00:00:55.180 And listen, I don't know the particulars of Eric Swalwell's living situation.
00:01:01.040 So I and this again, this letter, which I believe we do have, although I'm not entirely sure since I've been on with you,
00:01:08.280 doesn't really lay out in rich detail what they are what they are going after him for.
00:01:15.920 But to be honest with you, if you as Lisa just said, if you look at the list of people that the administration is is targeting,
00:01:24.140 it's all people who are political adversaries of the president.

00:03:50.640 You know, Judge Cameron McCurry of the District of South Carolina, Katie, came up here to Alexandria, Virginia, to the courthouse right behind me to hear arguments from lawyers for Tish James and James Comey together about why Lindsay Halligan's appointment here was unlawful and why, in light of that, the indictments against both of them cannot stand.
00:04:15.740 And Judge Curry is not a particularly demonstrative judge.
00:04:19.800 She's not a person that you can really tell her moods based on her expressions, for example, or where she's headed.
00:04:25.560 But she asked a couple of questions that indicate to people like me where this is going.
00:04:30.880 And the first question out of her mouth, and this is in Politico's very good report of today's hearing, was she asked the defense if they were in possession of what's called the declination memo that was written in the Comey case.
00:04:44.820 A declination memo is sort of what it sounds like.
00:04:47.920 It is a detailed legal memo laying out the reasoning why prosecutors believe that in the interest of justice, a case should not be brought.
00:04:56.480 Now, Jim Comey's lawyers don't have that.
00:04:59.080 But Judge Curry is asking the question because the government's position here is if anything went wrong in the appointment of Lindsay Halligan, it's nothing more than like a scrivener's error or a paper error.
00:05:09.500 And I think what Judge Curry is driving at is, no, no, no, something here was very substantial.
00:05:16.320 Something here was gained that otherwise would not have been.
00:05:19.620 You had line prosecutors authoring a declination memo.
00:05:22.980 Maybe that's not in your possession now, but we know it to exist.
00:05:26.300 And if they didn't want to bring the case, the very fact that Lindsay Halligan was appointed here and that Eric Siebert, who had been her predecessor, was forced to resign,

00:07:15.320 to basically pick their replacements.
00:07:17.520 And they're fundraising off of that.

00:07:20.460 But it's, I mean, fake money to begin with.

00:08:02.020 She was appointed based upon a statute giving her 120 day appointment.
00:08:07.260 And then the Attorney General, Pam Bondi, also made Halligan a special attorney to the

00:08:14.900 So she has full authority to do what she's doing.
00:08:18.260 And she could, they could just make her the first assistant U.S. attorney, and she can
00:08:24.440 continue doing her job as the first assistant.
00:08:27.220 Here's the bottom line.
00:08:27.980 They may try to get some Democrat judge to temporarily knock these U.S. attorneys out of their positions,
00:08:35.100 but it's not going to fix their problem.
00:08:37.600 If you look at what Halligan has done so far in response, for example, to Comey's motion to
00:08:44.440 dismiss the indictment for selective prosecution, Halligan showed overwhelming evidence in response
00:08:53.080 to that, that Comey lied to Congress and obstructed the congressional investigation.
00:09:00.620 She just put out more evidence today when Comey asked for a bill of particulars.
00:09:05.880 This evidence is very damning against James Comey, and I can see why these Democrat activists
00:09:13.840 are running to these Democrat judges to try to get rid of Halligan because she's holding
00:09:17.460 famous.
00:09:17.520 But they're also trying, I want to make sure the audience understands that these filings
00:09:20.720 are solid.
00:09:21.760 They're trying to make a case that there's really no evidence on Comey, and they didn't
00:09:25.320 file anything, and the judges are upset, and they're asking again today because they're
00:09:29.560 trying to build a narrative that, you know, the Trump Justice Department is just a group
00:09:33.080 of unprofessional savages that run into court with indictments but then don't have anything.
00:09:37.760 They're not ready to go to trial.

00:09:43.260 The facts are that Lindsey Halligan working with Cash Patel and Dan Bongino and Senator
00:09:48.900 Chuck Grassley's office have unearthed tremendous evidence of guilt against James Comey for lying
00:09:56.460 about the Russian collusion hoax, crossfire hurricane, lying about these ongoing investigations,
00:10:03.420 obstructing congressional investigations.
00:10:07.060 Lindsey has shown the receipts, and she's doing it the appropriate way.
00:10:11.080 It's Comey who's inviting this.
00:10:12.860 He's filing these motions, the motion to dismiss the indictment, the motion for a bill of particulars,
00:10:18.200 and in response to each one of those, Lindsey Halligan has shown her receipts, and again,
00:10:22.820 this evidence is overwhelming, and it's damning.
00:10:25.660 Now, of course, he gets to go to trial.
00:10:27.520 He can put on his own evidence.
00:10:29.800 He can confront the evidence and the witnesses against him with cross-examination.
00:10:34.160 He's presumed innocent, all of that, but if you look at this evidence with his own emails,
00:10:40.160 if we have a fair judge and a fair jury, Comey's going to prison.
