00:05:37.580Switzerland does have the equivalent of hate speech laws which protect certain characteristics
00:05:43.080such as race, religion, ethnicity and quite recently sexual orientation. The judge quite
00:05:50.660curiously said that the TQ plus element was also a sexual orientation which made no sense which was
00:05:57.220the basis upon which he was convicted. However we see quite a interlocking dynamic between
00:06:03.220the EU and Switzerland. As you correctly intuited, we have one foot out of the EU and one foot in.
00:06:10.860Officially, we are not members of the EU and have retained our sovereignty. On the other hand,
00:06:16.200everything the EU is doing in terms of the industrial censorship complex is establishing
00:06:21.700itself in Switzerland all at once. In fact, we have a famous writer from Switzerland called
00:06:26.800Friedrich Dürrenmatt, who wrote many plays and many great books, and he said he likes to live
00:06:31.760in switzerland because when the world ends it will end 10 years later in switzerland and that
00:06:36.940is precisely what we are seeing now all of the bad things that have happened around us in europe
00:06:42.920you know spurred on by the eu are happening now all at once one of the central designs of our
00:06:49.860government right now is to introduce a swiss version of the digital services act of the eu
00:06:56.200which would in effect, if it came through, mean that freedom of speech on the internet, on social media, on ex-Facebook and so on,
00:07:04.660would die in Switzerland through censorship if that DSA of the EU were to be implemented here.
00:07:12.480In effect, what it is, is if you look at the Swiss version, this is actually the next battle we are facing to prevent the Swiss Digital Services Act from coming in.
00:07:21.640And its central stipulation is that social media companies are mandated or obligated to delete or censor allegedly illegal content.
00:07:32.280Now, if you think about that, allegedly illegal is by definition legal, just as an alleged murderer is by definition an innocent man.
00:07:40.420So in Switzerland, we have a law which is coming in. They want to pass it to our Swiss Federal Council, and the parliament will probably agree to it as well, which cannot even censor illegal things by definition. It can only censor legal things.
00:07:55.000So if you think about that, on the one hand, we have our hate speech laws, which officially criminalize certain forms of speech.
00:08:02.860And with the DSA, you wouldn't only be able to say what is, well, the DSA would in effect make it also impossible to say what is legal.
00:08:12.160So in the end, you will neither be able to say what is illegal nor what is legal in Switzerland, which would effectively mean you can no longer say anything.
00:08:20.100And that is in principle what the EU has done with its Digital Services Act.
00:08:25.000It commands, this is the EU's Digital Services Act, it commands companies like Facebook to delete illegal content, which is just an allegation by Facebook, once again, in the EU.
00:08:36.780Just tell me something about the Swiss point of view at the moment.
00:08:41.220And I know there's a lot of bullying that comes out from time to time from the European Commission, from the European Union generally with regards to Switzerland, which is both a member of the European Economic Area and the Schenken Zone, but not a member of the European Union itself.
00:08:58.380And obviously the EU would like Switzerland to join because it's there right in the geographical heart of continental Europe, thriving, doing better than the EU members itself.
00:09:09.340And obviously you're sort of proving that it's possible to exist joined intercontinental Europe and not part of the political bloc.
00:09:22.020There is pressure time to time put on to Switzerland to join.
00:09:26.580And there are some people in Switzerland that would like to become full members.
00:09:29.800Where are the Swiss right now vis-a-vis membership of the European Union?
00:09:35.160most swiss people the overwhelming majority oppose a membership of the eu quite rightly for it would
00:09:42.580destroy our democratic sovereignty and unmake us a democracy you cannot be a member of the eu as a
00:09:48.600nation and simultaneously remain a democracy it is impossible now the eu is basically an oligarchy
00:09:54.920and as you pointed out this oligarchy which is ruled by unelected bureaucrats and technocrats
00:10:00.800has bullied Switzerland. In other words, they wish to impose things on us, and certain
00:10:05.660government circles are quite willing to hop along to the tune of the EU. And if we don't do as the
00:10:12.260EU says, they will no longer talk to us. They have, in certain instances, refused to talk to
00:10:18.340our negotiators, and so on. But, as you quite rightly say, the Switzerland is the last great
00:10:25.820bastion of democracy and freedom in Europe. And we are fighting hard, my organization and many
00:10:31.540others, including the Leonhard Christ in Switzerland, which operates across Germany and
00:10:37.740Austria as well, to stop this relationship with the EU coming on, which is a new bilateral
00:10:44.160agreement that our government wishes to impose upon us. And it is quite annoying to see that
00:10:52.280what Hannah Arendt said, the famous German philosopher, that basically the bureaucracy
00:10:57.140is the rule of no one in opposition to the people, which is the rule of the people,
00:11:02.200is instantiated in the EU. Great. Just give me 60 seconds again. You did mention just now that
00:11:11.280it's impossible to remain a member of the EU and be a democracy. Why do you say that? What do you
00:11:16.420mean by that? Well, quite simply, a democracy is where the people rule, which is the people's will
00:11:25.720in effect, which is both the will of minority and majority to follow the will of the majority.
00:11:32.140Now, if you look at France, which is in the EU or Germany, they are in the EU, which means that if
00:11:37.86080% of the French people were in favor of reducing immigration from Germany, they would not be
00:11:44.960allowed to do so because the EU's rules forbid it, which is the direct contravention of the
00:11:50.580French people's will. That means it is by definition not a democracy.
00:11:56.200So you're referring to the fact that European law is conditional on membership of the European
00:12:01.200Union, that European law is sovereign above national law. So you lose that sense of national
00:12:06.920self-determination as part of the Euro bloc, right? That's your argument.
00:13:34.680They can advise you, tell you all sorts of things, like if you have an old IRA, want to convert that into an IRA in physical gold, they'll tell you exactly what that involves.

00:14:53.100one of your recent articles tell me um what were you what your what your organization was founded
00:14:59.880to achieve what do you do um how do you go about it our organization was founded in the spirit of
00:15:08.380the enlightenment and um one of the things uh that we fought me and my board which is composed of
00:15:15.000professors is that we can't just simply talk about free speech all the time and lament the censorship
00:15:20.560We have to do something about it. So what my organization basically does is it provides people who have been censored or canceled in Switzerland and in Germany with lawyers, which we pay for, in order to defend them through the court, you know, if necessary to the highest court in the land to protect their constitutionally guaranteed right to free expression, artistic freedom, freedom of religion and conscience, and so on, including press freedom.
00:15:47.260So that is one of the core pillars of our organization, which goes back to the idea that my right to free speech comes with the responsibility to guarantee it to another, particularly to other citizens.
00:15:59.720Because if others don't have it, neither do I or anyone else. It is something for all or none.
00:16:05.240And the point is that we not only do this with lawyers, we also write articles, which you've already referenced a few of them.
00:16:12.660We also make videos online and interviews. We organize conferences and we partner up, just as the War Room does, by building a network of engaged people and organizations.
00:16:23.260We build up a network of organizations and people in Germany and Switzerland who are prepared to fight the good fight and stop Europe sliding into a sort of dark age in terms of free speech.
00:16:35.580That is the main function of our organization.
00:16:38.760We are currently looking at many cases in Switzerland and Germany. We have one case in Switzerland which is particularly bad. We have a guy, he's an entrepreneur in the shipping industry. This is Michael Bubendorf.
00:16:52.000He was refused the purchase of a firearm, and his previous firearms, which he owned, were confiscated, and he was labelled a threat to the state, the Swiss state, because he had criticised COVID measures of the government during COVID, and because he has libertarian principles, which are a bit anarcho-capitalist, which means he doesn't really like the government.
00:17:12.940Not only were his firearms taken away from him, he was also branded a threat to the state, as I had said, and they want him to see a psychiatrist in order to determine whether he's fit, mentally fit, to own firearms, which is quite a Stalinist thing to do. It is the pathologization of philosophical political views in Switzerland.
00:17:33.120Now, correct me if I'm wrong there, seeing as you're talking about they confiscated his firearms. There's a duty, isn't there, on all Swiss adult men to have a firearm at home, right? Is that right? Is that correct?
00:17:52.420Not necessarily a duty. Everyone can buy a firearm in Switzerland if they have no criminal record.
00:17:59.640It's very easy. In this respect, it is like the US. All adult males are required to go to the army,
00:18:06.480the Swiss army, and in that capacity, they can, if they so wish, take their firearms home.
00:18:12.900So in Switzerland, it is often normal to see on trains or on anywhere, really, people in army
00:18:19.360uniforms, walking around, taking their firearms home, or going back to the military barracks.
00:18:24.000It's quite something unusual in Switzerland, yes. And the thing is that...
00:18:33.440Oh, yes. It's certainly unusual by European standards.
00:18:37.660Yes, the German population has been thoroughly disarmed, as have many other populations. The
00:18:42.960Swiss, of course, have a proud tradition of being mercenaries and defending their country with
00:18:47.720citizens, soldiers, which comes out of the Enlightenment again, is quite something remarkable
00:18:52.440about Switzerland, along with our democratic tradition, which sees us vote regularly in
00:18:57.720national votes or referenda or initiatives, as we call them, where we can vote about anything,
00:19:03.500yay or nay, yes or no. It's quite something, yeah, something we wish to cherish. And the point is,
00:19:10.400if we do join the EU, officially or unofficially, that will all fall away.
00:19:17.720What was the right of appeal to this guy whose firearms were confiscated because he expressed dangerous anarcho-capitalist ideas?
00:19:31.600well our lawyer on the case which we are paying for is going through all of the instances he is
00:19:39.140appealing to the authorities which is the police and we're taking it to court at some point but
00:19:45.740these things are grinding along very slowly because in switzerland the wheels of justice
00:19:50.420turn very slowly which is quite in contradistinction to germany where things do move relatively fast
00:19:57.620In Germany, we've also got certain cases. We've got a women's organization protecting the right of women against the LGBTQ trans craze, which essentially boils down to this.
00:20:11.020There was a trans man, no, there was a trans woman, excuse me, these things are relatively obscure. There was a man pretending to be a woman trying to get into a woman's gym in Germany.
00:20:22.320And this woman's organization, Faunheldinen, so women heroes or heroines, referred to him as a he instead of a she.
00:20:31.920And now this man is trying to forbid that woman's organization from calling him a him.
00:20:37.520So saying it like it is or telling it like it is, calling men men and women women is being criminalized in Germany.
00:20:45.100And we have supported their crowdfunding and are helping them to support their case in court as well.
00:20:51.400We have assembled quite a network of distinguished jurists, lawyers, academics and journalists in both Switzerland and Germany, with which we hope to fight this battle, which is quite important because without the support of prominent people, normal people tend to lose heart.
00:21:09.980It's quite important that certain people put their head above the parapet.
00:21:13.480In fact, one of our top professors, who is a professor of media sciences and a philosopher who is equivalent to the Roger Scruton of Germany, had his house raided in the morning some time ago because he said that, well, you know, he made an allusion to a famous German song which was propagated or sung by the Nazis, but he was using it to critique wokeness.
00:21:42.200So one of the German newspapers printed something about the RFD, which is the right-wing populist party in Germany, the most popular party in Germany, as I understand it right now.
00:21:55.360And the newspaper basically said that Germany is awakening to the threat of the RFD.
00:22:01.880Our philosopher, our professor, basically took that phrase, it is awakening, and said that is equivalent to woke, because woke has to do with awakening.
00:22:12.200even in German. So he made the connection to Woke, and he said that Germany is awakening.
00:22:17.960And he said it a little bit differently than the newspaper article. And then they accused him
00:22:21.820of using that song, which sings Germany Awakes, and they accused him of being a Nazi. This was
00:22:27.660the state prosecutor of Berlin. Luckily, that died over quickly, and he sort of overcame that storm.
00:22:36.900Just going back to Switzerland one moment,
00:22:40.540do your courts have jury trials by and large,
00:22:43.320or are they magistrates sitting by themselves?
00:22:47.200Unfortunately, jury trials in Switzerland were abolished quite some time ago.
00:22:52.580Now it's basically a judge who decides guilty or innocent.
00:22:59.280That's like continental Europe generally,
00:23:01.880Just because I see that Britain's new Prime Minister, Andy Burnham, announced that he was going to reverse the Keir Starmer position on abolishing trial by jury in England, which we've had since basically Magna Carta in 1215.
00:23:17.960um would you have give me just 30 seconds on this would you um have any seeing as your country has
00:23:27.100abolished trial by jury in favor of simple judges sitting by themselves deciding innocence or guilt
00:23:32.980themselves and would you have any words of advice to the uk that might be
00:23:38.080whose political class at least is openly contemplating scrapping trial by joy
00:23:44.980Oh, most definitely. Most definitely. A judge who decides about guilt or innocence is basically an agent of the state. He is not impartial, I believe. I think that the freedom of citizens is the most important thing this world has to offer. It must be respected above all else.
00:24:03.600And the only people who have the right to deny a fellow citizen his liberty or their liberty, those are fellow citizens.
00:24:12.080So by removing the trial of jury, we have basically placed the liberty of people in the hands of the state.
00:24:18.220And so I think it's very important to emphasize that a jury of your peers is the only legitimate means of depriving anyone of his freedom, which you might call God-given freedom or constitutionally guaranteed rights.

00:24:35.120just tell me what what the view is regarding the swiss there on this is there any nostalgia to
00:24:44.680return trial by joy in switzerland because in many ways switzerland is the natural parallel to
00:24:49.700england in continental europe like like the uk you've had a long story of growing like a thousand
00:24:55.780years of growing um democracy most unlike the rest of the the continental european countries
00:25:02.160um well what's the view in switzerland with regards to having scrapped trial by juries
00:25:08.540any desire to move back to to that no not really um most people are fine with it um they don't see
00:25:17.320the problem with it uh we are very efficient so some people might justify the move to abolish
00:25:23.820juries with efficiency. Although I hear from my most specialized lawyers that the Swiss justice
00:25:30.200system is overloaded with cases, and it might soon collapse. However, that is related to the point
00:25:37.580which I said earlier, which is our wheels of justice turn very slowly, which means there's
00:25:42.340a backlog of cases which the courts have to go through. So it might actually be beneficial to
00:25:47.240go back to trial by jury. But at the moment, that is not something we can see as a popular movement.
00:25:52.420Where I am, just to tell you, where I am in Italy, the whole judicial process is widely held in contempt by Italians. It has no popular, very little popular legitimacy in terms of impartiality.
00:26:11.380but when i talk to italians and suggest uh moving to trial by jury no appetite whatsoever um andrea

00:45:43.180But people in this way argue that way that they're stupid because every airport is a border, a potential border with the country of Spain if the flight is going to Spain and from Spain.
