00:01:09.600 Joe Biggs has just been sentenced to 17 years by a D.C. courtroom court, D.C. judge for the
00:01:19.780 crime of seditious conspiracy.
00:01:22.560 Julie Kelly, walk us through what happened here.
00:01:24.880 So, Joe Biggs and three other members of the Proud Boys were convicted by a D.C. jury in May of seditious
00:01:32.960 conspiracy, an extremely rare offense that dates back to the Civil War.
00:01:37.540 No American has ever been convicted of seditious conspiracy before January 6th.
00:01:42.060 Nonetheless, we're talking about Washington, D.C., so anything can happen.
00:01:45.600 So, today was the first of five sentences.
00:01:49.240 One man was acquitted of seditious conspiracy.
00:01:51.680 He'll still be sentenced.
00:01:52.740 But today was Joseph Biggs, a member, leader of the Proud Boys, as you said, convicted of
00:01:59.000 seditious conspiracy, obstruction of an official proceeding, aiding and abetting the destruction
00:02:03.560 of government property.
00:02:04.620 Judge Tim Kelly added, allowed the DOJ's domestic terror, not even domestic, terror enhancement
00:02:15.020 at sentencing, claiming that Joe Biggs' involvement in trying to shake or dismantle part of a metal
00:02:21.880 fence at the Capitol on January 6th is resulted in or equates to a crime of terrorism and added
00:02:32.560 an enhancement that could add up to 10 years in prison for what otherwise would be a low-level
00:02:37.780 misdemeanor vandalism offense, claimed that that was an act of terrorism, and that's what
00:02:45.040 contributed to this excessive sentence.
00:02:47.940 Keep in mind, Jack, the DOJ wanted 33 years in prison for Joe Biggs, not only adding domestic
00:02:54.400 terror or a terror enhancement for the fence incident, but also his convictions of obstruction
00:02:59.860 of an official proceeding, conspiracy, etc.
00:03:03.480 Judge Tim Kelly, a Trump-appointed, allegedly conservative judge, that's what happened in
00:03:08.920 this courtroom this afternoon.
00:03:11.760 So, walk me through the theory of the case here, and we have three minutes, we'll take
00:03:15.340 a break, and then we have a longer segment.
00:03:17.040 But how is, he pushed over a fence, he destroyed a fence, how does that equal terrorism?
00:03:22.940 Well, he didn't even push over the fence, and there were multiple people at this police
00:03:28.500 line on the west side of the Capitol who were shaking these temporary metal barriers that
00:03:33.580 had been erected, really, for the inauguration.
00:03:35.780 They call them the bike fences.
00:03:38.680 Exactly.
00:03:39.320 So, they're temporary fences, right?
00:03:41.380 It's not like a permanent structure.
00:03:43.300 It's not a statue.
00:03:45.200 So, but because it fits this very vague definition part of the terrorism statute saying, well,
00:03:53.700 this is government property.
00:03:54.900 If you destroy or vandalize it, that's part of, that could be considered an act of terrorism.
00:04:01.140 Now, I'm sure the people who wrote that statute didn't think that, you know, 20 years later,
00:04:05.640 30 years later, it would be applied to someone shaking a fence outside of the Capitol.
00:04:09.280 But that's exactly where we are as the COJ and federal judges, Trump-appointed, Obama-appointed,
00:04:15.640 turn low-level offenses and nonviolent offenses like obstruction into crimes, federal crimes
00:04:22.120 of terrorism.
00:04:24.200 A federal crime of terrorism.
00:04:27.700 And look, I was there on January 6th.
00:04:29.660 I remember seeing the bike fences.
00:04:31.680 They were not part of a government facility.
00:04:33.840 They were not part of anything that anyone would consider a government facility.
00:04:37.140 And by the way, those temporary fences, fencing, weren't even at the Capitol itself.
00:04:44.260 They were way ahead, just on the lawn, basically just on the grounds.
00:04:49.800 Well, this was actually near the West Terrace.
00:04:53.080 So this allegedly, these temporary fencing had been erected for the inauguration, which
00:04:58.060 is strange because no one, you know, with COVID still.
00:05:00.460 So, but nonetheless, they were temporary fencing with a few Capitol Police officers behind that
00:05:06.800 fence.
00:05:08.020 And as I said, you know, Joe Biggs was there.
00:05:10.640 He was at the line.
00:05:11.480 He was shaking the fence a little bit with Ethan Dordine.
00:05:13.740 But now he is considered a terrorist.
00:05:18.360 A domestic terrorist, a guy who's a combat veteran, a guy who had worked as a reporter
00:05:24.600 for a long time, is featured in documentaries, well-known documentaries for Serving Our Country,
00:05:31.380 is given 17 years.
00:05:33.560 This is a joke.
00:05:34.860 This is ridiculous.

00:05:55.600 But these judges have decided to go further than ever before inside the United States,
00:06:02.420 sentencing people using terrorism enhancements for shaking a bike rack at the Capitol on
00:06:09.180 January 6th.

00:07:21.500 Walk us through some of the abject insanity that you saw, but at the same time, there
00:07:28.560 seemed to be bringing up, and you notice this again and again, they keep bringing up the
00:07:33.100 name Donald Trump again and again in connection to seditious conspiracy.
00:07:38.540 What went down?
00:07:40.300 So you're right.
00:07:41.360 So Judge Tim Kelly brought up Donald Trump's name.
00:07:44.960 Donald Trump, the man who appointed him to the federal bench in 2017, brought up his name
00:07:50.560 repeatedly in a pre-sentencing hearing on Tuesday.
00:07:55.820 The government, this DOJ, has basically said, not basically said, has said that the alleged
00:08:01.520 conspiracy, this seditious conspiracy, began on December 19th, 2020.
00:08:07.400 And that's not an accident, Jack.
00:08:09.220 That was the day that Donald Trump sent that tweet, come to Washington on January 6th, will
00:08:15.180 be wild.
00:08:16.460 Their reaction to that in private group chats then, the government says, the DOJ says, and
00:08:22.040 obviously Judge Tim Kelly agreed with, that initiated the plan to conspire to, quote unquote,
00:08:28.900 attack the Capitol.
00:08:30.620 So he brought up, and Donald Trump's name came up again today.
00:08:34.480 So by, here, I'm at the airport, by Judge Kelly again, noting that tweet and noting that
00:08:42.900 Donald Trump was responsible for prompting the Proud Boys to conspire to, what, overthrow
00:08:49.900 the government on January 6th.
00:08:51.480 So what you're saying is they're essentially, and if I can summarize for a second, what you're
00:08:59.200 basically trying to say is they're trying to claim that Trump's tweet, his tweet about
00:09:06.580 coming to D.C. for the protest was essentially, by the way, and I'm just going to say it, this
00:09:11.800 is the same exact logic that we saw from Fannie Willis in connecting this series of unrelated
00:09:17.420 efforts and actions into a grand sweeping conspiracy.
00:09:22.220 What you're saying is these judges, even some of which are Trump appointed, are doing the exact
00:09:27.400 same thing with his tweet in connecting them, these Proud Boys members, in a wide-reaching,
00:09:34.580 you know, spiderweb conspiracy to Donald Trump's Twitter.
00:09:38.320 Well, they actually, the Department of Justice and judges like Tim Kelly, actually go back
00:09:44.340 even further, citing Donald Trump's offhanded remark in the September 2020 presidential
00:09:50.040 debate when, after being prompted by Joe Biden twice, said, Proud Boys, stand back and stand
00:09:57.440 by.
00:09:58.180 What prosecutors have said and judges have basically endorsed is that was a call to action.
00:10:03.680 It was a call to arms that that was supposed to prompt all sorts of recruitment for the
00:10:10.060 Proud Boys, but Donald Trump said that from the debate stage.
00:10:13.660 So this has extensive ties to Donald Trump, and now we have the imprimatur of, you know,
00:10:20.860 a minor vandalism act being considered a terrorism act and stretching that, connecting that back
00:10:29.300 to Donald Trump.
00:10:30.160 That's why I don't think, Jack, that Jack Smith is done with Donald Trump related to January
00:10:35.300 6th, because these sentences, what these judges are saying, whether it's Tim Kelly appointed
00:10:40.560 by Trump, Ahmet Maida appointed by Barack Obama, they are the ones that are putting this terrorism
00:10:46.980 imprimatur on minor acts, non-violent acts, but eventually connecting an all-ex Donald Trump.
00:10:54.420 And so this is what you've said before, your theory has been all long, that it seems as
00:11:02.020 though Jack Smith, and it would seem that the DOJ obviously has caught wind of what he's
00:11:07.520 working on, what he's cooking up over there, that in the special counsel's investigations,
00:11:12.200 particularly the DC one, which of course is happening in the same building, by the way,
00:11:16.280 people understand how the geography of DC is the same building where all of this is going
00:11:20.580 on, there's another grand jury that could potentially be looking at what you've said before, a superseding
00:11:26.720 indictment.
00:11:28.020 Do you still think that it would be a seditious conspiracy charge to Donald Trump?
00:11:33.720 I believe that that is still possible.
00:11:36.000 The DC, the grand jury impaneled in DC for January 6th is still working.
00:11:40.780 That's my understanding from a source today.
00:11:42.760 You have to remember there's six unindicted co-conspirators in Jack Smith's original
00:11:48.820 indictment, which includes, you know, the same people in Fannie Willis' indictment, Rudy Giuliani,
00:11:54.140 John Eastman, Jeff Clark, Sidney Powell.
00:11:56.540 So they have yet to charge them.
00:11:58.680 So it's very possible Jack Smith will charge those individuals separately and then do what's
00:12:03.760 called a superseding indictment, which is to combine defendants, combine charges, add charges.
00:12:09.980 You know, he could bring seditious conspiracy charges against John Eastman, Jeff Clark, Rudy Giuliani,
00:12:17.320 Sidney Powell, and then that would sort of be the launching pad to do the same to Trump.
00:12:23.580 I just can't believe that after all this time and money and publicity that Jack Smith is just going
00:12:28.780 to walk away with a four-count indictment or four-count conviction on obstruction of an official
00:12:35.200 proceeding opposed to Enron law and three, you know, random conspiracy counts.
00:12:39.980 I just don't believe that that is his long-term, short-term plan.
00:12:44.980 Well, and we look at what the case has shown down in Georgia, and I'm going to go back to this again,
00:12:51.300 because in her RICO indictment, she also alleged this conspiracy.
00:12:57.020 Many of the actions would overlap, and I'm sure I've heard this, I'm sure you've heard
00:13:01.200 it as well, that there has been coordination between the office of Fannie Willis and the
00:13:06.780 investigation of Jack Smith.
00:13:08.480 Do you think then that perhaps this RICO case could be part of a roadmap into where the grand
00:13:15.040 jury is going in D.C.?
00:13:16.020 I mean, it could be, but, you know, because obviously they were working at the same time
00:13:22.900 Fannie Willis launched her investigation into Trump in February of 2021.
00:13:27.880 So I don't know if there was any collaboration between Fannie Smith and DOJ and then with Jack
00:13:34.840 Smith when he was appointed in November of 2022.
00:13:37.240 You'll recall when she was asked at her near midnight press conference after her indictment
00:13:43.120 whether there had been collaboration or communication between her office and Jack Smith, and she
00:13:48.920 refused to answer the question.
00:13:51.400 But look, part of my argument is Fannie Willis has kind of upstaged all of the other indictments,
00:13:57.740 including the classified documents, and now January 6th.
00:14:00.800 She got the big, needy, you know, 90-plus page indictment.
00:14:04.480 She has all the bad guys tied to Trump world, including Donald Trump himself.
00:14:09.560 So that's why, you know, I doubt that they're necessarily collaborating.
00:14:15.840 But, you know, she took a lot of stuff from the J6 report, so to Jack Smith.
00:14:20.120 That really is the roadmap, and that was the whole point of that committee, was to get all
00:14:24.780 of the witness transcripts, to collect all the information.
00:14:27.920 We now know that some of the material has been destroyed or is missing.
00:14:31.500 We know that certain transcripts have not been made publicly available.
00:14:34.880 All of that now is in hand to Jack Smith.
00:14:36.780 So I think that was more of the roadmap than anything else.
00:14:41.320 Julie, what should Republicans be doing when they're faced with this situation, when they're
00:14:46.920 seeing this, as you can see it coming, you know, right down the pike, as they say, why
00:14:54.000 does it seem like Republicans are in passive receive mode on this?
00:14:57.340 Because they are, because they don't know, they don't understand the gravity of what's
00:15:03.640 happening in these courtrooms.
00:15:06.180 They don't understand the precedent that is being set now, not just things like rattling
00:15:12.000 a metal fence on federal property, but obstruction and making up these crazy conspiracy schemes
00:15:19.180 and turning them into federal crimes punishable by 20 years in prison.
00:15:22.960 They just, they're not paying attention.
00:15:25.560 I understand the Hunter Biden and the Joe Biden and all.
00:15:28.400 I get that that's very important.
00:15:30.440 But look, at the end of the day, unfortunately, we know that's not going anywhere.
00:15:34.240 What they need to do right now is look at what's happening in these courts.
00:15:37.900 They need to call these judges in front of a public hearing, not transcribed interview.
00:15:42.560 They do have oversight capacity of the judicial branch.
00:15:46.100 I can't even tell you the last time a federal judge was impeached.
00:15:49.040 And maybe they don't have enough justification to impeach them, but they certainly can call
00:15:53.680 them to account and have them explain to the American people the decisions that they are
00:15:57.940 making basically behind closed doors.

00:16:17.400 So I think the House GOP should confront them publicly, televised hearings, and have Judge
00:16:24.300 Tim Kelly, Ahmet Maida, Beryl Howell, et cetera, explain their rulings, their pretrial detention.

00:16:32.460 He's already been in jail for 30 months.
00:16:34.900 He's been denied relief since his arrest in January of 2021.

00:40:42.820 And I believe that as we move forward, we're going to see a nation of 50 separate sovereign states in the way that our founders kind of intended to when they put that failsafe in there that said,

00:41:58.600 And you're right that it wasn't just one country, one federal state that was created under our Constitution.
00:42:05.000 It was an idea of this, of course, flowing through the 10th Amendment that states' rights would take primacy.
00:42:11.780 Now, though, I think there's a lot of laws that went in to change this.
00:42:14.880 I think the civil rights law, for example, was a huge erosion of states' rights, regardless of what Joy Reid and actually the one time I was on Joy Reid.
00:42:22.220 We really got into it over the Civil Rights Act, that they would have us believe.
00:42:28.720 But in a situation where the state of the states, as it were, is supposed to be like this, we're starting to see now this internal migration within the United States,
00:42:40.420 where people are moving from one area to another based largely upon politics, some of which in response to crime, but then, of course, is a political function at the same time.
00:42:50.600 So, Josie, can this be achieved?
00:42:53.480 Can a nation, a sovereign nation of 50 states be restored in America?

00:43:01.480 And I know because I'm one of those people that left my state to go for your state.

00:43:11.960 They're all up in Massachusetts, but it was best for my children to be in Florida.

00:43:33.440 But I feel like a lot of parents are waking up to this and they're moving away from states that maybe don't have their child's best interest at heart, whether it's the trans agenda or the pornography in the schools or, you know, just the equity as opposed to meritocracies in any of these states.

00:43:57.220 I believe Florida has had a huge influx of parents like me that moved here.
00:44:03.480 And I think it was Scott Kressler, I could be wrong, who said that, you know, he does all the voting, the voting stuff and said that it was like 100 percent red votes that moved here.
00:44:15.500 So we're not getting any blue votes moving here.
00:44:17.200 So people are starting to kind of balkanize themselves, I guess, in a way and put themselves where they feel most at home.
00:44:25.740 Well, and so we called this the civil I've called this the civil exodus.
00:44:28.460 And in fact, I've called for a civil exodus.
00:44:31.960 And this, of course, is in response to what a lot of people say.
00:44:35.360 They say, oh, we need national divorce and we need to break up into two systems.
00:44:39.400 I just and I just don't think it's realistic.
00:44:41.780 Frankly, I don't think it's it would and if it ever attempted to happen, it would not be peaceful whatsoever.
00:44:49.240 But you're seeing it.
00:44:50.300 Of course, California, probably the best example that people are just leaving.
00:44:53.660 They're voting with their feet and they're coming down to areas not just in Florida, but throughout the south.
00:44:58.940 And which is funny, because if you actually look at the trajectory of California's demographics,
00:45:04.080 a lot of the people that originally moved there to California in the settlement of California was post-Civil War.
00:45:11.120 So a lot of these people actually do a couple generations back have southern roots themselves.
00:45:16.620 So this might be sort of a great sort that we're seeing.
00:45:20.360 But but Josie, what what is your take?
00:45:21.960 And I'm not going to put you on a hot seat here.
00:45:23.260 But do you think that a that a civil exodus would be preferable to a straight up national divorce?
00:45:30.580 Yes, I don't believe a national divorce is even possible.
00:45:33.120 Look at how loosely they're throwing around sedition like just anybody.

00:45:40.320 Now, imagine trying to divorce your entire state from the country.
00:45:44.660 So so and they're not afraid to use that because it's power.
