00:03:10.280 The strikedown, essentially, of a huge swath of affirmative action in universities.
00:03:16.680 But also, breaking news, the Supreme Court area itself has been evacuated due to a suspicious
00:03:24.780 package coming right on the heels of this new release of the opinion 6-3 strikedown by
00:03:33.700 the Supreme Court.
00:03:34.680 We're going to follow that as it continues.
00:03:36.660 Mike Davis, what does this mean going forward for the program of affirmative action in other
00:03:43.440 parts of the government and at universities?
00:03:45.200 What it means is these elite universities cannot continue their illegal discrimination against
00:03:53.980 poor, more qualified Asian applicants in favor of the elite, well-connected black applicants.
00:04:01.720 And that has been systematic racial discrimination for too long.
00:04:06.560 And the Supreme Court has finally held that this is unconstitutional under the 14th Amendment
00:04:12.640 to the United States Constitution.
00:04:14.260 So when they consider applicants, they should look at factors like poverty instead of race.
00:04:22.040 Well, so I guess the question going forward is, what will be the enforcement mechanism?
00:04:27.620 Because we know that some of these university administrators, they've been trying to hide

00:04:32.080 You saw the University of Michigan years ago.
00:04:33.980 So will there open up a channel for people to be able to sue?
00:04:38.540 Will there be ways for people to actually dig into these programs?
00:04:42.900 Well, that's a very good question, Jack, because Harvard University immediately put out an email
00:04:49.540 that I posted on my Twitter where they're essentially telling the Harvard students, faculty, staff,
00:04:57.000 alumni, wink, wink, nod, nod.
00:04:59.460 We're going to keep discriminating against Asian Americans, poor, less connected, more qualified
00:05:07.340 Asian Americans in favor of the elite, less qualified black applicants.
00:05:11.840 And so they're going to continue to do it.
00:05:13.600 The way that you're going to have to enforce this, unfortunately, is plan whack-a-mole.

00:10:13.400 who were undercutting Trump every step of the way in 15 and 16.
00:10:18.100 If they had had their way, Hillary Clinton would be there today.
00:10:21.520 She would be there today, and we would have potentially six-three rulings in the other
00:10:27.380 direction.

00:11:43.320 legal analysis when it comes to the Presidential Records Act, when it comes to everything else
00:11:47.800 that's going on that got me in this fight with Andy McCarthy, of all people.
00:11:52.300 And all I did, by the way, was pull up his old columns from when he was at PJ Media before
00:11:58.560 he was at National Review, not the National Review line, where now it's become this whole
00:12:03.200 human events versus National Review thing, which, of course, is funny, because that's
00:12:07.020 what it's been for, what, 70 years when you think about it.
00:12:09.260 Is he saying that, no, no, no, it was totally fine for Obama to authorize the release of
00:12:17.260 the Stuxnet intel information through General Cartwright, who later, by the way, was charged
00:12:23.020 with perjury in the investigation, but Obama pardoned him.
00:12:26.540 That was totally fine, even though he didn't follow any formal process.
00:12:30.660 And I pointed out that what's very different from the things that you and National Review
00:12:36.080 are saying today, he writes a 5,000-word column responding to me last night in a very strange
00:12:44.020 manner, making all sorts of claims that I didn't make.
00:12:47.300 Then when I point out some of his false claims, he said, well, I'm sorry, I'm on vacation right
00:12:51.660 now.
00:12:51.920 But I wanted to ask you about a salient point in there, because he said that even under the
00:12:57.160 Presidential Records Act, that President Trump doesn't have the authority to take these because
00:13:02.880 he didn't document the collection of these documents.
00:13:06.460 What's going on there?
00:13:08.360 Look, I like these guys at National Review.
00:13:10.980 We were allies on the judicial fight confirming Trump's judicial nominees, including three justices
00:13:17.640 on the Supreme Court.
00:13:18.560 They just don't like Trump, and they are letting their opposition to Trump cloud their legal
00:13:25.340 judgment.
00:13:25.860 The Presidential Records Act is very clear that any document created or received by the
00:13:32.940 president or his White House staff is a presidential record, and it does not matter
00:13:38.340 whether they are classified agency records or not.
00:13:41.540 They're trying to say that classified agency records sent to the president to advise the
00:13:46.300 president or not presidential records, that is just not the law.
00:13:49.080 They are absolutely dead wrong about that part of the law.
00:13:52.620 And under the Presidential Records Act, the president himself gets to decide whether these
00:13:58.220 are personal records that belong to him.
00:14:01.160 And go look at the Clinton sock drawer case when Clinton had eight years of highly classified
00:14:05.360 audio recordings, including conversations with foreign leaders and his national security officials
00:14:11.680 that he took from the White House and he put in his sock drawer.
00:14:14.840 And an Obama judge in 2012 said the mere fact that Obama took those White House tapes that
00:14:21.100 was recorded by the deputy White House chief of staff for operations, took those White House
00:14:25.440 tapes with him when he left, deemed them personal under the Presidential Records Act.
00:14:29.880 He owns them.
00:14:31.040 They're not presidential records.
00:14:32.340 Alternatively, they are presidential records which are owned by the government, but under
00:14:38.080 the Presidential Records Act, the former president can access his presidential records any time
00:14:44.000 he wants.
00:14:44.680 So can his designated representative.
00:14:47.140 At best, this is a bureaucratic dispute, a civil lawsuit with Biden's librarians and other
00:14:54.140 bureaucrats over presidential records.
00:14:56.280 This is not espionage.
00:14:57.640 Ask these people, Jack, do they want President Trump to die in prison because of an espionage
00:15:04.600 charge, because of Trump's fight with Biden's and other bureaucrats?
00:15:08.140 And the answer they will probably tell you is yes, because they fear that Trump's going
00:15:12.180 to win in 2024.

00:15:16.520 And I'll just say, you know, without naming names, I've had a lot of people in Washington,
00:15:20.340 D.C. reach out to me and say that's exactly what's going on here.

00:19:26.460 They're trying to say, again, that classified agency records sent to the president to advise

00:19:53.160 And like you said, Jack, these are copies.

00:19:56.640 Maybe other than the love letter from the North Korean dictator to Trump, maybe Trump kept his

00:20:43.300 I was looking at them, not just the Presidential Records Act, but even went into the former
00:20:49.840 Presidents Act, the FPA, which is sort of a follow on to all of this and where it delineates
00:20:56.380 how the records are supposed to be used.
00:20:58.680 And, you know, Mike, here's the thing.
00:21:00.560 These acts, they don't have any timeline on them.
00:21:03.540 There's no it doesn't say anything about he he ceases being the former president seven
00:21:09.920 months after eight months after and then all of it has to be returned.

00:21:16.080 And it specifically speaks to the idea that obviously presidents and former presidents
00:21:21.380 are busy people.
00:21:22.620 And and you hear President Trump actually referring to this in that interview that he did with
00:21:27.260 Brett Berry said, you know, we didn't have time to go through it yet.
00:21:30.120 And it seemed to me that the language he was using in that interview was very similar
00:21:35.360 to the actual language of the statute itself.
00:21:37.720 And I wondered perhaps if he was that was the legal advice that he was given because they're
00:21:42.140 looking at the statute and saying, yeah, this is Mr. President, this is how it works.
00:21:45.780 And that is how it works.
00:21:46.980 I worked in the Bush 40, 43 White House.
00:21:49.360 I learned the Presidential Records Act inside and out during Kavanaugh's confirmation because
00:21:54.000 he was the White House staff secretary and we had to go through millions of pages of
00:21:57.800 records from the Bush 43 White House and we had to navigate the Presidential Records Act
00:22:02.840 to do it.
00:22:04.120 President Trump is absolutely right as a matter of law.

00:22:08.760 Why don't they walk down at the Biden Justice Department?
00:22:11.540 Why don't they walk down the hall to the Office of Legal Counsel, OLC, and get an opinion
00:22:16.820 before they had Jay Bratt, this partisan operative, go to this biased judge, magistrate judge,
00:22:22.560 Bruce Reinhardt, to get this unnecessary, unlawful, unprecedented home raid?
00:22:26.800 Why did they not even cite the Presidential Records Act when they did this?

00:22:35.800 The whole point of this raid was to get Trump's declassified crossfire hurricane records.

00:32:13.580 I happen to think that the First Amendment protects what he said on January 6th, but we'll

00:32:22.400 But yes, I do believe that all of those Republicans expect him to be wounded by these indictments and

00:32:29.880 In the Republican primary, in the polls, the opposite has been the effect.

00:33:20.640 have these Manichean views on it, where in the West it's now become, you know, it's democracy
00:33:25.760 versus autocracy.
00:33:26.940 And at the same time, you're not hearing very many people actually discuss the prospect of
00:33:33.380 peace on the ground in Ukraine.
00:33:36.620 Do you think that that's something that could also play a role in this?
00:33:42.960 Well, the American government is not in favor of peace on the ground.
00:33:47.200 I am sure that President Zelensky would go to Geneva and meet with President Putin or send
00:33:53.520 their number two or number three persons, their foreign ministers or defense ministers.
00:33:58.380 But Zelensky's American masters, Victoria Zuland, Tony Blinken, Lloyd Austin, Jake Sullivan,
00:34:05.100 and to the extent he knows what's going on, the president himself simply won't allow that.
00:34:10.200 They don't have an off-ramp for this disastrous, unconstitutional, illegal, immoral war that we
00:34:17.700 are fighting there.
00:34:18.620 My column out this morning, depending on where you get it, one title is Bloodshed and Honesty,
00:34:25.840 the other is War and Honesty, talks about how Congress cannot declare war on Russia because
00:34:31.920 Russia does not pose a military threat to the United States.
00:34:35.640 We pose more of a military threat to Russia than they do to us.
00:34:40.360 So rather than declare war, which they can't do, Congress decides to fund a war.
00:34:45.260 They haven't authorized troops, but Joe Biden and Lloyd Austin and Tony Blinken have sent
00:34:50.760 military equipment there that only Americans can operate.
00:34:54.400 So do we have troops on the ground?
00:34:56.280 Well, like Bill Clinton, it depends on what the meaning of is is.

00:35:03.320 If by troops on the ground, you mean Americans wearing boots and in fatigues and a helmet and
