00:17:40.440 ted basically argued that yes under this classical definition of what it means to be a totalitarian
00:17:45.440 regime america in the year 2024 qualifies and i thought they made a very sound argument so what i was
00:17:50.820 doing was responding to one very specific element of those six elements there which was this notion
00:17:56.580 of a uniparty so one of the classic one of the classic identifying traits of an authoritarian or
00:18:02.560 totalitarian regime is you only have one political party i mean nazi germany is obviously a good example

00:18:12.940 this essay is that america in the year 2024 whether we realize it or not actually does have only one

00:21:10.880 of magnitude insane so obviously there's four criminal prosecutions against donald trump they are all
00:21:16.100 legally deficient for for various reasons they are obviously all coming from a grossly politicized
00:21:20.700 election interference vantage point here the new york city case is a particularly extreme example
00:21:27.220 of a case that anyone who has any sense of the law any person who who went to law school and becomes
00:21:34.940 a prosecutor if you have a morsel a morsel of integrity in your bones you would never ever bring

00:21:46.000 campaigns for office to be the new york county new york district attorney he literally campaigned on a
00:21:50.800 platform of getting trump and prosecuting trump by any means necessary his own predecessor cy vance jr who's a

00:22:01.460 frivolous i can't justify using prosecutorial resources to do it same thing for the federal
00:22:06.000 prosecutor's office there the sdny the southern district of new york they did the exact same thing

00:22:16.000 is basically that these 130 000 in payments from the trump organization to michael cohen on the eve of the
00:22:22.640 2016 election were incorrectly put in the accounting books in the ledgers of the trump organization's
00:22:29.240 accounting books and whatnot because they call them legal services whether it is a when it should be a
00:22:34.380 campaign finance violation okay so there's multiple problems here one is the fraudulent bookkeeping
00:22:39.240 charge the actual state crime has a two-year statute of limitations now alvin bragg tries to get around
00:22:44.640 this very clear-cut statute of limitations by tacking on this in furtherance of an additional
00:22:49.640 an additional crime that's the federal campaign finance violation thing however he's a local da i
00:22:56.460 mean what gives alvin bragg the right to even tack on a federal crime to begin with especially when the
00:23:01.100 own federal prosecutor's office looked into it and said that they weren't going to do it then that
00:23:05.160 has its own statute of limitations problem as well here but in order to prove this case steve in order
00:23:10.260 to prove this case as even the bill clinton nominated fec federal election commissioner brad smith has
00:23:15.760 explained in order to prove this case in order to prove any campaign finance violation
00:23:19.460 case you have to prove that the sole and exclusive motive for a payment was unambiguously for the
00:23:27.500 sole and exclusive reason of getting that candidate across the finish line in other words in other
00:23:32.620 words if trump and his lawyers can show that there was any other possible motive for this payment that
00:23:38.660 was made from the trump organization to michael cohen any motive whatsoever they win the case because
00:23:43.420 the prosecution has not met anywhere close to its beyond a reasonable doubt burden and you know i can think
00:23:48.880 of any number of other reasons why maybe these payments were made you know perhaps president
00:23:53.000 trump didn't want baron trump to find out maybe he wanted to do it to preserve integrity of his
00:23:57.260 marriage with the first lady melania trump i mean there are so many other reasons why maybe these

00:24:06.500 discussed a little bit earlier it's just the grand spectacle of it all the fact that the president
