00:21:22.460 evidence to the grand jury in dc but they could bring separate charges they could bring the charges in
00:21:27.260 miami they could bring the charges in dc they could split it up the problem that jack smith has in dc
00:21:34.380 is there is a huge roadblock there is a precedent by the dc uh district court protecting uh president
00:21:40.940 clinton back in 2012 this obama judge protected hill uh protected bill clinton when he had eight
00:21:47.180 years of audio recordings highly classified audio recordings in his socks were 79 tapes and tom finton
00:21:54.300 at judicial watch our friend sued to get these tapes and the obama judge correctly held that under
00:21:59.660 the presidential records act it is the president's sole determination whether records are personal
00:22:05.020 that go to him or uh presidential records that go to the archives that almost certainly come back
00:22:10.380 to his library but the mere act of taking those audio tapes out of the white house when he left make
00:22:15.180 them made them personal according to this obama judge well the same thing is true with trump if he
00:22:21.260 took his records when he left they are personal records and it doesn't matter whether they're
00:22:25.180 classified or not they're presidential records he has secure office space in the office of former
00:22:29.820 president jack smith may be trying to avoid that precedent in dc so that may be the reason he wants to

00:23:11.740 i would actually wager that a jury down there would probably be more fair because you're probably
00:23:16.460 getting even split yeah and you and remember you have to have a unanimous jury in order to
00:23:21.900 convict it's a fine guilty exactly the court to convict so i mean it would be a hung jury at best

00:23:33.820 question and so but it's not because jacks if he goes and if jack smith charges in florida it's not
