00:18:21.860 that you have a right to a robust legal defense but in Jack Smith's investigation all three of
00:18:26.900 those appear to be intruded upon let me start with the most shocking of the revelations we
00:18:31.760 were able to get the release the pen register record showing the FBI sitting on Susie Wiles
00:18:37.520 phones and recording all of the informed phone numbers that the FBI and Jack Smith's team were
00:18:42.360 interested in this is an investigation that was codenamed plasmic echo it was focused on
00:18:47.660 the classified documents. It's the originator of the raid at Mar-a-Lago. And there are some
00:18:53.600 really significant bombshells. Let me start with the first. One of the most robust things that the
00:18:58.300 FBI was recording and tracking and mapping in real time was President Trump's contacts with
00:19:04.100 his legal defense team using Susie Wiles' phone as the mapping instrument. They were in real time
00:19:09.900 identifying what lawyers were calling at what time of day. That pretty much intrudes on the
00:19:15.920 ability of the president to have a fair at events.
00:19:18.080 It is basically putting your thumb on the scale by trying to cheat, by trying to understand
00:19:22.860 what the Trump legal strategy is.
00:19:24.840 Now, that's the first thing the pen register was capturing.
00:19:27.500 The second thing the pen register was capturing, it makes no sense because journalists had
00:19:31.040 nothing to do with the classified records case, was a journalist's call to Susie Wiles.
00:19:36.420 Those were being flagged in real time.
00:19:39.040 Some of my calls as a reporter for Just the News were flagged.

00:19:44.140 What possible criminal interest could there be by Jack Smith in mapping that?
00:19:49.460 The third thing that Jack Smith's team was mapping, clearly protected by the Constitution,
00:19:54.700 were activities of the campaign, including they were exploiting the Political Action Committee reports
00:20:00.440 that President Trump was filing from his MAGAPAC.
00:20:03.020 They were also monitoring in real time the social media of the Trump team.
00:20:07.560 They were monitoring endorsements.
00:20:09.580 At one point, they wanted to put a squeeze on former National Security Advisor Robert
00:20:13.900 O'Brien, so they went and looked up his political endorsements and tried to use that as a pressure
00:20:19.040 tactic.
00:20:19.620 Now, endorsements, money, social media, legal contacts, all protected by the Constitution,
00:20:25.380 but maybe not protected by Jack Smith and his team.
00:20:28.320 I think this is going to open up a whole new avenue of evidence.
00:20:31.760 Now, two other things I want to point out from the documents.
00:20:34.420 We knew that there was some controversy about the decision to go raid President Trump's
00:20:39.580 Trump's home in Mar-a-Lago.
00:20:40.580 Now, Jack Smith wasn't even appointed yet.
00:20:42.340 He was being run by some of the deep state prosecutors and the DOJ and the FBI.
00:20:46.880 We made public today some internal emails of the FBI showing that the FBI agent who
00:20:53.300 was running the counterintelligence unit and FBI that was the leading edge of the plasmic
00:20:58.140 echo classified documents case strongly did not believe that they had met the probable
00:21:03.180 cause standard for raiding President Trump's home.
00:21:06.220 And he argued that they should try to use a less intrusive tactic, like maybe a grand jury subpoena or a negotiation.
00:21:13.420 Obviously, he got overruled by the Biden Justice Department.
00:21:16.800 But the fact that a senior FBI agent didn't think the FBI was complying with the search warrant requirements is eye-popping in and of itself, given how intrusive that search was.
00:21:27.700 And then the final part is there's a mystery meeting, one that has a lot of intrigue surrounding it.
00:21:33.340 The documents show that in November 2023, Jack Smith's team and the FBI met at the CIA with former CIA director John Brennan.
00:21:42.680 The documents state that the alleged purpose for that meeting was to discuss expert testimony.
00:21:48.480 And I want you to think about this.
00:21:50.140 John Brennan was on TV for years bashing Donald Trump.
00:21:52.640 He's not going to be a neutral expert witness in the Donald Trump classified documents case.
00:21:57.280 So the stated reason for the meeting looks very suspicious.
00:22:01.100 But what's most suspicious about it is that the FBI took its notes, and basically the agents put their pens down and made no record of what occurred at the meeting.
00:22:11.160 The U.S. Attorney's Manual requires agents to take copious notes, to store them, to attach them in the files.
00:22:17.020 But in the case of this John Brennan meeting in November 2023, they went pencils down.
00:22:22.300 They just basically said the date, the time, attendees recorded none of the content, a complete blank set of notes.
00:22:28.480 Now, let's put the context of that meeting on a timeline.
00:22:32.140 It's about four or five months after John Brennan testifies to the House Judiciary Committee
00:22:36.580 that he didn't use the Christopher Steele, didn't try to use the Christopher Steele dossier,
00:22:42.380 the disproven Clinton opposition research document, for the famous intelligence community assessment.
00:22:49.380 That's the assessment where Brennan and Obama hijacked career officials' belief.
00:22:53.820 The career people do not believe Putin put his thumb on the scale of the 2016 election.
00:22:58.480 And John Brennan and Barack Obama wanted to change that.
00:23:03.040 Brennan says he didn't use the ICA in that testimony.
00:23:06.480 Evidence would come out a year later showing he did, in fact, extensively.
00:23:11.540 Maybe that is one of the reasons why those two sides were talking in November.
00:23:15.700 Certainly the timing fits.
00:23:17.240 It's the most relevant thing that John Brennan was involved in at the time was that testimony.
00:23:21.120 So a lot of bombshells all around, people still absorbing all the information, more
00:23:25.640 to come out in the next few days.
00:23:27.080 But certainly the monitoring of legal calls, if I'm a defense lawyer, I think I'm going to be pretty concerned today about what I saw in these documents.
00:23:35.900 One of the frustrations, John, before you go, one of the frustrations with the audience last week, they love the fact that what the Senate was doing, but they didn't think it got to the heart of it.
00:23:45.300 What do you envision the direction of the Jack Smith Inquiry and the Brennan Inquiry?
00:23:51.620 Because the audience, as you know, the same with Just the News, is very interested in accountability for both guys.
00:23:59.060 Yeah, listen, at the end of the day, most Americans want someone in handcuffs.
00:24:03.280 They want someone charged.
00:24:04.400 They want this era of weaponization to result in penalty that keeps future people from being tempted to do the same things that Jack Smith and the FBI and James Comey and the team did.
00:24:14.960 over a 10-year period. This was a 10-year ongoing operation to get Donald Trump.
00:24:19.740 Right now, it looks to me from the grand jury appearances and what I'm hearing from defense
00:24:25.600 lawyers and others is that they're focused on three things. One is, was Brennan's testimony
00:24:30.300 was accurate? Two, has there been any obstruction of this investigation? And keep a close eye on
00:24:35.180 that. That's a hot area of interest, according to the defense lawyers I'm talking to.
00:24:40.020 The third is, did, on a series of occasions, did the Justice Department, acting under the color of law, violate the president and others' civil liberties?
00:24:49.580 Did they do it when they went and got the phone records and text messages of Congress?
00:24:53.320 Did they do it when they raided Mar-a-Lago when they didn't have probable cause, according to these documents?
00:24:58.080 So that third one is the larger case.
00:25:00.740 That could involve everything from the FISA court in 2016 all the way to Jack Smith in 2024.
00:25:06.680 for. I think that's an area of big concern. It can be a criminal violation to knowingly and
00:25:14.400 willfully deprive some of their civil liberties, either by spying on the lawyers, executing a
00:25:19.860 search warrant that you didn't have authority to, making false allegations, knowing that evidence
