00:01:11.300 OK, so Carly Smolak, who was a former she's a former professional soccer player who played.
00:01:19.040 She was a contemporary of, you know, a lot of the names that you recognize today for soccer players.
00:01:24.580 would know, Julie Foudy, Megan Rapinoe. She played at Stanford for four years, was a starting
00:01:30.860 goalkeeper, and then went on and played pros for a few years. And then when she retired from
00:01:35.900 professional soccer, she found Australian Rules Football, where she had a wonderful experience,
00:01:42.980 won a whole bunch of national titles, represented the US going overseas, and then ran into a man,
00:01:50.520 a man joining her team and found out that he was a convicted child sex offender who had been
00:01:57.860 sentenced to over 40 years in prison for some pretty heinous, not pretty heinous, very heinous
00:02:03.020 deeds. And now he was identifying as a woman. That's right. And he went through his whole,
00:02:09.100 I am a woman phase when he was in prison. So coming out then immediately joined a women's
00:02:14.820 soccer team and had access to women and their children while they were traveling and playing.
00:02:18.960 and the league was doing nothing to protect the women.
00:02:22.740 So she got very fired up about that

00:02:59.200 to see you too. I think most notably about this hearing, or at least kind of what has attracted
00:03:05.180 a lot of attention on social media is the fact that 10 Democrats sit on this committee. Senator
00:03:11.480 Dick Durbin came in. He read an opening statement calling the topic a total distraction from what
00:03:18.660 voters actually care about. And then he left. The other senators, Democratic senators, didn't show
00:03:24.080 up. Not one Democrat asked a witness a single question. Did you all expect this to be the case?
00:03:33.240 Do we know why they didn't show up beyond what Senator Dick Durbin said? And do we think there's
00:03:37.960 a broader message that is being sent here, especially to women, especially to young girls,
00:03:43.760 when you have an entire political party in terms of elected representation who can't even bother
00:03:50.500 to stay in a room. You know, walking into this really grand and beautiful room in the Senate,
00:03:57.580 not knowing what to expect, and then watching the clock sitting next to all these beautiful,
00:04:05.180 young, well-spoken female athletes, some as young as high school, there to participate
00:04:14.040 in the process of our government and communicate in desperation, really, to our nation's senators
00:04:21.260 what they're going through and how they want our elected officials to help them.
00:04:28.900 And I'm looking at the clock and I'm like, well, this hearing is supposed to start right
00:04:34.080 now. And half of the seats in the committee were empty. And I'm like, are we delayed? What's going
00:04:43.960 on? Lo and behold, as we all saw, actually, Senator Klobuchar sat there briefly, never really looked
00:04:53.140 up once, I think, the whole time she was on her computer or phone. And then Senator Durbin
00:05:02.400 was there only to deliver the message that it was so incredibly unimportant to the Democrat leaders
00:05:10.820 that they were not going to ask any witnesses there. They were not going to ask any questions.
00:05:15.960 They were not going to engage whatsoever at such an unimportant hearing where girls and women were
00:05:27.040 really pouring their hearts out to ask for help. And there are so many thousands and thousands of
00:05:35.900 women across the country affected by this. They have their own daughters or granddaughters
00:05:41.720 in sports confronting men and boys in every sport at every single level. And for those senators
00:05:49.820 on the Democratic side to say, we don't care about this at all over any other issue.
00:05:56.560 It was so insulting. And I was sad. I was really sad as a mom of a girl just starting in sports
00:06:05.160 and sad for our country, because this is a top of mind issue to all Americans. This is even
00:06:13.440 Democrat voters, the constituents of these senators say, we care about women and girls
00:06:21.640 in sports and we care if they're mistreated. And for them to just dismiss it, to be honest,
00:06:27.980 I think it's fear. It's not that they recognize that people don't care about it at all. It's
00:06:35.320 they're scared to death because the leadership in the party has decided, taking the wrong stance
00:06:43.040 on this. And they're afraid to face the American people and to hear what are the ramifications for
00:06:51.080 their terrible policies that are allowing boys and men in girls sports. And so they fled and
00:06:58.160 they can't confront it. This is a top priority for, I would say, a majority of voters. Maybe
00:07:05.260 there are some people who think they don't have to worry about this because they don't have a
00:07:08.420 daughter who's competing actively. Here's what I will say to that. You don't have to have a
00:07:13.020 daughter who's competing because this issue is bigger than just this topic. I think this is a
00:07:18.620 perfect litmus test on if your elected official is willing to lie to you. Why would you believe
00:07:25.640 a word that comes out of someone's mouth, regardless of what the topic is, if that person
00:07:32.440 is willing to say that men can get pregnant and that women need prostate exams and that tampons
00:07:36.500 belong in boys' bathrooms. Why would you trust anything they say on any topic? I think this is
00:07:41.660 the ultimate litmus test that every single elected official especially should have to answer before
00:07:47.880 deciding if they qualify to serve in this capacity. Now, Kim, you said in your testimony, you said the
00:07:55.880 concept of gender identity is in direct conflict with the objective reality of sex, and you have
00:08:00.400 to choose one. Perfectly stated, but can you spell this out? Why can't the law protect both?
00:08:07.260 There are plenty of states that have both sex and gender identity as protected classes in their state
00:08:13.840 constitution. So are you saying you cannot protect both of these groups from discrimination as
00:08:19.580 these laws say? Elaborate on what you mean here. Not in the same place at the same time. You
00:08:26.540 definitely can't. You have to choose one. So I can't, you know, you have a girls sports team.
00:08:33.000 It's been set aside for girls. I can protect the spots on that team for the young girls who want
00:08:38.120 to play, or I can choose to protect that spot for the boy who believes he's a girl or who believes
00:08:44.420 he's entitled to one of those places. And the same thing is true for locker rooms. I can either
00:08:49.940 protect the girls for whom that area was designated so that they can undress and change
00:08:56.280 in a state of safety and comfort, believing that they are surrounded only by members of
00:09:01.520 the female sex, or I can protect the right of men to enter that space and violate the
00:09:06.900 safety and sanctity of that space for women.

00:09:11.260 I mean, it's true for anything designated for women.
00:09:14.060 So it comes down to a language issue. When you give men the right to call themselves women, then you strip away the right of women to advocate for their unique needs and experiences apart from men.

00:10:16.040 for, is grown men to ask young girls to pull down their pants so we can inspect their genitals.
00:10:21.600 Can you guys just debunk this, please? No one is advocating for this. No one wants a genital
00:10:29.240 inspection. So when you see this discourse online, how do you respond to this and what
00:10:34.820 actually are we advocating for, Marshy? So what's so ironic is that they're harping
00:10:43.300 no genital exams in women's sports, while they're also saying we want to force grown men
00:10:51.360 into locker rooms and showers with little girls after swim practice or after volleyball with
00:11:00.140 high school athletes. So it's so disingenuous. It's fear-mongering to the umpteenth degree
00:11:10.360 because what women are asking for is actually going back to something we used to do even at
00:11:18.680 the Olympic Games, which was cheek swabbing athletes who wanted to participate in the female
00:11:24.440 category. So this was done decades ago. Thankfully, the IOC is now reversing itself
00:11:32.580 and becoming the leader that they are supposed to be by reinstituting a simple cheek swab.
00:11:40.820 It's very cheap. It's easy, non-invasive. I had a two-year-old during COVID who I had to shove
00:11:48.360 a, you know, Q-tip up to tickle his brain in order to, you know, get on a flight to go and
00:11:56.760 see my parents to prove, you know, his COVID test. And yet we are not willing to just swab
00:12:05.920 a woman's mouth to determine that she's in the right category. It's really imperative now
00:12:14.540 That we are seeing, you know, plastic surgery advances, kids who have tragically been medicalized at such a young age that they are participating in women's sports, quote unquote, stealth because they're able to pass as women and girls, however, are experiencing, you know, state championship once in a lifetime athlete accolade titles given to them.
00:12:43.440 because they're performing, understandably, at a much higher level than genetic females.
00:12:50.160 And so this is the next frontier for the protection of women's sports,
00:12:56.760 cheek swabbing in order to protect our women and girls and to uphold the laws that we do have in
00:13:04.440 place. To suggest that you have a sports category for which there is no eligibility criteria other
00:13:11.940 than personal declaration is crazy. It's a non-category then because it's a completely
00:13:18.260 permeable boundary. And the reason we have people do drug testing, step on scales, make sure that
00:13:23.980 they're the right age, make sure they live in the right district, that they are citizens of a
00:13:28.520 certain country is to make sure that they are eligible for the category that they are competing
00:13:33.260 in. And that is, has to be the same case for the women's category. We've got to make sure that it
00:13:39.440 is a boundaried category to allow for female athletes to compete fairly and safely.
00:13:47.500 So, yeah, the sex screening thing is quite easy.
00:13:50.160 And I want to also say that to your listeners that every single young athlete in America
00:13:57.660 in middle school through high school has to go through a pre-participation physical right
00:14:02.320 now for Clarence to participate in school sports that every doctor knows your sex, especially
00:14:09.200 if they know your medical history, which you are by law required to provide.
00:14:13.460 So a cheek swab is, again, simple, easy, and it is complete, for the SRY gene, it's
00:14:20.840 completely accurate.
00:14:22.380 So yeah, we need to go for that.
00:14:24.620 But as far as what the USOPC is doing, contrary to the IOC, they are not installing or are
00:14:32.380 beginning cheek swabs for eligibility and registration for USOPC organizations.
00:14:38.780 And it's that USOPC is U.S. Olympic and Paralympic Committee.
00:14:42.600 It's an umbrella organization that oversees all Olympic sport in the U.S.
00:14:47.000 And we have men and boys competing under that Olympic umbrella, under their governance, in the women and girls category across the board and at the highest levels.
00:14:58.720 With just, was it now three or four weeks ago, we had a male athlete who just started cycling 18 months ago competitively.
00:15:07.340 We provided icons, provided the information necessary to the USA Cycling to say this is a male athlete in violation of their written policy.
00:15:18.620 And they continued to elevate him through the ranks until finally about three or four weeks ago, they gave him an international license to compete at a UCI event,
00:15:30.300 the most prestigious event on U.S. soil in the last decade
00:15:34.960 where he would be competing against Olympic gold medalists.

00:16:17.220 committee to not be holding accountable doing their job to hold accountable their national
00:16:24.980 governing bodies to uphold the rules and policies not just of the united states but of the
00:16:29.660 international sports communities so we have they've got to start doing their job and they
00:16:36.380 have got to start requiring the policy to be enforced, not just written in words, which is
00:16:42.440 what we're seeing across the board right now. Do you think the Trump administration knows about
00:16:47.860 this? Because when it comes to the Olympics, especially LA, 2028, President Trump and his
00:16:55.020 administration has been very clear, like, there will be no men competing in women's sports. So
00:17:00.500 do you think that they know the USOPC isn't adhering to the guidelines that the IOC has set
00:17:07.700 and certainly that we've seen kind of laid out from President Trump and his administration?
00:17:13.200 Because I imagine they would not be overly thrilled if they knew the USOPC was doing this.
00:17:19.020 And they would force their hand because up until this point, they've done a pretty good job of
00:17:25.220 that. I think there, of course, could be a case made about the NCAA and how maybe the Trump
00:17:31.240 administration believed them to be following guidelines, but that's a separate conversation.
00:17:36.320 Do you think they know about what the USOPC is doing?
00:17:40.680 Marcia, I think we're a little confused right now. We have notified high-level
00:17:48.280 government officials about what's happening. I don't know that they know the extent to which
00:17:56.980 it's happening. So I do believe that there are, I mean, this is kind of speculation though, Riley,
00:18:02.340 I believe that there are the people who are in charge of taking their big stick to hold the US
00:18:10.500 OPC accountable as it is a federally chartered institution, even though it doesn't receive
00:18:14.800 federal funding, it exists at the pleasure and discrimination of the U of Congress of the
00:18:21.260 government. So we have told people, you know, what's happening, but the enforcement is not
00:18:28.760 coming down from the top at the USOPC. So it's unclear at this point, what conversations are
00:18:34.880 happening. Yes, I wish they would be stronger. I wish they would be faster. But I, Marcia,
00:18:41.760 Do you have anything to add to that? I'm not 100% clear.
00:18:44.820 I would say they are aware to an extent, but Kim and I, and one of the reasons Kim was sitting in the Senate last week is to raise major alarm bells.
00:19:02.700 the American people also, you know, we we've gained wins, certainly, especially since the
00:19:11.040 Trump administration has been so focused on trying to help women and girls in sports.
00:19:17.320 We are seeing wins like at the Olympic Committee, like with keeping men out of women's sports
00:19:23.480 executive order, like we've seen for a couple of years now, which is great. But every time
00:19:30.460 we celebrate a win, a large part of the population believes it's over. So even when your sport
00:19:39.620 changes its policy in name and word only, parents, you need to hold these people's feet to the fire
00:19:50.140 and go to the media and talk about what you're experiencing and out them because the pressure
00:19:56.300 at this point is what is changing policy and awareness. It's not the people in the leadership
00:20:06.320 chair, because depending on who is sitting on that board, they are some of the biggest trans
00:20:12.560 activists we've ever encountered, our board members within these sports. This is why we have
00:20:18.720 come to this mass problem across sports. And so parents and voters and individuals,
00:20:27.700 we have got to rise up and start talking about this and demanding people do something about it
00:20:34.400 to rectify this right now. Because can you imagine when President Trump is out of the Oval Office,
00:20:41.440 who that next seat could be occupied by.

00:22:39.120 as if um the administration hasn't done or accomplished everything that they said they
00:22:44.220 were going to do or they're frustrated with gas prices again valid to feel that level of

00:22:54.120 but it would be so ignorant to sit this one out, to not vote in the midterm election because you

00:23:24.100 sounding the alarms, there was a new study that came out, I guess, research that had been
00:23:29.560 conducted by Concerned Women for America, CWA. And in this study, it concluded that 2,293 first
00:23:37.820 place finishes, they call stolen gold medals in U.S. women's and girls events have been taken by
00:23:43.240 men. Over half a million dollars in prize money taken from professional women events
00:23:48.780 since the mid-1980s by men identifying as women. In California, they had 611 first place
00:23:57.080 displacements. That's just in one state alone. 14,301 female category events entered by men.
00:24:04.700 You still have people who say this isn't really happening. Do you think this report is enough
00:24:11.400 to combat that? And it's important to mention also that this is just what's being reported
00:24:17.520 and recorded and what can be verified. Kim, would you say the number is higher than even what's been
00:24:23.560 shown here? Oh, yeah. No matter even, so I was just gonna, I was pulling up something I want
00:24:30.420 to read to you that expands on those numbers a little bit. But these are the numbers of people
00:24:37.100 we have been able to track, those of us invested in trying to verify whether or not girls are
00:24:44.860 having their opportunities and rewards stolen by boys. So we know that the number is higher than
00:24:52.360 this because so many go unreported, like vastly higher. We have tons of data that we are still
00:24:59.280 sifting through and trying to verify. But let me just read. I think that report was talking about
00:25:04.580 gold medals, 22 gold medals. And boys have won over 4,000 competitions and team matches
00:25:15.040 meant for female athletes at the K through 12 level. That is 4,000 times that a girl or an
00:25:21.980 entire team has had to lose to a boy in what is supposed to be a girl's only sport. 3,000 of those
00:25:28.840 4,000 were team matches, meaning 3,000 times a girl was sitting on a bench while a boy
00:25:35.460 played in her place on the field instead.
00:25:38.900 They have displaced 2,807 major top three medals and stolen at least 90 state championship
00:25:47.900 titles.
00:25:49.040 So those are the numbers we are aware of at the present time.
00:25:53.140 They grow every day.
00:25:54.260 Every day we uncover more research.
00:25:56.160 And even in states where there are policies or laws that are supposed to help us understand the numbers or protect girls, like in Michigan, there is a policy that if you are a boy and you want to participate on a girls team, that you have to submit for a waiver to participate on that.
00:26:17.140 we have found several boys in the last couple years during this policy who are playing on
00:26:25.100 girls' teams. And we know they're boys. We've verified it 100%. And they are not submitting.
00:26:31.420 They don't believe they have to follow the policy. It's as if this is a group of people
00:26:35.580 that the rules don't apply for. And even in states where there are laws protecting the girls,
00:26:42.500 We know about the volleyball player in Florida, but we also know of ones in Ohio and in Texas.
00:26:48.620 We have watched administrators interviewed to say, oh, here's the loopholes.

00:26:56.500 Like the cheek swab is the bulletproof way to say you have to be eligible because otherwise
00:27:02.820 we get individual activists like we have at the head of USA Hockey, USA Rugby, USA Volleyball,

00:27:11.000 We have activists who are just saying, rules don't really work for us here.
00:27:18.660 We're not going to uphold them.
00:27:20.440 And I thought that was a profound statement from one of the fathers who got up at the
00:27:26.100 press conference following the hearing saying, and I also think to your point, Riley, about
00:27:31.340 this being a low bar in society, a judge of whether or not someone can tell the truth,
00:27:37.420 is honest, and can speak objective facts that we're able to reason and logic with,
00:27:42.480 the father got up and said, how is my daughter supposed to trust in any system? How am I supposed
00:27:49.300 to trust in any system where the rules are arbitrary? They just don't apply because she
00:27:54.660 was born female. And I think that's a poignant thought that we're just dismissing truth. We're
00:28:01.900 dismissing written policy. We are saying girls, we can violate the rules for girls if we want to
00:28:10.020 preference a boy. Last thing for you guys, you guys have been backing federal cases against the
00:28:18.860 NCAA. Senator Hawley spent his time at that hearing hounding the NCAA, which he has been so
00:28:25.780 strong on this issue and across the board when it comes to parental rights and free speech and
00:28:31.920 and freedom of religion like he has been one of the greatest if not the greatest that we have in
00:28:37.560 washington dc i believe and especially when it comes to pressing the ncaa over the the years now
00:28:44.420 but he spent his his time doing just that and you guys are racking these cases against the
00:28:49.720 ncaa we've talked about or we alluded to the gains versus ncaa case but there are several others
00:28:55.020 Um, where do those stand and how can people who are watching or listening, how can they support
00:29:01.360 you all and your efforts and support these cases? Um, I'm going to, I'm going to kick it to Kim,

00:32:40.240 And we just got a huge lesson in that in the state of Virginia with Governor Spaniger overturning
00:32:45.720 the protections that the girls in that state spent years advocating for and had to really
00:32:51.560 suffer through, you know, their own situation with a man trying to join a women's team and
00:32:57.960 entering their locker rooms.
00:32:59.140 And it destroyed their team.
00:33:01.060 It destroyed their years in college.
00:33:02.640 And they put that on the side in order to be able to uphold this policy and now it's gone. So we've got to get legal victories in court to secure women's rights. We absolutely need funding. We are fighting this. We filed these cases believing that the American people wanted to see women win in court and that when we filed, they would come to support the girls that were brave enough to put their necks on the line.
