00:16:16.160He gave that green light when it comes to the execution of Nadal Hassan, the former Army major who admitted to carrying out the nation's deadliest mass shooting at an American military base.
00:16:28.120Hassan carried out the massacre at Fort Hood in Texas.
00:16:46.160Well, they're going to set a time and date for that, Kate. And it's not clear whether that will be Defense Secretary Pete Hegseth setting the time and date or whether it will be the Army Secretary setting the time and date. CNN has asked the Pentagon for some clarity on that. We'll know more probably in the next few weeks or so.
00:17:02.160But as Kate mentioned, this is an extraordinary case on many, many fronts.
00:17:07.280The Pentagon announced, as Kate mentioned, that Pete Hegseth had recommended the death penalty by firing squad for Nadal Hassan and that President Trump had approved it.

00:17:44.840shooting and killing 13 people and wounding 32 others before being apprehended by military police.
00:17:51.400He was convicted of 13 counts of premeditated murder and 32 counts of attempted premeditated murder and was sentenced to death.
00:17:59.680Now, Hassan had been radicalized and said that he was targeting U.S. Army soldiers who he was set to deploy with to Afghanistan in order to protect the Taliban and its leaders from the U.S. military.
00:18:12.560Here's what the Pentagon had to say in a statement regarding this case.
00:18:15.380Quote, Secretary of War Pete Hegsteth has recommended and President Donald J. Trump has approved death by U.S. Army firing squad for convicted terrorist Nidal Malik Hassan.

00:18:34.700Again, it's possible that Pete Hegsteth will set the time and place for the execution.

00:18:45.400Also, Kate, interesting here, besides Hassan, three other soldiers are on death row at Fort Leavenworth, Kansas.
00:18:51.880That's the Army's only maximum security prison.
00:18:55.400According to the Army lawyer, which is a bulletin for JAG officers, all of those soldiers were convicted of murder.
00:19:01.460And interestingly, the last two soldiers, again, who were executed by the U.S. Army, had not been convicted of murder.
00:19:07.720Private Eddie Slovik in World War II had been convicted of desertion, and Private John Bennett in 1961 had been convicted for the attempted murder and the rape of an 11-year-old Austrian girl.

And it's a legal finding from Secretary Mullen of the DHS, a legal finding. It's not Ed Martin's opinion. It's not Bannon's opinion. It's not Cleta's opinion. It's not a filing in a court.
00:33:24.260It's DHS finding that the machines for elections are using foreign parts and they cannot be secured.
00:33:33.000And so much so that the letter from Mullen says, I've got a special fund.
00:33:38.060It's a billion dollars, I went and found out, and one billion with a B dollars for states to change their election systems to protect themselves.
00:33:46.100So, look, I think this is a red hot crisis.
00:33:49.000I mentioned in an interview yesterday that Tina Peters was meeting with President Trump and that happened.
00:33:54.900And I haven't talked to her since the meeting, but I know they didn't meet about the, you know, the Colorado prison system.

00:34:12.720I think Mullen made his point with the letter. I think Lutnick has a chance to step up and also be a player
00:35:50.580Well, I think that one of the things that's really important, because a lot of people have said,
00:35:54.440well, the president needs to declare a national emergency for elections.
00:35:58.200Well, guess what? He already did. He did that in May of 2019.
00:36:04.320He declared that there was an emergency because foreign-owned—it's called information and communications technology and services, and that includes election infrastructure, manufactured in whole or in part or controlled by companies that are foreign adversaries, which is China, includes China.
00:36:26.360And there's not a voting system in America today, an electronic voting system in America today that is not manufactured in whole or in part in China.
00:36:36.520So the president in May of 2019 issued this, relying on the National Emergencies Act of 1976, issued an executive order ordering the Department of Commerce to promulgate regulations, which they did.
00:36:52.260The Department of Commerce regulations took effect in February of 2024, and they are the law.
00:36:59.780And it gives Howard Lutnick as secretary not only the authority, but the duty to act.
00:37:07.400And so here are some of the things that Secretary Lutnick could do today and that he needs to do today.
00:37:13.840He needs to order that the software in the Dominion systems in Georgia be replaced and upgraded, as all the other jurisdictions have done since 2022, when it was determined by Dr. Halderman that the Dominion systems have nine vulnerabilities.
00:38:21.980Yes, they are, because the Secretary of State has refused now for four years to install the upgrades.
00:38:28.220Secretary Lutnick has the authority under federal law and the duty under federal law to make sure that all vulnerabilities that have been identified are mitigated.
00:38:39.480And he has the authority to do it immediately.
00:38:44.740And then the other thing that he needs to do is the Department of Homeland Security sent him, along with the letter that Ed was referring to,
00:38:51.900The Department of Homeland Security doesn't have authority to mandate that states get rid of these vulnerable voting systems.
00:39:01.460But the Department of Homeland Security has created this fund.
00:39:05.940They've created grant funds through FEMA.
00:39:21.000Nobody else does, but Secretary Lutnick, Department of Commerce, does have in a, by law, under the national emergency that President Trump invoked in May of 2019, and then these rules were promulgated, and every transaction involving these vulnerable voting machines that have been manufactured in whole or in part in China, they fall under the Secretary's responsibility.

00:46:07.240The executive director of the board is a dyed-in-the-wool election denier, and he has now taken action, writing to the Trump administration saying Georgia's official state election board explicitly requests that Trump's attorney general and the feds must come into Georgia and take over the elections, intervene there as soon as possible.
00:47:26.480In Fulton County, Georgia, County Commissioner Dana Barrett says this is, quote, about undermining confidence in the elections process so that they can claim any results they don't like on November 3rd are fraudulent.
00:47:39.800Cleta Mitchell, Rachel Maddow has brought up, this lays the predicate because Georgia didn't take care of business.
00:47:46.800The election board was distorted and never got to the bottom of Fulton County's issues.
00:47:53.760Well, it isn't because of the lack of trying. The state election board fought very hard. The legislature removed the state election board from the control of Brad Raffensperger, but Georgia Governor Brian Kemp line item vetoed every dollar that the legislature had appropriated for the state election board for their website, for having staff and counsel.
00:48:20.180I mean, they've done everything, the establishment, the Republican establishment, and the Democrats have done everything they can to keep the state election board from doing its job.
00:48:30.660But the state election board chairman, John Favere, who's Brian Kemp's appointee, and he's been terrible.

00:48:40.000Those are the two members who voted against what the rest of the board members voted.
00:48:44.460The board members, the majority of the board, voted to adopt that resolution.
00:48:50.080They're not asking the government, the federal government, to come in and take over the elections.
00:48:54.220They're asking that Secretary Lutnick and DOJ exercise their responsibility under federal law, under regulations that were propagated under the Biden administration to fix the problems with the Dominion machines.
