00:00:04.880 The Ninth Circuit Court of Appeals has overturned Judge Emmergut's order blocking the federalization
00:00:10.280 of the National Guard, which means President Trump can deploy the National Guard into Portland,
00:00:17.080 Oregon. That is a big, big, big deal. It is a big deal. And I want to just correct one thing
00:00:21.860 and then explain why functionally it is the same. This is a stay of Judge Emmergut's opinion.
00:00:26.740 And that's why it reached the Ninth Circuit as soon as it did, because this is an emergency
00:00:30.840 motion to essentially pause her order. But as a functional matter, you are absolutely correct.
00:00:36.700 It has the function of overturning her order and thereby allowing the president to send
00:00:42.360 the National Guard back onto the streets of Portland. And Katie, I want to read, if I can,
00:00:47.380 just from a little bit of the beginning of this 93 page opinion. It says after considering the
00:00:52.560 record and by the record, they mean all the factual evidence at this preliminary stage,
00:00:56.380 we conclude that it is likely that the president lawfully exercised his statutory authority under
00:01:02.660 10 U.S.C. Section 12406. That's the statute we've been referring to as Title 10 when we have
00:01:09.100 conversations about the National Guard deployments, which authorizes the federalization of the
00:01:13.040 National Guard when the president is unable with the regular forces to execute the laws of the United
00:01:18.820 States. And this is the important part. The evidence the president relied on reflects,
00:01:22.840 quote, a colorable assessment of the facts and law within a range of honest judgment. We thus
00:01:29.240 conclude that defendants are likely to succeed on the merits of their appeal, basically saying that
00:01:35.180 when and if a court considers all of the record in this matter is tried and it gets back to an
00:01:41.360 appellate court through an ordinary process where they have full briefing and full evidence that they
00:01:46.040 still think Donald Trump is likely to prevail there because he has the discretion to determine as the
00:01:53.420 president within a range of honest judgment when it is reasonable.
00:01:57.040 So we're going to be here to talk about lots of lots of different things. And we might take a few
00:02:04.740 questions before, but we are discussing critical minerals and rare earths. And we're going to be
00:02:11.740 signing an agreement that's been negotiated over a period of four or five months. And it was sort of
00:02:16.960 good timing that we got it done just in time for the visit. And we work together very much on rare
00:02:22.480 earths, critical minerals and lots of other things. And we've had a very good relationship. We've been
00:02:28.100 working on that for quite a while. In about a year from now, we'll have so much critical mineral and
00:02:34.600 rare earths that you won't know what to do with them. They'll be worth about $2. But in the meantime,
00:02:40.220 we're working with Australia and other countries. They're working with us too. But other countries also
00:02:47.260 on that. But we're really working on anything having to do with military, military protection,
00:02:54.000 military ships, vehicles, guns, ammunition, everything, the whole thing. We've been long-term,
00:03:02.780 long-time allies. And I would say there's never been anybody better. We fought wars together.
00:03:10.100 We never had any doubts. And it's a great honor to have you as my friend. It's a great honor to have
00:03:15.640 you in the United States of America. We're seeing a peaceful opposition against Trump,
00:03:21.140 the likes that our country hasn't seen in a long time. And it's infuriating him. He's threatening to
00:03:29.180 potentially deploy the National Guard into San Francisco, which is why things like No Kings are
00:03:34.220 so important. Because this isn't a sprint. It's a marathon. And getting people on the ground gets
00:03:39.600 people connected with those community networks, which gives them the ability to resist against
00:03:43.380 Trump's regime every single day. And more importantly, it gives people the courage to
00:03:49.180 stand up. There was a poll that went out that four of five U.S. troops understand their duty to
00:03:54.080 disobey illegal orders. Using the military to crush peaceful dissent, using the National Guard
00:04:00.820 to crush peaceful dissent is illegal. It's fascist. It's what Trump wants to do. It's what he already
00:04:07.220 did in L.A. And it's what he's trying to do in Chicago and Portland and Memphis and in D.C.
00:04:12.700 and what he's going to try to do in San Francisco. And things like No Kings give both elected officials
00:04:18.520 and potentially pillars of this regime, people like the military, people like civil service employees,
00:04:24.840 the courage to stand up, to risk their own jobs and livelihoods because they know that we,
00:04:30.620 the people are backing them and that together we can stop this regime before it harms and destroys

00:10:26.720 have had disagreements. And he had Rudd in there today and said, where's another prime
00:10:29.900 minister? The one says, you know, we've said bad things about each other. He had Rudd
00:10:34.820 in there. He had the current prime minister, which they've never been particularly close
00:10:39.440 today. They were like brothers in arms. I've never seen such a positive meeting, a positive
00:10:44.640 bilat. He also didn't do in the Oval. I think they did it in the cabinet room so you can get
00:10:48.820 more media in there. Um, why was this so important to get the sign right at the top? That's how
00:10:55.680 important it was for Trump. They walk in, they signed the, they signed this deal right at the top
00:11:00.480 on, um, on rare earths because, uh, Besant is in route to go meet with the Chinese finance
00:11:07.280 minister. And Trump had said at this meeting, which I don't know that Beijing has not verified
00:11:11.980 it, but president Trump said he's meeting with Xi. Why was the rare earth such a big deal,
00:11:16.820 sir? I mean, uh, first of all, I think it's an, it was a very good meeting. It's definitely a win
00:11:23.460 for Australia. It took about 270 days since prime minister Albanese was, uh, uh, reelected. And that's
00:11:29.980 the longest, I think in the last 10 or 15 years that the two heads of states, uh, took to meet, uh, on
00:11:36.760 the heels of a victory. So that left the door open for a lot of pundits and, and, and criticism
00:11:43.640 that perhaps PM Albanese might not have the ear of president Trump, perhaps the AUKUS submarine deal
00:11:51.360 might be in, you know, in troubled water waters. And obviously today, uh, uh, for you and I, uh,
00:11:58.440 folks like us who've been paying keen attention over the past year on where this alliance might go.
00:12:03.740 It was a confirmation that, uh, the U S remains a steadfast partner in such an important, uh, um,
00:12:12.500 naval alliance in such a critical part of the world. That is the Indo-Pacific additionally.
00:12:18.820 And I think you're probably one of, uh, those that have covered the most, uh, some of the moves on
00:12:24.680 the part of China and the CCP to play hardball in the rare earth space to try and, uh, a corner the
00:12:33.420 United States by limiting exports of anything that has a remotely 0.1% of, uh, uh, critical minerals
00:12:43.680 or rare earth. Uh, and that means the entire technology and information industry, uh, across
00:12:50.100 all sectors, strategic, uh, sectors that is. And so, um, this, uh, this technology prosperity deal
00:12:59.880 that was signed right off the bat in the cabinet room between the two, uh, administrations, uh,
00:13:06.640 first reaffirms AUKUS, but also, uh, paves the way for a long-term strategic partnership
00:13:12.480 in sourcing critical minerals and rare earth. And it's, um, you know, it's a chess move on,
00:13:19.540 on China's, uh, attempt at pressuring, uh, the U S and its partners along, uh, the rare earth,
00:13:28.540 uh, uh, uh, route, which is so critical to our national security. So to the pundits back
00:13:34.980 in Australia, which have had 270 days to undermine and criticize both president Trump from far,
00:13:41.760 but also at home, their prime minister that the Trump administration was in retreat and
00:13:48.160 could not be relied upon. I think it's a strong message to our allies and our adversaries in
00:13:54.160 the region that have doubted that the U S would stick to its end of the bargain. It's also a very
00:14:00.840 strong message. It reaffirms, uh, and reassures our allies and it gives predictability, uh, if I want
00:14:09.440 to be politically correct to our adversaries, uh, it, uh, projects, you know, uh, continued naval
00:14:16.900 supremacy and the notion that, uh, the U S remains the world's leading naval force augmented now with
00:14:24.960 Australia and the UK and this, you know, generational partnership that we've come to know as AUKUS.

00:19:24.340 allies in the region that they're not alone in standing up to some of the bullying that the maritime
00:19:31.500 militia or the People's Liberation Navy exerts on their fisheries, on their territorial waters, on their
00:19:41.420 territorial claims. And therefore, it was of the utmost importance once AUKUS was signed not to pull back
00:19:52.680 from it because both allies and adversaries have already computed and incorporated that into their
00:19:59.240 war games. And therefore, had we pulled out or had anything happen to this alliance, it would leave a
00:20:05.400 massive vacuum, which would be immediately filled by our adversaries. I have to maybe state that something
00:20:13.440 you must know over the last two, three days, there's been a lot of noise coming out of the CCP. I think on October 17,
00:20:23.040 the Defense Ministry announced that the central, the Vice Chair of the Central Military Commission, a member of the
00:20:30.000 Politburo and eight other senior military commanders had been expelled from the Communist Party and the military for serious
00:20:38.480 violations of party discipline. So the lines are shifting. It's very hard, very opaque, very hard to
00:20:45.120 read what is going on behind closed doors with the party. But certainly, this peace through strength and this
00:20:58.560 reassurance of our commitments to our allies, both within NATO and outside of NATO, but certainly in the
00:21:05.440 in the in the Indo-Pacific is is making is making the rounds and is being noticed by both our adversaries and our
00:21:15.360 allies. By the way, we're gonna we're gonna the seven o'clock or six o'clock our excuse me, we're gonna go through
00:21:21.360 this even in more depth because President Trump, the Chinese Communist Party has thrown down in an open, active and
00:21:28.400 serious economic war against the United States with these heavy rare earths. And President Trump,
00:21:35.200 this is why it's going to be Australia first and next is going to get one of the Brazil. He's fighting
00:21:40.320 back and given some ammo to Scott Besson. He goes over and President Trump announced that he's going to
00:21:45.440 meet. We're going to cover it all. Also, the buried lead President Trump goes in a year, we're going to be

00:23:47.520 officer of the United States. You know that, right? A lot of people say, oh, he's the president. He should.
00:23:52.240 No, I'm the chief law enforcement. I'm allowed to be involved in it. But I haven't chosen to.
00:23:57.760 And DOJ whistleblower Erez Roveni, who was inside the Trump Justice Department,
00:24:02.800 pulled back the curtain on what it looks like inside. And the Trump administration's
00:24:07.440 open defiance of the courts in order to maximize mass deportations. Take a look.
00:24:12.400 It felt like a bomb had gone off. Here is the number three official using expletives to tell
00:24:19.840 career attorneys that we may just have to consider disregarding federal court orders.
00:24:24.400 And then it really hit me. It's like, we really did tell the courts, screw you. We really did just
00:24:32.080 tell the courts, we don't care about your order. You can't tell us what to do.
00:24:38.560 That was just a real gut punch. Normally, people deported in error are returned.
00:24:45.680 But instead, Roveni says that in a phone call from a superior, he was ordered to argue against
00:24:53.360 Abrego Garcia's return by telling a judge that Abrego Garcia was an MS-13 gang member and a terrorist.
00:25:02.160 And I respond, up the chain of command, no way. That is not correct. That is not factually correct.
00:25:12.160 It is not legally correct. That is a lie. And I cannot sign my name to that brief.
00:25:17.600 Well, Michael Patrick Leahy. OK, here's the thing. Barry Weiss is very pro-Israel.
00:25:26.800 She was criticized about this a lot. She's a Zionist. She allows to go on because this
00:25:34.320 is her first week as executive editor of CBS News. And the first thing she did was,
00:25:41.280 as Michael Patrick Leahy knows, she called the 60 Minutes crew in there and said,

00:25:48.800 It was a full meltdown. They leaked everything to the press. She allowed
00:25:53.200 the Leslie Stahl interview with Witkoff and Jared go forward, which buried Netanyahu, buried him,
00:26:01.760 full stop. Yet this one pops up. And Leahy, you more than any person in the United States of America
00:26:10.560 is on top of the story. Why is this story so outrageous, sir?
00:26:16.880 Well, this is Scott Pelley in 60 Minutes and the anti-Trump propagandists there, a throwdown,
00:26:23.440 a challenge to the leadership of Barry Weiss, because the clips you played are biased, dishonest,
00:26:29.920 and misleading. Particularly that last clip of the Arez Raveni who was fired by the Department of
00:26:37.360 Justice for not zealously defending his client's interest, the United States government. His claim
00:26:42.800 that there was no evidence that Kilmer Obrego Garcia had MS-13 ties is just a flat out lie.
00:26:51.120 In fact, if you go to two immigration court judge decisions in 2019, they kept him in detention while
00:27:01.440 his final deportation hearing was being held, because the two judges concluded there was enough
00:27:07.600 evidence that he was an MS-13 gang member. Now, why didn't Raveni present that to the court? He should
00:27:13.280 have. He didn't.

00:34:13.360 all of the mainstream pollsters lie by fudging the numbers by over and over again,
00:34:17.760 misrepresenting things. But one of the ways that they like to lie and to shill for the establishment
00:34:24.080 is by carefully deciding not to ask important questions. And so people who follow Rasmussen
00:34:29.840 reports know that we'll actually dig into it. We'll show that Americans want to deport everybody
00:34:34.560 in the United States. Imagine that that's what explains Donald Trump's win things like that.
00:34:39.280 Well, one of the things that every single one of them, every single one of them turned their nose
00:34:43.920 up, decided not to go into was vaccine safety. And as far as I know, in the entire industry,
00:34:49.440 the only other pollster that pulled at all about vaccine safety was Rich Barrett, the people's
00:34:54.080 pundit. And he told me personally, he lost clients. He had people text him. What are you doing? You're

00:35:03.360 Rasmussen reports had been so written off by the establishment that we decided to pull on this in the
00:35:08.400 fall of 2022. And we thought, you know, this might be one of those things. It's a fringe conspiracy
00:35:13.120 theory. We'll probably find small numbers. And the very first question we asked was whether or not
00:35:18.000 people had a major or minor side effect from the vaccine. And we broke the news on your show,
00:35:22.160 seven percent major side effect rate, another 31 percent. It was massive. So we've been asking about
00:35:28.800 this time and time again. And every single one comes back worse and worse and worse. We asked people
00:35:33.920 if they know. But hang on. Yeah, this is it. Don't bury the league. Give me that they know
00:35:38.400 something personally. That number, I think, was even more shocking. When you told me on the show,
00:35:42.720 I was like, what? Give us that. Oh, I know. Right. And it's like you probably had a cold open of some
00:35:48.800 weather person dropping dead on air in front of America. And 28 percent, 28 percent of Americans
00:35:55.680 thought it was at least, you know, someone agreed that they know somebody personally who died from
00:36:00.720 the COVID vaccines. Wow. The number kept going up. And then we got a number close to half of
00:36:06.320 Americans who said it's at least somewhat likely the vaccines are killing a significant number of
00:36:10.480 Americans. Well, just recently, the number still been going up. We had 56 percent of likely voters
00:36:16.320 said that it was likely the vaccines are killing a significant number of people. Now, that's the thing,
00:36:22.240 is that Donald Trump won because of accountability, because of pushback. A lot of it was because of
00:36:27.440 COVID. And Americans want all these wrongs righted. And I'll tell you, we haven't really heard a whole
00:36:33.360 lot about what's going on with this stuff. And it pisses me off so much to sit here and know, well,
00:36:39.840 trust in America's health industry is completely gone because of COVID. Now, by a two to one margin,
00:36:45.280 people say that they have to take their own health information into their own hands. They can't just rely
00:36:50.240 on a doctor. And you have all these doctors still sitting at the top of this regulatory pyramid
00:36:56.000 who have a revolving door to industry, who are running cover for industry, who are quite frankly,
00:37:01.760 siphoning trillions of dollars with sick care. We all know it. It's one of the reasons that our
00:37:06.720 republic is going to die because we are funding massive amounts of people in a sick care system
00:37:12.480 that is just basically legalized grift. Like that's really what's going on. There's so much corruption
00:37:17.360 and we haven't heard any, really anything about it. Well, I'm here to just stick one more,
00:37:22.640 you know, knife and the dagger of this rotted corpse. And that is nobody has pulled on the
00:37:27.280 hospital treatment protocols for COVID, literally not a single person. And we're talking about here,
00:37:32.960 the implications of over a million people died from COVID, most of them in the hospitals,
00:37:37.920 most of them with a lot of questions about ventilators and remdesivir and other things.
00:37:42.640 You know, we heard the stories about how you lose your license if you let anybody get treated with
00:37:46.560 ivermectin. But without our polling, it would all be anecdotal. It would all be super easy to
00:37:53.920 sweep under the rug. And of course, they'll still try to sweep this under the rug. So here's the two
00:37:58.880 questions. And we literally just did this for 1400 Americans. Has somebody, you know, personally died
00:38:05.920 from COVID-19 while being treated in a hospital? 32% of America says yes, 58% say no. And then asked of
00:38:14.800 those people, how likely is it that hospital treatment protocols for COVID-19 contributed
00:38:21.360 to their deaths? 30% very likely, another 17% somewhat for a combined total of 47%, almost half.
00:38:30.640 And only 14% say not at all likely, only 36% say not likely. So it's plus 11. So it's most people,
00:38:39.600 most people who have an opinion on why that person died, it would be a majority if you remove the not
00:38:45.440 shores. And there's a bipartisan signal. 34% of Democrats think it's likely, but 58% of Republicans
00:38:54.080 and 52% of independents, only 33% of independents say no. So this is pretty solid. People are like,
00:39:00.160 yeah, there's reasons to question this stuff. And what's really wild is you can even see the mama bear
00:39:05.600 signal. Women under 40 are overwhelmingly, overwhelmingly more likely to say this. 56%
00:39:12.560 very likely, 30% somewhat. And the age signal is also incredible. Of the 65 and older, only 21% say
00:39:20.000 very likely, another 14% somewhat. So that's 35. But look at the 18 and 29s, 56%, 31% very likely,
00:39:29.040 really stunning signal. It's almost two to one among 18 and 29 year olds.
00:39:32.160 Wow. So that also shows that, listen, establishment, you're not going to be able
00:39:36.640 to run away from the internet. These people are asking hard questions about literally everything,
00:39:41.360 about the very capitalistic system that we live in, about foreign influence, about the ways that
00:39:46.800 everything's been corrupted. And I think that we are not hitting this idea of accountability hard enough,
00:39:51.680 because I'm telling you, I try and stay rooted in this like sort of Zoom or online culture,
00:39:56.800 more so than I think most people. And what's being talked about isn't like,
00:40:00.480 oh, isn't it great? Republicans are giving us everything they voted for. It's like, no,
00:40:04.080 why isn't this system burning down fast enough? That's, I think, accurately captures what I see
00:40:10.320 anecdotally on the internet.
00:40:12.880 Let me ask you, is Bobby Kennedy, because, you know, recently, ever since they held back the 500
00:40:18.560 million in research for big pharma, and maybe it hasn't been pounded hard enough, but you can see
00:40:25.040 he's starting getting traction. Is that resonating with anybody? Because I keep recommending they
00:40:33.040 got to go bigger on their media narrative. You got Bobby Kennedy, you got the president, but
00:40:37.600 it's not having the push that you have to do to get through the white noise. Do you think
00:40:43.280 that Bobby Kennedy's actions are enough at least to turn it around with some of these people? And do
00:40:48.960 you think the messaging is amplified enough, and it's such a scale that it's going to break through
00:40:53.840 the white noise and get to the American people?
00:40:58.080 Remember the days of thunder? Remember the shock and awe as we saw USAID funding network
00:41:05.600 piping all this money into leftist NGOs? We automatically realized, no, it's not George Soros
00:41:10.880 that's just doing this for ideological reasons. It's a whole web of leverage, basically of arbitrage,
00:41:16.960 of influence arbitrage, and how when you and I were processing all that stuff, you probably knew
00:41:23.440 about it. But for me, it was an eye opener. This is way worse than we thought, but also more systematic
00:41:28.640 and understandable than we thought. There was like an aha moment. Well, in the polling, it's almost like
00:41:33.120 America reflexively felt that too, because we were setting right direction records. Remember 60% of 18 to
00:41:39.520 39 year olds were like, yeah, we're going to get a second golden age under Trump. Like this is happening.
00:41:44.480 He had a 60% approval rating among 18 to 29. Like it was wild. And it was because of Doge. And it was
00:41:50.720 because I think this idea of, I don't think there's any specific one thing that America knows, well,
00:41:56.000 if I got that, we'll be happy, everything will be fixed. But I think it's this pot of boiling water
00:42:00.560 that we're still sitting in. People, I think will start to, you know, connect the dots and say,
00:42:06.000 well, you know, not enough of this has been changed. And so again, we need to see more.
00:42:11.440 And I can't specifically say what that is because I'm not looking at the grand juries. I don't know
00:42:15.920 what evidence they have on these people, but we need to know, because again, I don't want to get
00:42:21.120 anybody sued for defamation here, Steve. But when you hear the story specifically about how that one
00:42:27.520 drug used pretty ubiquitously in the hospital treatment protocols, got its emergency youth
00:42:33.760 authorization and what safety trials were done and the people involved and whether,
00:42:38.720 whether they used to be at regulatory agencies and then became not, and they went to industry,
00:42:44.880 it stinks. It absolutely stinks. And people in this polling are tying the treatment protocols
00:42:51.760 to deaths, like real deaths in a non-partisan way. I mean, and again, people can say, oh,
00:42:58.720 it's not polling. You're just polling people who answer polls. It's like, okay,
