00:01:17.320 the street from us. Mike Davis, the viceroy, is going to join us. Ladies and gentlemen,
00:01:23.400 this thing expanded to be a lot more than just talking about birthright citizenship. So let's
00:01:27.980 go ahead and play our cold open. The viceroy is next in the war room.
00:01:31.000 Elena Kagan wondered why the administration would ever bring the merits of this case
00:01:37.440 to the Supreme Court. Let's assume that you lose in the lower courts pretty uniformly as you have been
00:01:46.940 losing on this issue and that you never take this question to us. I mean, I noticed that you didn't
00:01:53.600 take the substantive question to us. You only took the nationwide injunction question to us.
00:01:58.400 I mean, why would you take the substantive question to us? You're losing a bunch of cases.
00:02:06.600 This guy over here, this woman over here, you know, they'll have to be treated as citizens,
00:02:11.620 but nobody else will. Why would you ever take this case to us? Well, in this particular case,
00:02:16.320 we have deliberately not presented the merits to this court on the question of the scope of remedies,
00:02:22.300 because, of course, that makes it a clean vehicle where the court doesn't have to look at the...
00:02:26.760 You're ignoring the import of my question. I'm suggesting that in a case in which the government
00:02:33.660 is losing constantly, there's nobody else who's going to appeal. They're winning. It's up to you
00:02:40.820 to decide whether to take this case to us. If I were in your shoes, there is no way I'd approach the
00:02:46.500 Supreme Court with this case. Joining us now, NBC News senior legal correspondent, Laura Jarrett.
00:02:52.400 So, Laura, try to help us understand what exactly was being argued there. I set it up,
00:02:59.920 but I think you can probably bring it to us in simpler terms.
00:03:03.480 No, no, you did just great, Katie. I think there's a couple things going on here. One,
00:03:07.660 there is a fundamental clash going on right now, and not just on birthright citizenship,
00:03:12.040 but just generally between the federal courts and this administration. And you saw it a little
00:03:16.200 bit today as Justice Barrett is pressing the Solicitor General about, are you going to follow
00:03:20.380 federal court orders? And he's saying things like generally. That's what's going on on the one
00:03:24.780 hand, right? That ongoing tension, as we've seen the president criticizing judges for blocking his
00:03:30.020 initiatives and his policies. Then there's the question of really birthright citizenship. And the
00:03:34.500 idea that you could strip away a constitutionally guaranteed right was once seen as a fringe opinion,
00:03:40.320 but now it's being, at least by this administration, embraced as something legitimate. And what Justice
00:03:46.820 Kagan was saying there in the bite that you're playing is you're not bringing it to us because
00:03:50.200 you know you're going to lose. And so Kagan is saying you're trying to go on the edges here as
00:03:54.500 it relates to nationwide injunctions and limiting the scope of the orders because on the merits of
00:04:00.380 birthright citizenship, it was sort of taken for granted for a long time that that was guaranteed by
00:04:05.280 the constitution and that you're like unlikely to win in front of the Supreme court. And so instead
00:04:09.820 you'd rather have these fights in the lower courts. And if it means that a judge in New York says,
00:04:14.780 of course, birthright citizenship is guaranteed by the constitution, but a judge in Texas says,
00:04:19.340 oh no, it's not. Then you're living in sort of this patchwork universe. And that's where
00:04:23.880 sort of the challengers to this, um, to this EO have, I think had some traction, Katie, which is to say
00:04:29.300 you'd actually have a situation in which there are rights guaranteed under the constitution in New
00:04:33.700 York, but not in Texas. What do you sort of say to make it clear that this wasn't just about
00:04:41.400 birthright citizenship. It really wasn't about birthright citizenship. It was about, um, whether
00:04:47.140 a judge's ruling, if Trump doesn't like it actually applies. I mean, just explain what this was.
00:04:52.920 So this is such a good example for people to try and understand how procedure affects
00:04:59.540 substantive rights. And that's why everyone kept on saying, let's assume that whatever is a substance
00:05:06.220 is unconstitutional here, birthright citizenship. The Sotomayor example was about guns. And the
00:05:12.680 question is, how do you get people to be able to vindicate that so that their rights aren't violated?
00:05:19.500 And that is where the sort of whack-a-mole idea or catch me if you can is so much at stake because
00:05:26.760 the court could say, you have to bring individual cases all around the country. And that means each
00:05:34.220 person has to do that. And so rights can be violated against all sorts of people. And only
00:05:40.880 if you happen to have a lawyer and you happen to get there to court in time, this is not hypothetical.
00:05:47.000 And here's the thing I'd say for people who are saying, let me, give me a concrete example.
00:05:51.780 We are seeing it in the immigration front every single day. The Supreme Court said that you have to
00:05:58.860 bring this by habeas. Some people are like, I don't know what that is. What does it mean? It means you
00:06:04.100 have to bring these individual cases. And what does what is happening? You have a patchwork of
00:06:09.520 decisions. You have people having to race around the country. And what is the government doing? They
00:06:14.480 are literally playing whack-a-mole. They're playing a shell game with people's lives. They move people
00:06:19.940 around to jurisdictions where there's not yet a court case that says you can't do this so they can
00:06:25.960 export people or really extract them from this country. So we're seeing that confluence of
00:06:32.360 procedure affect people's substantive rights. And that's really being what's at the heart of what's
00:06:38.420 happening here today, but in a different context of birthright citizenship.

00:07:41.120 really a discussion far beyond just birthright citizenship. Can you walk us through what
00:07:47.000 exactly happened today? And is Weissman your favorite guy? Is he right or is he wrong, sir?
00:07:54.100 Well, it was a bit of a muddled mess today at the Supreme Court. Look, it is very clear under the
00:08:04.180 14th Amendment to the Constitution that the birthright citizenship provision of the 14th Amendment was
00:08:12.820 enacted to overturn the Dred Scott decision, to make sure that the children of freed slaves were
00:08:20.560 citizens of the United States and they had the rights of citizens of the United States. That's
00:08:26.260 what the intent of the birthright citizenship provision of the 14th Amendment was. That was
00:08:31.960 expanded by the Supreme Court to include in the Chinese exclusion case, that was expanded to include
00:08:38.920 lawful permanent residents of the United States. The children of lawful permanent residents of the
00:08:45.820 United States also have birthright citizenship under the Chinese exclusion case of the United States. But
00:08:52.280 foreign ambassadors' children do not have birthright citizenship invading armies. Kids do not have birthright
00:08:59.520 citizenship. People don't realize this, but even American Indians did not have birthright citizenship under the
00:09:07.360 14th Amendment to the Constitution. Congress had to pass a statute to give American Indians birthright
00:09:14.680 citizenship because the Supreme Court said that they don't have it under the 14th Amendment. So ask
00:09:19.860 this question. If American Indians didn't have birthright citizenship under the 14th Amendment,
00:09:26.340 how the hell do illegal aliens, kids, have birthright citizenship? They don't. They don't have allegiance
00:09:33.080 to the United States, which is a critical component of the 14th Amendment's birthright citizenship provision.
00:09:42.680 You have to show allegiance to the United States. If you are a lawful permanent residence kid, you have
00:09:50.240 allegiance to the United States. If you are an illegal aliens kid, if you're a Trendy Aragua or MS-13 baby,
00:09:58.060 your parents do not have allegiance to the United States, and therefore you should not have birthright
00:10:04.140 citizenship. Now, I don't know if the Supreme Court is even going to get to the merits of that
00:10:09.660 question. They're going to decide the issue of nationwide injunctions. Can one of these 680
00:10:16.380 district court judges around the country issue a nationwide injunction, effectively legislation
00:10:22.740 by a judge, unconstitutional legislation by a judge, and stymie the will of American voters
00:10:30.760 by putting a nationwide injunction on the duly elected president of the United States? It's unclear
00:10:37.080 after today's courtroom proceedings where the Supreme Court is going to land on either of those issues.
00:10:44.500 But I want to, for the non-lawyers, myself included, you know, I think Slaughter is the
00:10:50.760 solicitor general. Was he caught? It looked like, I don't know, to the untrained eye, like a trap set by
00:10:57.620 our favorite Amy Comey Barrett, and was it Kagan, that went down this road of even not talking about
00:11:07.260 birthright citizenship, but was going down this issue about, you know, was Trump going to follow
00:11:16.160 court orders? Almost teeing up this constitutional crisis we've talked about and bringing it up to
00:11:21.560 the court essentially today as they should decide it in this opinion on this. Am I wrong? Am I
00:11:28.560 misinterpreting what I heard? Well, John Sauer is the solicitor general of the United States, and he's a
00:11:34.020 friend of mine. He's a very effective advocate. He's the one who won the presidential immunity case
00:11:40.400 for President Trump, which ended this lawfare against President Trump and helped President Trump get
00:11:45.900 back into the White House. He's a very, he is a brilliant attorney, a brilliant advocate, a former
00:11:51.900 Supreme Court clerk for Justice Alito. So I, you know, to the extent that any of these justices
00:12:00.440 were playing political games, I think John Sauer did as well as anyone could do to advocate on behalf
00:12:07.960 of the president's positions and not falling into those traps. Yeah, I'm not saying, I'm not opining to
00:12:15.540 his job. I thought he actually did a good job. But it seemed like some of the justices, particularly
00:12:20.800 our favorite ACB and a couple of the liberals, were talking about a totally separate set of issues
00:12:26.500 than the issue that was supposed to be before them, sir. Yeah, that's a, that's a very good question,
00:12:31.980 Steve. And you have to ask yourself why the ladies of the court were going down that,
00:12:38.020 going down that path. I mean, those questions were not before the court today.
00:12:42.120 Uh, they weren't relevant to those cases. And so it's a very good question. It's,
00:12:47.080 it's, uh, it sounds like, uh, when, when they do things like that, they become political.
00:12:52.880 Are, is this teeing up in your mind that we're hurtling towards this? Cause she asked point blank,
00:12:59.640 did she not ACB? Is the Trump administration going to follow the court's decisions? So she's
00:13:06.460 kind of foreshadowing where they want to go on this?
00:13:11.420 Well, I mean, I would say to Professor Barrett, uh, that's, uh, yes, the president's going to follow
00:13:18.140 Supreme court's decisions like he always has. I would also say this, if the Supreme court's
00:13:24.580 decisions are lawless and dangerous, they're going to lose. The Supreme court is going to lose the
00:13:30.900 confidence of the American people. The Supreme court is going to lose its legitimacy with a
00:13:35.660 broad swath of the American people. And so maybe professor Amy Coney Barrett should be more concerned
00:13:42.320 about the lawless and dangerous rulings by the Supreme court that are destroying the court's rulings
00:13:48.360 rather than whether the president's going to follow those rulings, which he has, uh, done every,

00:20:21.200 got to be, we have to set things right down there. So we're working with people and we will have

00:23:39.620 is, uh, really great for us, uh, considering the historical, uh, adversities between Romanians
00:23:46.080 and Hungarians. So, uh, if all goes well, uh, by, uh, one month's time we will put, uh,
00:23:54.200 Kalin Georgescu, who won the first elections, back, uh, in the leadership of, uh, Romania.
00:24:00.500 And, uh, we will, uh, return to the voice of, uh, the people. All they are trying to do
