00:00:43.740 So now she is standing in the other deposition.
00:00:49.280 She was sitting down breastfeeding. This is quite interesting.
00:00:52.540 Yeah, we Flossom Talk.
00:00:57.360 Hi and welcome to Flossom Talk. I'm Jashti Flore, journalist, Hollywood truth teller, and your voice of reason in a town built on delusion.
00:01:05.160 Happy Friday, everyone. I am wearing my florals, or one big flower actually, today.
00:01:11.780 I felt like wearing something bright, and tomorrow is Valentine's Day, and I guess this is kind of a Valentine's Day color.
00:01:18.900 Anyways, there's a lot going on.
00:01:21.000 As you know, this week there was a settlement meeting, and the two parties did not come up with any resolution.
00:01:27.440 No settlement was agreed on, and yesterday Justin Baldoni and the other parties were back in court to discuss another settlement between his publicists, Stephanie Jones and Jennifer Abel.
00:01:38.020 There are so many parallel lawsuits here.
00:01:39.920 It's really confusing for a lot of people if you haven't followed this case really closely.
00:01:44.340 Anyways, it didn't look like they came out with any solutions yesterday either, but a lot of media outlets have been reporting on this, obviously.
00:01:51.440 And yesterday there was a funny story in the New York Post pointing out how entitled Blake Lively was and how bored she allegedly was while she was in the settlement meeting.
00:02:02.160 You got to hear this.
00:02:03.720 Also, I wanted to go through some more of the evidence that was unsealed.
00:02:08.580 There's some really fascinating stuff here that's coming out from Justin Baldoni's side.
00:02:13.580 First of all, there is a TikTok video that he attached as his evidence against Blake, showing a woman, warning everyone to talk bad about Blake Lively, saying that news will soon come out that all the women in this movie, it ends with us, were all victims.
00:02:34.820 Also, we have to talk about this trailer incident.
00:02:37.660 When Blake Lively accused Jamie Heese of walking into her trailer when she was barely dressed and accusing him of looking at her.
00:02:48.500 So now we have four different depositions and four very different stories here.
00:02:55.940 You got to hear this.
00:02:57.140 I will read from all of these depositions for you so you can see how none of this really adds up.
00:03:02.900 And it was funny this morning, I was doing my daily research online to see what the media was saying about this case.
00:03:09.380 And I saw this story in Marie Claire saying the reason Ryan Reynolds was absent from Blake Lively and Justin Baldoni's settlement hearing.
00:03:16.980 And I was like, oh, this is interesting.
00:03:19.040 Let's see what they have to say here.
00:03:20.620 And I was scrolling down and I was like, oh, that's me.
00:03:24.520 So that was quite funny.
00:03:27.140 They were just quoting me in their article.
00:03:29.640 So I went to their sites to get information about this case.
00:03:33.720 And then I found my own information there, which was quite funny.
00:03:36.740 So they're basically quoting me and they added my Instagram reel as well and used to save maternity as I had in my episode as their source.
00:03:44.520 Anyways, I was glad to see that Marie Claire did a balanced reporting here.
00:03:48.740 So let's look into this New York Post article from yesterday saying that Blake Lively had her chauffeur bring her Mahongset to court.
00:03:57.900 So apparently, according to New York Post, she was bored and probably texted her chauffeur saying, hey, bring me my Mahongset.
00:04:07.320 She's been promoting this game for a long time on her social media.
00:04:11.840 She's been talking about it on Instagram as well.
00:04:14.940 And apparently, I guess she's a big fan.
00:04:17.360 But this is how New York Post is reporting on it, saying, talk about feeling entitled.
00:04:23.740 Blake Lively had her chauffeur fetch her prize in Mahongset and bring it to her in court on Wednesday.
00:04:30.340 Well, anyway, it says here that by 11 a.m.
00:04:32.940 And we hear that Lively, likely doing some waiting while a judge went back and forth between her team and Baldoni's,
00:04:39.040 had grown wary of the wheels of justice turning slowly and called for her diversions.
00:04:48.240 We told her driver showed up at the door of the Daniel Patrick Mannion courthouse with the centuries-old Chinese tile game in hand.
00:04:58.800 I didn't know you could actually play that by yourself, or maybe she was playing it with some of her assistants or whoever was there with her.
00:05:05.700 But anyways, it's funny to me that they actually reported on that and they're calling her entitled.
00:05:10.300 I showed a video yesterday from Blake arriving at court.
00:05:14.040 And as I said then, it's interesting how even traditional media is reporting on this.
00:05:18.260 They are pointing out how much her designer, a Chanel designer bag costs and how much her Louboutin boots costs.
00:05:27.280 If she was a real victim, would they really do that?
00:05:30.440 Would you point out the value of what she's wearing?
00:05:33.960 I don't think so.
00:05:35.260 And as contrast to these other victims that we hear about now in the e-files,
00:05:40.160 why would you wear all these very recognizable designer items to court?
00:05:45.360 It's just kind of tone deaf, I think.
00:05:47.300 I don't know, let me know what you think about that.
00:05:49.500 Anyways, let's go get to this TikTok video, which when the first time I saw it, I was like,
00:05:54.340 oh, I think I've seen something similar like this.
00:05:57.620 But this specific video is something that Justin Baldoni added as his evidence.
00:06:03.760 So this woman is trying to warn other content creators or other people in general to talk badly about Blake.
00:06:10.800 Hi guys, I, um, there's something happening behind the scenes that I can't talk about because there's investigations happening.
00:06:19.220 All I can say is that the women of this movie are victims.
00:06:23.840 That's all I can say.
00:06:28.160 There's a reason.
00:06:29.360 It's been keeping, being kept quiet.
00:06:31.300 And I can't talk about it.
00:06:32.960 There is actual investigations happening.
00:06:35.380 Um, I am submitting things.
00:06:37.560 And, um, if you know of anything, please DM me, um, reach out.
00:06:42.920 I, I want as much information as possible to hand over.
00:06:48.020 Um, this was, this was not what I intended.
00:06:51.860 And everything that you think is happening, it's the opposite.
00:06:55.860 And I'm, I'm kind of shook.
00:06:57.920 And I honestly am in way over my head.
00:07:01.180 I'm working with other people now because it is way bigger story than you'd ever think.
00:07:05.560 Yes.
00:07:06.160 Who leaked this false information to this content creator?
00:07:11.300 I don't know.
00:07:12.520 There's a lot of misinformation out there right now.
00:07:15.660 The big narrative for all the Blake Lively supporters are that there were nine women involved
00:07:22.040 and that all these nine women were victims of Justin Baldoni and Jamie Heath.
00:07:28.140 Amongst these women are, for example, Leslie Sloan, Blake Lively's publicist.
00:07:34.560 And Claire Ayub, this woman who had nothing to do with this production as well.
00:07:38.580 The only people on that list of these nine women that actually felt uncomfortable in a
00:07:45.060 situation are Blake and Jenny.
00:07:49.640 I don't count Isabella Ferrer because she changed her story so much that I don't think
00:07:54.560 she's a very reliable witness because she was so excited to work with Justin at first
00:07:58.940 until Blake got to her.
00:08:01.000 So where are all these false narratives coming from?
00:08:04.600 Who's feeding this information to these content creators?
00:08:08.220 As I said so many times, we've seen the text messages that Leslie Sloan sent to journalists.
00:08:14.020 And that's why it would not surprise me for a second if they use the same tactics to get
00:08:21.560 to content creators.
00:08:23.260 It's so funny, again, how this shows that everything they're accusing just enough are
00:08:28.580 things that they did themselves.
00:08:30.660 I remember Andy over at Popcorn Planet had a content creator on and she talked about how
00:08:36.880 she was contacted with the same information from someone saying, you know, some really bad
00:08:43.600 stuff is about to come out about Justin and Jamie.
00:08:47.180 So you should remove all the content that you created criticizing Blake because you don't
00:08:52.480 know the first about this story.
00:08:54.340 Anyways, let's look into this trailer incident again because I was reading all these depositions.
00:09:00.140 We have four of them now telling very different stories of what happened that day.
00:09:04.920 So now we have Alex Sachs, one of the producers of the movie, who's been kind of supporting
00:09:11.460 Blake.
00:09:12.180 But then at the same time, we see text messages where she's explaining how horrible Blake is
00:09:16.980 to work with.
00:09:17.780 We also have Blake's makeup artist, Vivian Baker's deposition.
00:09:22.920 She was present in the trailer when they're saying that Jamie came into the trailer when
00:09:28.380 Blake was undressed.
00:09:29.500 And we have the hairstylist, Shelley Ann Carroll, with her version of these events.
00:09:37.800 We also have Jamie Heath's own version of what he said happened in this trailer.
00:09:44.480 I don't know where the truth lies here.
00:09:46.060 I'm not saying that Jamie Heath is the only person who tells the truth there, but it's
00:09:49.900 fascinating to me that everyone remembers this so differently.
00:09:54.160 Another important thing we need to keep in mind here is that both Vivian Baker and Shelley
00:09:59.360 Ann Carroll are friends with Blake.
00:10:03.900 They've been working with Blake for years.
00:10:07.040 She keeps hiring the same people on her projects.
00:10:11.360 And I remember even Blake reposting their birthday wishes to her last year in August when
00:10:18.160 she turned 38.
00:10:19.540 So they have a very close relationship.
00:10:21.900 So it wasn't any surprise to me that they would support Blake's version.
00:10:26.400 But one of the things that I reacted to here is that if you experience something that makes
00:10:32.400 you or people around you feel really uncomfortable, you tend to remember a little bit more about
00:10:39.020 what actually happened and where people were positioned when things happened.
00:10:43.380 It's not that many years ago.
00:10:45.060 I think it's two and a half years ago, maybe three years ago now.
00:10:48.060 So to me, I find it a bit strange that the people that were inside of this trailer remember
00:10:52.820 things so differently.
00:10:54.660 Another thing that I noticed from these depositions before I read them for you that I wanted to
00:11:01.700 point out is that none of these women are actually looking at this incident as S.H.
00:11:09.840 They are just saying that it was awkward or uncomfortable, but they're not saying that
00:11:16.900 this was harassment in any way.
00:11:19.180 They're not using those words.
00:11:21.140 And that's important because Blake needs to use this as evidence that she was S.H.ed on
00:11:27.060 the set of It Ends With Us.
00:11:28.340 Also, as you'll hear, some people say that Blake was breastfeeding when he arrived.
00:11:32.640 Some people said she wasn't.
00:11:34.380 One said that she was sitting down.
00:11:36.360 Another one said she was standing up.
00:11:38.080 But if she was breastfeeding, I don't know how open she is about breastfeeding her child
00:11:43.480 or pumping, but it seemed like she was one of those people who felt comfortable doing
00:11:49.860 that in front of others.
00:11:51.560 We remember the response she had to Justin Baldoni when he asked her if they should do
00:11:56.560 a rehearsal and she said, yes, you can come to my trailer.
00:12:00.460 I'm just pumping.
00:12:02.100 Funny thing how that text message also, by the way, is twisted by the Blake Lively supporters.
00:12:07.040 I found this thread on Reddit the other day that made me laugh so hard.
00:12:10.940 So they're now claiming that the reason she said that you can come to my trailer, I'm just
00:12:16.260 pumping, is because she had two trailers and one trailer was only for working out with
00:12:23.080 her trainer.
00:12:24.780 And by pumping, she meant pumping muscles.
00:12:27.720 I mean, it's funny how they come up with all these excuses for her.
00:12:34.280 And if that crazy theory would in any way be near the truth, Blake Lively would have said
00:12:40.320 that herself.
00:12:41.280 That would have come out by now.
00:12:43.300 OK, so let's hear how these stories are not adding up.
00:12:46.080 But before we get into that, I wanted to thank the two sponsors of this video, Green Chef

00:14:13.460 Okay, and also a big thank you to Honey Love for sponsoring this video.
00:14:17.540 I've talked about this brand so many times before because I'm so amazed by the quality
00:14:21.720 and the comfort of this brand.
00:14:23.680 I did mention in another video that they totally saved me at the Critics' Choice Award this year
00:14:28.420 when I was wearing this underneath my dress.
00:14:31.920 And it kept everything perfectly in place throughout the entire show.
00:14:36.740 And it's soft, it's breathable, and I could breathe in it.
00:14:42.360 Nothing rolling up or rolling down, and it feels luxurious as well.
00:14:48.100 I also love their bras.
00:14:49.620 These are so elegant, and I washed it probably like 50 times, and it still looks exactly the
00:14:54.800 same.
00:14:55.300 It's so soft.
00:14:56.180 I use it under regular t-shirts, under regular shirts, and I also use it when I go hiking
00:15:01.820 or when I work out.
00:15:03.620 And I do love this lining, which is quite sexy.
00:15:06.440 Don't tell Blake I said that if you're wearing something a little lower cut.
00:15:09.860 But the best part is that they don't dig anywhere.
00:15:13.560 No red lines and no pressure points.

00:15:53.280 Experience the new standard of support and comfort with honeylove.
00:15:57.760 Okay, so let's get into these juicy depositions.
00:16:00.860 So let's look first at how Alex Sacks, the producer, explained what happened in the trailer.
00:16:09.420 So Blake's attorney is asking Alex here,
00:16:12.200 Do you recall Miss Lively sharing with you that Mr. Heath had barged into her trailer while she was undressed?
00:16:20.860 I don't recall, she says.
00:16:23.380 Do you recall Miss Lively sharing whether she had clothes on at the time?
00:16:28.020 I don't recall.
00:16:29.240 But if I'm saying she was getting body makeup done, then she didn't have clothes on.
00:16:35.040 And to you who are understanding, when Miss Lively was getting body makeup done or removed,
00:16:39.320 was she generally topless?
00:16:41.220 It's interesting because from all of these depositions, it hasn't really been clear yet if she was getting makeup done or removed.
00:16:49.580 And she's asked here, do you have a recollection of Miss Lively specifically sharing that she was in some state of undress at the time Mr. Heath came into her trailer uninvited?
00:16:59.500 I don't remember, outside of reading this.
00:17:03.180 So she was there and this incident, according, as you'll hear soon, according to Blake Lively's makeup artist and hair person,
00:17:11.980 they were yelling, don't come in, whoa, whoa, whoa, at the door.
00:17:16.640 And they're saying that he entered anyway.
00:17:19.180 Alex Sacks was standing outside when this allegedly happened.
00:17:22.520 Then they're asking, do you have an understanding why Miss Lively would say, you can come in, but don't look, if she was wearing clothes at the time?
00:17:30.720 Alex says, likely because she knew the conversation was important and she was professional and probably wanted to discuss whatever needed to be discussed.
00:17:39.300 Did Miss Lively share with you that when Mr. Heath attempted to enter her trailer, she and her team yelled, no, no, no, don't come in?
00:17:46.540 I don't remember.
00:17:47.800 I mean, if you're outside a trailer and someone yells, don't come in, I think you remember that.
00:17:53.600 I don't know.
00:17:54.460 And then they're saying, do you recall Miss Lively sharing that Mr. Heath had insisted on having a meeting with her when he entered her trailer?
00:18:02.180 I don't remember.
00:18:03.420 Alex don't remember much at all.
00:18:06.120 I feel like some of these people have very selective memories.
00:18:10.000 And she's asked, do you recall Miss Lively conveying that she was uncomfortable with Mr. Heath looking at her while she was getting her makeup undone?
00:18:17.800 Done or done?
00:18:19.000 I don't remember.
00:18:21.360 Miss Giannetti responded to your text with regards to Mr. Heath entering Blake's trailer and said, not good.
00:18:27.780 You responded, nope.
00:18:29.900 Lawyer is asking, and was it your understanding that Miss Lively was uncomfortable with that?
00:18:35.640 She says, that's what I perceived.
00:18:38.100 So it seems like she's just been told this story secondhand by someone from Blake's team here,
00:18:43.220 because she doesn't remember anything else surrounding this episode when she was actually there.
00:18:48.120 Did Miss Lively recount this story to you in a way you perceived in a specific way that made you perceive she was uncomfortable?
00:18:56.900 And she says, not that I can recall.
00:19:00.340 So she doesn't recall Blake talking about this incident at all, and it made her uncomfortable.
00:19:05.340 But then she just said that she perceived it as she felt uncomfortable.
00:19:10.800 I don't know.
00:19:11.520 This is so messy.
00:19:12.840 Then she's asked, what was your reaction to hearing that Mr. Heath had entered Miss Lively's trailer,
00:19:17.360 uninvited, and looked at her while she was getting her makeup done, body makeup done?
00:19:22.440 And she says, I would imagine, I don't recall exactly, but I would imagine uncomfortable like I am reading it now.
00:19:29.180 You're uncomfortable even reading it, this attorney is saying.
00:19:33.380 And she says, yes.
00:19:34.560 Why?
00:19:35.160 Because I don't like that it happened.
00:19:37.080 Why not?
00:19:37.660 Because it's not appropriate for a workplace.
00:19:40.620 Okay, so that was the producer of the movie and her version of the story.
00:19:45.220 She doesn't recall or remember anything.
00:19:47.860 As I said before, Alex Sacks is one of the people on this set that accused Justin of having anger issues,
00:19:55.040 because once he was upset when she said that they got the scene and he said, I need to do another shoot.
00:20:02.100 And then he slammed his hand on a chair next to her or something like that.
00:20:06.700 And she claims that he was aggressive because of that incident.
00:20:09.380 But anyways, here is Vivian Baker, who is Blake Lively's makeup artist.
00:20:15.820 So she's asked here by the attorney asking,
00:20:17.620 do you recall whether there was an instance when Mr. Heath entered Miss Lively's hearing makeup trailer without invitation?
00:20:24.040 And she says, yes, there was a time that he came to enter and we all, there were myself and Anne.
00:20:30.460 And Blake was like, no, I'm not dressed.
00:20:33.040 No, no, no, don't come in.
00:20:35.400 The attorney says, and I would like to discuss this situation in a little bit more detail.
00:20:40.380 Aha, she says.
00:20:41.620 So from your recollection, did Miss Lively say Mr. Heath is coming over to discuss something?
00:20:48.360 No.
00:20:49.420 And do you recall whether there was a knock on the door by Mr. Heath?
00:20:52.760 You know, my memory is vague.
00:20:55.160 Everyone's memory is so vague here.
00:20:56.960 I think there was a knock.
00:20:59.000 What I remember more specifically is all three of us.
00:21:02.720 So there must have been a knock saying, no, don't come in.
00:21:06.240 And no, don't come in.
00:21:07.900 It was quite loud so that they wouldn't come in.
00:21:11.380 It was myself and Anne Blake saying it at the same time.
00:21:15.700 Miss Lively, and then he's asking Miss Lively herself and Miss Carol all heard a knock
00:21:20.340 and said loudly, don't come into the trailer.
00:21:23.680 And she says, mouthing many times.
00:21:25.860 Yeah, no, no, no, not now.
00:21:28.260 We're not, you know, like each person participated in the, you know, don't come in.
00:21:34.360 And at that point in time, did you know who was at the door?
00:21:38.300 No.
00:21:39.080 And what happened next?
00:21:40.460 They came in.
00:21:41.760 So now, apparently here, several people came in.
00:21:46.060 She's saying they.
00:21:48.000 And then the attorney is asking, okay, and was Miss Lively, can you describe for me, set
00:21:54.040 the scene for me?
00:21:54.940 Where were you?
00:21:55.920 Where was Miss Lively at the time?
00:21:59.180 Miss Lively had come in and removed her clothes and they were handed out the door to costume
00:22:04.640 or someone there that they could take the costume.
00:22:07.280 And I believe she was only in underwear.
00:22:09.580 She doesn't even remember that.
00:22:11.760 And she sat down in the chair and she had the baby.
00:22:15.940 The baby was given to her.
00:22:17.940 And I thought, I think, I'm pretty sure the assistant had left and we began to do our work.
00:22:24.200 And then the knock came on the door and we would say, no, no, no, don't come in.
00:22:29.920 So she was quite scantily clad because we just removed her costume and we were going to clean
00:22:35.560 her up.
00:22:36.380 So there wasn't a state.
00:22:37.840 I mean, I think we are, we were, as, as I said, we are always very cognizant of how
00:22:44.000 much, you know, get people off the clock so that they can get a turnaround.
00:22:47.160 So we were just busily working.
00:22:49.380 So I would have been to the right, but facing her.
00:22:51.700 And I believe Anne would have been to her left facing at her.
00:22:55.320 He's asking, okay.
00:22:56.200 And so at this point in time, Ms. Lively is wearing underwear, but no other clothing.
00:23:01.220 That's correct.
00:23:02.280 Okay.
00:23:02.640 And so her breasts were exposed.
00:23:04.680 Absolutely.
00:23:05.880 And was where, where was Ms. Lively facing?
00:23:09.220 And was she facing the door?
00:23:10.900 Was she facing a mirror or somewhere else?
00:23:13.260 She was facing the mirror.
00:23:15.600 And okay.
00:23:16.520 And what?
00:23:16.900 Was she standing?
00:23:18.680 No, she was seated.
00:23:20.680 She was seated.
00:23:21.660 Okay.
00:23:22.040 At this point in time, did you have an understanding of who entered the trailer?
00:23:27.420 And she says, after they opened the door, we all saw that it was Jamie and there was,
00:23:33.160 and Blake said, I don't remember exactly what he said, but I remember her saying, I'll talk
00:23:38.440 to you about this later.
00:23:39.460 Like, let me go ahead and move on.
00:23:41.260 I'll get dressed.
00:23:42.120 We'll talk about it later.
00:23:43.380 And I think he said something to the tune of, no, we'll do it now.
00:23:47.560 And I have small towels, like, you know, a little small towel that I think that I finally
00:23:51.780 just threw over the other breast because he didn't leave the room.
00:23:55.460 So that means if she was breastfeeding on one and she had a towel over the other one,
00:24:00.300 she didn't have any exposed breast, I'm guessing.
00:24:03.980 And was Ms. Lively holding her baby at this point?
00:24:07.900 Yes, she was breastfeeding, I believe, at her right breast.
00:24:12.260 So she was breastfeeding at her right breast and she had a towel over the other one.
00:24:17.200 And so was Ms. Lively's left breast exposed?
00:24:20.980 Yes, she says.
00:24:22.260 But she just said she put a towel over it.
00:24:24.460 And did she turn around to speak to Mr. Heath when he entered?
00:24:27.420 No, it was done through the mirror.
00:24:29.740 So at this point in time, had Mr. Heath been asked to leave?
00:24:33.160 Of course.
00:24:34.580 He was asked to not even come in and then asked to go.
00:24:37.820 Like, once you enter into the room and you see that, oh, this is an inappropriate time to be there,
00:24:42.920 you would naturally leave.
00:24:44.620 Did Mr. Heath leave?
00:24:45.980 No.
00:24:46.760 What happened after Mr. Heath did not leave the trailer?
00:24:49.500 I think that they had their whatever their discussion was.
00:24:52.220 I don't remember the words.
00:24:53.520 I became very focused on getting my job done to get her out as quickly as possible.
00:24:57.640 So she was more focused on getting her job done than protecting Blake from this very uncomfortable moment.
00:25:02.940 And apparently, okay, do you have a recollection of where Mr. Heath was standing for this conversation?
00:25:08.240 He was standing at the door with the door still mildly open.
00:25:11.560 So the door was probably maybe a foot and he would be obstructing that opening.
00:25:16.320 So when she's saying that, I find it weird that since the door was kind of open the entire time,
00:25:21.940 that all the other people didn't hear what was going on in there, including Alex Sachs,
00:25:26.320 who don't recall or remember anything about this.
00:25:29.760 But nonetheless, the door was open, she's saying.
00:25:32.460 He didn't come into the room to close the door.
00:25:36.240 He was still in the doorway.
00:25:38.480 So now he's just standing in the doorway, talking through the doorway to her.
00:25:42.800 And the door remained ajar for the entirety of the discussion?
00:25:48.380 That's correct, she says.
00:25:49.880 Okay, and did Ms. Lively ask Mr. Heath to face any given direction during the course of their conversation?
00:25:55.800 I don't know that I recall that, she says.
00:25:58.680 It was an uncomfortable situation and I focused on what I needed to do to help to get her in a state that she can leave, finish up my job.
00:26:06.320 And then she's asked, do you recall that what direction he was facing?
00:26:09.460 And she says, no, I was aware he was facing.
00:26:12.320 The door opens out.
00:26:13.920 So the door would be partly behind him and he would be able to look at her through the mirror.
00:26:19.700 And do you recall whether Mr. Heath in fact looked at Ms. Lively through the mirror?
00:26:24.700 Yes, she says.
00:26:25.840 I remember him engaging in a conversation, the conversation he wanted to have in that manner.
00:26:30.940 Okay, could Mr. Heath see Ms. Lively topless if he looked in the mirror?
00:26:35.900 Yes, she says.
00:26:36.940 But then she just said that she had her baby over her one breast and a towel over the other one.
00:26:41.640 Anyways, and it's your testimony that Mr. Heath was in fact looking in the mirror.
00:26:46.320 He was looking in the mirror, she says.
00:26:49.060 And then she's asked, did Ms. Lively seem upset with this interaction?
00:26:52.340 And she says, at the moment that it was happening, I was aware that it was felt like a violation.
00:26:58.320 But, you know, I think that we and myself and Ms. Lively were like, we just, it was just being handled.
00:27:04.540 You know what I mean?
00:27:05.340 Like we were, let's, let's get this, there was no reaction, so to speak of, you know, no reaction.
00:27:12.720 It was just like, let's get this handle so we can get out of this uncomfortable situation
00:27:18.180 is what my memory recall is we did.
00:27:22.900 And then she's asked, and do you recall after the fact discussing the encounter with Ms. Lively or Ms. Carroll?
00:27:28.560 After he left, wasn't much of a discussion, but it was certainly, you know, eyes open and mouth dropped.
00:27:35.940 I think I said, I've never seen anyone do that before.
00:27:39.060 Anne may have agreed with me.
00:27:41.480 I think that we were all really just in a state of shock.
00:27:44.680 We just finished our work and let Blake get out of there.
00:27:47.220 But there was not a discussion per se.
00:27:50.120 So they didn't really talk about it after it happened.
00:27:53.320 They were just like, and then they didn't talk more about it.
00:27:57.000 Okay, so let's hear what the hair person is saying here.
00:28:00.180 Shelly Ann Carroll.
00:28:02.200 She's, I think she goes by Anne, so I'm just going to call her Anne as well.
00:28:06.280 So she's asked here, can you describe for me what you recall about the occasion on which
00:28:10.560 Mr. Heath arrived to Ms. Lively's hair and makeup trailer?
00:28:13.780 And then she's describing the situation here.
00:28:15.620 She says, we, Blake, was having body makeup done in the trailer by Vivian.
00:28:21.300 Now she's getting body makeup done and not undone, by the way.
00:28:25.760 I don't know, just the detail.
00:28:27.900 We heard the door open and looked and went, whoa, whoa, whoa.
00:28:32.200 So at this point when she's telling the story, no one even knocked at the door.
00:28:36.400 They just opened it.
00:28:37.660 And it was Jamie at the door.
00:28:40.000 I had grabbed a cutting cape, which was over my chair, and held it up to try and cover her.
00:28:46.160 So she was holding up the cape, trying to cover Blake.
00:28:49.400 And at the same time, her makeup artist threw a towel over her other breasts while she was
00:28:55.780 breastfeeding.
00:28:56.420 And she said, Blake said, whoa, whoa, whoa.
00:28:59.300 I'm, you know, don't come in.
00:29:00.660 And he said, it will only take a second.
00:29:03.120 And that's when all of that action was happening.
00:29:05.580 He stayed in the trailer.
00:29:07.740 They had a discussion and he left.
00:29:10.460 And she's asked, and then she's asked, did you, did Mr. Heath abide by the protocol of
00:29:14.920 knocking on the door that you described earlier today?
00:29:18.800 No.
00:29:19.820 So definitely no knocking on the door here.
00:29:23.520 Did Mr. Heath ask for permission to open the door into Ms. Lively's private hair and
00:29:27.740 makeup trailer?
00:29:28.740 No.
00:29:29.680 You stated that you, Ms. Lively and Ms. Baker verbally indicated something to the effect
00:29:35.320 of, whoa, whoa, whoa, when Mr. Heath was opening the door.
00:29:38.780 Is that right?
00:29:39.420 Yes.
00:29:40.140 And did you, Ms. Lively, Mr. Baker, give a loud verbal indication that the trailer was
00:29:45.100 occupied at the point in time?
00:29:47.660 I believe we were speaking loudly, she said.
00:29:50.700 If they were speaking so loudly, I find it hard to believe that Alex Zacks didn't hear
00:29:55.560 that outside.
00:29:57.220 So you had an understanding that Mr. Heath heard you when you said something to the effect
00:30:01.560 of, whoa, whoa, whoa.
00:30:02.980 Yes.
00:30:03.780 And did Mr. Heath nevertheless open the door to the hair and makeup trailer?
00:30:07.500 Yes.
00:30:08.380 Now, at this point in time, where was Ms. Lively situated in the hair and makeup trailer?
00:30:13.280 She was towards the far right of the trailer, standing.
00:30:18.540 So now she is standing in the other deposition.
00:30:23.480 She was sitting down breastfeeding.
00:30:25.700 This is quite interesting.
00:30:27.240 And it continues.
00:30:28.120 And which direction was Ms. Lively facing when she was standing in the trailer?
00:30:32.500 I don't recall, she says.
00:30:33.920 Do you recall what Ms. Lively was wearing at the time?
00:30:37.760 Either nothing or a nude thong.
00:30:40.360 I think it's weird that you don't remember if someone is completely nude or if they're
00:30:44.520 actually wearing a thong.
00:30:45.780 And why would she be completely nude, by the way?
00:30:47.960 Anyways, Ms. Lively's breasts were exposed in that moment.
00:30:51.780 Yes.
00:30:52.900 And Ms. Lively was generally undressed and unclosed.
00:30:55.660 Yes.
00:30:56.580 And was that one of the reasons why you and Ms. Carol and Ms. Lively indicated that Mr.
00:31:00.780 Heath should not enter the trailer?
00:31:02.800 Yes.
00:31:03.140 So they're repeating here, Mr. Heath walked into Ms. Lively's hair and makeup trailer while
00:31:07.940 she was unclosed without knocking, without permission, correct?
00:31:11.660 Yes.
00:31:12.440 And that was after you and others loudly tried to stop Mr. Heath from entering the trailer?
00:31:17.740 Yes.
00:31:18.780 Did you say, don't come in?
00:31:20.380 And she says, yeah, I don't remember saying don't come in, but we were like, whoa, whoa,
00:31:24.260 whoa, just a minute, warning him.
00:31:27.260 And at that point, Mr. Heath stayed.
00:31:29.820 Is that right?
00:31:30.700 Yes.
00:31:31.060 And where was Mr. Heath standing for the remaining of this time in the trailer?
00:31:36.660 I'm not completely.
00:31:37.840 My back was to him, so he was behind me.
00:31:41.440 And was your back to Mr. Heath because you were standing with a cloth to cover Ms. Lively
00:31:46.620 for modesty?
00:31:47.740 So for some reason, they cut off her answer there, but then they keep asking about if
00:31:52.180 he took, if he could actually see her breasts from where he was standing.
00:31:56.040 And they're asking, given your understanding of where Ms. Lively and Mr. Heath were in
00:31:59.820 the trailer, if Mr. Heath had looked into the mirror, would he have seen Ms. Lively's
00:32:03.860 breast exposed?
00:32:05.260 You can see the room when you look.
00:32:06.900 You can see into different parts of the room through reflection.
00:32:11.100 Yes, she says.
00:32:12.300 And she's asked how it made them feel.
00:32:14.260 And she says, uncomfortable.
00:32:15.240 It was strange.
00:32:16.760 You found the interaction between Mr. Heath and Ms. Lively uncomfortable and strange.
00:32:20.200 I felt uncomfortable and strange.
00:32:23.140 Again, no harassment here.
00:32:25.340 No SH.
00:32:26.360 It's just strange and uncomfortable.
00:32:29.700 And why did you feel uncomfortable when he went into the trailer?
00:32:33.060 I guess because we had warned him, you know, he was in a state where nobody else should have
00:32:37.240 seen her in that way.
00:32:38.580 And he stayed.
00:32:39.740 So it was a strange interaction.
00:32:42.640 OK, so let's see what Jamie Heath had to say about what happened in the trailer that day.
00:32:50.200 So he's asked here, was there an incident in which you were in Ms. Lively's makeup trailer
00:32:54.440 along with Ms. Carol and Ms. Baker when she was in a state of undress?
00:32:58.960 And he says, I don't know that she was in a state of undress.
00:33:02.780 Do you have a specific memory of the incident that Ms. Carol and Ms. Baker and Ms. Lively
00:33:07.020 described?
00:33:08.120 I do, he says.
00:33:09.200 OK, and what is your memory of the incident?
00:33:11.120 So the four of us, Justin, myself, Ange Giannetti, oh, Ange was also there, and Alex Sacks
00:33:17.420 all went to her makeup trailer, the four of us.
00:33:20.040 I knocked, heard some sort of come in, or yes, or some indication that led me to believe
00:33:25.840 it was OK to open the door.
00:33:27.840 So the opposite of what the three witnesses said, this attorney is asking, and he said,
00:33:33.520 you asked me what?
00:33:35.320 You asked me what?
00:33:36.820 And the attorney says, I just want to make sure I understand you.
00:33:40.460 They say, they all said, they said no, and you heard yes.
00:33:45.040 Is that right?
00:33:46.080 And then they're talking between the lawyers there, and he's continued to talk, and he's
00:33:49.820 continued to tell his version.
00:33:51.220 He says, so I then knocked, to be clear, with Justin and Ange and Alex with me at the
00:33:55.980 bottom of her steps.
00:33:57.000 I knocked on the door, heard some indication to come in.
00:34:01.080 As I took a step up, I saw that she was leaned back.
00:34:04.320 She looked what I thought was either maybe breastfeeding or nursing.
00:34:07.980 I said to her, oh, it looks like you're busy.
00:34:11.000 I can come back.
00:34:12.140 As I turned around, she says, no, that's OK.
00:34:14.400 You can come in.
00:34:15.140 Just look away.
00:34:16.260 And I said, sure.
00:34:18.280 Very different story from Jamie here.
00:34:20.700 I don't know where the truth lays here.
00:34:22.360 I'm just giving you the facts, and it's up to you to figure out who you trust, what version
00:34:27.220 you think is trustworthy.
00:34:29.340 Anyways, he continues to say, now I never saw the front of her.
00:34:33.020 I just saw this which appeared to me a familiar position of her feeding or nursing or pumping.
00:34:37.980 So then I walked over to the side, looked away.
00:34:40.880 We had a two-minute conversation, could have been three, about whether or not we were going
00:34:44.940 to have the meeting that night or the next day.
00:34:47.280 I was trying to negotiate with her.
00:34:49.000 Could we do it tomorrow?
00:34:50.000 Because I was worried about the turnaround time, and we would lose money, which is an
00:34:54.440 implication.
00:34:55.160 We would lose hours in the next day, which is an implication of money.
00:34:58.980 We had a conversation back and forth.
00:35:00.420 She eventually said no.
00:35:01.440 She had to have it tonight, and she would not waive any sort of turnaround time and do
00:35:07.080 it off record.
00:35:08.080 So I then left, walked down the stairs out of the makeup trailer where Ange, Justin, and
00:35:12.260 Alex were.
00:35:13.140 Reported to them, she wants to do it tonight.
00:35:15.160 I tried to convince her to do it tomorrow, but she wants to do it tonight.
00:35:18.700 She walked out four or five minutes later, greeted us, said hello.
00:35:22.180 We went into her then trailer, and we had a discussion about what she wanted to meet with
00:35:26.640 us, and when she came to the trailer for the meeting, did she say anything about what had
00:35:30.640 just occurred in her makeup trailer?
00:35:33.240 She did not.
00:35:34.680 Did you ever learn that Ms. Lively had a different view of the incident in the trailer prior to
00:35:39.500 her testimony?
00:35:40.660 I learned that her different view is when I read her CRD complaint.
00:35:45.820 So Blake never complained about this incident before she filed her lawsuit, basically.
00:35:51.580 Yes, as you can hear here, there's a lot of different variations of this story, but I
00:35:56.320 think one important thing here is from all these three women who talked about their versions
00:36:01.240 of this story here, yes, as you can hear here, everyone had kind of different versions
00:36:05.740 of this story, and I don't know where the truth lays.
00:36:08.700 That's up to the jury to decide whenever it gets to trial, which I think it will do at
00:36:13.600 this point, but I think also when these women, they have to stick to what they said in their
00:36:19.180 depositions if they are witnesses for Blake in court, and if their stories are so different
00:36:24.840 from each other, it doesn't really look good.
00:36:27.620 And I think also something that I mentioned that if you are in a situation that makes you
00:36:32.220 feel so uncomfortable, I find it a bit strange that you don't remember the fact, whether the
00:36:37.360 person was standing or sitting, things like that.
00:36:40.760 Anyways, let me know what you think, who's telling the truth here.
00:36:44.480 Anyways, that's it for me, you guys, on a Friday.
