The White House is rejecting claims it defied a judge s order to halt the deportation of hundreds of migrants. Video shows some of those migrants arriving at a supermax prison in El Salvador over the weekend. The White House says they were removed from the U.S. under the authority of the Alien Enemies Act, a wartime law that dates back to the 18th century and has only been used 3 times before. The law allows the government to detain or expel non-citizens without first having to go before a judge.
00:02:19.840So this is before D.C. District Court Chief Judge James Bosberg, who on Saturday issued two temporary restraining orders based on what you just described as President Trump's proclamation.

00:02:38.400That was in dispute at this court hearing today.
00:02:40.980The Alien Enemies Act designating this Venezuelan gang, TDA, as a foreign terrorist organization and using that act to summarily deport known or suspected members of that Venezuelan gang.
00:02:56.860On Saturday morning, the ACLU, on behalf of five unidentified Venezuelan illegals who are tied to this gang, filed a lawsuit on behalf of these five Venezuelan terrorists.
00:03:15.100Judge Bosberg immediately issues a temporary restraining order denying their deportation.
00:03:22.800He then turned that into later and then ordered a hearing Saturday at five o'clock to look at this lawsuit.
00:03:31.020The government didn't really even have time.
00:03:34.920He then, after a hearing, orally told DOJ no more flights are to take off.
00:03:41.400And if there's any flights in the air, they are to be returned to the United States and then turn that lawsuit into basically a class action lawsuit that would cover any of these Venezuelan terrorists that would fall under the purview of the Alien Enemies Act proclamation.
00:04:03.480Of course, the DOJ immediately filed an appeal.
00:04:06.460Judge Bosberg scheduled another hearing today at five o'clock, which I just listened in on to, and is demanding, Steve, sensitive information about flight patterns, where he listed, he orally went through a whole list of questions that he did in a separate order.
00:04:30.520Judge Bosberg is demanding to know, from Trump's DOJ, how many flights took off on Saturday, where the flights went, what countries they went to, when they took off, when they landed, how many people were on the flights.
00:04:47.440Hold it. Hold it. Hang on. Hang on. Slow down. Slow down. Slow down.
00:04:51.240Are you telling me that this today was not to talk about the Alien Enemies Act or the appropriateness of doing it?
00:05:00.500You're telling me he wanted to know this whole thing was about asking the commander-in-chief in the Defense Department details about the deportations of these terrorists and these criminals?
00:05:09.580That's what this was about, and that's what he was hammering on?
00:05:13.660And I did note that as I was tweeting, covering this and posting it, this was not about even the president's authority, whether he can issue that proclamation, what would be covered under that.
00:05:28.220This was Judge Bosberg, and he repeatedly interrupted the DOJ attorney there representing the Trump administration.
00:05:37.020And this was basically just, you know, who has power over whom?
00:05:42.500And he truly believes that he holds the authority to prevent the president and his administration and his departments and agencies from executing this proclamation.
00:05:56.780He just went on and on about equities, that his equities as a judge, he said, don't end at the water's edge.
00:06:04.800They don't end at the airspace's edge because the DOJ is arguing, we're not going to give you this information.
00:06:11.580This is special authority, Article 2 authority that goes beyond the court's jurisdiction.
00:06:20.640And Judge Bosberg is basically saying, no, I have the authority to turn back those planes, and I want to know why you didn't do it.
00:06:28.500And the DOJ, again, is saying, we're not telling you because it will disclose foreign diplomatic relations, flight patterns, posing a national security risk.
00:06:38.840They detailed all that in the hearing, just as they have in their court filings.
00:06:44.540Judge Bosberg, this has, it really doesn't even have anything to do with the Venezuelans who are being deported.
00:06:50.400This is him trying to exert what he believes is his prevailing power over the president of the United States on this issue.
00:07:02.120So, like I said, he asked these several questions.
00:07:05.660The DOJ said, no, we're not going to answer them.
00:07:08.360He wanted to know why we're not going to answer.
00:07:10.560He then said he wants a sworn statement by tomorrow at noon.
00:07:15.060And if they don't disclose the answers to the questions he posed, he wants to know why.
00:07:23.660Well, we can put the husher on, and you could tell me in open court.
00:07:27.240Now, the husher, as you know, is something that judges put on when they're sort of sidebars between the judge and the defense attorneys and the government.
00:07:35.820He wanted to turn the husher on so the DOJ could tell him exactly all the details about these flights on Saturday.
00:07:43.760They are none of his business and far beyond his purview.
00:08:54.240I think most people coming to this fresh are kind of shocked about how you can have this standoff that's going to metastasize something ugly.
00:09:01.620If you hadn't read the reports of Julie Kelly over four years and how these judges and justices treated the J-6 prisoners who had no power,

00:09:17.140And look how arrogant they are and how they're sitting there treating them like decks.
00:10:11.120And Julie, a shiver must have gone down your spine when this guy's treating the governments, the DOD lawyers, like they treated the J-6 lawyers years and years ago, ma'am.
00:10:26.240And, you know, this is an eye-opening experience for most Americans but not for the war room posse.

00:10:35.480But, yes, this did escalate and take this to another level.
00:10:39.120You know, I was in Judge Bosberg's courtroom in December of 2024, and he put on trial a woman who was inside the Capitol for nine minutes.
00:10:47.980She was charged with four misdemeanors, the very common misdemeanors.
00:10:51.440She asked Judge Bosberg, the chief judge of the D.C. District Court, asked him to delay her trial until after Inauguration Day because the president had promised pardons for J-6ers.
00:11:05.020And she would have been in that first class, we believe, the easiest, lowest hanging fruit, only misdemeanors.
00:11:12.140He refused to delay her trial, ignored promises by the president of pardons for these individuals, put her on trial the week before Christmas.
00:11:22.860This woman, this woman, who committed no violence, she was convicted in a matter of hours by a D.C. jury.
00:11:29.380Now, luckily, of course, she was pardoned, and her sentencing never took place.
00:11:34.040But this is the mindset of not just Judge Bosberg.
00:11:38.760It is shared uniformly in that D.C. courthouse that I call the circle of hell, the rot in our system right now.
