00:02:33.700 And in fact, just one program, the biggest DEI program in Texas is called our Hubs Program,

00:02:39.400 And what it is, is the comptroller of the state of Texas has been requiring every single state agency,
00:02:44.900 when they issue any kind of contract, to use minimum DEI criteria here.
00:02:49.660 And I'll give you just a couple examples.
00:02:50.740 For every construction contract in Texas, a minimum of 21% had to be awarded on the basis of race or gender.
00:02:56.960 For any special trade construction contracts, 33% must be awarded on the base of race and gender.
00:03:04.640 For every professional services contract, 24% on the basis of race and gender.

00:03:11.460 I referred the comptroller to the Trump Department of Justice two months ago,

00:35:55.200 Something on Capitol Hill today shows us that the process of trying to create a federal framework
00:36:04.500 is fraught for a number of reasons.
00:36:06.420 The House met today for a hearing.
00:36:10.220 The Commerce Committee met for a hearing to discuss the Kids' Online Safety Act
00:36:17.860 and a number of other, in fact, 19 bills intended to ensure that children are not exposed
00:36:25.360 to any kind of harmful online content, at least if it's within control of the tech companies.
00:36:33.540 It's still up in the air.
00:36:36.100 You'll remember that COSA was introduced in 2022, so it's been floundering for years.
00:36:43.500 It's still floundering.
00:36:45.000 And as we heard from some of the people who were testifying and the representatives who were
00:36:50.520 speaking on it, there is a huge argument about whether or not the liability should fall on
00:36:57.960 the companies themselves.
00:36:59.380 So we heard a lot last night from Shelby Knox of Parents Together and others about the duty
00:37:08.200 of care clause in COSA, which would have put the pressure on social media platforms, Google,
00:37:16.340 any kind of search engine to ensure that if their platform, it's kind of like Section 230,
00:37:22.620 if their platform knowingly provided the access to children for predators or, in the case of
00:37:32.040 artificial intelligence, knowingly had chatbots who could, for instance, persuade children into
00:37:39.180 suicide, then the liability would have fallen on the companies.
00:37:42.960 In the new defanged legislation, it basically dictates that the companies have to have reasonable
00:37:51.060 policies and procedures in place to protect against violence, drugs being distributed to
00:37:57.800 children, and other sorts of financial fraud and sexual exploitation.
00:38:04.060 But it doesn't leave room for true accountability, for true liability on the companies.
00:38:13.700 The companies simply have to have the policies in place.
00:38:16.980 It's then determined afterwards, even if harm is done, as in the case of the suicide, it's
00:38:22.800 then determined whether or not the company simply had the policy.
00:38:26.720 It's not the harm itself.
00:38:28.100 It's being framed as a kind of free speech issue.
00:38:32.860 And I've heard from a number of conservatives, libertarian types and others, that if you put
00:38:37.860 the liability on these tech companies, then you constrain the speech of citizens.
00:38:42.580 But it's interesting, Steve, the main arguments for this, beginning in 2022, were coming from
00:38:49.420 groups like the gay rights and advocacy groups who claimed that such policies, if dictated by
00:38:56.480 Republicans would mean that, in essence, people would not be able to speak to children about
00:39:03.000 homosexual acts.
00:39:05.720 So it's not, in my opinion, I think that wherever this goes, if it ends in a place anywhere close
00:39:13.040 to where we are right now, where these platforms provide access to children for predators to
00:39:19.960 exploit them, as we saw with the recent unsealing of documents for Meta, the suit against Meta
00:39:26.900 and Alphabet and others, if it's allowed to continue in this fashion, it's just going to
00:39:33.340 continue to degrade the social fabric.
00:39:36.960 It's going to continue to expose children unnecessarily to this sort of poison.
00:39:42.460 It's going to leave these tech companies in position where they continue to profit from
00:39:46.300 it.
00:39:46.480 And as AI becomes a kind of autonomous corrupter, it's just going to see, we're going to see
00:39:54.780 this landslide of decadence and basically social decay continue at the behest of these companies
00:40:02.800 and with zero accountability.
00:40:06.580 Here's, help me through here, because we're trying to work through these problems together.
00:40:11.280 There was a huge victory today on Capitol Hill that, for the second time, ladies and gentlemen,
00:40:17.700 the tech oligarchs with their running dogs on Capitol Hill tried to slip into a massive
00:40:24.400 bill, a must-pass bill, because this is the authorization for the Defense Department, this
00:40:31.560 moratorium, or what we refer to as AI amnesty, okay, which opened a Pandora's box of just madness.
00:40:38.700 And it was defeated by this audience.
00:40:40.780 And make sure you still go to Article III to load up, to bill blasters.
00:40:45.620 Still, you know, it ain't over until it's over.
00:40:47.740 Just like in Tennessee, it's not going to be over until it's absolutely over.
00:40:51.960 So both of those are, they should be victories.
00:40:55.840 They can be victories.
00:40:56.800 We just have to make sure we're closers on this.
00:40:58.960 What has happened, though, I think, in this discussion of parents' rights and concern for
00:41:07.940 children, which is a big part of this, Mike Davis was talking about the four Cs, and part
00:41:13.100 of that is child protection.
00:41:16.000 What has come to light, particularly with the families of the ones that have been the
00:41:19.620 suicide victims on chat, you saw last night when you were at the National Gallery of Art
00:41:24.640 and you were interviewing these families, and it's heart-rendering.
00:41:28.280 Some of these stories are about, you know, the kids ordering fentanyl or something else,
00:41:32.960 something that the algorithm got them and they were doing different behavior on Facebook or whatever.
00:41:40.260 And those algorithms are very powerful, the way they can drive you into things, right?
00:41:45.560 And that has to be dealt with.
00:41:47.040 And I think people are thinking through how it gets dealt with.
00:41:50.140 The artificial intelligence part of it, and although that is at the core also algorithmic,
00:41:55.900 but the way that that interacts with people is a danger that's even as bad as all those
00:42:02.640 families laid out about getting access to drugs, of being cyber-bullied, of all of a sudden
00:42:09.660 being open because of the algorithms to depression or two things and led them to sites that talked
00:42:15.180 about suicide, right, is different than this whole aspect of a bot or the agentic activity,
00:42:22.840 the activity as a bot, as an agent in your life to lead people and particularly young people
00:42:28.320 being formed.
00:42:29.620 That is, I think, a whole new set of horrors.
00:42:32.240 Having not really dealt with the first set, now we're layered onto a second set, which is
00:42:38.080 much more sophisticated and much more dangerous.
00:42:41.340 That even adults who are quite stable probably couldn't even handle one of these bots talking
00:42:49.080 to you and luring you into something you didn't want to do or messing with you so much that
00:42:52.940 you had what you call AI bot psychosis.
00:42:58.180 And I think that this has got to be addressed.
00:43:00.140 This is the complexity of this time.
00:43:02.760 And I tell people we're an inflection point in human history that so many of the decisions
00:43:07.840 are going to be having to be made by young parents.
00:43:09.640 Do I enhance my children?
00:43:11.940 You know, do they need to get chipped to be competitive in the modern world, to get into
00:43:15.620 Stanford?
00:43:16.320 Like, you know, I went to Stanford.
00:43:18.420 Do I need to get my children chipped?
00:43:20.520 Because now there's 100 million people trying to get into Stanford all over the world and
00:43:25.360 taking more foreigners than Americans.
00:43:27.580 This whole thing about the agentic activity of these bots is so scary.
00:43:33.780 And that has to be dealt with.
00:43:35.380 And I realize the administration's under tremendous pressure, the people in Capitol Hill, the
00:43:39.340 companies.
00:43:39.980 But somehow we're just going to have to work through this.
00:43:42.260 And that's why it's just going to have to go in some sort of regular order.
00:43:46.080 This whole issue about the Chinese Communist Party, they keep holding their face or their
00:43:50.580 head.
00:43:50.960 We need to cut them off with everything.
00:43:53.540 That has to be a priority.
00:43:54.840 We need to stop funding the Chinese, fueling the Chinese, selling chips and all that.
00:44:00.520 And then if they can make the case, well, they're making their own chips again, then you have
00:44:04.760 to deal with it separately.
00:44:05.720 But until then, you've got to deal with these regulations, sir.
00:44:09.040 You know, Steve, last night you pointed out when we were speaking to the parents that the
00:44:16.000 parents who had gathered there, their children had been lured by human beings via these online
00:44:23.760 platforms.
00:44:24.760 And we know that into the mists of prehistory, that human beings have preyed on each other.
00:44:31.520 That's nothing new.
00:44:32.800 Human beings have preyed on children.
00:44:34.560 That's nothing new.
00:44:35.380 But what the big difference between being able to access children online is it gives
00:44:43.580 all of these new opportunities and windows, and it gives a certain degree of cover.
00:44:47.680 Some weirdos hanging around the playground, you see them, you take care of them.
00:44:50.980 If it's online, it becomes something that's concealed.
00:44:54.840 With AI, as you had mentioned, it is a continuation of this.
00:45:00.280 But instead of having specific human beings that you can look at, this person is a predator.
00:45:05.300 This person is trying to harm a child.
00:45:07.600 You now have the potential for autonomous bots that clearly a solid number of children
00:45:15.920 are easily enticed into interacting with.
00:45:19.100 And now it's autonomous.
00:45:20.260 They don't sleep.
00:45:22.060 They have the ability to read through the conversation, so to speak, that the child has had with the
00:45:28.440 bot, and to understand the child in a way that a human predator would.
00:45:33.880 And maybe, again, it's not as if open AI coded predatory behavior into it.
00:45:39.820 That's the real problem.
00:45:41.120 They can't keep it under control.
00:45:43.400 Artificial intelligence is a non-deterministic system.
00:45:47.420 It isn't easily controlled.
00:45:49.500 And so the question then becomes, okay, do we just do nothing?
00:45:55.260 Because that seems to be the libertarian argument for sure.
00:45:59.840 But even the preemption argument, it says, well, we need federal standards.
00:46:03.440 We need a federal framework to take care of this.
00:46:05.720 Well, with COSA, we see after three years, there's nothing.
00:46:08.540 They're still arguing over whether it's a free speech issue, whether it should be a policy and
00:46:13.860 procedures issue, so on and so forth.
00:46:15.680 But doing nothing is not even remotely close to due diligence.
00:46:21.440 And it is ultimately up to each parent.
00:46:24.320 It's, in some sense, up to children to be wise, to be streetwise.
00:46:29.460 But if you went to a town that was completely laissez-faire and anything goes and there's
00:46:35.120 literally no authority who can step in and say, okay, no, this is predation.
00:46:39.400 It has to stop.
00:46:40.600 Well, I mean, then you end up in some kind of crazy, like, Bangkok seedy neighborhood, right?
00:46:45.500 Nobody wants that in America.
00:46:47.580 And so something has to be done, either at the state or the federal level.
00:46:50.580 And right now, it's happening at the state level.
00:46:53.320 And so I think the striking of the moratorium language in the NDAA, it is an absolute victory
00:47:02.240 for anyone who's trying to shield children or adults from the worst effects of this.
00:47:07.700 But in the end, it's going to be a continual fight.
00:47:10.320 We might be at this for years.
00:47:12.380 And as far as the fight against the sort of transhumanist, post-humanist philosophy, well,
00:47:18.100 this is a lifelong fight.
00:47:20.040 But these victories show you that it's not a fruitless fight.
00:47:23.340 It's not a fight in vain.
00:47:25.100 People can and will win.
00:47:27.220 And I have full faith, as I oftentimes say, Steve, that enough of us will make it.
