00:00:21.120 Judge James Bosberg, now saying that the government appears to have acted in bad faith.
00:00:25.560 This comes after the hearing wrapped just moments ago to determine whether or not the government violated his court order to stop the deportation flights,
00:00:34.680 two of them, with alleged members of a gang to a mega prison in El Salvador.
00:00:40.860 President Trump invoked the Alien Enemies Act last month.
00:00:43.920 It's a wartime authority used to deport non-citizens with little to no due process by arguing that the Venezuelan gang is a, quote,
00:00:51.220 hybrid criminal state that he says is invading the country.
00:00:54.820 Joining me for more is ABC News justice reporter Alex Mallon and ABC News senior Washington reporter Devin Dwyer.

00:01:01.380 And, Alex, the hearing just wrapped here.
00:01:02.720 What are your main takeaways?
00:01:05.160 I mean, it was really a fascinating hearing, Kena.
00:01:07.680 I mean, Judge Bosberg really laid it on the government.
00:01:10.660 And it really seemed like he's leaning towards initiating contempt proceedings.
00:01:14.880 Now, what that's going to look like, we don't know.
00:01:16.500 But he basically tried to drill down the timeline of the government.
00:01:20.020 And that March 15th, that Saturday hearing where he initiated this verbal order to the government to say,
00:01:25.520 if there are currently any planes in the air with migrants that are being deported under the Alien Enemies Act,
00:01:30.860 you need to turn those around.
00:01:32.040 The government has maintained both that they comply with a written order that was later issued by Judge Bosberg.
00:01:38.600 And also, they said that his jurisdiction was largely moot once the planes were out of international waters.
00:01:45.920 This hearing, though, Judge Bosberg said that the rushed process that the administration engaged in
00:01:51.260 to put those, you know, over 200 migrants on those planes and get them to that supermax prison in El Salvador
00:01:57.340 seemed to be deliberately and done in bad faith.
00:02:00.960 He said that it seemed to be designed to basically dodge any court order that he issued that day.
00:02:08.100 And so he said that at the conclusion of that hearing, that he was going to consider whether the administration,
00:02:13.540 there was a probable cause that they did violate his order deliberately.
00:02:18.900 He said he will be issuing some kind of written order on that sometime likely next week.
00:02:24.040 Okay, so, Devin, depending on what that written order says here,
00:02:26.780 if they do decide that they, you know, violated his orders, what's the consequence?
00:02:31.840 Well, the judge in this case, Kena, has limited options,
00:02:35.180 and judges in general don't like big divisive showdowns with the federal government, as we see here.
00:02:41.240 And that was every indication we received from Judge Bosberg today.
00:02:45.660 He was really using the levers of his ability to question the government, name, have them name names,
00:02:51.500 get down to the facts, scrutinize the truth.
00:02:54.180 But at the end of the day, judges have pretty limited tools at their disposal
00:02:59.400 when it comes to holding the government to account for an alleged violation of their order.
00:03:03.800 Sure, he could issue jail time.
00:03:05.800 He could issue fines for any officials involved in this who disobeyed him.
00:03:09.820 But judges typically don't want to do that when it involves an agency that those sorts of things
00:03:14.880 can also be challenged in court.
00:03:16.760 So, Bosberg is really limited, and it does appear, Kena, that he's simply trying to use the power of the bench
00:03:23.040 to extract more information more than anything else.

00:05:52.460 And you look around the world at how that's happening all the way from Israel to
00:05:56.380 Brazil, to France, to South Korea, and here in the United States, it's kind of
00:06:00.300 this, it's, it's all moving as a piece.

00:06:40.120 They're there to give you actually the facts of what's going on and you make up

00:08:41.480 And because Boesburg is the guy as the head judge of the, of the first level of courts there,
00:08:47.440 the district courts, he's got a target on Trump.
00:08:50.340 He is coming for president Trump of that.
00:08:52.880 There's no doubt he's coming for Trump and you've actually exposed how he's trying to
00:08:57.600 do it.
00:08:57.920 So take it away, ma'am.
00:08:58.800 So what I just posted, and this is a very detailed timeline of what went down on March
00:09:05.840 15th and how Jeb Boesburg not only just decided to pursue a contempt case against the Trump
00:09:14.060 administration, but he actually set it up starting in the early morning hours of March
00:09:20.760 15th when that ACLU lawsuit was filed representing the illegal Venezuelans who are going to be
00:09:28.060 covered by the Alien Enemies Act.
00:09:31.240 And I go through all of Boesburg's movements and decisions that day, comments that he made
00:09:37.220 during that hearing, comments he made afterwards to tip his hand that this was specifically,
00:09:44.920 it appears, taken by him as the chief judge, not assigned to him, that he took this case
00:09:51.800 early that morning, continued to make these decisions and lure Trump officials into a contempt
00:10:00.200 trap.
00:10:01.060 Now, what does that address?
00:10:03.020 What you just played in the cold open, this so-called oral ruling, he calls it, to turn
00:10:10.660 planes around, knowing that when he set this hearing at five o'clock on March 15th, he already
00:10:17.520 knew that two planes carrying these illegal Venezuelans would be taking off during the hearing.
00:10:26.200 So he set the hearing time specifically to coincide with the departure of these two deportations
00:10:33.000 planes.
00:10:33.500 He then called a brief recess in the hearing, directing the DOJ attorney to go try to find
00:10:41.720 out details about these flights, which of course the DOJ attorney couldn't do because it was
00:10:46.540 a Saturday night.
00:10:48.120 Boesburg knew that.
00:10:49.920 When the poor DOJ attorney comes back at about six o'clock, says, I have no details, Boesburg
00:10:55.780 and the ACLU knew these flights had taken off.
00:11:01.080 He then enters what he called this oral ruling at about 645.
00:11:06.320 The planes had already been long gone over an hour out of U.S. airspace.
00:11:11.000 They took off from southern Texas to Central America, ordered those flights back.
00:11:16.420 Now, what's interesting, Steve, is what he said verbally.
00:11:19.440 He did not include in a written temporary restraining order that he filed about 40 minutes
00:11:26.220 later.
00:11:27.160 But now this verbal ruling is the basis of this contempt investigation.
00:11:32.560 We're expecting this opinion to be issued tomorrow in what he has called probable cause
00:11:38.660 for contempt.
00:11:41.160 Accused the Trump administration last week of acting in bad faith and disobeying at least
00:11:47.940 this order.
00:11:48.720 Now, his other two written orders, of course, have been vacated by the Supreme Court, so
00:11:52.940 they're not even active anymore.
00:11:54.780 So any contempt investigation inquiry that he wants to proceed with will have to be based
00:11:59.960 on this verbal ruling.
00:12:02.480 So, so sketchy.
00:12:04.080 And so my new piece really articulates almost hour by hour what happened that day as he created
00:12:11.740 that contempt trap for the Trump administration.
00:12:15.020 Okay, okay, help me out here.

00:12:27.920 You got to remember, every department of those, like Fort Apache, you have the administrative

00:12:40.900 the enemy's inside the wire constantly.

00:12:46.260 There are not enough people gotten through there and confirmations and all of it.

00:13:14.740 go in there because these people are fighters and subject matter experts and they won't back

00:13:22.420 When I read your thing and I see it, shouldn't the Justice Department lawyer that's actually
00:13:28.220 representing the government and President Trump and DOJ and the people that were involved
00:13:35.640 in DHS, shouldn't they have known?
00:13:38.680 When you lay it out, it's pretty obvious what was going on.
00:13:41.720 Why wouldn't a skilled lawyer have seen this and start combating that in the courtroom and
00:13:46.680 try to shut down or at least expose it and say, hey, judge, I know what you're trying
00:13:49.920 to do here and we're not going to play games.
00:13:51.620 We're not playing this game.

00:13:54.740 Well, I think this was part of how everything and Judge Jeb Bosberg, as I say in my piece,
00:14:00.960 he admitted everyone's working on the fly here.
00:14:04.420 He said, I haven't had any time to research this.
00:14:07.920 He verbalized many times how quickly he was rushing.
00:14:10.680 He said at one point in a later hearing, this was out of the norm.
00:14:15.160 This was not the common way that lawsuits like this were handled.
00:14:19.480 So they rushed this on purpose to put this DOJ attorney dragged into this on a Saturday,
00:14:28.100 had no idea that this was coming.
00:14:30.820 So that's how they really caught this guy off guard.
00:14:35.100 And then knowing it was a Saturday evening on March 15th and that he wouldn't be able
00:14:40.720 to get in contact with the right people and give Judge Bosberg more details.
00:14:45.820 Now, I will say, Drew Ensign, who is the attorney, DOJ attorney, I think he did what he could
00:14:51.460 in this particular hearing on March 15th.
00:14:53.920 I was not impressed with his subsequent performances, especially on April 3rd, when he started voluntarily
00:15:00.600 giving up names of Trump officials he talked to after that hearing who might have been listening
00:15:06.000 in to the March 15th hearing.
00:15:07.700 But in his defense, when you used to cover J6, and I know this from my own trial, you would
00:15:21.020 have the most senior guy show up in the department.
00:15:22.980 I mean, they had, they were, people were like in shock for a misdemeanor.
00:15:26.080 They were bringing the heavy artillery out when they had me.
00:15:29.400 And I understood it.
00:15:30.940 Hey, if we can get banned and we're going to send a message to all these people, right,
00:15:34.060 on a misdemeanor and send him to a federal prison, we'll do it with the same with Peter.

00:15:39.960 The second or third time the guy goes in court, he's one guy.
00:15:43.940 I mean, I understand they are strapped over there, but wouldn't this rise to say, hey,
00:15:48.620 look, this is, they're trying to get us on a criminal contempt charge and they're going
00:15:53.460 to try to throw some DHS people, maybe some military people, and they're going to go all
00:15:58.320 the way up and try to do something with Trump.
00:15:59.840 Now, wouldn't that, wouldn't you have like this three or four scenes, shouldn't Pam have
00:16:04.460 like maybe showed up that day symbolically, like, like, like the old, like the Biden Justice
00:16:10.460 Department used to do all the time to send Lisa Monaco and those people to send, to send
00:16:15.940 their, their highest and their most seasoned prosecutors in for misdemeanor hearings, ma'am?
00:16:22.080 Well, I think what happened that evening and when Bosberg made that ludicrous statement about
00:16:28.460 turning planes around, first of all, I don't think the DOJ attorney thought that that was
00:16:33.240 really serious.
00:16:34.020 But Judge Bosberg also said, I'm going to put this in a written order and you got, he
00:16:40.100 actually said, no one has to write anything down.
00:16:42.320 I'm going to put this in a written order.
00:16:44.260 So then when he filed his written minute order at about 726 that evening, he did not include
00:16:51.100 his comments about returning the planes.
00:16:55.560 So at that point, I'm sure the DOJ thought that that verbal command was not in play because
00:17:02.660 it wasn't reflected in the written one.
00:17:05.280 And then that became an argument later.
00:17:07.860 And there's case law and common practice that says verbal, it has to be a written order,
00:17:12.040 has to be on the docket.
00:17:13.280 Like the other two temporary restraining orders issued that day were on the docket written
00:17:16.980 and the verbal one was not.
00:17:18.800 So that's been an ongoing dispute.
00:17:22.760 But what I didn't like was give a coffin up names when the judge goes, who, well, I
00:17:27.180 can't really know.
00:17:27.900 I don't, I don't remember it.

00:17:30.140 And you're coughing up names.
00:17:31.460 That to me should just tell the judge, hey, we'll get back to you.
00:17:34.440 And then you, then you stonewall it or you, you drag it out.

00:17:38.580 That's when you know the judge has got the fix in for you.
00:17:42.020 This thing stinks to high heaven.
00:17:43.420 And my concern is this going to metastasize because MSNBC is driving this every night.
00:17:49.640 This is like the one they, they, they fantasize about because they see Trump going to Danbury
00:17:54.340 on a contempt charge.
00:17:55.800 Trust me, these people are so deranged on Trump hatred.
00:17:58.580 They're twisted.
00:17:59.880 And Bosberg's one of them.
00:18:00.940 And this also makes, which I think is Mike Davis's impeachment thing is absolutely justified
00:18:05.720 because of what's happening here.
00:18:08.040 Where do we stand?
00:18:08.700 I thought paper's supposed to be followed.
00:18:10.040 Is this thing actually going to move forward?
00:18:11.660 Or since he was kind of overruled about the main event, doesn't it, well, shouldn't it

00:18:18.760 No, what he did, Bosberg did very brazenly after the Supreme Court ruling came down Monday
00:18:25.380 night, Tuesday morning, he canceled a hearing that was set for that day.
00:18:29.440 So this is April 8th on a preliminary injunction.
00:18:33.060 So this is the natural next step after a temporary restraining order.
00:18:36.480 So he was going to hold a hearing.
00:18:38.460 He canceled it.
00:18:40.040 But what he's told the ACLU representing these illegal Venezuelans is, hey, by April 16th,
00:18:46.400 I want you to file another memo or notice as to why you think that this courtroom is still
00:18:52.480 the proper venue to seek a preliminary injunction.
00:18:55.680 Well, how ballsy is that?
00:18:56.960 I mean, the Supreme Court had already said in its opinion that the Washington jurisdiction
00:19:03.220 was improper, that you should seek habeas, and it should be in the jurisdiction where
00:19:09.400 the defendant is in custody.
00:19:11.760 And in this case would have been Southern Texas, at least at that point.
00:19:15.060 So he's still challenging now, not just the Trump administration, but now the Supreme Court.
00:19:21.100 So we'll see next week what the ACLU comes back with.
00:19:25.140 Now, can he proceed with preliminary injunction hearings?
00:19:29.480 I mean, I suppose so.
00:19:31.620 He'll probably be smacked down by the Supreme Court again.
00:19:35.320 But he is not done pushing the envelope on this.
00:19:39.040 He took this on as a crusade.
00:19:41.160 Look, this is the guy who has called January 6th an insurrection.
00:19:44.440 He said this over and over in J6 cases, that that was an insurrection incited by President
00:19:50.780 Trump.
00:19:51.700 So this is a longtime grudge that that Jeb Bosberg has had.
00:19:56.200 And so this is why he's going to keep pushing this as long as he possibly can.
00:20:00.620 If, just to make sure I understand, if ACLU decides they're not going to file, I know
00:20:08.060 they are because they're going to try to get this, figure out this Texas thing.
00:20:11.600 Is the contempt thing still a thing?
00:20:13.480 Is he still going to push that separate and above everything else?
00:20:16.260 Or because the Supreme Court ruled it, that just dies and President Trump and his team
00:20:20.780 are off the hook?
00:20:22.880 No, I think he will definitely pursue the contempt case.
00:20:26.820 Now, the ACLU, I believe in the five original plaintiffs, they've already sought habeas
00:20:32.460 in, I believe, New York and Texas.
00:20:34.920 So I'm not really sure what the ACLU will do with a preliminary injunction, except for
00:20:39.640 the fact that Judge Bosberg turned those five unnamed illegals into a class action, into
00:20:46.680 a class.
00:20:47.580 So he did that in one of the temporary restraining orders that has been overturned.
00:20:52.420 But this demonstrates how messy all of this is.
00:20:55.240 He still believes or wants to believe that there's a thread he can hang on to, to keep
00:21:00.660 this matter in his courtroom.
00:21:01.920 But that's separate from what would be a contempt inquiry or contempt allegations related to the
00:21:08.820 verbal order that was not on the docket and not reversed by the Supreme Court, because it
00:21:13.980 wasn't even, wasn't even an issue or a question in that litigation.
00:21:19.000 Um, but we will know tomorrow because he said last week that he would issue his opinion on
00:21:25.380 contempt this week.
00:21:26.300 So I'm sure we will have it at some point tomorrow.

00:22:06.620 So I think they're just slowly bit by bit kind of, um, you know, take disassembling little

00:22:17.660 Yes, because so much damage has already been done.
00:22:20.200 And to your point, distracting the Department of Justice and the president and the entire Trump
00:22:24.840 administration, sabotaging the agenda, um, of the president and his white house team,
00:22:31.420 because this is all anyone has really been talking about is what's happening in these various
00:22:37.160 lawsuits and taking away resources in time that I know the DOJ wants to use in other areas,
00:22:44.260 including investigations and prosecutions of what we would like to see.
