Learn English with John McCain. John McCain delivers a blistering attack on President Trump and calls him a "scumbag." John McCain speaks at the 2020 Democratic National Convention in response to President Trump's claims that he won the 2020 election.
00:00:00.000Separated by a giant ocean, it's a war that should have never started, and it wouldn't have started if the 2020 U.S. presidential election weren't rigged.
00:00:11.440It was a rigged election. Everybody now knows that. They found out. People will soon be prosecuted for what they did.
00:00:18.560Trump says you're a criminal and you belong in prison. He says you belong in prison, not because you did anything wrong, mind you, but because you did everything right.
00:00:30.360You pursued the facts. You followed the law. You stuck with extreme caution to every rule of professional responsibility. You had the audacity to do your job.
00:00:47.340Everybody here knows what you did wrong in Donald Trump's eyes and why he says you belong in prison.
00:00:54.300You found, and I quote from your sworn testimony before the committee, you found proof beyond a reasonable doubt that President Trump engaged in a criminal scheme to overturn the results of the 2020 election and to prevent the lawful transfer of power.
00:01:12.060When asked whether you believe the evidence was enough to obtain a criminal conviction against Donald Trump at trial, you had a one word answer. Yes.
00:01:22.740When asked if Donald Trump was responsible for the violence that took place at the Capitol on January 6th, you said our view of the evidence was that he caused it and that he exploited it and that it was foreseeable to him.
00:01:37.020You found that Trump knew he had lost the election.
00:01:41.700How? Well, his own attorney general, William Barr, repeatedly told him so and described all of Trump's theories as BS.
00:01:49.120Trump's, Trump's top campaign advisors, told him he lost the election.
00:01:54.360Vice President Pence told him he lost the election.
00:01:58.020More than 60 federal, state, and court decisions, including eight rendered by judges, he appointed to the bench, rejected every outlandish election fraud and corruption claim that he made.
00:02:11.000Trump himself even privately acknowledged it, gesturing to Joe Biden on TV and saying, quote,
00:02:17.240Can you believe I lost to that effing guy?
00:02:21.000He knew he lost, but he threw everything into his big lie, which some people, even in this room to this day, will stand by.
00:02:30.560Probably 10 people on this committee who have more conversations with 10, 15 people on this committee who have more conversations with Donald Trump than myself.
00:02:38.000But anybody who says that Donald Trump thought he won that election, that is just plain not true.
00:02:45.800No way, unless he's the best actor in the history of this building.
00:03:05.540And I think on January 6th, I think, I can't believe there were any congressmen here who didn't think Joe Biden was going to be sworn in as president.
00:03:16.740So this was, it was a riot, but it wasn't a threat to the future of the republic.
00:03:22.640...souls made you aware that President Trump is live tweeting, live, I guess you call it truth, socially, as we speak.
00:03:29.480Are you aware of this, about this hearing?
00:04:06.760Mr. Smith, if you care to respond, I'll give you an opportunity.
00:04:11.020But I will simply say, we are grateful for your service to this country.
00:04:15.460We appreciate your fidelity to the rule of law.
00:04:19.920And I would echo the comments that have been made by my Democratic colleagues to ignore the noise that you hear from so many of my colleagues who would debase themselves in this way.
00:04:30.720It is, in my view, subversive of the oaths that we took to defend the Constitution.
00:04:41.880I'm happy to give you an opportunity, Mr. Smith, if you'd like to respond.
00:07:01.440Because he lost and it wasn't particularly close.
00:07:04.360But that's why he has to continue spreading the big lie today.
00:07:08.660It's the reason why, you know, just think about it this way, Nicole.
00:07:11.220In the last three weeks, he has said, number one, he wished he had seized the ballot boxes in 2020.
00:07:16.720Well, that's a hell of a piece of evidence that Jack Smith didn't have.
00:07:20.340But it comes out of the words of Donald Trump's own mouth now to The New York Times.
00:07:25.000He has said that he wished we don't have elections in the midterms at all.
00:07:31.080Well, that's like a hell of a piece of evidence, right?
00:07:33.400And he says that because incumbent presidents tend to lose the midterm elections.
00:07:38.340So let's everyone bookmark that for this November when Donald Trump says that they actually won the midterm elections.
00:07:44.300And that's why he needs to seize ballot boxes and the like.
00:07:47.660And then third, and this is the one that's most chilling given the testimony today, is on the stage yesterday in Davos, Donald Trump said, I'm breaking news.
00:07:57.360And the breaking news he had was that there are going to be criminal prosecutions of people involved in the 2020 election.
00:08:03.080Now, that could be Jack Smith. It could be people on his staff. It could be people like me who are lawyers.
00:08:08.380It could be people on the Biden campaign. Who the hell knows what Donald Trump's adult brain is thinking?
00:08:13.640But, you know, when you add all those things up, it's clear where we stand, which is that Donald Trump lost the election.
00:08:20.040He has spread. He has built a movement on a big lie.
00:08:22.760Of course, Jack Smith could have proven that.
00:08:25.520And Donald Trump is now going to abuse the Department of Justice to go after everybody who tells the truth.
00:09:17.340I wish in my soul, I wish that any of these people had a conscience.
00:09:23.220Ask yourself, what is my task and what is my purpose?
00:09:26.960If that answer is to save my country, this country will be saved.
00:09:33.360War Room. Here's your host, Stephen K. Vance.
00:09:36.580Thursday, 22 January, year of alert, 2026.
00:09:45.860What a way to start off the first day of the second, or I guess the second day of the second year of President Trump's third win for the presidency.
00:09:56.960Julie, because Rachel Maddow is going to have a special night, we're going to get called to that, do more of this tomorrow.
00:10:02.140Just my observation, because I don't know the details to the level you know the details to.
00:10:07.680I know the details of 2020 and how President Trump won in January 6th, but the rest of it is your area of expertise.
00:10:15.660One thing I will say that I know MSMAC and CNN very well of watching us so much and curating years, all the way back from the Breitbart days.
00:11:35.240I think they had collaborated on the areas that they were really going to zone in on Jack Smith.
00:11:41.320I think they took enough time talking about his collection, his unconstitutional, unlawful collection of subpoenas for the phone records of U.S. senators and House members.
00:11:54.440I didn't want them to spend too much time on that.
00:11:58.900And they did tie it into the larger unconstitutional behavior of Jack Smith.
00:12:04.120And I think there were some interesting nuggets that were disclosed today that the committee and Republican leaders in both the House and Senate and perhaps the Department of Justice should follow up on.
00:12:15.100And I think that Smith's testimony opened the door, just like last December, for at least some false statement charges against him and certainly other charges related to his misconduct as special counsel.
00:13:01.020Jack Smith also claiming last month and today that classified documents, highly sensitive documents, classified documents were found in boxes in a ballroom and bathroom at Mar-a-Lago.
00:13:17.920There is no way that Jack Smith could prove that.
00:13:20.580In fact, at the end of the documents case, before Judge Cannon tossed that indictment in July of 2024, one of his lead prosecutors had to disclose that they didn't even know if these alleged classified papers were in the boxes that had been moved around Mar-a-Lago that represented the basis of the obstruction charge.
00:13:43.260I know I'm getting in the details here, but he's making claims under oath about these cases that he cannot prove.
00:13:51.720And I hope that the DOJ and Congress follows up on that.
00:14:09.260Particularly, I agree with you, the shout out to Jim Jordan and the very organized, because, you know, I was the first to say, hey, I don't know, Gates is not around.
00:21:01.940Even Jack Smith, when he was trying to answer the Democrats were, they were so riled up about the directness of the lines of questioning from Republicans.
00:21:13.000So you could see at the end, then Jamie Raskin at the end said, well, if this report on the documents case is allowed to be released by the court,
00:21:20.860we're going to have Jack Smith back here so he can answer questions about the documents case.
00:21:27.960If they thought that this was a home run, Jamie Raskin, you know, shrewd as he is, he would say, all right, that's all we need to hear from Jack Smith.
00:21:38.180But he was hinting that he might want to have him come back a third time.
00:21:42.480So, no, it definitely was a disaster for Jack Smith.
00:21:47.400I think that there are still a lot of things that we need to learn and expose as to what he did in both of those cases.
00:21:54.180And hopefully there will be another opportunity.
00:21:57.220I think the Senate wants to call him in as well.
00:22:01.720And, of course, the Senate will be interested primarily because they're mad that Jack Smith got their toll records, understandably so.
00:22:09.080But there's a lot more that Senate Republicans can do to further expose the corruption, the deception, the unconstitutionality, the criminality of Jack Smith and his entire team.
00:22:23.500So I hope that Senate Republicans will proceed accordingly.
00:22:27.780You've been by far, I think, the harshest critic of Smith because you followed it and been in court day by day of this.
00:22:35.620You actually laid out a 10-prong approach to this.
00:22:55.400Are you satisfied that this was carried out the best way he possibly can by the House Judiciary on the Republican side?
00:23:02.900I mean, I think they did a very commendable job, obviously, as we just said.
00:23:08.440However, most of the malfeasance by Jack Smith and his team happened in the documents case.
00:23:15.800And Jack Smith is claiming because that report is under seal and Judge Cannon will not allow the release of it because the indictment was dismissed, that he wouldn't be able to answer questions on it.
00:23:29.360Fine. I still think there's enough on the table, a missed opportunity today to confront him about the FBI's use, bringing those colored classified cover sheets to the Mar-a-Lago raid, attaching them to files and taking photographs, adding that to a court document, getting that out to the media to make it look like that's how the documents were found.
00:23:53.660I think misrepresentations to the court and mishandling evidence, which we know that came out in the documents case as well.
00:24:04.660Jay Brath, his lead henchman, who was threatening defense counsel Stanley Woodward, who's now in the White House, representing Walt Nada, threatening Stanley Woodward that if he got Nada to flip on the president and become a cooperating witness,
00:24:20.080then they wouldn't put a brick on his judicial nomination, which was pending at the time in Washington, D.C., the piercing of attorney-client privilege in that case, thanks to Beryl Hull.
00:24:32.580What appellate court judges slammed, the pursuit, the subpoena of the president's private Twitter data, along with the nondisclosure order that also claimed he would be a flight risk if he found out about the Twitter.
00:24:48.780So there's so much more attached to the documents case.
00:24:53.020I think that demonstrates his malfeasance, his misconduct, his team's misconduct, because the January 6th case was basically put on ice for almost seven, eight months pending the Supreme Court's immunity decision.
00:25:06.660There just wasn't a lot happening there.
00:25:08.640But all the action was really in Florida.
00:25:10.760So if this does go to the Senate, or Jack Smith comes back again, or the DOJ is looking at areas to investigate and potentially bring charges, the documents case to me, and yes, you're right, I covered, I think, every single hearing in Florida, and of course all the proceedings dating back to the special master case after the raid, there's just a lot more there.
00:25:56.220President Trump actually in Davos said, hey, now he won 2020, indictments are coming in this.
00:26:02.840Do you have any sense what President Trump's talking about, and why did the Democrats go back time and time again like almost every speaker?
00:26:49.020But, of course, as people were pointing out today, we are just learning.
00:26:52.460We have just learned about proven election fraud in Georgia.
00:26:56.580So when confronting Jack Smith, who's saying it was a fraud for the president to talk about a crime of fraud, to talk about election fraud when he knew it was wrong.
00:27:10.260Well, no, he didn't know it was wrong.
00:27:11.700To this day, he's still saying that there was fraud in the election.
00:27:14.480So that wipes away the entire basis of Jack Smith's J6 indictment against the president.
00:27:20.060But, of course, we've learned a lot more since even this indictment was handed down in 2023 about voting and election fraud in all of those states.
00:27:29.640So I think he also felt cornered on the basis of that indictment, the weakness of the evidence, the weakness of the charges that he brought.
00:27:39.460So, you know, maybe this will just be one of those weird karmic periods where everything kind of comes together.
00:27:46.100Jack Smith having to defend this criminal indictment based on the president's belief that the 2020 election was stolen and also new evidence that that actually is the case.

00:29:59.560I don't want to give too much away, but let's say even Homan's appearance today, there might have been some issues regarding that about potential violence.
00:30:15.620You saw the church in Minneapolis, the violence.
00:30:19.360These people are getting, they're dangerous, and the more desperate they get, particularly when they know they're not going to win and not going to get control back, they're going to get more and more dangerous.
