00:04:36.320D.C. Circuit precedent. And just to make clear, that's the federal appeals court that oversees him,
00:04:41.200said it's really clear that if you have a White House hard pass, it cannot be taken from you
00:04:46.700without notice and an opportunity to be heard. And the notice has to also tell you what are the
00:04:52.140standards of conduct that you should use to govern your own and what is the punishment, right?
00:04:57.540We can't just capriciously, Leo, yoink, yoink, yoink. There's got to be some process.
00:05:01.040So while it was a victory for the First Amendment, it was not a victory on the First Amendment.

00:06:02.520Now, we go to tonight's, and that's where the rubber meets the road, because there is a decision and a case involving the Associated Press, Associated Press versus Budowich.
00:06:11.820And in that decision, which was decided on First Amendment grounds, a divided panel of the D.C. Circuit said that while the appeal was playing out and the Associated Press won this at the lower court, while an appeal was playing out,

00:06:58.300that may not be as entitled to robust First Amendment protections,
00:07:02.860particularly when the president might have an interest in excluding people
00:07:06.320from spaces that are traditionally private.
00:07:09.100Tonight's space seems to me to be one where we don't really have an analog in the case law.
