So you have to ask why.
00:21:03.460 Why was there such lawlessness and cowardice by the Supreme Court?
00:21:08.460 And this is a very important question because this goes to the heart of the Supreme Court's legitimacy.
00:21:16.460 President Trump campaigned on the fact that he is going to secure our border and he's going to deport illegal immigrants.
00:21:23.460 They are all criminals, right?
00:21:24.460 He's going to especially focus on Trendyiragua, foreign terrorists, and MS-13 gangbangers.
00:21:31.460 And President Trump is doing exactly what he promised American voters he can do, and he's following the law.
00:21:38.460 It's these lawless judges on the district courts and now the lawless judges on the Supreme Court who are just making up the law as they're going.
00:21:47.460 They're essentially becoming judicial activists, telling the president that he has to halt planes.
00:21:53.460 How long are they going to hobble the president in his ability to get these foreign terrorists the hell out of our country?
00:22:00.460 What process is due?
00:22:02.460 And why are we so concerned about Trendyiragua terrorists?
00:22:05.460 Why can't they file habeas petitions?
00:22:08.460 So here's the bottom line.
00:22:09.460 This is what President Trump needs to do.
00:22:11.460 He needs to round up all these illegal immigrants.
00:22:14.460 He needs to detain them in Texas or Guantanamo or wherever he wants to detain them, and then they can sit in that holding pen until the Supreme Court figures out what due process is due to these people.
00:22:28.460 My concern is – you're the constitutional lawyer.

00:22:49.460 Are they starting to listen to the firestorm that's outside?
00:22:52.460 Because this – the only way they're stopping Trump right now to delay is to deny.
00:22:57.460 They understand the federal courts, and this is just going to get them – you're going to see – just as we came on here, Harvard dropped a suit against President Trump.
