00:05:02.060House Judiciary Committee Chairman Jim Jordan has referred former special counsel Jack Smith to the Department of Justice for a potential criminal investigation, accusing Smith of intentionally making false statements to Congress last year.
00:05:16.440The Ohio Republican yesterday sent a letter to acting attorney general Todd Blanche claiming there is, quote, strong evidence that Smith made willfully and intentionally false statements in a closed door deposition last December.
00:05:30.660Specifically, Jordan pointed to Smith's answers to questions about whether prosecutors obtained phone records of members of Congress during his investigation into efforts to overturn the 2020 election.
00:05:42.920During the deposition, Smith testified that he did not seek search warrants for the contents of any text messages from members of Congress during his probe and only sought toll records.
00:05:54.880But Jordan noted in his letter that documents produced this month by the DOJ shows Smith's team obtained text messages from 44 lawmakers.
00:06:06.880Smith's attorney responded by calling the referral meritless and based on a spurious claim.
00:06:13.760A congressional criminal referral is a non-binding request asking the DOJ to investigate whether someone has violated federal law and to determine whether further action is needed.
00:06:24.380The DOJ is not required to pursue charges or even open an investigation.
00:06:30.400Before we go, John, this case is a perfect example of why any person who finds themselves in the crosshairs of this Department of Justice in one of these retaliatory investigations, and I consider myself among them, I am currently, I have received a subpoena in an investigation.

00:06:52.240Do not provide answers under oath. Do not provide answers to Congress. Do not provide answers to questions to agents or to a grand jury, because this Department of Justice will take what you say and apparently what you don't say and try to use that against you all in pursuit of the president's revenge mission.

00:20:54.260And so that was his message. But I have to tell you, his biggest applause line when he said was when he said the Senate must pass the Save America Act, like people just jumped out of their shoes to cheer him on for that.

00:21:14.160And Republican leaders should pay attention if they're concerned about turnout, that the emotional power of the Save America Act for turnout is very strong.

00:32:18.680to the Justice Department on Biden's special counsel, Jack Smith. Jack Smith, as we know,
00:32:26.240was this rogue political partisan operative, this scud missile launched by Biden to try to
00:32:33.080take out Trump. And as part of Jack Smith's investigation of Trump and his aides and his
00:32:40.180allies, Jack Smith subpoenaed the text messages, the content of the text messages from 44 members
00:32:49.280of Congress, including 20 senators and 24 House members, including the Speaker of the House,
00:32:57.180the number two in the House. It's a big deal to subpoena congressional members' telephone records,
00:33:05.740their text messages. They did it for 44 of them. And then Jack Smith didn't apparently have the
00:33:13.220taint teams in place, the filter teams in place to make sure they're doing a review for privilege,
00:33:19.700which is a big problem. And then Jack Smith got asked about what he did in those investigations
00:33:26.740as part of his December 17th, 2025 deposition in front of the House Judiciary Committee. And Jack
00:33:34.020Smith, according to Jim Jordan, the chairman's criminal referral lied. He provided materially
00:33:41.240false statements to Congress, to the House, because Jack Smith said that he only got the
00:33:47.760toll records of these phone calls, meaning two from phone number duration and not the content.
00:33:55.080Well, according to this criminal referral, that is a lie. Jack Smith lied because he did get
00:34:00.90044 members of Congress's text messages. And so that's why we have this criminal referral.
00:34:07.660When you have these criminal referrals, I've helped draft these for then-chairman Chuck Grassley, the Senate Judiciary Chairman, when I worked on the Kavanaugh affirmation and we set criminal referrals.
00:34:18.620When you lie to congressional investigators like this, like Jack Smith is alleged to have done here, according to Jim Jordan's letter, you could be charged with perjury because it's under sworn testimony under his deposition, presuming it was a sworn deposition.
00:34:34.720You could be charged with false statements, 1,001 false statements.
00:34:39.860You can also be charged with obstruction of a congressional investigation.
00:34:43.820And if you did this with others, you could be charged with conspiracy.
00:34:46.800So this is a very serious criminal referral, and the Justice Department should and must treat this seriously.
00:37:00.780I want Jack Smith to go through this process because what he did was criminal.
00:37:06.580He must face severe legal, political, and financial consequences for it to send a deterrent to these other lawfare Democrats, these other bad actors like McCabe, the former deputy director of the FBI, so they understand that if you do this, you will face consequences.
