00:02:11.400 related to a lawsuit of Donald Trump's firing of two members of separate what they are supposed to be
00:02:19.100 independent boards, the Merit System Protection Board, and also the National Labor Relations Board.
00:02:27.720 Donald Trump removed two members, one member of each board.
00:02:31.100 They filed lawsuits.
00:02:32.720 They were reinstated by D.C. judges.
00:02:35.740 And now that the appeal of those firings was heard today by a three-judge panel in Washington.
00:02:42.380 Now, what are those judges going to take away from John Roberts' comment
00:02:47.560 that they are insulated from any bad decisions as they try to go along with their colleagues in the D.C. courthouse?
00:02:56.320 So this is not just consequential for your district court judges, but certainly appellate court judges as well.

00:03:08.500 should not depend on relief from the highest court to save them from this judicial overreach.

00:03:25.100 and this is the group that filed the lawsuit on behalf of five unidentified Venezuelan illegals

00:03:51.200 No, it is organizations like the ACLU, Democracy Forward, where Mark Elias sits on the chairman of the board.

00:04:03.120 They are the ones creating it, and Judge Bosberg yesterday in that hearing, as petulant, as unprofessional,
00:04:11.980 demonstrating no judicial temperament whatsoever, berating the government,
00:04:17.400 and trying to get these granular details from the Department of Justice about these flights.
00:04:23.300 So he ordered today, Steve, he demanded that the DOJ file a sworn statement by noon today,
00:04:30.540 either disclosing information about those flights or explaining why they would not do it in public.
00:04:37.280 The DOJ gave their sworn statement today.
00:04:40.940 They filed that at noon.
00:04:42.320 They said that they did not defy Judge Bosberg's temporary restraining order,
00:04:47.960 that he immediately entered on Saturday without giving the government time to even file a written response to this lawsuit
00:04:57.940 and entered those two temporary restraining orders.
00:05:02.880 They said we didn't violate your order that was entered later that evening,
00:05:07.260 that the ones who were on the planes, first of all, two of the planes departed after Judge Bosberg
00:05:12.940 filed his second written temporary restraining order.
00:05:17.940 And they said the third plane that took off after he filed that at about 7.30 on Saturday night,
00:05:24.040 that those illegals were not subject to this Alien Enemies Act.
00:05:32.600 So Judge Bosberg, still, that was not enough for him.
00:05:35.400 So this afternoon, he filed another order.
00:05:39.760 And what he said is he told the DOJ to file ex parte, which means in court with no one there,
00:05:47.200 and under seal, so he won't have access to it,
00:05:50.740 a declaration providing the following details regarding each of the two flights leaving U.S. airspace before 7.25.
00:05:58.360 Again, this is before Judge Bosberg entered his order,
00:06:04.260 turning the five defendant or plaintiffs, the five illegal Venezuelans,
00:06:09.600 into basically a class action suit,
00:06:12.040 saying that those five illegals, now this will cover any illegal who would be covered by the Alien Enemies Act.
00:06:21.040 So, first of all, on what basis does he have the right to demand information about flights that took off
00:06:27.640 before his order was entered?

00:06:31.300 And then he wants this information.
00:06:33.080 What time did the plane take off from U.S. soil and from where?

00:06:38.980 What time did it leave U.S. airspace?
00:06:41.280 According to flight logs, one left at 5.36, another one left at 5.45, roughly.

00:06:49.420 They both, I believe, landed in Honduras first, around 8.30.
00:06:54.200 What time were individuals subject solely to the proclamation transferred out of the U.S. custody,
00:07:01.340 meaning taken into custody by First Honduran officials?
00:07:05.200 And how many people were aboard solely on the basis of the proclamation?
00:07:09.620 This is another order he entered today.
00:07:12.280 Now, the DOJ did say that they would disclose this under seal.
00:07:16.940 So, perhaps they will give this information.
00:07:19.440 It appears that a lot of it is already on the public record.
00:07:22.580 But yesterday, he also said he wanted to know the total number of people in the country,
00:07:28.060 Venezuelan illegals, suspected terrorists.
00:07:30.920 He wanted to know how many were in the United States.
00:07:35.180 Again, how is this his business?
00:07:37.700 This is a proclamation that was drafted by the president, that was signed on Friday night,
00:07:43.940 that was published on Saturday.
00:07:46.340 On what basis does Judge Bosberg have the right, number one, to stop a presidential order,
00:07:53.040 but number two, to demand this sort of granular information, which the DOJ said,
00:07:59.080 if it was disclosed and some of it went public, that it would jeopardize national security.
00:08:05.780 And this is strictly under the purview of the president's authority related to foreign and diplomatic relations.
00:08:12.740 I also want to bring up a point about just the way this judge and others are handling questioning the government's lawyers.
00:08:25.280 This would be the government representing President Trump as President of the United States,
00:08:28.580 Office of the President, and his cabinet officials in the departments.
00:08:32.800 When you reported for all those years on here every day about January 6th,
00:08:39.180 if the Justice Department gave an answer to a judge, it was like Holy Writ, correct?

00:08:49.220 they want the government to go bring individual receipts for every detail.
00:08:53.800 It's almost like the judges are prosecuting a case against the Justice Department,
00:09:00.760 the lawyers, whatever department it is, the Department of Defense, and President Trump.

00:10:07.140 So I just have to sit there and laugh at the sudden dramatic shift in demeanor
00:10:13.100 of these federal judges dealing with prosecutors because this is not how they dealt with prosecutors in Washington

00:10:30.140 Now, all of a sudden, they are holding DOJ's feet to the fire
00:10:34.540 after acting like nothing more than a rubber stamp of almost every single one of them

00:11:01.240 So this temporary restraining order that was issued by Judge Bosberg lasts for 14 days.
00:11:07.620 Now, here is the little trick, the stunt that these judges are playing,
00:11:12.380 is that temporary restraining orders typically are not appealable.
00:11:17.300 Now, this was the issue that was raised by the Supreme Court.
00:11:21.420 I believe it was Justices Thomas and Borsuch or Alito, I can't recall,
00:11:27.580 but saying that the judges are using these TROs that are usually not appealable,
00:11:32.180 but they're really preliminary injunctions in disguise.
00:11:35.880 They know that there's little basis to appeal those.
00:11:39.500 Now, the DOJ did appeal, immediately appeal, Judge Bosberg's temporary restraining order
00:11:45.400 issued on Saturday night.
00:11:48.240 So that is, there were briefs due.
00:11:50.240 I think there was a brief due, one of them filed today by the Department of Justice.
00:11:56.800 Of course, the DOJ has asked the clerk of the D.C. Circuit Court
00:12:00.740 to remove Judge Bosberg from this case, reassign it to another judge.
00:12:07.120 I'm not sure what judge we would do better at because they're all terrible.
00:12:12.500 So they're asking for that.
00:12:14.060 Of course, that will be denied.
00:12:15.760 I do want to raise a point that some of your other, I think Natalie raised and Laura Loomer raised.
00:12:20.860 First, recusing a judge, the judge has to agree to be recused.
00:12:27.960 There is really no other way.
00:12:30.320 You can't even appeal a judge who has denied a motion to recuse him or herself.
00:12:38.140 So that's another way that the administration cannot get any relief.
00:12:42.260 So that's why they went directly to the clerk of the D.C. Circuit asking for this case to be reassigned.
00:12:49.940 At any rate, that is on appeal.
00:12:52.060 I don't think that they've set oral arguments yet, but they are accepting briefs on that.
00:12:57.500 There's another hearing before Judge Bosberg on Friday.
00:13:01.460 And so this will be the disclosures that he's asked for.
00:13:05.480 Also, an updated complaint or response by these plaintiffs.
00:13:10.280 But in the meantime, it appears that the Trump administration is prevented, prohibited from following President Trump's proclamation to immediately deport these Venezuelans who are subject to the Alien Enemies Act.
00:13:28.920 Now, there are some signs and some rattling that they are going to ignore that.
00:13:32.780 I think that it's totally appropriate in this case, and especially what Justice Roberts said today, to ignore this temporary restraining order on the basis that, number one, too, it's out of jurisdiction.
00:13:47.220 None of the original five Venezuelan terrorists live in Washington, D.C.
00:13:53.500 They were all in facilities in custody in other states.
00:13:58.700 So there's a jurisdiction issue here, too.
00:14:01.660 But without getting too technical on it, how does a lower court judge like Bosberg get to prevent the president and his team, top officials, DOJ and DHS, from executing his order that's completely under his purview?
00:14:19.140 So this could get really, really ugly and nasty fast.
00:14:26.020 It probably should, because of what Judge Bosberg, how he has handled it.
00:14:32.360 Steve Bosberg still has not explained why he entered the temporary restraining order.
00:14:36.600 He didn't say that the Alien Enemies Act is legal.
00:14:40.020 He didn't say that the president didn't have a right to issue that proclamation.
00:14:44.140 He didn't defend even due process rights.
00:14:48.320 His only two orders on this have been what they call minute orders.
00:14:52.240 So it's a sentence or two on the docket.
00:14:54.340 He has not issued a long opinion parsing out all of the legal arguments that he believes are on his side.
00:15:02.240 This is a total reactionary response to President Trump, because Judge Bosberg, like so many of them, has nothing but contempt for the president.
00:15:15.560 You know, he I posted the transcript from Ray Epps' hearing that Judge Bosberg presided over in January of 2024.
00:15:23.560 And Judge Bosberg called January 6th an insurrection incited by Trump supporters.
00:15:29.100 So he himself, like the rest, have a record of making false, inflammatory, derogatory comments about the president.
00:15:38.320 So he still hasn't laid out his own legal argument as to why his temporary restraining order was issued or should stand.
00:15:46.760 This is nothing more than a power play by James Bosberg and attempting to supersede the authority of the president of the United States.

00:33:42.480 That was so good what she said about recusal because we tried to get Hernán Vera, our judge, to recuse because he was appointed by Hunter's father, and he wouldn't do it.
00:33:53.060 And so we were stuck in this liberal jurisdiction with a federal judge appointed by the plaintiff's father, and all we could do was hang on.
00:34:01.700 But once we were going to depose Kevin Morris, the guy who was funding the lawsuit to begin with, we can't prove this, yet we might be able to eventually.
00:34:12.360 We believe Kevin then went to Hunter and said, no, I'm not setting for a deposition with Ziegler because I was going to be there.
00:34:17.300 I'm a weird civil litigant where I actually show up to the depositions with the attorneys, and he cannot sit with me.

00:34:45.080 We haven't won anything in this case yet because of the liberal jurisdiction except that designation with prejudice because that's going to allow us to do a motion for fees, and if that gets denied, we're going to appeal it to the Ninth Circuit because, like the D.C. Circuit, the Central District of California is one of the few district courts that's even more liberal than the Ninth Circuit, which is hard to do.

00:36:06.560 Are you calling for a full accounting from state and particularly the ambassador there to exactly what's going on and why are all these resources and assets?
00:36:15.340 We're talking about having to cut potentially Medicaid, social programs, the Defense Department.

00:42:30.640 I also, you know, with you, General Kellogg's daughter, Wesley Hunt, who I think was a helicopter pilot, I think was an Apache pilot, wasn't he?

00:43:13.200 So all three of you were actually thinking about going to the academy and volunteering really in some of the darkest days of the Middle Eastern wars.
00:43:22.560 And then all of you basically, essentially, as soon as you got out pretty quickly or graduated pretty quickly, you were to two commands that eventually deployed to the Middle East.
00:43:33.220 What lessons do you learn from that?
00:43:35.620 It's a little different today.
00:43:37.480 Hopefully, we're not in any more wars in the Middle East if President Trump completes what he's trying to do.
00:43:43.560 But what lesson do you take from that about you guys that kind of volunteered and went in during the darkest days of these Middle East wars?
00:43:51.920 Well, we volunteered for this, and we were trained at the academy that when we came out, we would most likely deploy, and all three of us did.

00:44:03.940 And I believe that we need to get back to that.
