And I say this as somebody who's actually quite harsh on conservatives on the topic of pro-choice versus pro-life, because, look, there's a ton of women who, like me, when I was pro-choice, you grow up in high school and you learn that it's a clump of cells. They were just like, no, we absolutely have to be able to abort our children in the womb. They were celebrating that. And beyond that, what did they what did they run on?
00:02:48.160 What was the platform? It really was just abortion and black men needing to behave like black men because Obama came down. He I guess he left Martha's Vineyard and had to remind the brothers, the brothers about what you have to be doing. And the brothers just weren't here for it.
00:03:07.780 So, yes, it is true. Kamala has formally conceded the race about an hour ago. And I will say I thought that it was a well-written speech by whoever wrote that speech, because obviously it's some invisible speechwriter.

00:23:34.600 What's interesting here is that the DOJ is moving to end them even before he takes office,
00:23:39.880 citing the longstanding DOJ policy that sitting presidents can't be prosecuted.
00:23:45.880 And there was some thought that maybe special counsel Jack Smith was going to sprint through
00:23:49.760 the finish line, was going to work up until the last day, force Trump to fire him, wait
00:23:54.100 till a new attorney general was appointed.
00:23:55.960 But that does not appear to be the thinking inside the department.
00:23:59.120 The thinking is that these cases can't go forward.
00:24:01.880 There's no reasonable prospect of getting to trial within the three months before Donald Trump
00:24:07.240 takes office.
00:24:08.460 These cases are mired in legal issues that would be appealed all the way to the Supreme
00:24:12.460 Court had Donald Trump lost the election.
00:24:14.980 So now that he's won the election, DOJ officials are thinking that, look, there's just no room
00:24:20.060 to move in these cases.
00:24:21.460 And so the sensible thing to do is to figure out a way to wind them down.
00:24:26.620 And it may stem from Donald Trump's lawyers filing some kind of motion or making a request
00:24:31.820 saying in light of the DOJ policy, you need to drop these cases.
00:24:35.480 Now, there are a few wrinkles here.
00:24:36.700 One of which is that the classified documents case includes two other defendants who are
00:24:40.880 not subject to that policy.
00:24:42.140 And it's been dismissed, obviously, but that dismissal has been appealed.
00:24:45.600 And the DOJ considers that ruling to be very bad law.
00:24:48.720 They would like to be overturned.
00:24:50.100 So that appeal may continue in some form.
00:24:53.240 But the reality is that Donald Trump is not going to be a part of these cases.
00:24:56.920 And what this means, I mean, we knew this, right?
00:24:59.520 But just coming to grips with what this means intellectually is that Donald Trump is not likely to be held
00:25:05.280 accountable on these very serious federal criminal charges that many people believe were worse than
00:25:10.960 what Richard Nixon did or was accused of doing in Watergate.
00:25:14.340 Now, there's no guarantee that Trump would have been convicted at trial.
00:25:17.100 But as Joyce Vance, our legal commentator, said to me this morning, what's not going to happen is he's not
00:25:22.640 going to face a jury of his peers who would evaluate the evidence and render a verdict?
00:25:29.140 Yeah.
00:25:29.540 You see, this is why I'm not feeling like Trump should be magnanimous.
00:25:32.480 And I think that was almost the problem is like he got into office last time and he was sort of like,
00:25:35.940 I'm just going to let it all go.
00:25:36.820 Like first, when he was running, he was like, lock her up.
00:25:38.400 And then he was like, I'm going to let it all go.
00:25:39.840 And then what they did when they got power is they let nothing go and they went after him for four years.
